The number in question was upgraded to an iPhone 4S on April 26, 2013 and Ms. [redacted] did purchase Apple Care.  Apple Care is a product offered by Apple.  C Spire serves as an agent and is allowed to sell Apple Care and handle warranty issues.  Apple Care extends the warranty period...

to 2 years rather than the normal 1 year period.  It also allows 2 instances of damage that can be claimed on Apple Care that are not covered under the warranty.  In the case of damages, customers are charged a processing fee of up to $** in accordance with the Apple policy.
As with any phone manufacturer's program, the replacement phones are warranty ready devices that are normally reconditioned devices that have been refurbished by the manufacturer.  There is no contractual language that provides the customer with the opportunity to receive a new phone.
Ms. [redacted] says that she has the names of people with Apple who told her the replacement would be new.  I would be glad to take those names an investigate.  C Spire actually handles this warranty process in the stores so that customers do not have to ship phones and wait for replacements.  The phones we provide customers are actually provided to us by Apple for this purpose.

C Spire's terms and conditions say the following:

C Spire continues to offer data service in an unlimited amount.  However, we do reserve the right to alter the speeds based on consumption. The usage amount that would trigger speed alteration is 4 times that of a normal customer.  Therefore, we supplied well more than the normal amount for the $** that was paid.

In accordance with the customer service agreement, C Spire sent Ms. [redacted] a notice of planned amendment of her service plan. In fact, C Spire discontinued offering its unlimited plans in November of 2014.  C Spire is working towards the orderly migration of its legacy unlimited customers  to rolling data plans, such as the 6GB rolling data plan offered to Ms. [redacted] .   Under this plan, any portion of allotted data not used in a given month is rolled to the next month, up to a cumulative maximum amount of 6GB rolled into any billing cycle.  Data passes are available for purchase, as necessary, for additional data. Ms. [redacted] is welcome to select among C Spire’s service plans to accommodate her desired usage. C Spire’s data management tools empower the customer with rolling data plans (up to the plan’s monthly limit), data balance checks at datapass.cspire.com, data overage protection and purchase of additional data using Optional Data Top Up Passes. Ms. [redacted] can make an informed choice among plans whose terms are transparent and clearly stated.

I am rejecting this response because it doesn't correlate with my initial issue regarding the billing issue/dispute.  Additionally, I have not been contacted regarding the matter.  I have had to pay the over-charges to ensure that my cellular lines would not be dis-activated.  Thus, irrespective of whether it's been paid or not my complaint still stands and I am seeking resolution to the matter.

Had Ms. [redacted]'s plan change gone in as she had wished on 1/17, her bill that closed on 1/18 would have had a charge for $65 for the mobile [redacted].  Instead, it was billed $140.
Her plan was changed correctly on 1/27.  Therefore, her bill that came out on 2/18 reflected a...

net charge for this same number of $11.78 due to the fact that the charges had been reduced and there was a partial month credit.  Had her plan changed on time, this would have been charge of $65.As a result, this line was billed $151.78 for these 2 months and should have been billed $130.  Therefore, a credit of $21.78 plus taxes and fees are being credited to her account.  The total credit is $23.96.  We hope this resolves this matter.

C Spire's terms and condtions regarding the unlimited plan say the following:

While we do reserve the right to alter speeds due to high usage to protect the network, we continue to offer data at a flat rate for the remainder of that period.  We encourage our users to utilize WiFi whenever possible to help alleviate this problem.  C Spire does offer other plans there the speeds will not be altered.
The plan Mr. [redacted] is on is not available on 4G devices.  We continue to support it on 3G devices.

The amount does fluctuate based on the area where the data is used.  Ms. [redacted] mentions 7GB.  If she remains below this amount, her speeds should stay consistent at this time.

I am rejecting this response because: On Wednesday, 5/18/16, I contacted CSpire via phone and the representative stated that they could not tell me anything about the account and it is nothing they could do to help me with this matter. They did NOT mention that TransUnion contacted them earlier this month on 5/2/16 or 5/5/16. If this information was forwarded to TransUnion during these dates, the hard inquiry should have been removed by now. It still appears on my credit report. Please see screenshot attached where CSpire is listed twice on my credit report. This information is accurate and up to date because I purchased the TransUnion Credit Monitoring System for $9.95/mo. So, please let me know what I should do next to resolve this issue.

C Spire is not in breach of contract.  Mr. [redacted] relocated to an area with poor coverage.  This is out of C Spire's control.  However, if Mr. [redacted] will pay $[redacted].  C Spire will settle the account with a $0 balance.  We feel this is fair given the discounted price we sold the phones for.  If Mr. [redacted] will mail this to the following address, we will credit the difference.

I received a letter in the mail, dated 06/19/15, from C Spire stating that the second "unlimited" plan on my account will be automatically converted to the 6GB rolling data plan and I will be charged an additional $40 per month for this change due to my daughter going over her data usage. I've been a loyal customer for almost 10 years and if data was a problem, a text message or a letter should have been mailed prior to this stating that my child was using too much data and WiFi should be used when applicable. I have always been under the impression that "unlimited" was just that, but I didn't know that it wasn't really "unlimited". How is it that I'm paying for an unlimited data plan for both lines and my usage is still being monitored? Isn't that false advertisement? When I called and spoke with a customer service rep she was very unhelpful and kept telling me to go on-line and look at their policy. After going on-line, I have yet to find a statement stating that my plan can be increased at the discretion of C Spire. What I did find was "....CSpire reserves the right to limit throughput speed or amount of data transferred at times of network congestion." I informed the customer service rep of this and she stated that someone would call me back, I never received a call back. Upon calling a second time after a few weeks, I was connected with a very rude customer service rep who was very unhelpful. After the service I have been receiving from C Spire lately, I would not recommend them to anyone.
I explained to them that this is my daughter's line and of course her data usage will increase in the summer because she out of school, I would like to keep my current data plan and use WiFi when applicable to cut down on her data usage since I now know that the "unlimited" data plan is definitely not "unlimited".

In reviewing the details of this account, there appears that a former C Spire employee misinformed Mr. [redacted].  Therefore, we will adjust his balance to $0 and cease any collection efforts.

When Mr. [redacted] was billed on May 31st, there was a past due balance forward of $283.51 and a new current amount of $156.16.  On June 21st, Mr. [redacted] paid $283.51 leaving a balance on the account of $156.16.
On June 27th, Mr. [redacted] came in to complete the transaction he notes in his...

complaint.  At 2:18 P.M. the transaction was completed that gave him a phone at no charge but charged him a $170.00 early device replacement fee.  As he said, he did not want to complete this transaction.  Therefore, it was reversed and a credit transaction of $207.57 was posted at 2:21 P.M.  Then at 2:24 P.M., Mr. [redacted] purchased a phone and an accessory for a total of $186.16.  Instead of paying for this, he had it billed to his account.When customers bill items to their accounts, they do not book to their balance until the end of the cycle.  However, when a credit is placed on the account it is immediate.  Therefore, the charge for $207.57 was set to hit Mr. [redacted]' account at the point of billing on 6/30.  This credit amount cleared his past due balance of $156.16 and left a credit balance of $51.41.  The amount of $207.57 and $186.16 showed up in his current amount which was $539.19.  Had the transaction simply wiped out the initial $207.57 charge, his bill would have had the $156.16 past due and a current amount of $331.61 which included the new phone he actually did purchase.  As a result, his balance would have been the same but his amounts would have been different for past due and current.
Mr. [redacted] paid nothing on his account from June 22nd, through August 31st causing his account to be severely past due.  However, as you can see by the break down above, we did bill Mr. [redacted] for the early device replacement fee but credited it.  The only true amount he has been billed was for the phone he purchased that same day.  Other than that, he has been billed for services.  C Spire is confident that our billing is correct.

Ms. [redacted]'s iPad was on a 3GB per month plan.  Her usage was as follows:
Feb of 2015: 1.3 GB
March of 2015: 1.2 GB
April of 2015: 2.1 GB
May of 2015: 1.4 GB
June of 2015: .8 GB (This month was low because service was interrupted for non-payment.
The iPad was purchased on an installment plan and not paid for nor returned.  In reviewing account notes, Ms. [redacted]'s calls regarded the bill and plans but not technical issues.  Based on what we are seeing, the device has ample use.  It could also have been used on WiFi connections even after the account was disconnected.  Due to the fact that Ms. [redacted] did not pay for the device, we feel that the bill is due at this time.

We have issued a credit of $[redacted] for the billing cycles of 4/22, 5/22, 6/22 and the upcoming 7/22 cycle.  We will post credits before the closing of the billing cycle each month to fulfill our offer.

The account in question is not in the name of [redacted].  However, we do have a signature from the account holder agreeing to the terms and conditions that include the following language:
"C Spire reserves the right to (i) limit throughput or amount of data transferred, deny Service and/or terminate Service, without notice, to anyone it believes is using the Service in any manner prohibited above or whose usage adversely impacts its network or service levels, and (ii) protect its network from harm, which may impact legitimate data flows. Customer may not send solicitations to C Spire subscribers without their consent. Customer may not use the Services other than as intended by C Spire and applicable law."
C Spire does offer a warning prior to the point where the speeds are altered.  If Ms. [redacted] would have the account holder file a complaint or request the signature copy, we will be glad to produce it.

Ms. [redacted] purchased an iPad in February of 2015 on a device installment plan.  It was on a separate account because her account was not eligible to add another device.  No payment was ever paid on the account and it was eventually disconnected.  As a result, the full cost of the...

device was charged.At this point, Ms. [redacted] wants us to send her an indoor cell zone which has a cost to C Spire of $300.  We will not be sending her that device until she pays the write off account for the iPad.  That balance is $687.71.
