Mr. [redacted] does not have a credit account with Seventh Avenue. Mr. [redacted] was mailed a Seventh Avenue catalog that included an invitation to apply for a credit account. Upon receipt of his order and request for an extension of credit, Seventh Avenue evaluated Mr. [redacted]'s creditworthiness and...

determined that it could not grant his request for credit in its entirety. Instead, Seventh Avenue offered to open a credit account for Mr. [redacted] if he paid a portion of his order in advance. Upon receipt of the requested payment Seventh Avenue would ship the merchandise Mr. [redacted] ordered and open an account in his name, posting the unpaid balance of the order to his new credit account. Mr. [redacted] would then have the opportunity to earn increases in his credit limit by making regular, timely payments on his account.

Mr. [redacted] opened his account in December of 2013. The information provided at account opening included Mr. [redacted]’ name, address, and email address, match the information included on the complaint. Moreover, Seventh Avenue has previously mailed an identity theft affidavit to Mr. [redacted]’ attention for...

him to complete sign and return. He has not done so. Seventh Avenue’s records indicate a second affidavit was mailed to his attention on February 3, 2017. Seventh Avenue will investigate this matter further if and when the affidavit in returned. In the interim, the information available establishes a reasonable basis for believing that Mr. [redacted] opened the account and is responsible for payment of the balance.  Thanks, Matt

Ms. [redacted] was pre-screened to receive a pre-approved credit
offer from Home at Five.  The promotional
materials for this offer state:

Please note the highlighted text. It 1.)does not indicate
that Ms. [redacted] was pre-approved for a $400 credit limit: 2.) clearly indicates
her credit order is subject to approval and 3.) refers the consumer to the
terms of the offer on the back of the order form.
Ms. [redacted] placed an order with Home at Five on April 14,
2015. The amount of the order exceeded $400. After reviewing Ms. [redacted] credit
history, Home at Five offered to open an account for her if she remitted a down
payment equal to 1/3 of her order total. Had she made the down payment, an
account would have been opened in Ms. [redacted] name and the unpaid balance of her
order would have been charged to the account. As a result, she would have
received an extension of credit between $100 (the minimum limit listed in the
terms of the offer) and the upper limit of $400 listed on the promotional materials.
Finally, it should be noted that a creditor has the right,
under the FCRA, to review the credit history of any consumer who responds to a
pre-approved offer and to revoke the offer if the review indicates the consumer
no longer meets the criteria established for the offer.

A letter indicating Ms. [redacted] settled her delinquent account for less than the full balance was faxed to her attention on April 18, 2016 and a hard copy was mailed to her attention. Our records indicate the prompt return of the Lodge Furniture Protectors due to just not...

fitting.  We regret it was an error on our part credit was issued for the Recliner Protector only in the amount of $44.95 and we missed the Sofa Protector.  Per your call on 9/22/15 it was brought to our attention and credit of $69.95 was issued.   We regret it was missed when the original processing was completed in December. We have also issued credit for the original shipping and processing and will remove any finance charges and late fees from your account, reducing the account to a zero balance within the next twenty four to seventy two hours.  Shipping and processing information is listed on the order blank in the center of the catalog or on line under Customer Service. It is not automatically credited, which is a common practice in the catalog industry when a product is returned because the customer didn’t like the product or changed his or her mind, or the item did not fit.

They have said they are sending a fraud package on two different occasions but have not done so. I cannot force someone to admit that they committed fraud. If they'll send the package I would be more than happy to complete the package. I would like that the fraud package be sent certified so that I can track it. Seventh Avenue is trying to Bill me for 122 dollars on merchandise they claim they have not even mailed. We do not want the merchandise but they should not be trying to charge me for something I didn't order or they haven't sent.

The accounts referred to in the complaint were coded as fraud on January 22, 2016 and Ms. [redacted] was notified of that action in writing. No information regarding the accounts will appear on her consumer credit report.

This information has been forwarded to the proper department for their review, which in turn was credited in full 9/28/2016. While completing the investigation it was noted you also made payment for the suit in the amount of $93.49 (109.99- 16.50 discount = 93.49) received 4/18/2016. We have issued a request for the refund check to be sent within the next seven to fourteen days.

sometimes circumstances are beyond our control.  It is difficult to determine how popular an item will be when creating our catalog and unfortunately the wreaths popularity and supplier inventory were unable to meet demand. A notice was sent in this regard on 10/20/2015.  We also noted an additional [redacted] which is available and is very similar , yet listed with a different identifying code and price. It is a darker, more Rust colored Pumpkin with Red & Green Leaves. Records indicate an order was started and deleted prior to completion 10/20/2015.

The previous accounts included in bankruptcy cause any new orders to be automatically declined by the system, which is why you have been asked to place all orders by telephone.
