that your account has been has properly reported as a Discharged Chapter 7 BK to
the Credit Reporting Agencies (CRAs).  A
foreclosure sale was completed on this properly on February 16th,
2016.

on April 13th, 2016 to the to the main credit repository agencies to
update your credit report.

Rushmore mistakenly sent duplicate payments to the Salt Lake County Property Tax office then transferred my loan to a new provider. The new provider informed me there was a shortage in the escrow amount that was transferred. I called on the 27th of January and for four hours numerous individuals at Rushmore denied there was an error. Finally a man claiming to be a supervisor in the tax office confirmed there was a double payment and he would call me the next day to resolve it. I hadn't heard by February 3rd so I called back. I was told by a service associate that the check had been sent to the new provider. I checked, that was untrue, so I called back. Another supervisor assured me the check was still there and she would research it and call me back that night. Nothing. I called back this morning and have fought all morning trying to get a tracking number and courier service that they would use to ship my check to the new provider. Instead I was hung up on, ignored and forced to call back.

Bank, National Association as Legal Title Trustee for Truman 2013 SC4 Title Trust, which is a privately
held trust.
We have conducted an investigation and it was determined the servicing responsibilities of the loan
transferred from Wells Fargo Home Mortgage (Wells) to Rushmore effective February 19, 2014, as a
conventional loan, with a payment amount of $766.58 and an interest rate of 2.91900%. At the time of
transfer the loan was due for the October 15, 2013 monthly payment and $237.39 in late charges.
Our records indicate the Chapter 13 Bankruptcy was completed on March 11, 2014, and removed from
the account. On April 30, 2014, the loan assessed its first late charge of $33.76, since servicing began
with Rushmore. Please note, on July 10, 2014, Rushmore made an adjustment to the account removing
both the assumed $237.39 and assessed $33.76 late charges. Attached you will find copies of both the
Wells and Rushmore Payment Histories as well as your most recent Mortgage Statement for your records
and review.
As of the date of this correspondence, the account is three (3) payments delinquent and contractually due
for the June 15, 2014 monthly installment. Please note, at this time there is no foreclosure activity on your

We appreciate the opportunity to provide you with this written response.Rushmore has reviewed the issues you disputed beginning with the events that occurred on October 6, 2016. We have confirmed that all letters were mailed as previously stated. We also sent you copies of these letters with our correspondence dated April 14, 2017 for your records.Rushmore's records reflect that on October 20, 2016, you contacted Rushmore advising that you would like to do a repayment plan. You stated you could send a payment of $1,000.00 as a down payment and then begin making payments of S1,035.00 towards a twelve month repayment plan. We agreed to submit this offer to the investor to be reviewed. On November 7, 2016; November 8, 2016; November 21, 2016; December 2, 2016; and December 13, 2016, Rushmore called you leaving a message for a return call. Rushmore did not receive a return call.Rushmore does not show any records of the calls you state you made to [redacted]'s direct line on December 29, 2016. However, on January 18, 2017, Rushmore did speak to you discussing the missing documents needed. You stated that you had mailed them to us on January 13, 2017, and would also fax them as well. We asked that you call us back on Friday, January 20, 2017, to confirm receipt of the documents that you sent to us. Documents were received on January 27, 2017, and January 31, 2017. After reviewing all of the documents received, we still did not have a complete Application for our review process. On February 9, 2017, Rushmore sent you a letter advising that we were unable to review you for a loan modification because we did not receive a complete Application.On April 10, 2017, Rushmore sent you our Borrower Assistance Application. As Rushmore discussed with you during a phone call on April 10, 2017, we are willing to work with you and consider your application for any and all loss mitigation options that the owner of the loan offers, We need a new, complete application in order to accomplish this. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[Rushmore gives no resolution. [redacted] is a Judiciary state therefore if a foreclosure is withdrawn, as it was in January 2014 due to trial modification. An attorney confrimed this for me. So a notice via d mail is required 30 days prior to any filing. Rushmore was furnished with all documentation to support a hamp. They ignored this an attempted to raise my payments by $470 a month, this does not make  my home more affordable hence making home more affordable.
Rushmore was given documents that the taxes were not being paid as they claim they were doing. They ignored this in the modification offer dated october 21, 2015. Rushmore is very secretaive and deceptive. I asked if the modifcation was via hamp or as they refer to in house, they never answered. They never sent me a certified notification they were the servicer, only sent me bills. They use [redacted] drop to circumvent this requirement
In the meantime my mortgage is behind 19 months because they won't take any back payments , violating the terms of the mortgage. Thus putting in a worse financial situation going from 4 months to 19 months. They never credited the 3 trial payments I made whick would make it 16 months plus the 2 motnhs I paid in october and november 2014. They state ina reinstate,ment they are protection their interest in the property, acting as they own the loan
A complaint with Consumer Fianancial Protection is open ans wellas an investigation by the Office of the US Comproller on Currency as wellas the [redacted] Banking Commission. My next step would be sueing Rushmore in Civil Court]

On three different occasions out of the last six months, Rushmore has inappropriately applied the additional money that I have sent to them, which I wanted used for principal reduction. Each time, I needed to call them to get it straightened out. What they had done instead was divide the money intended for additional principal as though it were an additional month's payment (part of it toward principal, and additional escrow and taxes, despite their having plenty of my money put aside for insurance and property taxes). During one of the occasions that I called, I spoke with a very condescending snot who actually asked me if I had written my intentions on the check I sent. Yes, I did; of course I did; plus it was explicitly identified on the stub that accompanied the check. This is so obviously intentional on their part. They clearly don't care about customer service or customer satisfaction. I'm in the fortunate position at this time of being able to make additional principal payments, but not to the point of being able to pay the entire balance to get these people out of my life for good. Unfortunately I have to monitor my account activity on-line like a hawk. I cannot and do not trust them. If you are STUCK with Rushmore for the longer term, I'd strongly suggest refinancing and getting rid of this company and their clearly shady business practices as quickly as possible.

With regard to the direct bill, please
note tax collectors will frequently send a COPY of their tax bill to homeowners
for informational purposes only. It does not equate to a bill. We identified
that both you and Rushmore made a tax payment, which has been confirmed with
the county. 
 
They have applied the duplicate
payment to the next installment due making the taxes paid in full for the
entire year.  We have confirmed the
annual tax amount correct at $5896.84, which makes the current monthly tax
collection of $491.40 also correct.
 
Please note Rushmore completed an
Escrow Analysis on October 14, 2015 effective with the November 1, 2015 payment
based on the paid in full taxes. The new monthly payment is $2,006.94, which is
a reduction of $151.94 per month.
 
Please note, as a consumer you have
the right to request the investigation documents relied upon to determine our
conclusion with regard to the Notice of Error that you submitted.

I would appreciate this being corrected, as that was the original purpose from the beginning of this issue. I also don't appreciate you giving such specific information in your rebuttal. That information was not provided by me to the Revdex.com to begin with, and now if the Revdex.com posts this on their profile of your company it will be public knowledge.
