order at the website [redacted]com, she was obliged to review her

Event Tickets Center Terms & Conditions
General [redacted]com acts as an
intermediary between buyers and ticket sellers ("TICKET SELLERS") to
facilitate the purchase and sale of event tickets, and as such is not directly
involved in the actual ticket sale transaction between the buyers and TICKET
SELLERS. All sales are final. As tickets sold through SITE are often obtained through the
secondary market and prices are determined by the individual ticket seller, the
prices for tickets may be above or below face value. Tickets sold through SITE
are from a third party; therefore, the buyer's name will not be printed on the
tickets.  Please note that the name on the tickets does not affect the
buyer's ability to access the event.
The terms and conditions were
available to [redacted] as a scroll box during the checkout process and as a
link on each page of the site. Had [redacted] not clicked on the “yes” button
on the checkout page that states “I agree to the Terms & Conditions,” the
software would have removed her from the checkout page and she would not have
been able to go on to complete her order. Also, the total price, including
service fees and delivery charges, was shown to her before she gave her credit
card information and completed her order.  [redacted] agreed to both the
price and the terms before sending her order request for processing.
At no time before placing her
order did [redacted] contact the site's Customer Service Department with any
questions or for any clarification of the pricing or terms and conditions.
 The site's customer service number is prominently and conspicuously
displayed in the title banner of the site. 
[redacted] was made aware of
the fact that tickets are in many cases sold above face value and that
[redacted] is neither a primary sale box office nor the venue.
 
There is no refund due.

I am rejecting this response because:
I have spoken with [redacted] and attempted to contact "John" at Ticket Galaxy with a representative from [redacted] on the phone.  Ticket Galaxy would not accept my phone call and hung up on me.  John later called back and would not let me explain what [redacted] had explained to me, regarding the fact that if Ticket Galaxy had actually not charged my card, the money would be put back on the card within the day.  John stated rudely that he was rejecting the order and promptly hung up. I still have a charge on my credit card from Tickey Galaxy. In regards to having issues processing the order, how was Ticket Galaxy able to charge my card in the first place if there was something wrong with the information provided?  This company is fraudulent!!

It seems that [redacted] concerns and order placing confusion lie with the website, which is
[redacted]. As stated before, Ticket Galaxy does not operate or own
the website, nor the call center. Her concerns with the placing of her order
would have to be voiced with the website.
 
I am unaware of what
research Ms. Frost has found that claims that we refund outside of our terms
and policies, but we make a point to avoid action not in the terms and policies
as we really on them to efficiently process and fulfill the orders provided by
the websites that we list our tickets on.
 
As such, there is
currently no refund due.

Thank you for continuing to mediate [redacted]'s concerns. 
With respect to [redacted]'s claims of accuracy in our claims that she was educated, we wish to slightly alter the semantics in our explanation. She is correct that we cannot 1000 percent say that she is educated in regards to filling out the form, we can one hundred percent verbalize that she was alerted. The information is readily available and if the terms and policies are accepted, then they are binding.  
As far as [redacted]'s claim that she contacted us immediately, she is partially correct. [redacted] contacted us one hour and nineteen minutes after placing the order. While she did contact us very quickly, this is a relatively moot point as the terms and policies are in effect as soon as the order is placed. 
Because of these reasons and the reasons previously explained, there is still no refund due.

If Ms. Sink has concerns about the website www.BroadwayTicketsCenter.com she should bring her concerns to their attention. Ms. Sink purchased her tickets from us and has since received her tickets. This has been a completed transaction without cause for a refund. We respectfully request that this matter be closed accordingly.

website that is not owned or operated by Ticket Galaxy.  Ticket Galaxy has no role in how the website is advertised or what service fee it asks for.  However, Ms. [redacted] agreed to be bound by the website's terms and conditions, which were conspicuously displayed on the checkout page, by actively clicking a check box before checking out.  Those terms and conditions explicitly note that all sales are final.  We rely on the finality of this kind of web order in order to run our business efficiently and offer competitively priced event tickets.

Our records indicate Ms. [redacted] selected two tickets for the June 17 performance by Steve Miller Band at the Wolf Trap, Vienna, VA. The ticket listing was in Zone F. The seller notes indicated on the ticket listing page of the website, as well as Ms. [redacted] receipt state the following:
 
Seller Notes: Lawn. If more than four (4) tickets are purchased from this group, your tickets may be split. All seats are guaranteed to be located within the requested zone. Tickets will be ready for delivery by Jun 13, 2015. 
 
Ms. [redacted] contacted our customer service department on March 30, 2015 regarding the seating location. A representative explained that Ms. [redacted] order was filled correctly.

Customer emailed stating she puchased Orchestra seating and asked for a seating change or a refund. emailed "The original purchase was for Zone F. Zone F includes the Lawn section which was stated at the time of purchase. Your order has been filled in Section LAWN, Row GA, Seats 1-2. As the order has been filled as requested we are unable to provide alternate seating at this time. have an all-sales-final policy which you agreed to prior to completing your order.
 
Ms. [redacted] was educated to the fact that tickets are in many cases sold above face value and that [redacted] is neither a primary sale box office nor the venue. Ms. [redacted] freely-chosen acceptance of the price and the terms and conditions indicates that she did make a conscious and educated decision to purchase tickets at the location and price she agreed to.
 
There is no refund due.

I am rejecting this response because: the full price was exaggerated and over the resale/current value of tickets. Wrong tickets were sent and company is a client service driven business with poor client service. This should not be this difficult to realise the company was wrong in their part of this transaction. A patron gets directed to this website to buy tickets and is upcharged and made to pay a fee for service that was more than the tickets. Ticket Galaxy is doing wrong by their clients. If you read ANY of their reviews online you see this is a regular occurrence. They cheat people that are just trying to get a fair price.

Occasionally tickets ordered may no longer be available at the price or in the quantity originally ordered at the time the order is received. Once we are notified of the exact seating, we will assign seats to our orders. Once this happens, your tickets will be shipped. Please note that your order will be filled according to the zone or section that you requested."

Customer emailed in "You say we are guaranteed three seats in that section. We selected three consecutive seats in that section. Can you confirm that the seats will be together? Furthermore, what recourse do you offer if, for some reason, the seats are not in the section and row range we selected and paid for?" Emailed back "All seating is guaranteed to be consecutive and filled according to the section and row range that you requested."

We have been in business for over 15 years and have a great team that works hard to make your experience as enjoyable as possible. As previously explained, our records indicate you selected seating in Orchestra 8R, rows A – U. Per our terms and policies, the seating provided to you is guaranteed to be within the Section and Row Range that you requested. In addition to being within the area requested, your seating is guaranteed to be consecutive. We do not anticipate any problems in filling your order within your originally selected Section and Row Range. Unfortunately we are unable to cancel your order. We have an all-sales-final policy which you agreed to prior to completing your order. Therefore we are unable to issue a refund for your order. There may be other avenues you can try, however. the order ID number for his transaction, as the contact information provided was not sufficient to provide a match in our system. The order ID is an eight-digit code available on the receipt.

I am rejecting this response because: they are responsible for the misrepresentation of the website.  They have received multiple complaints from people who were fooled by the false advertising.  If you look them up you can find toms of complaints about them.  They purposely mislead consumers for their own financial gain.  Notice how they say competitive but when I found the real [redacted] theater website they were half the cost with no delivery or service fee.  This type of business is completely unscrupulous and should be held accountable.

I am rejecting this response because:In response to Ticket Gallery's version of what transpired, I offer the following:
      I agree with Ticket [redacted] explanation in regards to the original purchase of two tickets on Sept. 24th as well as their policy in sections "General" and "Face Value". However, beginning with the Oct. 3rd request, their story is filled with inaccuracies. I did contact them on Oct. 3rd after receiving an email that the tickets were for the evening performance and not the matinee performance as I wanted. I explained the situation to the representative and asked if the evening tickets could be exchanged for the afternoon tickets. If this was possible, I would like to change the order to 4 tickets. At this point I was put on hold while she checked to see if there were 4 tickets together. After a few minutes she returned and said she found 4 together. She DID NOT mention price, location or that the only option was an upgrade. She then asked if my credit card number was the same. I informed her it was not as the bank had just recently replaced my card due to a security issue.  She did not ask for my card number as she apparently did not have the authority to do so on a different card. She then passed me on to her supervisor ( [redacted]) who told me the new card was ok and the tickets would be $281 and did not tell me this was an ADDITIONAL charge. The fact that the first two tickets ran $196.50, I assumed the 4 new tickets may be in a different section that was not as expensive. I DID NOT state that I thought the afternoon tickets were half price.                                                                                                                           I understand that you must have terms and conditions for your business. I did agree to them with the purchase of the first two tickets. However, you violated your own policy by voiding my first purchase and canceling my e-tickets which were never downloaded. As such your terms and conditions are null and void. I am dealing with this as "theft by deception" and if my refund is not forwarded soon I may be forced to take legal action.

The website terms and conditions were available to Ms. [redacted] as a scroll box during the checkout process and as a link on each page of the site. If Ms. [redacted] did not click on the “yes” button on the checkout page that states “I agree to the Terms & Conditions,” the software would have removed her from the checkout page and she would not have been able to go on to complete her order. Also, the total price, including service fees and delivery charges, was given to her before she gave her credit card information and completed her order. Ms. [redacted] chose to comply with the price and the terms before sending her final order for processing.
 
At no time before placing her order did Ms. [redacted] contact our Customer Service Department with any questions or for any clarification of the pricing or terms and conditions. If she was unsure about the order she was placing, she was free to call the Customer Service Department at the readily available number or to comparison shop at other sites before finalizing her order.
 
Ms. [redacted] was educated to the fact that tickets are in many cases sold above face value and that www.[redacted].com is neither a primary sale box office nor the venue. Ms. [redacted] freely-chosen acceptance of the price and the terms and conditions indicates that she did make a conscious and educated decision to purchase tickets at the location and price she agreed to.

9/29/16, [redacted] ordered three tickets for the March 19th show at
the [redacted] from an online resale
marketplace called boxofficeticketsales.com. This is not a website owned nor
operated by Ticket Galaxy. Any questions or concerns about how
Boxofficeticketsales.com advertises or displays information would have to be
referred to that company.
Boxofficeticketsales.com
is a website that we list our tickets on, and as such we depend on their terms
and policies for efficient transactions. The highlights from the terms and
policies, which are also highlighted on their website is that the website is a
resale marketplace, not the actual ticket seller, the prices may be above or
below face value, and that the seats are together. This is not in fine print
and is on multiple areas of the website throughout the ordering process. There
are other parts of the terms and policies which pertain to [redacted]’s
concerns.
General BoxOfficeTicketSales.com acts as an
intermediary between buyers and ticket sellers ("TICKET SELLERS") to
facilitate the purchase and sale of event tickets, and as such is not directly
involved in the actual ticket sale transaction between the buyers and TICKET
SELLERS. All sales
are final.
As tickets sold through SITE are often obtained through the secondary market
and prices are determined by the individual ticket seller, the prices for
tickets may be above or below face value. Tickets sold through SITE are
from a third party; therefore,
the buyer's name will not be printed on the tickets.  Please note that the
name on the tickets does not affect the buyer's ability to access the event.
Above Face Value Tickets sold through SITE
are often obtained through secondary market TICKET SELLERS and are being
resold, in many cases, above the price or "face value" listed on the
ticket. All ticket prices include additional service charges and handling fees
as defined on each order. SITE
and its TICKET SELLERS are not directly affiliated with any performer, sports
team, or venue; and SITE does not act as a primary sale box office, unless
otherwise stated. By
agreeing to these TERMS, USER agrees that the purchase price for tickets on
their order does not reflect the original purchase price of the ticket and may
be either higher or lower than the original purchase price.

I am rejecting this response because:I do not accept this response. I would like clarification - are you saying the issue is with [redacted] office? I called them and they stated ticket Galaxy would be the company that would provide the refund. I do not appreciate getting caught inbetween this blame game. I don't know how to put it clearer to state that I was misinformed and did not agree to pay in USD - I will not accept any response other then having this rectified. As to your comment regarding refunds not being given - there are countless Revdex.com cases where the action ended in a refund.
