Mr*** purchased a floor model Barefoot Spa from an event we hosted in Baltimore, MDThe customer selected a unit and inspected it in the show room and signed off on the condition at the time of saleUpon delivery the customer noticed a flaw that he had not noticed in the show room, and rejected delivery of the unitThough it is against our policy and procedures, we agreed to deliver a different unit to the customer at no additional chargeThe customer signed for the delivery of the new unit, then later called to complain of "scuffing" on the panelBecause this was not noted at the time of delivery, and we have already gone above and beyond to facilitate a secondary delivery for the customer, we explained there was nothing we could do about the minor cosmetic scuffing on the panel that was not noted prior.
Signature Productions is a Barefoot Authorized Reseller, and we are authorized to distribute products manufactured by Barefoot SpasWe are separate entities, just like any dealer or distributor for companies like Ford or Chevrolet

On 3/5/I purchased a barefoot spa's hot tub with a coverIt was priced as one unitTotal price was $7,The Invoice#/purchase agreement # is ***The spa serial # is model PLIt was financed thru *** *** From the research I have done a spa cover can cost anywhere between $- $I am working on getting the exact cost for this specific coverI have contacted Barefoot spa's/Signature Productions about this issue advising them them 3/when they called to inquire about how the delivery wentThey advised and gave me the # to contact *** Spa covers*** covers claim its a tear that I did(Which I later found out from other Revdex.com complaints that thats how they operate(blame the customer) Then they requested I pay to mail it to them and they would repair it, which is ridiculous because it would cost me more to pay the postage for mailing it, newer mind the cost involved in getting it boxed to ship, then it would to just go buy a new oneAlso I don't want a repaired NEW Spa coverI want a NEW one without defects which is what I paid forThen I made a Revdex.com complaint against Signature Productions and *** Spa'sI also called *** bank today to put in a claim and dispute the spa cover portion of the charges

For your reference, details of the offer I reviewed appear below.Dear Sir,Attached are copies of our contract with Spa Blowout ( Signature Productions), and as you can see nowhere on the contract does it state lead time for delivery or the responsibility of the customer to contact them for deliveryThe salesperson, *** ***, stated to me and my husband that yes it should take 6-weeks, but we were told by *** that we would receive a call the day before delivery to set up a time and to make the final paymentWe lost track of time and before we knew it it was close to weeks and we hadn't heard from them at all, there are both mine and my husbands phone numbers on the contractMy husband tried calling several times before he finally got to talk to a customer service rep by the name of ***He inquired about the delivery of the spa and *** stated he had to talk to the dispatcher, ask to talk to them, they weren't in, they were out on the road, he left our name and number and never received a return callThey continue to state that there aren't any refunds, returns or exchanges, but what holds them accountable to a reasonable time frame? We have filed a second dispute in with our credit card company as well, trying to get our deposit back since they didn't hold up their end of a verbal and now from their response a written agreementYour help with this situation would be greatly appreciated

For your reference, details of the offer I reviewed appear belowI purchased this hot tub from Barefoot not some representativeFrank *** specifically told us he works for Barefoot spa while mentioning how they have been in business for years etcThis hot tub was delivered to my house contaminated with white water mold infested in the PVC pipingI contacted Frank the day of delivery and received sinstructions from him and followed them as instructed, days later the hot tub contracted a white water mold infestationHe never once in this process made any mention of any other person, entity or customer service I needed to contactOnly after the problem started and Frank Newman ignored my texts and multiple phone calls, we found the Barefoot spa number online and out of desperation started calling themI have now left messages for the CS manager Amanda and I respectfully disagree with her assessment "I was out of the office"I have been calling for more than two weeks now and was told by whoever answered the phone she was on the line and if they could help or did I want to leave a messageNO REPLY not one after I left messages for her and twice that many to their company representative Frank Newman. You cannot simply pretend this is not your problem because you feel I purchased this hot tub from Frank which you now claim not to be a company employeeHe told Michelle and I he represents Barefoot spas and he is our contact person fro set up and all other issues including repairs and warranties if ever needed
This is not a water problem Amanda was so eager to point outThis was not caused by inadequate chemicals or balancing of the water, I used all the chemicals you provided me with (I was told by Frank "this is all you need") I also followed every instruction Frank gave meMichelle was listening to the instructions on speaker phone and wrote it down step by step to ensure we do everything rightI have proof of all the communications between Frank (your representative) and myselfIncluding all the unanswered texts and pictures I sent him This infestation was too fast and too severe to have been caused by a water problem, this was caused by Barefoot's lack of sanitizing this tub after it was pressure tested
I have now spent two full days in freezing temperatures draining and flushing this biofilmI have spent almost $on chemicals alone, I have had to refill a gallon tub and reheat the water three times To make this an even better experience I diagnosed with a skin condition because of this whitewater mold and paid $for medicine to treat this very painful rashAll of this is caused by Barefoot and its representatives unwillingness to help me when I reached outIt is unacceptable that I am told by Frank Newman acting on your behalf that he is my point person your company, never once making mention that he is in fact NOT the point person and now Amanda has the audacity to tell me I called the wrong personAmanda now pretends as if I did not contact customer support which I actually did, after finding out the hard way Frank was not my point personThe reason I started calling Amanda (and belong ignored) was because when I asked Barefoot customer service about white water mold I was told "I have never heard of that"I have spent almost $and are stuck with a hot tub giving me a rash and nobody is willing to help me
I request an $refund to not only offset all my expenses, effort, pain and frustration but also allow me to find professional local help for my problem***

Called business spoke with MrG*** he stated that he spoke with Mr*** Jr on December 5, letting him know that if the pillows are melting that to many chemicals are being usedBecause if the tub got hot to the point to melt the pillows the tub would catch on fireMrG*** sent
Mr*** an email on December 5, with an authorization form to fill outOnce that information is received back then MrG*** will be able to get a tech scheduled to come out and look at the tub to help diagnose the issue

I have spoken to the customer and asked them to fill out a warranty authorization formOnce that is complete I will send him a new pump to replace the broken one

This customer called in after the show and wanted to cancel since she was unable to lift the coversWe offered to buy the cover lifts to help assist her, as I explained very clearly several times that we did not want to just keep her down payment, and I wanted to help her get this deliveryAfter
much back and forth she said if we had to keep the money then so be itShe understood very clearly what the terms were, and we are ready and willing to deliver her spa if she will accept it

We have solved this one with the customerShe has accepted delivery of the spa, which we upgraded for her, and is happy with us at this pointThe spa did get damaged in transit, but we are providing her with a technician to repair it ASAP

This letter is to notify your company (Barefoot Spa, Signature Productions) that I am cancelling our hot tub order of January 24,with your company; we no longer want your productAs you are well aware, we notified Signature Productions in person less than twelve hours after visiting the event at the *** *** (the morning of January 25th) that we wanted to cancel our order, but were turned away by aggressive and unhelpful staffAt no time during the two hours that I spent trying to cancel the order did anyone inform me that my cancellation request needed to be in writingAdditionally, I would like to restate that I hold true every detail outlined in my complaint to the Revdex.com and will provide them with a copy of this letter
As I know you also know, nowhere on the purchase agreement is there one word about a
"restocking fee to be equal to the amount paid up to the time of cancellation", and at no time
during the sales transaction did the salesman, *** ***, state that fact or the fact that we
were signing a "final sale" documentTherefore, I expect my $1,deposit charge to my credit

*** *** First of all, I would like to dispute one of the elements of Signature’s alleged remedies for placement of my spaThe delivery crew did not offer any alternate placement options other than my drivewayThere is no place in my front yard or side yard where the spa could be placedThe delivery driver, Peter, did however, admit that he was partially to blame, as he did not ask me specific questions about delivery placement when he called to give us the time and date of deliveryWe did speak directly to one another after he left me a voice mail to let me know the original delivery date had been postponed because of mechanical issues with his truckWhen we spoke, I asked him to confirm the new delivery date and time, and he never asked me any questions about where the spa was to be placedWhen we signed the contract for the purchase of the spa with the salesman, Chris, he added notes to the delivery team, alerting them to the fact that the spa would need to be brought up a gravel hill and placed in the back yardApparently those notes did not make it to the delivery teamPeter, the delivery man, also said he realized that he did not ask specific placement questions while on route and was a bit concerned that he was making this delivery “blind” with no additional information. I read the terms of delivery in the contract when I signed it, and understood that standard delivery involved two men taking up to two hours to deliver and place the spaI was not concerned about the contractual language, as I was assured by the salesman, Chris, and his supervisor that the delivery and placement I needed would be “a piece of cake” for the delivery crewChris even showed my wife and I a folder with pictures of several non-standard deliveries, one of which involved a crane, and another which required a boat for deliverySince I had no idea what the delivery people were capable of, I deferred to Chris and his assurance that our delivery would assuredly be a standard delivery. Once again, I am maintaining that Signature is guilty of using misleading sales tactics to close a saleMy additional argument for this is that salesman, Chris, asked what it would take to make a sale to us that dayWe told him we were just there to gather information and look over the merchandise, but told him if the price was right and delivery could be made to the specified location in our back yard and this delivery was included in the final price, then we might make a deal that dayIt was his assurance that the delivery could easily be made where we requested it, and that delivery was included in the final price, that we decided to make the purchase. Since my initial complaint to the Revdex.com, I hired a crane operator to place the spa in my back yard at a cost of $I am now asking that $be deducted from the price I paid for the spaThis will be the only remedy acceptable to me at this timeI can provide a receipt for the cost of placement upon request

As stated in the original complaint, we were assured by our salesperson, Edward V***, that if we cancelled the order our deposit would be refunded. In truth, as you will see by the email attached, I did not cancel our order. They refused to provide a contract that was as detailed as the contract we were originally shown. When I sent the attached email back, I received a rude phone call stating they had never had to explain the contract before to anyone. He went over it with me, using terms that did not match the original contract. I told him I had no problem moving forward with the Hot Tub for $*,***, but to ensure that I received everything originally promised, I needed the contract to state exactly what it said originally, but with the lower price. He finally told me to be quiet as he was talking and I needed to listen to him. He said you will forfeit your deposit of $***. When I explained, again, that we had been assured by Edward that we would get that money back, he said Edward was wrong. He said, "You will file a dispute and I will provide the credit card company with a copy of your signature showing you signed, with the words, no refunds. You will lose. I do this all the time." He then hung up on me.I was prepared to move forward with the Hot Tub at the lower price, but after all of this, I would never do business with them, nor would I allow any friends or family to do so. The contracts are attached in the email pages and you will see that they differ enough to cause concern with what we were being provided for a lesser price. I do want to be clear that I did not break or cancel the 2nd contractIt was their choice to cancel when they refused to provide proper paperwork and then hung up on me.As a token of our appreciation for the time Edward spent with us, I sent him a text to let him know that we didn't cancel the deal, his boss hung up on me. I didn't want him to get into trouble or loose a commission thinking I didn't want the hottub. He responded with a note to his boss, but he copied me instead. I was shocked to see this as I thought he was sincere, but when I mentioned that he had sent it to me I received back a shout of SORRYCopies are attached of same.This is a very unprofessional company with exceedingly poor customer service and very questionable business practices
