July 12, 2016Revdex.com of Upstate South CarolinaAttn: [redacted] North Church Street, Suite C Greenville, SC 29601- [redacted] Dear [redacted] We received the response from Mr [redacted] concerning the original reply we sent for his Revdex.com complaint We were able to contact [redacted] , who had recently traveled from the US to Canada He advised us that he had the tires inspected at a [redacted] store in Montana during his travels [redacted] advised [redacted] that the tires did have sidewall cracking However, the [redacted] codes indicated the tires were year old and not eligible for adjustment under the Standard 6-year warranty I was able to speak with the dealer at [redacted] ***, who verified the information provided by [redacted] [redacted] advised us that he proof of purchase showing the tires were purchased within the last years With proof of purchase, we can adjust the tires under the 6-yr warranty Because [redacted] is currently in Canada, we have agreed to adjust the tires for him at a 50% credit under the terms of the warranty provided he sends us a copy of his proof of purchase upon his return home We worked directly with Mr [redacted] to locate a dealer that will adjust the tires for him before he travels back to the US Sincerely, [redacted] ***Michelin North America Tell us why here

We have reviewed the circumstances with Mr. [redacted] Michelin tires. Our records indicate that we were initially contacted by Mr. [redacted] on 07/19/2017 concerning alleged wet traction concerns with his Primacy *** tires fitted on his 2015 Toyota Avalon. Mr. [redacted] was advised of the 6 year warranty coverage and that wet traction was not a warrantable condition. However, we did advise him that we would review for any possible assistance if an authorized Michelin retailer provided inspection results of the suspect tires to us. We provided information on 7 authorized dealers he could visit during that contact. On 08/22/2017 we received the required inspection results from Holly at [redacted] Toyota. We noticed at this point with projected mileage Mr. [redacted] ’s would most likely fall short. Being as wet traction is not covered under our warranty guidelines we offered a 33% credit on Michelin replacement tires based on the projected mileage in an attempt to resolve Mr. [redacted] ’s concerns. Holly, the representative at [redacted] Toyota is currently awaiting approval from Mr. [redacted] to replace his tires on this basis. Mr. [redacted] will have 14 days to accept the offer. The tire that I still have in my possession will be inspected by a professional to confirm my complaint, that it is a tire manufacturing issue. We spoke with Mr*** earlier today. We let him know that we will process the additional 20% credit (for a total of 75% credit). For the convenience of the consumer, we asked for a copy of the invoice from him, so that we can mail him a check for the 20% difference

We received
your email regarding Mr ***’s complaints
Based on the
dealer’s
inspection of the tire on Mr ***’s Toyota, the tire came out of
service due to a road hazard injury. The
Michelin passenger and light truck tire warranty covers defects in workmanship
and materials for years from date of purchase or the life of the tread,
whichever occurs first. Road Hazard
damage is not covered
Strictly as a
goodwill gesture to assist Mr *** with the cost of the replacement tire, we
provided 75% credit (installation charges and taxes are the
consumer’s responsibility)
We feel we have tried in good faith to assist Mr ***
outside the realm of the limited warranty.
We are sorry that he does not agree with our decision. However, as a goodwill gesture, if Mr ***
would provide a copy of the tire purchase invoice, we will gladly reimburse the
remaining 25% he paid to replace the tire directly to him. He may contact our office at 1-866-***-*** for instructions on sending his invoice

The following information is what we were advised by the tire dealer inspecting these tires.Dealer Chris from ***'s Total Car Care & Tire Service called in on a irregular wear case on tires.Date Of tire purchase is APR 2013.Current TD is LF LR 3, RF 3, RR 3, original is
10.Based on the Limited Warranty Chart, offer is 1@85% charge to cns for Irregular Treadwear, no mechanical issues for the LF.Based on the Limited Warranty Chart, offer is 1@70% charge to cns for Irregular Treadwear, no mechanical issues for the RF.Based on the Limited Warranty Chart, offer is 1@85% charge to cns for Irregular Treadwear, no mechanical issues for the LR.Based on the Limited Warranty Chart, offer is 1@85% charge to cns for Irregular Treadwear, no mechanical issues for the RR.Averaging the offers to be 4@81% charge to consumer per tire.Claim type 7, authorization code required.Dealer will call back to let us know if the offer was accepted, give us a claim number, and get an authorization code.Our Limited warranty would have covered these tires at approx 50% based on mileage IF the tires had been worn evenly (meaning no more than 2/difference in tread depth across the face of the tread). As you can see, these tires measure irregular tread wear up to and 4/across the face of the tread. For this reason, and to try and help the consumer in a small way, we offered a 19% discount toward the purchase of new Michelin or *** tires. The consumer refused our offer. We feel that our offer was fair in that the tires are not covered under our limited warranty

replaced the *** tires with a competitor brandOur warranty guidelines specify
that “If a tire is covered, and more than 2/32nds of an inch of original tread
has been worn (or more than 25%, whichever is more beneficial to you), or it
has been more than months from the date of purchase, *** will replace
the tire with a comparable new *** replacement tire on a pro rata basis.”
We cannot, under the
warranty guidelines, offer credit on the cost of competitor tiresWe will gladly
honor the existing offer of any due credit towards another set of ***
tires for Ms***’s or any other vehicle in her family for months
(expires 8/24/19)

respondOur file for Mr*** indicates that we were contacted on March 3, by Mr*** bringing to light his concerns of cracking with his tiresWe were advised by Mr*** that ***’s Club would not process a warranty claim on his behalf with no specific reason as to why was stated at that timePlease be aware that wholesale clubs such as ***’s Club, ***, or *** Wholesale Club only service tires they sellThese processes are separate from ours At this point we assisted in finding a dealer willing to process a warranty claim on Mr***’s behalf through Michelin North AmericaWe were informed that Mr***’s tires did exhibit moderate cracking in the sidewall areaA pro-rated credit of 70% was determined to be due based on the tread depths provided to us. On page one of the Michelin tire Owner’s Manual it states “If there is a defect in workmanship and materials during the life of the original usable tread, or six (6) years from date of purchase (whichever comes first), your tire may be replaced on a pro rata basis under this warrantyAfter six (6) years or the wear of the original usable tread, whichever occurs first, all warranties, expressed or implied, expire.” On page of the Owner’s Manual it reads” If a tire is covered, and more than 2/32nds of an inch of original tread has been worn (or more than 25%, whichever is more beneficial to you), or it has been more than months from the date of purchase, Michelin will replace the tire with a comparable new MICHELIN replacement tire on a pro rata basisThis means that you will be responsible for paying a portion of the costThe Michelin tire retailer will determine the portion for which you will be responsible by multiplying the percentage of the original usable tread worn, by the current selling price at the adjustment location or the price in the current Michelin Base Price List, whichever is lowerYou also will be responsible for paying in-full the cost of mounting and balancing the tire, and the cost of any other service charges and applicable taxes, including *** *** packs.” Each selling retailer determines what their costs will be with no influences from Michelin North AmericaThe pro-rated credit is offered in percentages to be calculated along with what the retailer determines the starting price to be We respectfully decline to offer any additional credit to Mr*** and feel the appropriate amount was provided based on the use of his tires Sincerely, Jon Michelin North America Executive Response Team
