I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
 I MUST address Rushmore Loan Management Services LLC's response to my complaint. THIER RESPONSE IS FACTUALLY UNTRUE. I have DOCUMENTED PROOF that yesturday morning, Rushmore Loan Management Services LLC attempted to ILLEGALLY FORECLOSE on my home. [redacted] had our OPEN AND PENDING lOAN MODIFICATION COMPLETED PACKAGE FOR OVER A MONTH BEFORE THEY TRANSFERRED THIS LOAN TO RUSHMORE. The package was ALREADY COMPLETE - AND THEY NEVER SENT ME ANY NOTIFICATION PRIOR TO THE TRANSFER OF THE LOAN 6/1/2016 OF ANY MISSING DOCUMENTS. Also, [redacted]'s "Point of Contact Person, [redacted] Resendiz, NEVER REACHED OUT TO US during the last six months or more, of our PENDING and ACTIVE loan modification. ONLY on 6/1/2016 did we receive WRITTEN notice that [redacted] TRANSFERRED our Loan to Rushmore. As I stated before, I immediately attempted to log into the Rushmore "Portal" that they must supply to homeowners,.....I could NOT log in. I called our new "Person of Contact" Mr. [redacted], to discuss with him our PENDING loan modification that was transferred to them by [redacted]. I asked Mr. [redacted] SPECIFICALLY, DO YOU HAVE ALL OUR PAPERWORK FOR OUR PENDING LOAN MODIFICATION? Mr. [redacted] CONFIRMED TO ME THAT HE HAD ALL OUR PAPERWORK, AND THAT IT WAS APPROXIMATELY 100 PAGES. He then told me that I would have to complete ANOTHER LOAN MODIFICATION PACKAGE !!! (SO, even though he had a COMPLETE PACKAGE in front of him from Nationstar, he demanded that we complete another one..........this would be my 9th or 10 loan modification package in 2 years.).Never the less, I COMPLETED AN ENTIRE LOAN MODIFICATION PACKAGE FOR RUSHMORE. PAPERWORK WAS EMAILED AND SENT CERTIFIED MAIL TO RUSHMORE 6/28/16. WE HAVE DOCUMENTED PROOF THAT RUSHMORE RECEIVED IT ALL BEFORE THE DUE DATE OF 6/30/16. NEVER DID I HEAR AGAIN FROM RUSHMORE LOAN MANAGEMENT SERVICES LLC. I knew that there had been a "PENDING Trustee Sale dated 7/7/16, that SHOULD HAVE BEEN POSTPONED, AS RUSHMORE ONLY RECEIVED OUR COMPLETE AND PENDING LOAN MODIFICATION APPLICATION AND SUPPORTING DOCUMENTS ON 6/30/16. BOTH RUSHMORE AND [redacted] REFUSED TO POSTPONE THIS TRUSTEE SALE WHILE I WAS UNDER AN ACTIVE AND PENDING LOAN MODIFICATION REVIEW, WHICH THE MUST DUE BY LAW. THE CALIFORNIA HOMEOWNER'S BILL OF RIGHTS SPECIFICALLY STATES THAT A LOAN SERVICER CANNOT CONTINUE FORECLOSURE PROCEEDINGS, INCLUDING A TRUSTEE SALE WHILE A HOMEOWNER IS BEING CONSIDERED FOR A LOAN MODIFICATION - THIS IS DUAL TRACKING. RUSHMORE AND [redacted] DID THAT TO US. RUSHMORE NEVER ASKED ME FOR ADDITIONAL INFORMATION UNTIL YESTURDAY MORNING 7/7/16 AT 8:46AM ,(over the phone)  WHEN I FINALLY GOT [redacted] AT RUSHMORE TO STOP THE SALE TEMPORARILY AND THAT IS WHEN HE ASKED ME, OVER THAT PHONE CALL FOR ADD'L INFORMATION. LET'S BE VERY, VERY CLEAR HERE: THE ONLY REASON RUSHMORE POSTPONED THE SALE YESTURDAY OF MY HOME AT 8:46AM (SALE WAS THE SAME DAY AT 9AM) WAS BECAUSE I BOMBARRED THEM WITH EMAILS, SENT A COMPLAINT TO THE Revdex.com, SENT A COMPLAINT TO THE CA. ATTORNEY GENERAL'S OFFICE, AND TO THE CONSUMER FINANCIAL PROTECTION BUREAU. MAKE NO MISTAKE, RUSHMORE HAD PLANNED ON ILLEGALLY FORECLOSING ON MY HOME YESTURDAY MORNING AT 9AM, AND ONLY STOPPED THE SALE AFTER MY REPEATED CALLS TO THEM, AND EMAILS AND COMPLAINTS. THIS IS THE ONLY REASON THEY POSTPONED THE SALE. THEY ONLY RECEIVED MY NEW INFORMATION ON 6/30/16, THEY HAD NO TIME TO REVIEW MY PAPERWORK, MAKE ANY DECISIONS ABOUT IT, AND THEY WERE WILLING TO "STEAL"  A HOMEOWNER'S HOME WITHIN A WEEK OF RECEIVING IT!!!!!! NOT TO MENTION THAT I HAVE FRAUD IN THE ORIGINATION OF MY LOAN , AND THAT THERE IS A BROKEN TITLE TO MY HOME, AND THAT RUSHMORE LOAN MANAGEMENT SERVICES LLC DOES NOT EVEN LEGALLY OWN MY LOAN. (they have also been made aware of this).  THEY KNOW THAT I DO NOT GET THE CHANCE TO GO IN FRONT OF A JUDGE TO PROVE THIS, SO THEY ATTEMPT TO FORECLOSE ON MY HOME THIRTY SEVEN DAYS AFTER RECEIVING THIS LOAN, AND LESS THAN A WEEK AFTER RECEIVING OUR APPLICATION FOR HELP. THEY ARE NOT TELLING THE TRUTH HERE, AND THEY ARE ATTEMPTING TO QUICKLY AND ILLEGALLY FORECLOSE ON MY PROPERTY. I WANT THE TRUTH TO BE EXPOSED. I TOOK A "SCREENSHOT" OF [redacted] FORECLOSURE'S AUCTION SITE YESTURDAY MORNING, BEFORE THE PENDING SALE AT 9AM...........AS OF 8:46AM THE SALE WAS STILL GOING FORWARD...............ONLY WHEN I CONTACTED [redacted] DIRECTLY YESTURDAY MORNING DID THEY STOP THE SALE TEMPORARILY. IF RUSHMORE WAS DOING THE RIGHT THING LIKE THEY SAID IN THEIR DISPUTE OF MY CLAIM, WHY DID IT TAKE ME TO PERSONALLY CALL [redacted] YESTURDAY MORING TO STOP THE SALE????????

Error and/or Request for Information. We made this determination because your current complaint is substantially the same as your previous complaint you have submitted to the Consumer Financial Protection Bureau (CFPB) web portal on May 9, 2016. Rushmore substantively responded to this prior complaint. Attached, for your reference, is a copy of our previous response dated May 11, 2016.As of the date of this correspondence, the account is 27 payments delinquent and contractually due for the March 1, 2014, monthly installment. Rushmore Loan Management Services took over my mortgage a few months ago and for the first few months, it was fine, aside from the fact that I had signed up to go paperless and still get inundated with hard copies of everything. We are now in the process of refinancing since interest rates have dropped since we first bought our house. I had to request a "Verification of Mortgage" document from them, which has single-handedly delayed the refinance process by a month.

I put the request in and was assured I would have it no later than a certain date (within 3 weeks, which seems like a long time for this request), and it was like pulling teeth just to get the rep to give me an estimated date. The day after said date when I still hadn't received anything, I called to follow up to find out that my request had been denied because they needed it in writing - except no one ever told me that when I called, and no one bothered to tell me my request had been denied in the first place. It took multiple phone calls and hours of frustration to finally get this document.

None of the reps are knowledgeable. Every statement that's made or question that's asked results in being put on hold for up to 10 minutes, just for the rep to return to the line to give a canned response or no response at all. Further, they all refused to connect me to a supervisor when I requested it. I took down names and direct lines, thinking speaking consistently with the same rep may help my case, but no one returns phone calls, even when I marked my voicemails urgent. One rep even tried telling me that my request was being delayed because they didn't have all the paperwork on my account because we are a "new account," even though it's been 6 months since it was transferred.

I fought hard and finally got the document I needed after a month of spending my lunch hours fighting with them. My husband thinks they are using tactics to frustrate me into giving up so we don't go through with the refinance and they lose our account, but I honestly think it's just poor customer service. Everyone there is a complete ie. I can't wait to finish the refinance process and be rid of this awful company. We are working with a local credit union, so our new mortgage will stay with them and this won't happen again.

After reading other reviews that have been posted online about this company, I felt it was important to share my experience with the Revdex.com. I've read reviews talking about scams and possibly illegal activity, and after the experience I've had with them, I wouldn't be surprised if they were conducting their business in an unethical way.

Rushmore requested the recording of the Assignment of Mortgage from the responsible parties on September 5, 2017. We did, however, receive the executed Deed in Lieu documentation on September 14, 2017. Soon after, on September 20, 2017, we came to know that the recorded Assignment of Mortgage was not available, thereby making the title not clear for completion of the Deed in Lieu.On October 23, 2017, during a telephone conversation, we explained to you that we are awaiting the recording of the final Assignment of Mortgage, in order to complete the recording the Deed in Lieu. During a follow-up conversation held on November 16, 2017, you explained to a Rushmore representative that you canceled your homeowner's insurance policy.We issued notices requesting that the proof of insurance coverage be provided on November 8, 2017, and December 13, 2017. On January 31, 2018, the enclosed notice was mailed explaining that after not receiving the required proof of coverage, we purchased a policy for the property. The TPP consists of three trial installments of $976.26. On December 7, 2017, Rushmore received funds of $976.26. Once the boarding process was completed, the funds were applied on December 18, 2017, as the first trial installment. As Rushmore is the current servicer of the loan, it is not necessary to notify the prior servicer of funds received. We have enclosed the transaction history for your review. The TPP is currently active, and once the TPP is completed, Rushmore will review the account for a permanent loan modification.In Mr. [redacted]'s correspondence submitted through the CFPB website portal, he requested for monthly billing statements and payment coupons. According to the United States Bankruptcy code, an automatic stay is an immediate injunction that occurs when the bankruptcy is initially filed. The stay prohibits all creditors from conducting collection activity, ceasing all calls, and demands. In accordance with an automatic stay, Rushmore will not provide monthly billing statements while the account is in active Bankruptcy status. Please note billing statements can be viewed as an attempt to collect a debt, which would conflict with the protection provided under the bankruptcy. Furthermore, Rushmore does not provide coupon booklets.In Mr. [redacted]'s correspondence submitted through the CFPB website portal and Revdex.com website, he requested for a written apology. We have reviewed the account and found ourselves in compliance with servicing and bankruptcy guidelines. I was so happy May 2015 to get a Mod on saving my home. The Loss Mitigations guys were great!

Now I have tried 2 nights to call customer service to cancel/reschedule my June payment that will make me 30 days ONE TIME and they REFUSE to do it, keep asking why can't I make it, "unforeseen expenses" I say, they ask what are they? Who the heck are they - then the degrading starts - You have a responsibility to your investors, and how are you going to make up 2 payments next month, do you really intend to keep the house, a 30 day will make it unlikely to refi, and lastly telling me notes are in my account as to how difficult it is to work with me. What the HECK! DO NOT EVER CONSIDER RUSHMORE FOR A LOAN.

After we received your first complaint regarding this matter in November 2015, we discovered that the City tax office misapplied the payment due to incorrect tax account numbers being provided. Rushmore Loan Management did NOT provide answers to the questions we asked of them in our numerous Qualified Written Requests to you. Rushmore provides only a "small PORTION" of answers to our questions. We believe that this home loan is an UNSECURED DEBT, stemming from an old Countrywide Loan dated 12/21/2005. We CHALLENGE RUSHMORE LOAN MANAGEMENT SERVICES LLC, [redacted], AND [redacted] TO PROVE THAT THEY OWN THIS LOAN!!  WE DO NOT WANT TO SEE SOME OLD COPY OF OUR NOTE WITH COUNTRYWIDE HOME LOANS ....THIS DOES NOT PROVIDE PROOF TO US THAT YOU OWN THIS LOAN!!!!!!!!!!!!! PROVE THAT COUNRTYWIDE HOME LOAN CWAB 2005-BC5 WAS ACTUALLY DEPOSITED IN THE TRUST IN THE TIME FRAME LEGALLY ALLOTTED . PROVE THAT COUNTRYWIDE HOME LOANS LEGALLY ASSIGNED INTEREST OF OUR NOTE TO B[redacted] PRIOR TO FEB 2012. regarding the mortgage loan account referenced above. Please note that Rushmore is the servicer of the loan and that the owner of the loan is [redacted] Loan Mortgage Corporation. The servicing responsibilities for the loan transferred from [redacted] Mortgage to Rushmore effective October 17, 2016. We appreciate the opportunity to provide you with this written response.On December 9, 2017, Rushmore sent you a letter which confirmed that Rushmore had been notified of property damage and described our repair monitoring process. We listed the required documents that you would need to provide and sent you a Conditional Waiver of Lien and an Affidavit that needed to be signed, notarized and returned to us. We also reviewed our process with you during a phone call on that same day.On February 27, 2017, Rushmore called and left a message requesting a return call. Rushmore did not receive a return call. However, on March 9, 2017, Rushmore received a claim check in the amount of $20,558.22 and another claim check in the amount of $1,306.09. Both were endorsed, and Rushmore deposited the checks into your loss draft account. We also received the requested documents. Rushmore called and confirmed receipt of the checks and the documents. Because you had multiple contractors, you provided us with specifics on how the first draw should be disbursed. Rushmore sent the checks to you via Federal Express on March 14, 2017.On March 15, 2017, we received a call from you asking when the inspection needed to be performed. We advised you that once the repairs were 50% completed, you would need to call us in order for us to order the inspection.On April 5, 2017, Rushmore received an e-mail from you stating that you were ready for the first inspection. We ordered the inspection and listed you as the contact. On April 18, 2017, Rushmore received a call from you stating that you had not been contacted by the inspector yet. Rushmore called you back and provided the inspector's information.
