If Ms. [redacted] has reported this incident to the police, Home at Five would appreciate receiving a copy of the police report to assist in resolving this matter as quickly as possible. Please note that Home at Five will not be contacting the FBI or any other law enforcement agency regarding the...

possibility that someone is breaking into Ms. [redacted] mail box.

We received the correspondence from the Revdex.com in regards to your order #[redacted] placed 11/25/2015 via mail.  We apologize for any disappointment with the Furniture Protectors.

Our records indicate the prompt return of the Lodge Furniture Protectors due to just not...

fitting.  We regret it was an error on our part credit was issued for the Recliner Protector only in the amount of $44.95 and we missed the Sofa Protector.  Per your call on 9/22/15 it was brought to our attention and credit of $69.95 was issued.   We regret it was missed when the original processing was completed in December. We have also issued credit for the original shipping and processing and will remove any finance charges and late fees from your account, reducing the account to a zero balance within the next twenty four to seventy two hours.  Shipping and processing information is listed on the order blank in the center of the catalog or on line under Customer Service. It is not automatically credited, which is a common practice in the catalog industry when a product is returned because the customer didn’t like the product or changed his or her mind, or the item did not fit.

We apologize, and appreciate the opportunity to explain.  We hope you’ll allow us another chance to serve you better in the future.  Sincerely, Seventh Avenue

The accounts referred to in the complaint were coded as fraud on January 22, 2016 and Ms. [redacted] was notified of that action in writing. No information regarding the accounts will appear on her consumer credit report.

Mr. [redacted] does not have a credit account with Seventh Avenue. Mr. [redacted] was mailed a Seventh Avenue catalog that included an invitation to apply for a credit account. Upon receipt of his order and request for an extension of credit, Seventh Avenue evaluated Mr. [redacted]'s creditworthiness and...

determined that it could not grant his request for credit in its entirety. Instead, Seventh Avenue offered to open a credit account for Mr. [redacted] if he paid a portion of his order in advance. Upon receipt of the requested payment Seventh Avenue would ship the merchandise Mr. [redacted] ordered and open an account in his name, posting the unpaid balance of the order to his new credit account. Mr. [redacted] would then have the opportunity to earn increases in his credit limit by making regular, timely payments on his account.

Seventh Avenue has mailed an identity theft affidavit to Ms. [redacted] and will attempt to reach her by phone at the number provided in the complaint.

We received the correspondence from the Revdex.com regarding requests for a catalog and promotional email. Thank you for requesting the Seventh Avenue catalog.  We appreciate your notifying us that a catalog has not been received, and apologize for any...

disappointment.
Occasionally there are problems with delivery. Our records did not indicate the same address as listed on the complaint, so it is entirely possible the catalog may have been sent to an incorrect address.  Normal delivery for a catalog request can be from seven to twenty one days.  At times there is the possibility that we are out of catalogs and may not be able to send one until the next issue is printed.  We are in the process of manually sending a catalog to you, please allow seven to ten business days for delivery.  In the interim, please feel free to view our catalog site seventhavenue.com.  You may place an order online, or contact us toll free @ 800-218-3945 for assistance twenty four hours a day.
Promotional emails are sent periodically.  Since the confirmation email had been received, rest assured, they will arrive when upcoming promotional information is sent.  Please feel free to check your spam folder, just in case.
We have forwarded your information to the proper departments for their further investigation and review.  We appreciate your understanding and are grateful for your understanding.  Sincerely, Seventh Avenue

As stated previously, the second account, ending in [redacted], was not opened until January of 2015, thus the only months in which this issue could have arisen were February and March of 2015. Also, as previously noted, the account was opened in the name [redacted] via the internet, using the information supplied by the consumer at the time the account was opened. The name on the account ending in [redacted] was changed to [redacted] in October of 2014. That change, however, had nothing to do with the establishment of the new account in the name of [redacted]. Since Ms. [redacted] has acknowledged that both accounts are hers, Ashro will join the accounts into one so that she will receive only one billing statement.

Ms. [redacted] placed an order with Monroe and Main on November 25, 2015 in the amount of $538.12, which was approved for shipment, on account number XXX-XXX-[redacted]. However, on December 3, 2015 Ms. [redacted] placed an order via the internet using account number XXX-XXX-[redacted]. Unfortunately, Ms....

[redacted] pre-approved limits are not associated with that account number. In fact, no limits are attached to that account number, which resulted in Monroe and Main requesting a consumer credit report and a request for a down payment prior to shipping the order. Ms. [redacted] pre-approved limits remain in place on her existing account. Monroe and Main regrets an inconvenience Ms. [redacted] may have experienced as a result of this matter.

Montgomery Ward’s records indicate Ms. [redacted] made a purchase that was posted to her credit account on December 23, 2015. The first payment of $20 on her account was due on or before January 25, 2016. No payment was received by the due date. As a result, a billing statement was prepared on or about...

January 27, 2016 that reflected a Minimum Amount Due of $40 (the past due payment plus the scheduled payment for February).
A payment of $25 was received and posted to her account on February 2, 2016, leaving an additional payment of $15 due on or before February 25, 2016. Again, the required payment was not received by the due date. A payment of $20 was received on March 5, 2016, leaving an additional $25 due on or before March 25, 2016 (Ms. [redacted] made a second purchase in February that increased her scheduled payment to $25). The required payment was not received by the due date and, once again, a statement was sent to Ms. [redacted] indicating the need to pay the current payment and the past due amount. No payment was received and, as a result, on or about April 27, 2016, a statement was sent to Ms. [redacted] indicating a Minimum Amount Due of $70, consisting of a past due payments totaling $45 and the current payment of $25.
As a courtesy to Ms. [redacted], Montgomery Ward has credited her account to remove two late payment fees. This adjustment will appear on her next monthly billing statement.
Further, Montgomery Ward will cease calling Ms. [redacted] regarding the collection of her account. However, the balance remains due and payable. Ms. [redacted] should be aware that failure to pay the outstanding balance will result in the assessment of finance charges and late payments fees and may result in other adverse consequences.

Ms. [redacted] was mailed an identity theft affidavit on February 5, 2015, which she has failed to complete and return. Based on the information currently available, Ashro has a reasonable basis for believing the account was opened by Ms. [redacted] and that she is responsible for payment of the balance....

Ashro will investigate this matter further upon receipt of additional information or documentation from Ms. [redacted].

As a courtesy to Ms. [redacted], Seventh Avenue and Ginny's have coded her account records to request deletion of the account information from her consumer credit file. This request will be transmitted as part of the companies next regular update to the consumer reporting agencies and may take 30 days...

to appear on a consumer credit report, depending on the update schedule for the various agencies.

Revdex.com:
I have reviewed the...

response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
This is not the first tike I have been lied to by this company, therefor I will need something on company letterhead for each of the colony brands stores in writing verifying that you have requested deletion to all of the accounts. once this has been done then I would be satsified. this is because of all the lies I am told by colony brands.
Regards,
[redacted]

As previously stated, we have credited Mr. [redacted] account to reflect a zero balance.

Home at Five apologizes for the delay on responding to
Mr. [redacted] request for a credit limit increase. Home at Five will also not
be increasing Mr. [redacted] credit limit. Please note, however that this
decision is not based on Mr. [redacted] credit or payment history, but on
planned...

changes to the Home at Five business. These changes are scheduled to be
announced on the Home at Five web site on February 24, 2016.

An identity theft affidavit was mailed to Ms. [redacted] in January, but was never returned. The account at issue was opened in August of 2013 and features multiple purchases and payments. Based on the information currently available, Seventh Avenue has a reasonable basis for believing the information it...

has furnished to the consumer reporting agencies is correct. Seventh Avenue will investigate further upon receipt of additional information or documentation from Ms. [redacted].

We received the correspondence from the Revdex.com in regards to your order #[redacted] placed 10/9/2015 via internet. We are sorry the Pumpkin Wreath [redacted] was no longer available for purchase. We make every effort to provide the best service and highest quality possible, however,...

sometimes circumstances are beyond our control.  It is difficult to determine how popular an item will be when creating our catalog and unfortunately the wreaths popularity and supplier inventory were unable to meet demand. A notice was sent in this regard on 10/20/2015.  We also noted an additional [redacted] which is available and is very similar , yet listed with a different identifying code and price. It is a darker, more Rust colored Pumpkin with Red & Green Leaves. Records indicate an order was started and deleted prior to completion 10/20/2015.

Please accept our apologies for any problems you have experienced in placing an order. The previous accounts included in bankruptcy cause any new orders to be automatically declined by the system, which is why you have been asked to place all orders by telephone. We are sorry to for any inconvenience, but appreciate the opportunity to explain.  Sincerely, Seventh Avenue

Montgomery Ward believes its previous response was completely self explanatory. Ms. [redacted] may cooperate with Ward's investigation of her claim or not, as she chooses.
