(The consumer indicated he/she DID NOT accept the response from the business.)
I really appreciate Stericycle trying to work this with us through one of their managersSadly, this has happened to us too many times in the pastThey do new agreements then go back to sneaking in increases without the courtesy of informing clientsI understand their agreements allow for periodic increases to cover any cost increases they may face for assorted reasonsEvery business has to accommodate changes that results in increased expensesInternal adjustments have to be made to run the operations cost effectivelyThese increased costs cannot be always passed to clientsI disputed their fuel charges when gas was close to $per gallon, now that gas is at lowest price they are still passing this to the client instead of offering lower monthly fees - a poor business decision
In Healthcare we have constantly absorbed higher costs due to changes in Federal regulation with EMR systems, changes in billing regulations and other regulations, lower reimbursements, increases in the cost of doing business from many of our vendors such as Stericycle, malpractice insurance, business insurances and othersWe have never passed any of these increased costs to our sick patientsWe are always making internal changes to accommodate constant increases and to run the business efficiently and keep our doors open
I rather invest my time to find an equivalent service at competitive price and an agreement that does not have these constant price increases that my business cannot affordI wish to be relieved from this agreement without penaltiesWe are a very small private companyThank you

both partiesAs an attempt to reach a compromise here, we will offer to meet in the middle and Stericycle will waive half of the current liquidated damages charge leaving the balance due of $

Although we believe our agreement to be entirely valid and enforceable, Dr*** has been a good customer to us over the yearsIn the interests of maintaining positive relations, we will agree to waive the early termination fee previously assessed to account #*** leaving the amount due $

I am rejecting this response because: We do not feel, as stated previously, as though this contract was obtained in a legal and ethical mannerThe individual the Stericycle obtained a signature from was not authorized nor did she possess the skill set needed to evaluate both the contract and the actual needs of the business As a result of Stericycle's actions, we have a contract for a service we have never needed, nor utilized Had Stericycle obtained, when signing contract initially with the owner, a list of authorized people authored to change or approve contracts, we would not be in this position today With other vendors, they inquire as to who has signing get authority at the onset of the initiation of the relationship Not surprisingly, we have not had an issue such as the one we now have with Stericycle.According to Stericycle business model, it is perfectly okay to communicate with any employee whether they possess authority to sign a contract or the skill set to evaluate a contract or determine business needsIn addition Stericycle was not forthright in disclosing to this employee the exact nature of this agreement She was basically told this was what the business needed in order to properly dispose of its expired medications which is in fact not correct Clearly, this employee did not understand any of the contractual issues at hand. Finally, what kind of world would we have if it was perfectly acceptable to obtain contracts without regard to terms, costs, necessity, or obtain these from those not authorized and/or equipped to understand, negotiate and understand the salesperson or nature of the contract itself?
Sincerely,

I am rejecting this response because: We appreciate the gesture of Stericycle in waiving some of the amount, however, we want that the full amount be waived

While we regret Ms*** dissatisfaction, the terms and conditions of our agreement does state in section 2a; “This agreement shall automatically renew for successive terms equal to the original term unless either party has given days’ notice in writing during the six month period prior
to the renewal date of its’ desire to terminate this agreement”One of the primary reasons our agreements are set to automatically renew is so that the medical waste removal continues as scheduled, reducing the risk of non-compliance with state regulations
We have offered to work with *** ***, LLC on potential resolutions to this matter, however they have insisted upon proceeding with termination of their service agreementNonetheless, we value *** ***, LLC as a long time Stericycle customer and in the interest of maintaining positive relations we have agreed to waive the liquidated damages previously billed leaving the amount due $

I do understand the contractual nature of the liquidated damages, however, the calculation and amount of damages appears punitive in nature and not representative of the professional relationship and spirit of the agreement that was intended on part of the practiceObviously, it was the oversight of the practice to have allowed such language, but it was not realized such scrutiny would be necessary with a company such as Stericycle this day and age

Please note, the terms and conditions of our service agreement do allow for price increases to address cost escalationOur price increases are a standard condition of our service agreement to help cover any cost increases we may face to meet regulatory requirements across local, state, and federal standards as well as prepare for investments in our business to keep abreast of needed technology and ensure the protection of our customers as part of our 'cradle to grave' service offeringWhile we try to absorb most of these costs, at times we must pass them on to our customersStericycle uses its business judgment to allocate increases in costs that are incurred on a system-wide basis to individual accounts
One example of a significant investment made by Stericycle is a massive incinerator improvement projectWe are required to upgrade all incinerators nationwide in order to meet EPA requirementsThis is a multi-million dollar investment that Stericycle has made in order to remain complaint with federal guidelines
Nonetheless, we value *** as a long time Stericycle customer and in the interest of maintaining positive relations we have agreed terminate their account without assessing liquidated damages

***/STERICYCLE has until May 2nd to contact Mr*** and complete this transaction or Mr*** will have to go thru the totally unnecessary steps needed to obtain the *** of an Attorney.
