Revdex.com:
I have reviewed the response made by the business in reference to complaint ID *** and find that this resolution is satisfactory to me
Sincerely,
*** ***

Complaint: ***
I am rejecting this response because: While the contract does allow for periodic increases, the increases we have incurred with Stericycle are above and beyond their listed percentage possibleWe have tried multiple times in the past to resolve these issues and are always given a "discounted" fee for a while, but which inevitably increases again without noticeThis is no longer acceptable to our practiceWe would still like our contract cancelled with no fees incurred so that we may move on from this association
Sincerely,
*** ***

Our service agreements do allow for periodic price increases and these increases are a standard condition of our service agreement to help cover any cost increases we may face to meet regulatory requirements across local, state, and federal standards as well as prepare for investments in our
business to keep abreast of needed technology and ensure the protection of our customers as part of our 'cradle to grave' service offering
However, we are more than willing to work with our customers to find a service program with a rate that works for themWe offer a variety of different program levels and pifrequencies and can help to evaluate these optionsWe will have one of our Managers reach out to Dr*** directly in order to review potential solutions to this matter

We hereby acknowledge the receipt of Revdex.com Claim# *** response notification for *** *** .We have forwarded the consumer’s response to the respective department, and they shall proceed immediately with inquiries in an effort to resolve the consumer’s pleaYou will be informed regarding progress of procedurePlease expect to receive written response within days

Although we believe our agreement to be entirely valid and enforceable, Dr*** has been a good customer to us over the yearsIn the interests of maintaining positive relations we have cancelled account # *** without penalty, effectively removing fees previously billed leaving the amount due
$ We truly appreciate the opportunity we have had to serve Dr*** over the years and wish continued success for the business

Initial Consumer Rebuttal /* (3000, 7, 2015/06/30) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The business did NOT AT ALL address my complaint! I wanted to TERMINATE my AUTOMATICALLY RENEWED year contractThe business did NOT AT ALL respond to this requestI want to TERMINATE this contract immediatelyPlease help me get the business to do this
Final Business Response /* (4000, 9, 2015/07/09) */
While we regret Dr***'s dissatisfaction, we believe we have acted in full accordance with the service agreement signed by Dr*** officeWe have offered to work with Dr *** *** on potential resolutions to this matter
Please note, the terms and conditions of our service agreement do allow for price increases to address cost escalationOur price increases are a standard condition of our service agreement to help cover any cost increases we may face to meet regulatory requirements across local, state, and federal standards as well as prepare for investments in our business to keep abreast of needed technology and ensure the protection of our customers as part of our 'cradle to grave' service offeringWhile we try to absorb most of these costs, at times we must pass them on to our customersStericycle uses its business judgment to allocate increases in costs that are incurred on a system-wide basis to individual accounts
One example of a significant investment made by Stericycle is a massive incinerator improvement projectWe are required to upgrade all incinerators nationwide in order to meet EPA requirementsThis is a multi-million dollar investment that Stericycle has made in order to remain complaint with federal guidelines
Nonetheless, we value Dr*** as a long time Stericycle customer and in the interest of maintaining positive relations we have agreed terminate their account without assessing liquidated damagesWe will be sending one of our service personnel to perform a final piand to retrieve any remaining Stericycle boxes or tubs on Monday July 20,
Final Consumer Response /* (2000, 18, 2015/07/29) */
The consumer indicated ONLINE that the business responded to this complaint to his/her satisfactionHe/she also stated:
My case has been resolved satisfactorilyStericycle has cancelled my "automatically renewed" contract as I had requestedThank you so VERY much for your assistanceI know that I could not have accomplished this without your cloutKeep up the good work!

Initial Business Response /* (1000, 5, 2015/08/17) */
Please note that the terms and conditions of our agreement does state in section 2a; "This agreement shall automatically renew for successive terms equal to the original term unless either party has given days notice in writing during the six
month period prior to the renewal date of its' desire to terminate this agreement"One of the primary reasons our agreements are set to automatically renew is so that the medical waste removal continues as scheduled, reducing the risk of non-compliance with state regulations
This particular agreement was signed in February of 2012, and did automatically renew in February of We continued to provide service as scheduled until we were requested to cancel the account in August of At the time of the cancellation request we did offer to work with Dr*** Office on a modified service agreement that could be adjusted to suit any changes in his medical waste needs, however he declined our offers
In closing, although we believe our contract to be entirely valid, in the interest of maintaining positive customer relations we will agree to cancel the account without penalty as requested and remove the current invoice billed
Initial Consumer Rebuttal /* (2000, 7, 2015/08/17) */
(The consumer indicated he/she ACCEPTED the response from the business.)

Complaint: ***
I am rejecting this response because Stericycle has been increasing its prices 18% over months, which equates to an inflation rate of almost 40% per year and this has been going on for two years. Clearly, Stericycle has not had this kind of inflationary pressure and it is using its contract to gouge the customer rather than to protect itself from cost increases. In addition, I have worked with Stericycle's customer service group and their "solution" is to have our company sign a new contract to extend the term of our relationship. The new contracts also have inflation clauses, which while not as egregious as the current contract, are still unacceptable. To fix this problem, Stericycle has either terminate the current agreement without an outrageous early termination fee, or agree to fulfill the remainder of its contract at a price that equals the original contract charge plus a reasonable inflation adjustment since the contract's inception
Sincerely,
*** ***

I was not complaining about fee increasesI never signed up to do business with them and I am not at all interested in their "cradle to grave" servicesI never signed a contract with them or was aware of this contract until I bought the business from the previous ownerIf they have such good service, why are they so sneaky about contract renewals (renewed AUTOMATICALLY for MONTHS a month before I bought the practice with no notice to the contract holder)?

(The consumer indicated he/she DID NOT accept the response from the business.)
I am happy that they will not continue to pursue this issue, but I am certainly NOT satisfied with the way they handled the whole processAgain, they did not really address the issue which was that they were trying to hold a new provider responsible for a contract they never had the opportunity to view or sign, not a complaint about fee increases (which is what their boiler-plate response was about)I have read several of the complaints and reviews of this company.I am confident that they will continue these unethical practices (trying to convince people they can be held responsible for fees they never signed up for)I spent much of my time and energy and that of my staff on the phone and online and even consulted with an attorney before they agreed to drop the issue

Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to our company. Sincerely,*** ***

Complaint: ***
I am rejecting this response because: We've been partners (business-wise) for some time now and the only request I want to ask is that, let's be professional enough to part ways and in good termsI, therefore, request the whole amount be thoroughly waived and not just one-half.
Sincerely,

While we regret ***DDS dissatisfaction, we believe our contract to be entirely valid and bindingWe have attempted to resolve this matter by offering to negotiate with *** *** DDS and believe we presented a very reasonable
resolution for both parties
The office of ***DDS currently has a signed service agreement on file with Stericycle for every week pickup service that does not expire until March 1, We believe this agreement to be entirely valid and enforceableRegardless, because ***DDS has been a good customer to us over the years, in the interests of maintaining positive relations we have cancelled account *** Additionally as an attempt to further appease the customer we will offer to waive half of the current liquidated damages assessed $5,455.14, leaving you responsible for the remaining balance $2,727.57, effectively removing the service fee's billed of for no services rendered on account *** We have provided your attorney with identical information
Initial Consumer Rebuttal /* (3000, 8, 2015/09/18) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Oddly, the contract states medical waste container pick ups a yearWe are confused how picking up "every weeks" equates to medical waste pick ups a yearWe see no where in the contract advising of every weeks picking up medical wasteStericycle is implying that on a contract with yearly pickups they don't have to pick up except for every weeksThis would clearly be a breach of contract as it is clearly a mathematical impossibility for this to be soThere is no week break down in the contractFurthermore, we have advised that sometimes Stericycle would go months without picking up medical waste and we would always have to call to request pick upWe have employees that are willing to validate this information and Stericycle's breach of contractIt is sad that Stericycle breached the contract forcing us to look for other services, and now wants the customer to pay for liquidated damagesStericycle has offered no response to our business going months without services we were paying for and keeps insisting that its contract is valid, but only to its advantageWe maintain that Stericycle breached its own contract by not providing services times a yearWe also maintain that if days written notice is good enough for Stericycle, it should be good enough for Stericycle's customersUnfortunately, Stericycle wishes to hold it's customer's hostage using threats of liquidated damages, collection companies and attorneys when they clearly just admitted to breaching their own contractEvery weeks does not equate to medical waste pick ups a year and there has been no response for our business going months without Stericycle's servicesWhen a business is paying for a service, we expect the service to be performed and it was notFurthermore, with the continual increase in prices we had little option but to look for another company to perform the same servicePlease help us stop Stericycle from threatening customers with liquidated damages, collections, and breach of contract, when they in fact breached the contract
Final Business Response /* (4000, 10, 2015/09/21) */
While we regret Mr***'s dissatisfaction, we believe we have acted in full accordance with the service agreement signed by ***DDSWe have offered to work with Aubrey *** on potential resolutions to this matter, however they have insisted upon proceeding with the early termination of a service agreement still within its' initial term therefore we feel the liquidated damages provision outlined in section 2c is validShould ***DDS wish to resume discussions around continuing services with Stericycle and finishing out the remainder of their agreement, we would be happy to continue that dialogue

One of our managers and Mr*** are negotiating a potential solutions to this matter

We believe our agreement to be entirely valid and enforceable, Dr*** *** has been a good customer to us over the years. In the interests of maintaining positive relations we will remove the penalties previously billing on account # *** leaving the amount due $We truly
appreciate the opportunity we have had to serve Dr*** *** over the years and wish continued success for the business

I am rejecting this response because:I have signed a new 2-yr contract with StericycleThe terms of the agreement are a substantial improvement on the 'rolled -over' contract that Stericycle created when my previous contract ended in 4/2015. As discussed in my initial complaint, Stericycle does not notify its clients 60-days prior to the end of their or 3-year contracts, so that reasonable negotiations can occurInstead the company automatically rolls over, the fees are increased substantially --- and then the customer is contacted to extend the terms of the contract -with threats of large termination fees. This is not an ethical means of contract negotiations, instead this is a 'strong arm' tactic to force clients into perpetual, unending contracts.
Sincerely,
Nathaniel ***

While we regret *** *** *** dissatisfaction, we
believe we have acted in full accordance with the service agreement signed by *** *** *** office. We have offered to work with *** *** *** office on potential resolutions to this matter; however this account
does
have a signed service agreement on file that does not expire until August
1, *** *** *** office has insisted upon proceeding with
the early termination of a service agreement still within its' initial term,
therefore we feel the liquidated damages provision outlined in section 2c is
valid. As an attempt to reach a compromise here, we will offer to meet in
the middle and Stericycle will waive half of the current liquidated damages
charge of $510.44, leaving the balance due $and effectively removing
the service fee’s bill for no services rendered on account ***

In the interest of maintaining positive relations we have agreed to waive half the liquidated damages charge, leaving the balance due $2,Should Ms*** wish to resume discussions around continuing services with Stericycle and finishing out the remainder of their agreement, we would be happy to continue that dialogue

Complaint: ***
I am rejecting this response because: Based on the previous stated absurdities of overcharging and price gouging, I want our contract terminated (never had an authorized signature from the start ) with no termination fee and a refund of the overchargesWe will not enter into any service agreements with StericycleSigning a long term agreement regardless of the initial terms would only continue with repeated overcharges and exorbitant price increases
Sincerely,
David ***
