The IRS attached my wages last March, and I had heard Optima Tax Relief commercials on the radio (WTOP)I aasked around , and although no one I knew had ever used them, but it seems they all knew someone who had, and all gave very favorable opinionsWell, that's all I needed, because I was between a rock and a hard place,, having several years of UNFILED TAXESSo I made the call, and was immediately put at ease by the friendly and (as I soon found out) knowledgeable and helpful folks at OptimaThey immediately got my liens released, and quickly had a plan ready for me to followI am on a payment plan that is very affordable, and now am stress freeI cannot thank the wonderful people at Optima enoughThey helped put my life back together, and possibly even saved my life
SUMMARY Optima Tax's management has been in contact with the client and has come to a
mutual resolve RESPONSE - Optima Tax’s management has been in contact with the client to address their concerns as outlined in the complaintTo clarify, Optima Tax approaches each case in two phasesPhase one being the Investigation Phase and Phase two being the Resolution Phase with each Phase requiring a separate fee for services During the Investigation Phase we gather all information from the client regarding their tax liability and cross reference that information with the IRS conditions we obtain during our initial IRS compliance callFrom there we formulate a strategy to help resolve the case, present the client with our findings, and our formulate a strategy where the client ultimately has the choice to move forward onto the Resolution phase or they can take the information we provide them and resolve the liability on their own The client was thoroughly informed during their initial consultation call that we do work in a two phase approach and each phase requires a separate feeThis information is also provided to the Client multiples times and is also included in our Client Services AgreementFurthermore, each client will go through a voice recorded Verification call that covers all legal disclosures and feesDuring that call the client confirmed and understood the structure of our services and all details provided to themIf at any point the client does not acknowledge the legal disclosure or fully understand any information provided to them then the call stops and services ceaseSince the client acknowledged that they understood the structure of our services they agreed to move forward and subsequently completed our contractual obligations and presented the client with a thorough breakdown of our Investigation and how we can help resolve their case At Optima Tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophyWe take all complaints very seriously, and we do our best to turn them around when possibleOptima Tax believes it took the necessary steps to address the clients concerns and considers the matter closedPlease do not hesitate to contact Optima Tax with any questionsThank you

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me. Optima Tax did refund a majority of the fee as a result of two important issues that were the basis for the complaint:
1) Business expensesWhile Optima may have instituted policies around notification of the risk business expenses can pose from an audit perspective, in the present case I was not provided any such suggestion, comment, or given the opportunity to either accept or decline the suggestion
2) Self-preparedThe IRS regulations are very clear, and have been clear for many, many years, that if anyone other than the tax filer themselves prepares the tax return, the individual or organization preparing the tax return on behalf of the tax filer must complete the appropriate section on the tax returnIn the present case, Optima failed to abide by the IRS requirement and, instead, placed Self-Prepared on the form
Optima does realize the errors made and did resolve the matter by reaching an amicable solution

SUMMARY -

contact with the client
prior to the filing of this complaint in order to
discuss his concernsUnfortunately however, the client has been extremely unresponsive
We do our best to treat each complaint with the utmost sense of urgency and
strive to resolve all of our clients’ issues to their full satisfaction,
however this can only be achieved with the client’s full cooperation
RESPONSE
-
Optima Tax’s management has attempted to address the client’s
concerns on more then one occasionUnfortunately, the client has yet to
respond to any voice messages or email correspondence, which hinders our
ability to address their claim directly and efficientlyAs the client stated,
they have been a client of Optima Tax
for a little over a yearAlthough we’re extremely successful in resolving any
case we take on, we explain to each of our clients that there are a number of
unique factors which dictate the time it may take for their case to be resolvedGiven the
complexity of this client’s case, the IRS required an abundance of documents
and updated informationThe documents the client initially provided were outdated
and subsequently a request was made upon the client to send in the most updated
documentsFor example, the client provided May, June and July’s financial
statements but the IRS in turn requested August, September and October’s
financial statementsThis is a common occurrence when resolving a tax
liability and one of the factors which may cause a delay in the resolution of a
client’s fileIn this particular case, Optima Tax
was negotiating an Offer in Compromise which requires as much documentation as
possible to assure it is accepted by the IRSThe client had been informed regarding
the importance of this process on more than one occasion
As their
representative, it is our job to build our client’s case to ensure we can
achieve the best possible outcome; this is why we stress to our clients the
importance of providing full and up-to-date documentation to us in a timely
fashionAfter all documents were received from the client we then submitted
all the necessary documents for an Offer review to the IRS in early FebruaryAs
explained to the client on multiple occasions, we now had to wait for the Offer
Specialist to review the information and determine if they are a candidate for
an OfferThis review process can take the IRS anywhere between 6-months to
review and either approve or deny the requestAgain, the client was informed regarding
this processOn May
29, the assigned Optima Tax Professional received a call from the Offer
Specialist requesting the client’s updated financial information with a
deadline for submission of June 5, The assigned Optima team immediately
reached out to the client and stressed urgency in getting the updated documents
into Optima TaxUnfortunately,
certain financial statements were not provided in a timely manner by the client
and we have yet to receive those documents requestedOn July 10, an
Optima representative provided the client with a thorough breakdown as to why
we could not submit for another Offer as it was based on their inability to
substantiate certain expensesThe Client was very understanding and was
advised that we would include all outstanding balances back into a
Non-Collectable statusThereafter, communication was sporadic and eventually
the client was unresponsive to our attempts
At Optima Tax we strive to uphold the philosophy that
"clients come first" and all of our representatives go through rigorous training to assure we abide by that
philosophyWe take all complaints very seriously, and we do our best to resolve
any and all complaints to our clients’ full satisfactionOptima Tax will continue their efforts in attempting
to contact the client and fully resolve this unfortunate dispute, however this
can only be achieved with the client’s full cooperation. Thank you

Optima
Tax's management has made contact with the client to
discuss his concerns as outlined in the complaint and the parties have come to
a mutually agreed upon resolution
RESPONSE
-
Optima Tax’s management has made contact with the client to discuss
his claimUpon review of the case, we have no doubt that the client thoroughly
explained his financial situation to his Tax AssociateWe also have no doubt
that his Tax Associate thoroughly explained to the client our two phase
approach, including that the retainer for Phase Two resolution is contingent
upon the investigation into the complexity of the case
Once the
investigation was complete, the information Optima Tax received from the IRS
showed that his case was significantly more complex than what was initially
conveyed to Optima TaxDespite such difficulty Optima Tax was able to
negotiate a stay of enforcement of the client’s impending collection activity
to allow him time to gather the necessary financial documents
to submit for a resolutionWe understand the client’s concern with the quoted
price, however we hope the client understands that Optima Tax performed a
thorough investigation as outlined in the Client Services AgreementAlthough we
regret the client did not initially see the value in our services, we are
pleased to say that after discussing the work performed with the client, we
were able to come to a mutual and satisfactory resolution
At Optima Tax we strive to uphold the philosophy that
"clients come first" and all of our representatives go through rigorous training to assure we abide by that
philosophyWe take all complaints very seriously, and we do our best to turn
them around when possibleOptima Tax
believes it has addressed the client’s concerns appropriately and considers the
matter closedPlease do not hesitate to contact Optima Tax with any questions

Optima Tax's management contacted the client to discuss her
concerns as outlined in
the complaint
RESPONSE
-
Optima Tax’s management contacted the client to discuss her
concerns as outlined in the complaintIt is regrettable to hear that the client’s
main point of frustrations revolved around communicationAccording to our
review, however, it is our sincere belief that the communication was consistent
with the flow of a typical case at Optima.
At Optima, providing an excellent customer service is our priority and
that includes making sure that all significant and material events are clearly
communicated to a client. . For most of the cases that we handle at
Optima, we must gather all documents and have them analyzed by the assigned Tax
Professional to assure its presentable for the IRSWith the amount of detail
that goes along with every case that is enrolled, there naturally will be some
down timeFurthermore, there often could be a significant amount of down time
as the IRS reviews the case details once they are presented on behalf of a client. We understand waiting could be frustrating,
however, we attempt to assuage such frustration by informing each client of the
process. Even for this particular case,
our staff had thoroughly informed the client on the process and the assigned
team achieved a very reasonable resolution for the client that she respectfully
rejected
Although
we are very successful in preventing liens, bank levies and wage garnishments,
we make no promises or guarantees that such action will never happen while
being represented by Optima TaxThe
IRS also has no obligation to inform Optima Tax
that they are in the process of issuing any type of enforcement as their
obligations are to the tax payerThis is preciously why we inform all our
clients to send in any IRS correspondence immediately to OptimaAlthough we
are very pleased to know that the client appears to have resolved her case, we
sincerely believe that the manner in which she was able to resolve her liability
was a direct result of Optima Tax
representationWhile we are happy to know that the client seems to have resolved
her case, we do not want to discount the immense amount of hours that we had
put forth in the caseAs we continue to discuss her concerns, we are hopeful
that we will come to a mutual agreement regarding her dispute
At Optima Tax we strive to uphold the philosophy that
"clients come first" and all of our representatives go through rigorous training to assure we abide by that
philosophyWe take all complaints very seriously, and we do our best to turn
them around when possibleOptima Tax
believes it has addressed the client's concerns appropriately but we’ll continue
to strive towards a mutual agreementPlease do not hesitate to contact Optima
Tax with any questionsThank you

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
They never address any of my questions or concerns head on or state the facts completely wrong I was not raising an issue with them over the tax lien, The tax lien had already been present for months Yes, Optima did submit a request to the IRS to remove the lien It's the response from the IRS that revealed what was going on at OptimaThe IRS denied the request to remove the lien The reason they gave was that I didn't have an installment agreement in place to pay off my tax debt with them I had been accepted on an installment agreement payment of $per month back in FebI made the payments every month and I still continue to make the $payment I took it upon myself to investigate with the IRS why they were saying I didn't have an agreement in place I never received any kind of notification that is was being cancelled or even that there was an issue The IRS employee that I spoke with said that given Optima has my Power of Attorney any notices would go to them Optima says they never received anything The IRS employee told me that it looks like the installment agreement was cancelled because I didn't file a federal tax return for One of the specific items I hired Optima to do for me was to file my returnBut they failed to do soThe basis of my complaint with Optima and the complaint I filed with you (Revdex.com) is that Optima caused my Installment Agreement with a $per month payment to be cancelled because of their failure to file my tax returnThe IRS will establish another Installment Agreement for me with a payment of approximately $per month This is the main point that I can't get Optima understand their culpability, their responsibility for, their blatant mistake that triggered the IRS cancelling my existing $per month payment The result of Optima not filing my tax return in time, is that the IRS has increased my requirement monthly payment by $more than I was paying I did nothing wrongWhy should I have to pay this higher monthly payment because of Optima's mistake.Optima's response to you completely twisted the facts They are saying that the increased tax balance from caused my installment agreement to be cancelled The IRS told me quite specifically over the phone that it was cancelled because they don't have a return on file from me How would the IRS know that I was going to owe money on my taxes if my return hadn't even been filed yet? Additionally, Optima never consulted with me or advised me about the possible issues with having a balance due for the tax yearThe statements they are making about this situation are blatantly false I continuously ask them to provide me with the written documentation of their correspondence with the IRS about my case, but they refuse to do that. Please this is wrong wrong wrong, I don't want to let them get away with this Please re-open my claim or what ever you have to do This issue and the phone conversations I was having with their designated rep back during the Feb/March time frame, caused me major medical issues from the stress they were causing meI had to be off work for a couple weeks and my doctor did not want me to have contact with Optima about this until my blood pressure was back to an acceptable range

I had some past Federal tax situations that I needed help with I had heard about Optima Tax Relief on the Mark Levin radio broadcast I gave them a call and was immediately talking with a gentleman that was very business like, but also I felt that he cared about making sure I felt at ease, and that I was in good hands He asked me a series of questions for a basic check to make sure they could help me After it was determined Optima could help with my situations the process started
During the time it took to go through the many steps to insure that every “T” was crossed and “i” dotted I talked with several different people at Optima that handled different parts of my situations Dealing with the IRS on behalf of anyone like myself that needs help can not be easy, but these people did an outstanding, professional job Every time a question came to my mind or I wanted to check on the status of one of the steps the process was going through the people at Optima were very quick to return my phone call, or email, but the majority of the time I was immediately put in touch with my case worker At times when my case worker wasn’t available at the time the person I was talking with was extremely helpful and took care of my inquiries, if they could, or insure my case worker would get back to me by the next day, which they always did
Everyone I talked with at Optima was always very pleasant, knowledgeable, helpful, and put me at ease during that very trying time During the whole process it took for Optima to work with me, and the IRS to bring to a finalized solution, I really felt that they totally cared about getting the best outcome for me, and that they were diligently working towards that end When I got the word from my case worker on what the IRS agreed to I was overjoyed, and I felt that a huge burden was lifted from off my shoulders thanks to these hard working people Optima did a fantastic job and I would highly recommend them to anyone that is dealing with IRS problems
