Once again, Ticket Galaxy only owns and operates our own website. [redacted] accepted the alternate tickets offered at a $40 total discount. Because
she had accepted the alternates, we aren’t able to offer a refund for the
tickets that she agreed to at this time.

Dear Revdex.com -Thank you again for helping to mediate this matter.  We regret that Ms. [redacted] has rejected our response.The tickets Ms. [redacted] purchased were priced above face value, the value printed on the tickets, and she was notified prior to placing her order that the ticket price she would be paying upon placing her order may be above face value.   As for the service fee, it is a service fee and is labeled accordingly.Ms. [redacted] repeatedly characterizes our conduct in this transaction as "scalping".  But had Ms. [redacted] tried to buy resold tickets "outside an event" she wouldn't have been able to secure her tickets at the time of or prior to the pre-sale of those tickets, nor would she have a guarantee that the tickets are valid for entry to the event.  Ms. [redacted]'s allegations are wrong, prejudicial, and evoke certain racial stereotypes that are not fit for this forum.  I respectfully request that her complaint and response be removed from the Revdex.com website.  We fully respect customers' right to challenge and seek to clarify the terms of transactions, but that right does not allow someone to make defamatory accusations.Please respond to this matter promptly.Thanks again,DanTicket Galaxy

[redacted] placed his order from his computer at the website, [redacted] he was obliged
to review his order and accept that website’s terms and conditions before his
order was complete. These terms and conditions clearly state:
General
[redacted] ("SITE") acts as an intermediary
between buyers and ticket sellers ("TICKET SELLERS") to facilitate
the purchase and sale of event tickets, and as such is not directly involved in
the actual ticket sale transaction between the buyers and TICKET SELLERS.
Tickets sold through SITE are from a third party; therefore, the buyer's name
will not be printed on the tickets. Please note that the name on the tickets
does not affect the buyer's ability to access the event.
The
following are the rules or "TERMS" that govern use of the SITE by
USER, the USER of the SITE ("USER"). By using or visiting the SITE,
USER expressly agrees to be bound by these TERMS and to follow these TERMS and
all applicable laws and regulations governing the SITE. [redacted] reserves the right to change these TERMS at any time, effective immediately

As far as
Minnesota’s 3 day cooling off period, according to the Attorney General’s
website, it applies to only specific situations, which are: Home solicitation
sales, life insurance policies, hearing aids, extended car warranties, military
personnel (cell phone/ wireless contracts, rental contracts, club contracts,
service contracts and membership travel contracts when called to active duty),
Debt Management/ Debt Settlement Service contracts, Credit services contracts,
Health club/ Social Referral Clubs/ Buying clubs, Reverse mortgages,
residential roofing/siding contracts, and Agricultural contracts.
Because our
orders don’t fall inside these categories, the terms and policies of
[redacted] are what governs the sale.
There is no
refund due.

I am rejecting this response because: This website is misleading.   Why on earth would someone pay more than double face value for a ticket to an event that never sells out. Today is Thursday and the event is on Friday and I just checked  on the venue website , there are better tickets still available .  Businesses like this should shut down. I am advising all of my friends and family to steer away from scalpers like this. Ticket scalping is illegal and this is calling it like it is.

admission area. This means that there is no assigned seating for the area. The
tickets that we provided to [redacted] are Lawn tickets, which is what he had

·         Delivery: Costs
associated with the Delivery Method chosen by USER and the SITE'S arrangement

·         Total:Entire
amount charged to USER, including each ticket's price as set by the FULFILLER,
Service Fee, and Delivery.
The website terms and
conditions were available to [redacted] as a scroll box during the checkout
process and as a link on each page of the site. If [redacted] did not click on
the “yes” button on the checkout page that states “I agree to the Terms & Conditions,”
the software would have removed him from the checkout page and he would not
have been able to go on to complete his order. Also, the total price, including
service fees and delivery charges, was given to him before he gave his credit
card information and completed the order. [redacted] chose to comply with the
price and the terms before sending his final order for processing.
[redacted] was educated to the
fact that tickets are in many cases sold above face value and that [redacted]is neither a primary sale box office nor the
venue. [redacted] freely-chosen acceptance of the price and the terms and
conditions indicates that he did make a conscious and educated decision to
purchase tickets at the location and price he agreed to.
 
There is no refund due. Thank

I am rejecting this response because I still feel that it was wrong to be charged for tickets that I did not receive and a show I did not attend.  If a refund can't be given, I would like to receive tickets to another show valued at the same price instead.

customer service seriously and appreciate the opportunity to respond to Ms.
McBride's concerns.
According to our customer service records Ms. McBride has
already been completely refunded in full in the interest of customer service.
When Ms. McBride did place her order for tickets she did so
through LocalTicket.com which does have numerous disclaimers that the tickets
she was purchasing may be above face value and that she was purchasing on a
secondary market, or resale website. Ms. McBride was also provided with an
itemized list of her purchase which indicated the price per ticket on her
order, the service fee per ticket, along with the delivery fee.
Since Ms. McBride has already been provided with a refund we
assume that this matter is resolved.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is unsatisfactory to me.There was an option for a $15 delivery of an actual printed ticket. Why would any one of sound mind pay double to have printed e-tickets mailed to them verses printing them instantly for $7.50. I also called to complained during the beginning of February because it was not explained that the tickets are not mailed out until two weeks before the actual event date.  I purchased the $15 delivery of actual hard copy tickets to include them in a gift. I was extremely disappointed when I found out they would not be mailed out anytime soon. I could go back in and purchase more ticket to prove that there is an option. However, they will not refund your entire purchase for any reason, to include purchasing ticket insurance.Thank you Revdex.com.

I do not find this to be a satisfactory response from Ticket Galaxy, but I realize I cannot waste any more time on this matter. The bottom line is that I've learned a lesson and will never order tickets through a second or third party.  I will go right to the venue. Their response to my complaint along with their explanation iof termes, conditions, and policy iwas not obvious on the websites. I have no recourse but to accept the unethical behavior of Ticket Galaxy or Box Office Ticket Sales (which I never heard of or received information from at all). I appreciate your efforts to resolve this issue although I'm still left believing this is a ticket scalping/scam operation. Thanks again. I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me. (Not really).

There are a couple of inaccuracies in [redacted]
claims that have to be cleared up.
 
On 9/29/16, [redacted] placed his order on his computer on
[redacted] which is a website not owned or operated by Ticket Galaxy.
The website that Ticket Galaxy owns and operates is TicketGalaxy.com.
[redacted] is one website where we list our inventory. [redacted] claims
that he wishes that the website had made it clear that he was not purchasing
through the primary market vendor. On TicketNetwork’s website, it does state
that [redacted] is a resale marketplace, not a box office or venue.  As
far as the pricing is concerned, the secondary market’s pricing does fluctuate.
Due to this, most websites have to abide by an all sales final policy,
including [redacted] and TicketGalaxy.
 
Additionally, when placing his order on his computer at
[redacted] did have to agree to the terms and policies before
placing the order. These terms and policies state, among other information:

[redacted] had demanded that he be sat in an aisle seat, due to a medical
restriction. Normally, we cannot guarantee aisle seats and we do not list our
seat numbers for a number of factors. We make an exception and did work with
[redacted] to get him an aisle seat so he could view the event as comfortably as
possible.
 
Because of the reasons listed above, among others, we will
be unable to offer [redacted] a refund at this time.

other sites before finalizing her order.
Our customer service records
do indicate that [redacted] did send an email to our customer service
department regarding this order. A customer service representative replied with
the following information:
Hello [redacted] Thank you for
contacting us with questions about your order. We are happy to help. Your order
has been filled in (Section 212, Row J, Seats 5-8). These tickets are in the
correct sections requested they were to be anywhere in sections 208-217 in rows
A-Q. There are advantages to going through the secondary market. We get a lot
of opportunities for advance ticket purchases and VIP seating that the public
does not. Sometimes the primary market is sold out in a particular section or
completely sold out. For some events price fluctuations allow for discounts and
bargain shopping. I’m sorry we were not the best deal for this event but we
could be for future entertainment. When we are ready to ship your package, an
automated email will be sent to you with the FedEx tracking information for
your order. If you have any additional questions, please feel free to call our
office at ###-###-####. Thank you for using Ticket Galaxy, we hope you enjoy
your event.

the fact that tickets are in many cases sold above face value and that www.Tickets-Center.com
is neither a primary sale box office nor the venue. Ms. [redacted]

her email in a prompt and professional manner explaining her purchase and the

When [redacted] placed her order from her computer at the website,
[redacted] she was obliged to review her order
and accept that website’s terms and conditions before her order was complete.
We rely on the terms and policies of the website to efficiently process orders.
These terms and conditions clearly state:

acts as an intermediary between buyers and ticket sellers ("TICKET
SELLERS") to facilitate the purchase and sale of event tickets, and as
such is not directly involved in the actual ticket sale transaction between the
buyers and TICKET SELLERS.All sales are final. As tickets
sold through SITE are often obtained through the secondary market and prices are
determined by the individual ticket seller, the prices for tickets may be above
or below face value. Tickets sold through SITE are from a third party; therefore,
the buyer's name will not be printed on the tickets.  Please note that the
name on the tickets does not affect the buyer's ability to access the event.
The following are the rules ("TERMS") that govern use of the

of the SITE ("USER"). By using or visiting the SITE, USER expressly
agrees to be bound by these TERMS and to follow these TERMS and all applicable
laws and regulations governing the SITE. SITE reserves the right to change these

USER'S access to the SITE, bar USER from future use of the SITE, cancel USER'S
ticket order, and/or take appropriate legal action against USER.
Above Face ValueTickets sold
through SITE are often obtained through secondary market TICKET SELLERS and are
being resold, in many cases, above the price or "face value" listed
on the ticket. All ticket prices include additional service charges and
handling fees as defined on each order. SITE and its TICKET SELLERS are not
directly affiliated with any performer, sports team, or venue; and SITE does
not act as a primary sale box office, unless otherwise stated. By agreeing to
these TERMS, USER agrees that the purchase price for tickets on their order
does not reflect the original purchase price of the ticket and may be either
higher or lower than the original purchase price.
All sales are finalSince tickets are a one-of-a-kind
item and not replaceable, there are no refunds, exchanges or cancellations. If
an event is postponed or rescheduled, tickets will be honored for the
rescheduled date. New tickets will not need to be issued. If an event is
cancelled without a rescheduled date, USER will need to contact the FULFILLER
for a refund. The FULFILLER may require USER to return the supplied tickets at
USER'S expense before receiving any refund USER is entitled to due to
cancellation. SITE is not responsible for providing or securing this refund for
USER. Any shipping and handling charges are not refundable. Refunds will be
processed in the same currency as the original order. Conversion charges,
including though not exhaustive of the ones issued by USER'S bank,if any, are
not covered by [redacted].org or Fulfiller. Neither
SITE nor the FULFILLER will issue exchanges or refunds after a purchase has
been made or for lost, stolen, damaged or destroyed tickets. When USER receives
tickets, USER should keep them in a safe place. Please note that direct
sunlight or heat may damage tickets.
The website terms and
conditions were available to [redacted] as a scroll box during the checkout
process and as a link on each page of the site. If [redacted] did not click on
the “yes” button on the checkout page that states “I agree to the Terms & Conditions,”
the software would have removed her from the checkout page and she would not
have been able to go on to complete her order. Also, the total price, including
service fees and delivery charges, was given to her before she gave her credit
card information and completed her order. [redacted] chose to comply with the
price and the terms before sending her final order for processing.
Because the terms and policies were accepted prior to placing the
order, there is no refund due.
