I have reviewed the response made by the business in reference to complaint ID [redacted], and am disappointed in the diligence with which even the Revdex.com complaint has received.  For your reference, details of the offer I reviewed appear below.The facts stated by Rushmore are inaccurate.  On the August 1st conversation, the associate confirmed that payment was receive 7/29 and not 'over the weekend'.  My address was changed(to a temporary address which I resided through 9/2 and continue to have access as necessary) on 8/1 and confirmed again on the 8/23 phone call.  These could both be verified if Rushmore had taken the time to review the recorded calls.They present that they received 'unable to forward' responses, the last date being 8/24 and never attempted to reach me by phone or email even though, by confirmation on the call 9/10, they had both of these documented accurately.  On the same phone call from 9/10, I changed the address to my now permanent address.  Again, had Rushmore even attempted to understand the issue via the recordings,  would have been in a position to improve communication and resolution.The bottom line;they should not have processed the withdrawal 8/1, they should have been able to process a refund immediately versus the ridiculous process of me requesting to have my own money back, they should have contacted me when they received the 'unable to forward' and should have taken care to represent themselves better as part of the resolution.  I've had to incur interest as part of not having my funds prior to 9/1 and this is a company that benefitted from 10 year of on time payments.  Nice to know that a company appreciates your business.

[Rushmore simply restated what was said in the previous response. The lien has still not been released as of 8/1/2017 and has been rejected twice since. Can Rushmore please contact the vendor they use in Burlington county NJ and have them send the correct documentation and fees to ensure this is done. Their response is inaccurate the it is not the county that is hold this up it is the vendor that Rushmore is using. I am simply asking that Rushmore take ownership of this since they chose the vendor. Please contact the vendor and ensure they are correctly filing the documents. If Rushmore is not sure I can send what is needed although I spoke with [redacted] on several occasions and sent a list of what was needed. I will be than happy to send the info again. Just to be clear The county is not the issue Rushmore is responsible for having the release recorded so if the vendor they hire is not competent it is Rushmore's issue. Please correct this and in future responses please be truthful and accurate. ]

 I MUST address Rushmore Loan Management Services LLC's response to my complaint. THIER RESPONSE IS FACTUALLY UNTRUE. 
I have DOCUMENTED PROOF that yesturday morning, Rushmore Loan Management Services LLC attempted to ILLEGALLY FORECLOSE on my home. 
[redacted] had our OPEN AND PENDING lOAN MODIFICATION COMPLETED PACKAGE FOR OVER A MONTH BEFORE THEY TRANSFERRED THIS LOAN TO RUSHMORE. The package was ALREADY COMPLETE - AND THEY NEVER SENT ME ANY NOTIFICATION PRIOR TO THE TRANSFER OF THE LOAN 6/1/2016 OF ANY MISSING DOCUMENTS. Also, [redacted]'s "Point of Contact Person, [redacted] Resendiz, NEVER REACHED OUT TO US during the last six months or more, of our PENDING and ACTIVE loan modification. ONLY on 6/1/2016 did we receive WRITTEN notice that [redacted] TRANSFERRED our Loan to Rushmore. As I stated before, I immediately attempted to log into the Rushmore "Portal" that they must supply to homeowners,.....I could NOT log in. I called our new "Person of Contact" Mr. [redacted], to discuss with him our PENDING loan modification that was transferred to them by [redacted]. I asked Mr. [redacted] SPECIFICALLY, DO YOU HAVE ALL OUR PAPERWORK FOR OUR PENDING LOAN MODIFICATION? Mr. [redacted] CONFIRMED TO ME THAT HE HAD ALL OUR PAPERWORK, AND THAT IT WAS APPROXIMATELY 100 PAGES. He then told me that I would have to complete ANOTHER LOAN MODIFICATION PACKAGE !!! (SO, even though he had a COMPLETE PACKAGE in front of him from Nationstar, he demanded that we complete another one..........this would be my 9th or 10 loan modification package in 2 years.).Never the less, I COMPLETED AN ENTIRE LOAN MODIFICATION PACKAGE FOR RUSHMORE. PAPERWORK WAS EMAILED AND SENT CERTIFIED MAIL TO RUSHMORE 6/28/16. WE HAVE DOCUMENTED PROOF THAT RUSHMORE RECEIVED IT ALL BEFORE THE DUE DATE OF 6/30/16. NEVER DID I HEAR AGAIN FROM RUSHMORE LOAN MANAGEMENT SERVICES LLC. I knew that there had been a "PENDING Trustee Sale dated 7/7/16, that SHOULD HAVE BEEN POSTPONED, AS RUSHMORE ONLY RECEIVED OUR COMPLETE AND PENDING LOAN MODIFICATION APPLICATION AND SUPPORTING DOCUMENTS ON 6/30/16. BOTH RUSHMORE AND [redacted] REFUSED TO POSTPONE THIS TRUSTEE SALE WHILE I WAS UNDER AN ACTIVE AND PENDING LOAN MODIFICATION REVIEW, WHICH THE MUST DUE BY LAW. THE CALIFORNIA HOMEOWNER'S BILL OF RIGHTS SPECIFICALLY STATES THAT A LOAN SERVICER CANNOT CONTINUE FORECLOSURE PROCEEDINGS, INCLUDING A TRUSTEE SALE WHILE A HOMEOWNER IS BEING CONSIDERED FOR A LOAN MODIFICATION - THIS IS DUAL TRACKING. RUSHMORE AND [redacted] DID THAT TO US. RUSHMORE NEVER ASKED ME FOR ADDITIONAL INFORMATION UNTIL YESTURDAY MORNING 7/7/16 AT 8:46AM ,(over the phone)  WHEN I FINALLY GOT [redacted] AT RUSHMORE TO STOP THE SALE TEMPORARILY AND THAT IS WHEN HE ASKED ME, OVER THAT PHONE CALL FOR ADD'L INFORMATION. LET'S BE VERY, VERY CLEAR HERE: THE ONLY REASON RUSHMORE POSTPONED THE SALE YESTURDAY OF MY HOME AT 8:46AM (SALE WAS THE SAME DAY AT 9AM) WAS BECAUSE I BOMBARRED THEM WITH EMAILS, SENT A COMPLAINT TO THE Revdex.com, SENT A COMPLAINT TO THE CA. ATTORNEY GENERAL'S OFFICE, AND TO THE CONSUMER FINANCIAL PROTECTION BUREAU. MAKE NO MISTAKE, RUSHMORE HAD PLANNED ON ILLEGALLY FORECLOSING ON MY HOME YESTURDAY MORNING AT 9AM, AND ONLY STOPPED THE SALE AFTER MY REPEATED CALLS TO THEM, AND EMAILS AND COMPLAINTS. THIS IS THE ONLY REASON THEY POSTPONED THE SALE. THEY ONLY RECEIVED MY NEW INFORMATION ON 6/30/16, THEY HAD NO TIME TO REVIEW MY PAPERWORK, MAKE ANY DECISIONS ABOUT IT, AND THEY WERE WILLING TO "STEAL"  A HOMEOWNER'S HOME WITHIN A WEEK OF RECEIVING IT!!!!!! 
NOT TO MENTION THAT I HAVE FRAUD IN THE ORIGINATION OF MY LOAN , AND THAT THERE IS A BROKEN TITLE TO MY HOME, AND THAT RUSHMORE LOAN MANAGEMENT SERVICES LLC DOES NOT EVEN LEGALLY OWN MY LOAN. (they have also been made aware of this).  THEY KNOW THAT I DO NOT GET THE CHANCE TO GO IN FRONT OF A JUDGE TO PROVE THIS, SO THEY ATTEMPT TO FORECLOSE ON MY HOME THIRTY SEVEN DAYS AFTER RECEIVING THIS LOAN, AND LESS THAN A WEEK AFTER RECEIVING OUR APPLICATION FOR HELP. THEY ARE NOT TELLING THE TRUTH HERE, AND THEY ARE ATTEMPTING TO QUICKLY AND ILLEGALLY FORECLOSE ON MY PROPERTY. I WANT THE TRUTH TO BE EXPOSED. Rushmore Loan Management Services LLC (“Rushmore”) is responding to your rebuttal
correspondence submitted to the Revdex.com (Revdex.com) on August 17, 2017, regarding
the mortgage loan account referenced above.
Rushmore endorsed and release the loss draft check within ten days of receipt. The process was
completed in an expeditious manner.
On July 7 2017, the loss draft department updated our system of record to reflect that your area
code was 703. This was determined to be incorrect and, as stated in our previous response,
Rushmore corrected the area code to [redacted] on the phone number listed in our system on August 8,
2017. Rushmore made one call to you regarding payment on August 10, 2017, since the update
was completed. Prior to that call, Rushmore has not spoken to you via phone regarding payment
since June 6, 2017.
Per the terms of your note, which has been enclosed for your review, all payments are due on the
first day of the month. Although you have fifteen days to make the payment without receiving a
late charge penalty, you are considered late on the second day of the month and Rushmore
reserves the right to contact you regarding your payment as early as the second day of each
month.
Rushmore has acted in a prompt, courteous and professional manner when speaking to you
verbally, or via written correspondence, and will continue to do so. As of the date of this correspondence, the account is current, and the next contractual monthly
installment is due on September 1, 2017. Should you have any additional questions, please do

The response from Rushmore Loan Management stated that we only have one loan and requested copies of credit report to support our claim.It is in black and white that Rushmore has listed  2 loans listed on [redacted]'s [redacted] report.  One under Mortgage and one under "other loans".When they remove the "other loan" from his report we will feel that this claim is settled.

Requires 30-day prior notification of such a filing as well as assignment of mortgage-They are not paying my taxes as they claimed and are trying to recover in their latest modification offer. I received a delinquency notice from my town, they are 2 quarters behind-They won’t tell me who my payments go to, only 3 trusts on the note-They send back my payments, stating it doesn’t cover past due but did accept 2 payments, October & November 2014-They ordered a market analysis for the modification. It showed my home is $24000 less than balance, never reduced the balance according to hamp guidelines but are charging me in advanced corporate fees.-I haven’t been able to get a hold of my case manager [redacted] in over 30 days. Doesn’t return phone calls or emails. I have tried to contact her supervisor; I am told to call back. The servicing responsibilities for the loantransferred from [redacted] to Rushmore effective May 2, 2016.A full social security number is required to set up an online account at www.rushmorelm.com.This, and other required information, is matched against the information in our system of recordto ensure the security of the online account. When calling Rushmore, only the last four digits ofthe social security number would need to be verified.
Regarding your claim that there is never a live person to assist you, Rushmore last spoke to youdirectly on October 4, 2016. In addition, conversations occurred with a Rushmore representativeon September 6, 2016; September 12, 2016; September 14, 2016; and September 15, 2016.During this same time frame of September 6, 2016, through October 4, 2016, Rushmore leftnumerous messages requesting a return phone call to attempt to assist you.
When your loan transferred from [redacted] to Rushmore on May 2, 2016, your accountwas due for the April 25, 2016, monthly installment of $403.01. On July 2, 2016, Rushmorereceived a partial payment of $400.00, which was not enough to satisfy the monthly installmentamount due. These funds were placed in suspense until your next payment was received on July13, 2016, in the amount of $400.00. The April 25, 2016, payment was posted at that time and theremainders of the funds were placed in suspense. The enclosed payment history will reflect that you have continued to make partial payments for less than your contractual monthly installmentamount due, which has led to funds being placed in suspense and applied once the additionalfunds necessary to complete the monthly installment amount were received.
As of the date of this correspondence, the account is 2 payments delinquent and contractuallydue for the August 25, 2016, monthly installment. If you would like to discuss available paymentassistance options, please call the assigned representative:

the owner of your Loan is WilmingtonSavings Fund Society, FSB, doing business as [redacted] Trust, not in its individual capacity but solely asTrustee for [redacted], which is a privately held trust.We have conducted an investigation and it was determined the error asserted within your correspondencedid not occur on the account. Here are the reason(s) why Rushmore concluded that your loan is in factbeing serviced correctly:Our records indicate Rushmore has recently provided response to your complaint submitted to theConsumer Financial Protection Bureau (CFPB) website portal on October 9, 2015, which pertained toconcerns duplicate in nature.
As advised, Rushmore reviewed and denied the loan for modification on June 12, 2015 due to aninsufficient good faith payment of $5,000.00. There was no appeal period for this decision due to beingwithin 90 days of the sale date.
A Chapter 13 Bankruptcy was filed on August 14, 2015, thus stopping the foreclosure sale that waspreviously scheduled for August 17, 2015. Rushmore received an incomplete modification applicationpackage on September 10, 2015 and sent an Acknowledgement and Missing Document Letter the sameday. The bankruptcy was dismissed on September 18, 2015.
An additional Missing Document Letter was sent to you on September 24, 2015, again requesting themissing documents required for review and advising you the completed application must be receivedgreater than 37 days from the scheduled Foreclosure sale date. The review was denied on September 29,2015 based on the complete Home Retention package was not received more than 37 days before theForeclosure sale. The Missing Document Letters indicate the Recorded Quit Claim Deed and complete 2014 Tax Returnswere requested on multiple occasions and the reason for denial on multiple reviews.Please note, as a consumer you have the right to request the investigation documents relied upon todetermine our conclusion with regard to the Notice of Error that you submitted. Enclosed we haveincluded those documents for your records.
