As the client stated in his rebuttal, he has been working with Optima Tax to help with his case and to ensure that communication continues at a high levelHowever, after addressing his concerns and assuring him that we’ll take every measure to obtain the best possible resolution, the client became uncooperative and is unwilling to work with management to reassign his case back to his assigned teamAs stated in our previous response, Optima Tax successfully released the bank levy and as long as he stays compliant with the agreement we negotiated on his behalf, this will prevent future levies In reviewing the case, the client received a notice in early September confirming the payment agreement that Optima Tax established for the clientThe letter also gave specific instructions on how and when to make his payment to the IRSAdditionally, Optima Tax had been attempting to establish communication with the client in an effort to return his case back to our servicing team, but the client was not responsive Although we attempted to address his concerns, the client didn’t seem to understand why his case was at a standstill or understand why we require certain documentation to continue moving forward with his caseAt no point will Optima Tax prolong a case or talk in coded circlesOur job is to present our client’s with the facts of their caseWe presented the client with his options that he respectfully declinedWe will acknowledge his request and refrain from communicating with him furtherWe will also package and prepare all applicable paperwork and mail it to the client per his requestHowever, although he has requested that Optima Tax cease communication, we will look into other options that may be beneficial to the client and we’ll present them in writing if necessary

Although the Revenue Officer may have stated otherwise to the client, Optima Tax most certainly made numerous attempts to establish communication with the Revenue Officer so that we may address the client’s outstanding tax liabilityAs stated in our initial response, our records contradict the statements made to the client by the IRSAny messages received by the assigned IRS agent were returned immediately and at no point did the IRS attempt to email the assigned Tax Pro as negotiations typically are handled verbally until we approach a final resolve Also, as stated in our initial response, the client’s failure to provide all the supporting documentation in a timely manner resulted in enforcement action by the IRSOn more than one occasion the client had been provided an itemized breakdown of the requested documents both verbally and via emailTo date, Optima Tax has not received all of the requested supporting documentation from the clientThe assigned IRS agent would not cease any enforcement action until those documents are receivedAlthough the client seems to think otherwise, submitting for an appeal would not have been the best course of action at this stage of the client’s caseThroughout our communications with the client, we clearly inform him that the Revenue Officer will not release any levy until all documents are receivedBased on our experience, it is likely that the client would not have experienced enforcement action from the IRS had we been able to provide the requested documentation to the assigned Revenue OfficerUnfortunately this was not possible without the client’s cooperation Unfortunately upon investigation, the associate mistakenly stated that Revenue Officers earn a commission on the taxes they successfully recoverHowever, Optima Tax has thoroughly addressed this matter with the corresponding agentHowever, it is true that, based on our experience, when there is a Revenue Officer assigned to a client’s file, they tend to be more unreasonable when dealing with the tax payer directlyAs such, Optima Tax understands the importance of effective representation in order to successfully resolve our client’s case

The response is inaccurate and dishonestFrom the very first conversation with the Sales Rep whose name was *** *** we were told that Optima had different programs that would be available to us in order to help with our tax situationHe did a good job as sales person selling what has resulted in a higher payment than we had beforeWe had an agreement with the IRS for $per month and I have every payment that was madeI told *** and *** *** another rep about the agreement*** even told me to continue making my $payment until Optima had the opportunity to review everythingSo we were paying Optima and the IRS at the same timeThere were no Liens and no Garnishment being imposed on us because we had a payment agreement with the IRSOptima should have never taken this case but they saw a way of taking advantage of someone who trusted their advertisement and sales repI told *** *** more than once that it did not make any sense that she would ask us to sign a new agreement prior to any interest and or penalty being removed or anyone from Optima talking with us about any of their programsAs a matter of fact she became so frustrated with me she told me she had to go to lunch or she would get into trouble and she would call me back after lunch which she never didShe waited for a couple of days before calling me backI again ask about the different programs we were told about and that was when she said that unless we sign the new agreement Optima could not move forward so we signed it and a few days later *** *** another rep called and said she would be closing our case which has led to where we areWe also have email correspondence saying someone was to contact us early at the start to discuss the different programs however no on from Optima ever did. Optima is being deceitful and dishonest and did not earn a penny of $5,395.00. For these reason we want our money backThe only thing they did was file one year of tax and have us paying more to the IRS

Tax did not fulfill its contractual obligations. Our services are broken down into two phases,
an Investigation Phase and our Resolution PhaseDuring our Investigation Phase
we were able to make contact with the IRS and obtain all the necessary
information to help resolve the client’s IRS liabilityAs part of the
Investigation services, our job was to address the levy that was in place prior
to the client contacting Optima Tax
Although we are highly successful in releasing wage levies, the IRS would not
release the levy due to a variety of reasons that we cannot disclose at this
timeEven though the IRS would not release the levy, we successfully obtained
an extension for the client in order to provide further documentation to the
IRSThis extension ultimately would have prevented the IRS from taking further
actions against the clientAfter informing the client of the services that
Optima Tax provided, we came to a mutual agreement that satisfied both parties

discuss their claim and we’re still working towards a mutual resolutionAs the
client stated, we prepared her returns as part of our Resolution services and
ultimately negotiated a favorable Installment Agreement on her behalfHowever,
we would like to kindly remind that although Optima has been successful in
obtaining excellent outcomes for many of its clients, Optima does not guarantee
nor promise that there will be a reduction nor absolvement of tax liability
Having
that said, once we finalize a resolution for our clients, the IRS will no
longer initiate any enforcement action however; the client will still receive
balance due notices from the IRS up until the liability is paid in fullThis
is very commonHowever, it appears that the client was not making the monthly
payment as agreed uponIt is also common for the IRS to issue a lien to
protect their interest in the liability and to assure the client does not
default on the agreement regardless of the amount owedIn some cases, a
request can be submitted to have the lien removed
Based on the
Installment Agreement arranged for the client, all balances that had a
liability were included in the payment plan along with the tax yearPlease
note that we did not include the tax year as there was no outstanding
balanceThe paper work was faxed and received by the IRS on July 17,
Moreover, we also have paperwork dated for July 28, confirming that the
Installment Agreement had been accepted by the Internal Revenue Service that
included all years with a balance. We
hope our explanation was sufficient to satisfy client’s inquiry, and we
sincerely anticipate that we will come to a mutual resolution in the near
future.

Per multiple emails with *** ***, The investigation phase consists of, “providing a stay of collection, conducting the investigation, and building a full financial profile.” Per the contract that I signed, after completing the investigation phase, I would receive a final investigation consultation, in which you would “go through the details of my Personal Tax Resolution plan and explain why you recommend this course of action. At this point, you would also provide a breakdown of costs to implement my Tax Resolution plan and an estimated timeframe to complete my plan.” I never received a Personal Tax Resolution plan, nor a discussion of why you recommended this course of action nor a break down of cost or a timeframe to complete my plan. As this is a major component in the “Investigation Phase”, I do not feel that Optima Tax Relief completed what was promised to me in writing by *** *** or what was also contractually signed for

As outlined in our Client Services Agreement, the client engaged Optima to
perform an investigation of his tax liabilityAs the client identified, after
we completed a thorough investigation, we presented him with our findings and
the proposed services that we could provide in our resolution phaseAs in this
case, before Optima Tax begins its service, each client goes through a voice
recorded Verification call which thoroughly discloses the services we will be
performing and all legal disclosures

contacting the client, we reiterated the structure of our services to which the
client understoodHowever, we are sympathetic to the fact that the client may have misunderstood our approach to
