Regarding complaint for [redacted]
Case# [redacted]

Dear Ms. [redacted],
Thank you for giving us the opportunity to respond to Ms. [redacted]’ complaint.
Upon receipt of this complaint, our office has reviewed the account. Please accept this as I.Q. Data International’s response to the complaint.

If I understand Ms. [redacted]’ complaint correctly, she feels that she does not owe on this account and it should be removed from her credit report based on her interactions with our office.  In her complaint Ms. [redacted] refers to telephone conversations she had with our Agency several years ago where she feels the Collection Specialists mistreated her and were unwilling to meet her terms of a payment arrangement and processed payments without her approval.

In response to the telephone conversations Ms. [redacted] refers to, our records reflect conversations in February of 2012, in which the consumer admitted to the account and requested a payment arrangement.  This arrangement consisted of an agreement to pay $166.00 down payable that day and subsequent payments of $166.00 per month using her prepaid debit card.  That arrangement was cancelled the following month when the payment could not be processed.  Our Agency reached out to the consumer, who supplied us with a new card for payment.  The following month that payment failed to process again and upon reaching the consumer she informed our collection specialist that there were not enough funds on the card due to fees that she was unaware of preventing the payment from processing.  On May 15, 2012 the consumer was informed that the payment arrangement had been broken and was advised if payments were made up we could continue to work with the arrangement unfortunately, no resolution was made on that particular call.  May 17, 2012 a new payment arrangement was agreed upon and payments of $75.00 per month, were secured on a prepaid debit card, the payment arrangement was again
verified by the Collector’s manager.  Some of those subsequent
payments again were unable to be processed and we were
unsuccessful in our attempts to reach the consumer.

Ms. [redacted] submitted electronic disputes with the Consumer Reporting Agencies, in January of 2017, stating the information on the account was inaccurate but was not specific as to what information was inaccurate to warrant an investigation of the account.  Prior to this complaint, our last communication with Ms. [redacted] was January 20, 2017, in which she phoned our office requesting a deletion based on the treatment she had previously received in 2012.  Unfortunately, there was no resolution to resolve the balance on this call.   We have no record of Ms. [redacted] requesting validation of the debt however, we have attached a copy of the accounting of the balance for your review.

Consumers often contact us with a unilateral decision regarding repayment of debts and we are often faced with the unenviable task of explaining to them that, while anything sent to our office will be applied, that payment arrangements or settlements were not part of the original agreement and that we are under no obligation to accept terms of anything less than the full balance of the defaulted debt.  In this case, payment arrangements were accepted from Ms. [redacted] and she has paid approximately 50% of the original balance of $992.74, but that has not cleared the account.

I apologize if Ms. [redacted]’ interactions were less than she expected.  If she has any documents to refute the charges I encourage her to submit them to our office for review.  Additionally, if she would like to discuss her account in further detail she may contact our collection manager, Dane H[redacted] at 888-248-2509 ext., [redacted]

Please contact me if any further information is needed.

Sincerely,

Holly H[redacted]
Assistant Compliance Manager

Thank you for giving us the opportunity to respond to [redacted] complaint. Please accept this as [redacted]’s, response. If I understand [redacted] complaint correctly, he has stated that our Agency promised to remove and “delete” the collections account from his credit report history but has not complied.   Our Agency has received and responded to the CFPB complaint filed by [redacted] for the same issue.  As our response to this Revdex.com complaint I have attached the response submitted to the CFPB and furthermore have attached the results to our inquiries showing the consumer is not reporting an account with [redacted].  Our office strives to be a leader in compliance and consumer relations, I apologize that our processes did not meet [redacted] expectations.  When there are multiple agencies working together there can be a delay in processing, however this issue has been resolved. Please do not hesitate to contact me if you need any further information.

Complaint: [redacted]I am rejecting this response because: They claimed that I did not complete their documentation which authorizes them to speak with the Revdex.com however they never emailed or mailed me such a document to complete and sign.  I have provided them all of my contact information so there is no reason why I did not receive it.  It is another stall tactic.  In addition, even in the attachment, there is NO instruction on how to return the form (fax, email, mail) and to who's attention it should be sent.  I will gladly do so if given all the details.Sincerely,[redacted]

Complaint: [redacted]I am rejecting this response because:Karen;     You seem to think the issues have been resolved.  This is inaccurate.  First of all, this has tarnished my credit and caused a denial of my housing application.  I will soon be homeless because there is no way I can come up with $400 for a security deposit for an apartment I was only supposed to pay $100 security deposit for.  Secondly, I am concerned that you believe the following statements:"IQ Data is committed to treating every consumer with the dignity and respect to which they are entitled and is committed to its compliance efforts and ethical debt collection practices.""Another requirement of employment is the taking of the Collector’s Pledge whereby IQ Data staff commits to professional and ethical treatment of all consumers."Let me draw your attention to my second message sent to the Revdex.com, one that reflects a very different and accurate portrayal of TWO of IQ Data's representatives, one of whom is supposed to be a manager:I just attempted to make contact with IQ Data International again this afternoon.  I was able to speak with an agent named Erin who claimed that they are not reporting derogatory information to the credit bureaus.  When I was in disagreement with her statement and indicated that the credit bureau was informing me otherwise, she transferred me to her manager, Randy.  When Randy answered the phone, asking how he could help me, I had stated that they (IQ Data International) were indicating that they were not reporting a balance owed to the credit bureau.  He interrupted me before I could finish the next sentence to tell me that this is incorrect, that they are not reporting derogatory information to the credit bureaus.  Yes, you read that correctly. He disagreed with my statement by stating exactly what I said in a different combination of words.  I immediately requested that he please listen to what I am saying because it was clear he wasn't listening to anything I just said.  He began laughing.  Although I was rather disconcerted, I attempted to move on by informing him what the credit bureau has claimed. He interrupted me and began speaking over me, despite my request to not interrupt me while I am speaking.  I asked him again to not interrupt me and to listen to what I had to say and he responded maliciously and hung up.  This is not acceptable professional behavior.  It still stands that the credit bureaus are indicating that IQ Data International is reporting this derogatory information on my credit file.  These are the facts.  If IQ Data International is legitimately claiming they filed the appropriate paperwork to the credit bureaus, then they need to be contacting the bureaus and disputing this with them directly, as I cannot be a middle person when the representatives of IQ Data International choose to disrespect me and disconnect the line intentionally.   I would like this to be added to the complain record if possible.  This company should be shut down. To elaborate on the malicious response that Randy made, I believe it went something like, "I don't have to deal with this crap."  Does that sound like Randy, or Erin for that matter, were treating me with dignity and respect?  Is that ethical debt collection practices? Are they compliant with this imaginary pledge to commit to professional and ethical treatment of all consumers?  These issues have yet to be addressed.  The extra $300 that your company has cost me has not been addressed.  My potential homelessness as a result of careless efforts on behest of IQ Data has not been addressed.  I hope you can better IQ Data's image in this regard.    Sincerely,[redacted]
