I am rejecting this response because: I have read other responses and I notice that everyone is the same except they change the persons name. Apparently a lot of folks have been taken by this dishonest business
and they will do nothing to compensate anyone. I'm not going any further as I can see it will do no good, but please keep this on file so other people hopefully don't get hooked, but I doubt that will happen.

Thank you for mediating this issue.  We value the opportunity to address Mr. [redacted]'s concerns.
Mr. [redacted] selected a ticketing option tailored to customers who want to attend their event for a given price, but who are not...

concerned about the exact location of their seats, in particular Mr. [redacted] requested tickets seating him in the Balcony of the venue.  The tickets we will provide Mr. [redacted] will seat him in the Balcony as his order indicates.
Mr. [redacted] agreed to the terms and conditions governing his order before completing that order, including the clause that indicates that "All sales are final."
It is unfortunate that the tickets Mr. [redacted] will receive are not in his preferred balcony section, but the tickets do conform to Mr. [redacted]'s order.
Furthermore, we guarantee that the tickets Mr. [redacted] receives will be valid for entry, and not, as he puts it "bad tick".
We sincerely hope that Mr. [redacted] enjoys the [redacted] concert.

I am rejecting this response because:The disclosure of a third party merchant on the initial website is incorrect and misleading. I have contacted the Providence [redacted] and notified them of this deceptive ticket sales website. They are looking into infractions of copyright and other issues and are notifying customers of this ticket scam. Ticket Galaxy also did not deliver the tickets that were originally purchased. Original ticket purchased were for row V left balcony. The tickets issued were row V center balcony, where there was a large pole and disruptive lights. Ticket Galaxy did not inform me of the change in seating location prior to the show, even after calling to request a refund. These seats were not equal or upgrade in any way. Therefore, the merchandise was not delivered as purchased. Customer Service is the lowest priority for this business. Chase Credit Card Customer Service called this company on my behalf to mediate a refund, given the deceptive business practices and faulty merchandise that were delivered to me. Doug (last name undisclosed), refused to talk to them and instructed that I contact them directly. I contacted Ticket Galaxy directed and they informed me that they would not speak to me. This is a scam operation with multiple complaints filed with the Revdex.com. Further, the all sales final policy was not readable. All sales final precludes an agreement that the consumer transaction was transparent in what was being purchased. This was not the case with this transaction, and so I would argue that in the interest of Customer Service, a full or partial refund should be issued. I will not accept the businesses response. I have also engaged the Connecticut Department of Consumer Affairs in this matter.

("TICKET SELLERS") to facilitate the purchase and sale of event
tickets, and as such is not directly involved in the actual ticket sale
transaction between the buyers and TICKET SELLERS. All sales are final. As
tickets sold through SITE are often obtained through the secondary market and
prices are determined by the individual TICKET SELLER, the prices for tickets
may be above or below face value. Tickets sold through SITE are from a third
party; therefore, the buyer's name will not be printed on the tickets. Please
note that the name on the tickets does not affect the buyer's ability to access
the event.
The website terms and
conditions were available to Ms. Whittaker as a scroll box during the checkout

order did Ms. Whittaker contact our Customer Service Department with any
questions or for any clarification of the pricing and terms and conditions. If she
was unsure about the order she was placing, she was free to call the Customer
Service Department at the readily available number or to comparison shop at
other sites before finalizing her order.
Ms. Whittaker was educated to
the fact that tickets are in many cases sold above face value and that www.Excite.com/events
is neither a primary sale box office nor the venue. Ms. Whittaker's
freely-chosen acceptance of the price and the terms and conditions indicates
that she did make a conscious and educated decision to purchase tickets at the
price she agreed to.

Ms. [redacted] placed two orders for the [redacted] April 25 game at the [redacted]. The transaction was in US currency. Including service and delivery fees, the first order for four tickets in Section Lower J, Rows 1-10 totaled $339.40; and the second order for three tickets in Section Lower J, Row 10 totaled $264.55. Both totals exclude any applicable taxes which will appear as a separate charge on the card in addition to the order totals.
 
When Ms. [redacted] placed her orders from her computer at the website, www.[redacted].com she was obliged to review her orders and accept that website’s terms and conditions before her order was complete. These terms and conditions clearly state:

Pricing All prices are in United States Dollars (USD) unless otherwise specifically stated. SITE cannot confirm the price of an item until after an order is completed by USER. Despite SITE'S best efforts, a small number of the items listed on the SITE may be priced incorrectly. If the FULFILLER discovers an item's correct price is higher than the stated price, the FULFILLER will either complete the order at the original price, contact USER to inform them of different price with an option to purchase, or cancel USER'S order and notify USER of such cancellation.
Schedule of Fees and Charges The price charged to USER'S credit card beyond the price of the individual tickets shall include the following fees and charges:
Service Fee: Cost per ticket associated with SITE operation, customer service center operation, and other costs associated with the fulfillment of USER'S ticket request.
Delivery: Costs associated with the Delivery Method chosen by USER and the SITE'S arrangement of USER'S ticket delivery by the FULFILLER.
Total:Entire amount charged to USER, including each ticket's price as set by the FULFILLER, Service Fee, and Delivery.
 
Taxes Prices stated on the SITE do not include any state or other local taxes that may apply to USER'S order.  TICKET SELLERS may collect sales tax as is appropriate for their locality. If taxes are applicable to USER'S order they will be added to USER'S order as a separate charge in addition to the TOTAL.
 
International Shipping If USER is located outside of the United States, USER must choose an International Delivery option. If a domestic shipping option is chosen for an order to be shipped outside the United States, the shipping cost will be adjusted by the FULFILLER after the order is placed to use the International Rate.
 
The website terms and conditions were available to Ms. [redacted] as a scroll box during the checkout process and as a link on each page of the site. If Ms. [redacted] did not click on the “yes” button on the checkout page that states “I agree to the Terms & Conditions,” the software would have removed her from the checkout page and she would not have been able to go on to complete her order. Also, the total price, including service fees and delivery charges, was given to her before she gave her credit card information and completed her order. Ms. [redacted] chose to comply with the price and the terms before sending her final order for processing.
 
At no time before placing her order did Ms. [redacted] contact our Customer Service Department with any questions or for any clarification of the pricing or terms and conditions. If she was unsure about the order she was placing, she was free to call the Customer Service Department at the readily available number or to comparison shop at other sites before finalizing her order.
 
In addition, when Ms. [redacted] contacted our Customer Service Department on April 9, her seating was upgraded to Section L Row 7 to keep all seats in her party side by side. Furthermore, her delivery fee was refunded in the interest of customer service.  Our records show a credit for the amount of $40.00 for placed on her card on April 9.
 
Ms. [redacted] was educated to the fact that tickets are in many cases sold above face value and that www.[redacted].com is neither a primary sale box office nor the venue. Ms. [redacted] freely-chosen acceptance of the price and the terms and conditions indicates that she did make a conscious and educated decision to purchase tickets at price she agreed to.
 
There is no refund due.

While we regret that [redacted] has disagreed with our response, a phone order placed is still bound by the same terms and policies as placing the order on the website. 
If [redacted] takes issue with how the order was placed, then we would have to refer him to eventticketscenter.com, as TicketGalaxy does not own or operate the website. As stated, it also does not own or operate the call center into which he called to place his order. 
For these reasons, and the reasons previously mentioned, there is no refund due at this time.

As per the trailing message, I did not include a response in my reply.  I was hoping to provide you with my response.
Here is my response:
What is relevant is not whether the ticket reseller has followed the letter of the law in the resale of tickets, but rather the deceptive manner in which these tickets have been marketed to customers though the channels they have chosen to participate in. In this case, the domain name, header graphics, and user interface of design all conspire to fool the unwary into purchase tickets from what appears to be the Broadway production itself.
The disclaimer tacked into to the end of the pages in the site is nothing more than a mechanism by which to put the site into technical compliance with the law, while the remainder is in violation of its spirit: as the domain name, site design, graphics, and other user interface elements are all intended to enable the site to masquerade as the original Broadway ticket seller.
It is for these reasons that we claim that the Company is engaging in deceptive and immoral business practices by willfully and knowingly contracting with a site that is designed to deceive customers into thinking they are purchasing tickets from a legitimate Broadway production

The following statement by the business is UNEQUIVOCALLY FALSE:
"We assisted Mr. [redacted] in arranging to resell the tickets, but can take no responsibility for his success or failure in doing so."
Contrary to that contention, the business has done NOTHING WHATSOEVER to help me to resell my tickets. The only thing the business did was to provide me with a 1-800 number for a third-party reseller, which has NEVER, NOT ONCE, answered the phone when I've called (during normal business hours) and which has NOT returned ANY OF MY PHONE CALLS.
It's disappointing that Ticket Galaxy so readily is willing to take people's money for the inflated prices they are charging and then, when there is a problem, they not only refuse to assist, but they feel compelled to falsify the facts.
Now that Ticket Galaxy has made that contention, however, they must stand by it. I expect to receive a call from Ticket Galaxy within 48-hours, facilitating the resale of my tickets. If they do not do so, this will be an implied admission that they PATENTLY LIED about assisting me to resell the tickets.
I will await their response.

According to our customer service records Ms. [redacted] placed her order over the phone with a customer service representative with [redacted]. It's possible she located their phone number while
performing a search for tickets the event, however it would not be possible to
be redirected from the venue's website to this third party site. Ticket Galaxy
lists tickets for sale across numerous websites, and as such does we do not
own, operate or manage the website where Ms. [redacted] order was placed. We
are familiar with the website’s policies and the disclosures that the customer
service representatives provide to all customers.
Those policies explain that the website is a member of the
secondary ticket market and is not affiliated with the event, performer, or
venue in any way. They also state that all sales are final, there are no
refunds, exchanges, or cancellations. And lastly that ticket prices may be
above or below the face value of the ticket.
These customer service representatives also provide the
complete breakdown of an order's total price before completing the order. The
total price includes the price per ticket, the website's service fee, and the
delivery fee. Ms. [redacted] was therefore informed that her order was comprised
of three tickets priced at $143 each, the website's service fee of $48.62 per
ticket, and an additional $7.50 for delivery.
She was given this breakdown before she willingly agree to
the website's all sales are final policy and before she agreed to complete the
order. Therefore no refund will be provided as of this time.

The representative further confirmed that Mr. [redacted] had placed his order through [redacted] and is therefore bound by the terms and policies. Mr. [redacted] received his tickets in time for the event.

value. Tickets sold through SITE are from a third party; therefore, the buyer's
name will not be printed on the tickets. Please note that the name on the
tickets does not affect the buyer's ability to access the event.
Above Face Value. Tickets sold through SITE are often obtained through
secondary market TICKET SELLERS and are being resold, in many cases, above the
price or "face value" listed on the ticket. All ticket prices include
additional service charges and handling fees as defined on each order. SITE and
TICKET SELLERS are not directly affiliated with any performer, sports team, or
venue; and SITE does not act as a primary sale box office, unless otherwise
stated. By agreeing to these TERMS, USER agrees that the purchase price for
tickets on USER'S order does not reflect the original purchase price of the
ticket and may be either higher or lower than the original purchase price.
All sales are final. Since tickets are a one-of-a-kind item and not
replaceable, there are no refunds, exchanges, or cancellations. If an event is
postponed or rescheduled, tickets will be honored for the rescheduled date. New
tickets will not need to be issued. If an event is cancelled without a
rescheduled date, USER will need to contact FULFILLER for a refund. FULFILLER
may require USER to return the supplied tickets at USER'S expense before
receiving any refund USER is entitled to due to cancellation. SITE is not
responsible for providing or securing this refund for USER. Any shipping and
handling charges are not refundable. Refunds will be processed in the same
currency as the original order. Conversion charges, including though not
exhaustive of the ones issued by USER'S bank, if any, are not covered by SITE
or FULFILLER. Neither SITE nor FULFILLER will issue exchanges or refunds after
a purchase has been made or for lost, stolen, damaged or destroyed tickets.
When USER receives tickets, USER should keep them in a safe place. Please note
that direct sunlight or heat may damage tickets.
Schedule of Fees and Charges. The price charged to USER'S credit card beyond the
price of the individual tickets may include the following fees and charges:

Service Fee:
Cost per ticket associated with SITE operation, customer service center
operation, and other costs associated with the fulfillment of USER'S ticket
request.
·        
Delivery:
Costs associated with the Delivery Method chosen by USER and the SITE'S
arrangement of USER'S ticket delivery by FULFILLER.
The
total price stated is the entire amount charged to USER, including each
ticket's price as set by FULFILLER, Service Fee, and Delivery. 
The website terms and
conditions were available to [redacted] as a scroll box during the checkout
process and as a link on each page of the site. If [redacted] did not click
on the “yes” button on the checkout page that states “I agree to the Terms
& Conditions,” the software would have removed him from the checkout page,
and he would not have been able to go on to complete his order. Also, the total
price, including service fees and delivery charges, was given to him before he
gave his credit card information and completed his order. [redacted] chose to
comply with the price and the terms before sending his final order for
processing. We do not assume responsibility for [redacted]’s failure to
review his order before making his payment.
At no time before placing his
order did [redacted] contact our Customer Service Department for any
clarification on the pricing or terms and conditions. If he was unsure about
the order he was placing or the site he was purchasing the tickets from, he was
free to call the Customer Service Department at the readily available number or
to comparison shop at other sites before finalizing his order.
[redacted] was educated to
the fact that tickets are in many cases sold above face value and that www.[redacted]
is neither a primary sale box office nor the venue. [redacted]’s
freely-chosen acceptance of the price and the terms and conditions indicates
that he did make a conscious and educated decision to purchase tickets at the
price he agreed to.
There is no refund due.

mediating this matter. We take matters of customer service and transparency
very seriously. Our records...

indicate that on 12/12, [redacted] called in and
spoke with a representative of [redacted] to place her order. [redacted]
is a website which is not owned, nor affiliated with Ticket Galaxy. The
representative who assisted [redacted] in placing his tickets is required to
explain that the tickets may be found above or below face value, as well as
that the order is still bound by the terms and policies that are listed online,
despite the order being placed over the phone. [redacted] was also informed
that there is an all sales final policy before being allowed to place the
order.
Those terms and conditions explicitly note that all sales are final.
 We rely on the finality of this kind of web order in order to run our
business efficiently and offer competitively priced event tickets. Because
this was agreed to prior placing the order, there is no refund due.

Thank you for bringing this matter to our attention. We take customer service very seriously and would like to take the time to address Ms. [redacted] concerns.
 
When Ms. [redacted] contacted our Customer Service Department on April 27, 2015 regarding a ticket purchase placed on her credit card, the following correspondence was sent to her:
 
“This order came to us on April 23, 2015 at 10:49EST through www.[redacted].com for 2 tickets to [redacted] on Friday July 17, 2015 at 8:00PM at the [redacted] in [redacted]. The order was placed using an IP Address located in [redacted]. If this order was placed without your consent, we are happy to help in any way that we can. We just need a little bit of information from you. Please supply us with proof of your credit card being canceled from your bank or Credit Card Company, or provide us with a police report of the incident within 72 hours. You can fax this information to [redacted] or email it to [redacted]. It is, of course, your right to place this charge in dispute through your credit card company. Please note that once you do so it actually becomes a legal issue between your credit card company and our accounting department. At that point we are unable to make any adjustments to your account until the dispute is resolved. We strongly encourage you to call our office between the hours of 9:00am-6:00pm EST at your earliest convenience to resolve this issue.”
 
In addition, a manager has since contacted Ms. [redacted] to reiterate the above information. On May 4, 2015, Ticket Galaxy accepted a chargeback placed through her credit card company in lieu of a refund. We request that this matter be closed as Ms. [redacted] dispute with her credit card company has been resolved in her favor.
