Thank you for bringing [redacted] continued concerns to
our attention. In our previous response we informed [redacted] that her order
was placed at [redacted] This website does not look like any venue’s website and in fact specifically
states at the top, "We display secondary market tickets. This site is independently
owned and operated and is not affiliated with any box office or official
website." In addition to this disclaimer, [redacted] was also required to read
and agree to the website's policies.
These policies, in plain language state that the prices of
tickets may be above or below face value. Additionally [redacted] states that the
order was not filled correctly. [redacted] purchased two tickets in section:
Orchestra, row: E and received those exact tickets. [redacted] then claims that
she thought they were center orchestra tickets and therefore the order was not
fulfilled correctly. However, the description of tickets stated Orchestra Row
E. It did not state Left, Center, or Right. If [redacted] had specific
questions about this listing she was free to call the customer service
department before completing her order. [redacted] ordered tickets in the
Orchestra Row E and received those exact tickets. This has been a completed
transaction and per the website's all sales are final policy no refund will be
provided.

order. We do typically have to abide by an all-sales final policy as laid out
by the website that the customer places their order with. This lays out that
there are no cancellations, exchanges, or refunds. We have taken this opportunity
to correct [redacted] in his inaccuracies, while still providing the seats
that he had intended to order.

[redacted] states that his original order was placed on January 20, 2015 for the “[redacted]” show in [redacted] for April 2, 2015. However, our customer  records indicate the only order placed by [redacted] on January 20, 2015 at [redacted] was for “[redacted]” show in [redacted] on April 4, 2015. [redacted] original selected listing included three tickets located in Gallery section, Row G for $52.00 per ticket.
 
There is no listing indicated for “Zone 3/Tier A-R” at $54.00 per ticket on [redacted] Our technology does not alter the name of a seating location selected by a customer during the checkout process; the location listed on a receipt matches the description on the ticket listing page.
 
While the “Gallery Section, Row G” listing is currently estimated for delivery on March 29, 2015 for the April 2, 2015 show, the delivery date of March 31, 2015 is clearly indicated on the “Gallery Section, Row G” listing for the April 4, 2015 show. Therefore, the delivery estimation listed on the receipt for [redacted] original order was indeed correct. Please see the image files "April2.jpg" and "April4.jpg" for verification.
 
 The “MISC Expenses” charge of $47.58 is the service fee for the order. A service fee is applied to each individual ticket. Therefore, a $15.86 service fee per ticket for all three tickets totals $47.58. The total price, including service fees and delivery charges, was given to [redacted] as an itemized breakdown before he gave his credit card information and completed his order. A delivery method must be selected to complete the transaction. By doing so, the itemized breakdown is calculated and displayed at the top of the checkout page. [redacted] selected “Standard Delivery” which on [redacted] is a flat rate of $15.00 for an entire order. This information is disclosed on the same primary page where the customer reads and agrees to the website terms and conditions. Please see the image file "ItemizedOrder.jpg" "CheckoutPage.jpg" for verification.
 
 When [redacted] placed his order from his computer at the website,[redacted] he was obliged to review his order and accept that website’s terms and conditions before his order was complete. These terms and conditions clearly state:

The website terms and conditions were available to [redacted] as a scroll box during the checkout process and as a link on each page of the site. If [redacted] did not click on the “yes” button on the checkout page that states “I agree to the Terms & Conditions,” the software would have removed him from the checkout page and he would not have been able to go on to complete his order. [redacted] chose to comply with the price and the terms before sending his final order for processing.
 
At no time before placing his order did [redacted] contact our Customer Service Department with any questions or for any clarification of the pricing or terms and conditions. If he was unsure about the order he was placing, he was free to call the Customer Service Department at the readily available number or to comparison shop at other sites before finalizing his order.
 
Furthermore, our customer records indicate that when [redacted] contacted our Customer Service department on January 20, 2015 he claimed he was unable to attend the event date he selected and requested to cancel the order. A customer service representative advised him of our all sales are final policy, though if he had an alternative date in mind, we would look into any options to accommodate an exchange; however this would not cancel the original order. Ultimately, our Customer Service Department was able to accommodate an upgrade request and a possible new date change at no additional cost to [redacted]. A voicemail and email was sent to the customer on January 23, 2015. The order was then filled with “Section: Mid Orchestra Left, Row: S." Please see the image file "OrderNotes.jpg" for verification.
 
We request that this matter be closed as [redacted] was educated to the fact that tickets are in many cases sold above face value and that [redacted] is neither a primary sale box office nor the venue. [redacted] freely-chosen acceptance of the price and the terms and conditions indicates that he did make a conscious and educated decision to purchase tickets at the location and price he agreed to. [redacted] order was filled with an upgraded set of tickets at no additional cost.  
 
There is no refund due.

According to our customer service records, Mr. [redacted] completed his order for tickets earlier this morning. When he did place his
order for these tickets he was informed in the "Seller’s Note" that,  "These tickets are paperless. You will receive
them at the venue on the day of the event." This note appeared on the webpage
containing all of the available tickets for sale, along with the checkout page,
and again on a final review page before placing his order.
If Mr. [redacted] was unsure what this note meant or what not
comfortable with receiving his tickets until the day of the event, he was free
to choose from the hundreds of other ticket options available to purchase which
had standard shipping options available.
Mr. [redacted] instead willingly chose to complete his order
and in doing so agreed to the website’s terms and policies. These policies
state:

The Delivery Method on the checkout page defaults to "paperless." Once this option is selected there is also a disclaimer in bold that appears
right below the dropdown box. This  disclaimer

provided in any physical form. Instead, you will meet a representative from
your ticket seller's office at the venue prior to the start of the event. The
representative will accompany you into the venue by presenting their credit
card to venue personnel. Please remember to bring a government-issued photo ID
matching the name on the order. After placing your order, please contact your
ticket seller directly to arrange a meet-up time and place. The seller's
contact information will be in your order confirmation email.
A screenshot of this part of the checkout page is being
provided as evidence that Mr. [redacted] was well-informed of the type of ticket
that he'd be receiving.
Because Mr. [redacted] was well-informed of the type of
purchase that he was making and did agreed to the website's all sales are final
policy no refund or cancellation of his order will be provided. If he has
further questions about arranging for the receipt of his tickets Mr. [redacted]
should contact our customer service department at ###-###-####.

to our records, [redacted] placed his order on eventticketscenter.com, which
is a website that Ticket Galaxy lists inventory on. We do not own or operate
Eventticketscenter.com, nor do we own or operate the call center where the
order was subsequently placed.
 
The operators in the website can only go off of the current
inventory that they are able to see. Additionally, the secondary market’s
inventory and pricing fluctuates, sometimes wildly, which is one of the reasons
that an all sales final policy has to be agreed to prior to placing the order.
Despite [redacted] ordering tickets over the phone, the order is still bound
by the terms and policies of EventTicketsCenter.com, which state:

Dear Revdex.com,Thank you for continuing to mediate [redacted]'s concerns. With respect to [redacted]'s claims of accuracy in our claims that she was educated, we wish to slightly alter the semantics in our explanation. She is correct that we cannot 1000 percent say that she is educated in regards to filling out the form, we can one hundred percent verbalize that she was alerted. The information is readily available and if the terms and policies are accepted, then they are binding.  As far as [redacted]'s claim that she contacted us immediately, she is partially correct. [redacted] contacted us one hour and nineteen minutes after placing the order. While she did contact us very quickly, this is a relatively moot point as the terms and policies are in effect as soon as the order is placed. Because of these reasons and the reasons previously explained, there is still no refund due.Thank you again for mediating,Doug, Ticket Galaxy

Revdex.com:I do not find this to be a satisfactory response from Ticket Galaxy, but I realize I cannot waste any more time on this matter. The bottom line is that I've learned a lesson and will never order tickets through a second or third party.  I will go right to the venue. Their response to my complaint along with their explanation iof termes, conditions, and policy iwas not obvious on the websites. I have no recourse but to accept the unethical behavior of Ticket Galaxy or Box Office Ticket Sales (which I never heard of or received information from at all). I appreciate your efforts to resolve this issue although I'm still left believing this is a ticket scalping/scam operation. Thanks again.
 I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me. (Not really).

I am rejecting this response because:
I was unaware that ticket galaxy was not a reputable ticket
company and thought they were affiliated with the [redacted] ticket sales. At the time of the ticket purchase the venue had over
500+ tickets still available.  When the
verification email from ticket galaxy went through I immediately attempted to
contact ticket galaxy. Had Ticket galaxy clarified the difference between the
ticket price, the true location of seating, the markup and the service charges, I would
not have purchased from ticket galaxy. They miss represented themselves and the
product they sold me.

he was required to read and agree to that website’s terms and policies. These
policies clearly state:

Mr. Lane was required to read and agree to these
policies before his order was complete and without doing so, the software would
have removed him from the checkout process.
However, despite Mr. Lane agreeing to these

I do not accept this response. I would like clarification - are you saying the issue is with [redacted] office? I called them and they stated ticket Galaxy would be the company that would provide the refund. I do not appreciate getting caught inbetween this blame game. I don't know how to put it clearer to state that I was misinformed and did not agree to pay in USD - I will not accept any response other then having this rectified. As to your comment regarding refunds not being given - there are countless Revdex.com cases where the action ended in a refund.

our attention. Our customer service records indicate that [redacted] purchased
her tickets through a customer service representative at www.TicketsW.com. At
this time she was informed of the website's policies and willingly agreed to
them. Included in those policies is the information that the website is a
member of the secondary ticket market and is not affiliated with any venue,
event or performer. The representative informed her that the tickets being
purchased may be above or below face value, however the actual face value is not
known to the customer service representative nor is it advertised. Therefore
[redacted] was informed that it’s a possibility that what she’s purchasing may
be above or below face value.
Additionally, when determining a ticket's actual face value
the price listed on the ticket may not be entirely accurate. There are
additional taxes and fees, including annual subscription fees that do not
always appear on a ticket. For this reason the face value is not advertised or
even made available to customer service representatives.
Also, the website
lists tickets from numerous vendors. Not all of the tickets that appear on www.TicketsW.com belong to Ticket Galaxy. If
the venue has concerns over tickets that are being advertised they should
contact the website, as this is beyond anything that we have control over, nor
is it related to [redacted] transaction.
For all of the above reasons no refund will be provided.

to his before he gave his credit card information and completed his
order. [redacted] chose to comply with the price and the terms before

order for processing.
[redacted] was educated to the fact that tickets are in many cases sold above
face value and that Stadium-boxoffice.com is neither a primary sale box office nor the venue. [redacted]'s freely-chosen
acceptance of the price and the terms and conditions indicates that he did make
a conscious and educated decision to purchase tickets at the location and price
he agreed to.
There is

I am rejecting this response because: the business cannot 1000 percent say I was educated when I filled out the form and submitted my payment in what I am assuming was under a minute. I was under the impression it was ford field box office. Which, it stated in the url. I will get an attorney to represent me if I am not given a refund. I made my transaction then immediately called ticket Galaxy and asked for a refund once I understood what happened. It was not like I waited weeks or months. It was literally minutes maybe an hour.

We request that the first attachment we provided ([redacted] 1.jpg) be reviewed. Specifically, the first listing on the top of the page is
the listing that Mr. [redacted] chose to purchase. In addition to saying "Zone E"
rather than "Sec E" as other section listings were advertised, there is a large
description of this Zone included in the listing itself. Mr. [redacted] would not
have needed to scroll anywhere on his cellphone to have seen this as it is part
of the description.
Mr. [redacted] willingly agreed to purchase tickets advertised
as Zone E, with a description that the seats were in rows T-Y of the Balcony,
not rows A-H which is Section E.
There has been no attempt to mislead or confuse any
customer. Mr. [redacted] clicked on the description of the tickets in order to
purchase them. Again once he got to the checkout page there is a "Seller's Note"
in bold font which also says this same information. Mr. [redacted] was made aware
that the tickets he was purchasing were not in Section E, but were in Zone E.
If he has any further questions about this transaction I
encourage him to call our customer service department at ###-###-####.
