C Spire's terms and conditions say the following: "C Spire reserves the right to (i) limit throughput or amount of data transferred, deny Service and/or terminate Service, without notice, to anyone it believes is using the Service in any manner prohibited above or whose usage adversely impacts its network or service levels, and (ii) protect its network from harm, which may impact legitimate data flows." C Spire continues to offer data service in an unlimited amount However, we do reserve the right to alter the speeds based on consumptionThe usage amount that would trigger speed alteration is times that of a customer Therefore, we supplied well more than the amount for the $ [redacted] that was paid

The number in question was upgraded to an iPhone 4S on April 26, and Ms [redacted] did purchase Apple Care Apple Care is a product offered by Apple C Spire serves as an agent and is allowed to sell Apple Care and handle warranty issues Apple Care extends the warranty period to years rather than the year period It also allows instances of damage that can be claimed on Apple Care that are not covered under the warranty In the case of damages, customers are charged a processing fee of up to $ [redacted] in accordance with the Apple policy As with any phone manufacturer's program, the replacement phones are warranty ready devices that are normally reconditioned devices that have been refurbished by the manufacturer There is no contractual language that provides the customer with the opportunity to receive a new phone Ms [redacted] says that she has the names of people with Apple who told her the replacement would be new I would be glad to take those names an investigate C Spire actually handles this warranty process in the stores so that customers do not have to ship phones and wait for replacements The phones we provide customers are actually provided to us by Apple for this purpose

Mr***'s phone was non-functional and would not navigate to the home screen This is not necessarily a software issue and could be caused by liquid damage to the device His phone was out of warranty and we offered his options one of which would have been an insurance replacement device According to the notes on the account, Mr [redacted] did not want to pay the deductible On the day after this complaint was filed, Mr [redacted] did upgrade his device While there were some terms stated to him, these were conditional on the device when we saw it After we examined the device, we could not abide by these terms Mr [redacted] now has a new working device and we hope this matter is settled.%

C SPIRE IS THE WORST CELL PHONE COMPANY EVERTHEY ARE VERY DISHONESTI SWITCHED TO THEM FROM ATT AND WAS TOLD THEY WOULD PAY MY ATT BILL, MY LAST BILL CAME IN AND THEN THEY SAY OH WELL YOU WILL JUST GET A CREDIT TO YOUR C SPIRE ACCOUNT AND THEY NEVER CREDITED THE ACCOUNT, WE HAD TO HAVE AN EXTENSION ON OUR BILL TO KEEP OUR PHONES FROM BEING CUT OFFAFTER TALKING TO I DON'T KNOW HOW MANY DIFFERENT PEOPLE AND STILL NO ANSWERS AS TO WHY THEY HAVE NOT CREDITED OUR ACCOUNT AND KEEP TELLING US SOMEBODY WILL CALL US BACK WITH AN ANSWER AND WE NEVER GET A CALL BACKOUR PHONES WERE DISCONNECTED AFTER WE HAD AN EXTENSION ON IT AND THEY SAID THEY WOULDN'T BE CUT OFF BC IT WAS THEIR MISTAKE NOT OURSSO WE HAD TO PAY THE AMOUNT OF THE CREDIT THAT THEY WERE SUPPOSE TO PAY TO GET OUR PHONES TURNED BACK ON AND NOBODY WILL GIVE US AN ANSWER AS TO IF THEY ARE GOING TO GIVE US OUR MONEY BACK OR NOTTHEY KEEP TELLING US IT WILL BE 2-DAYS BEFORE WE GET A RESPONSEI WOULD NEVER RECOMMEND THIS COMPANY TO ANYBODY

Phone insurance and the Percs Upgrade program are both presented to the customer at point of sale on a signature pad and the customer must agree to these and sign the signature pad Ms [redacted] did both Including tax, she was charged $ [redacted] for these features C Spire has actually credited $ [redacted] to the account Ms [redacted] service has been interrupted due to a past due balance that still remains C Spire feels it has taken every necessary step to rectify this issue

The amount of usage that could cause this alteration will be different depending on the location of the usage Ms [redacted] 's recent usage has averaged an amount that is twice that of the average customer We hope this explains the issue and properly documents the terms that were agreed upon

Mr [redacted] purchased his devices at discounted prices on December 18, C Spire offers a day disconnect policy that allows the customer to return their devices and pay nothing for the service during that period of time in order to test services Mr [redacted] did not take advantage of this Further, there are no complaints recorded in our system regarding technical service We will call Mr [redacted] and attempt to troubleshoot his problems

Had Ms [redacted] 's plan change gone in as she had wished on 1/17, her bill that closed on 1/would have had a charge for $for the mobile [redacted] Instead, it was billed $Her plan was changed correctly on 1/ Therefore, her bill that came out on 2/reflected a net charge for this same number of $due to the fact that the charges had been reduced and there was a partial month credit Had her plan changed on time, this would have been charge of $65.As a result, this line was billed $for these months and should have been billed $ Therefore, a credit of $plus taxes and fees are being credited to her account The total credit is $ We hope this resolves this matter

Complaint: [redacted] I am rejecting this response because: The plan has still not been changed back to the unlimited data plan as the response stated had been done as of 5/4/@ 14:The rep at the store changed the plan without the permission of me, the account holder, or my wife, who was in the storeShe called me to ask about the plan change while in the store after he mentioned it and I directly spoke with the rep and told him "No"I found out later that he had already changed the plan before receiving consent from either of us and he told my wife that he would change it back, but did notAlso, the rep told her to take it to a computer store to fix the battery issueThere is nothing wrong with the screenWhat further details do you have about the battery issue? Ms [redacted] 's bill has been mailed to her billing address monthly We have a record in our tracking system that it was received in her post office and out for delivery Ms [redacted] asked for us to send her a copy by email In order to protect customer information in accordance with Customer Proprietary Network Information requirements as mandated by the FCC, we do no email bills.In C Spire's terms and conditions, it is clear that customers are billed through the end of the upcoming billing cycle and that services will remain until that point C Spire followed this process in this case if Ms [redacted] still does not have a bill, we can have one delivered to her local retail store for her to pick up Otherwise, the billing that we have issued appears to be correct at this point
