Thank you for helping to mediate Mr. [redacted] situation.  Mr. [redacted] concerns are directed to the website on which he purchased tickets, a third party website that is not owned or operated by Ticket Galaxy.  Ticket Galaxy has no role in how the website is advertised or what service fee it asks for.  However, Mr. [redacted] agreed to be bound by the website's terms and conditions, which were conspicuously displayed on the checkout page, by actively clicking a check box before checking out.  Those terms and conditions explicitly note that all sales are final.  We rely on the finality of this kind of web order in order to run our business efficiently and offer competitively priced event tickets.

Complaint: [redacted]I am rejecting this response because: Their site specifically says that if the tickets that are sold are not available that the same or better tickets would be offered. this was not the case. The tickets that I was offered were many rows back and not the same or better than my original purchase. I accepted the alternate tickets not knowing where they were in the theater and would not have accepted offer if I had known where they were. This was done over the phone and I was not told that these tickets were at the very top of the theater in the back. Not at all what I had purchased as a gift.

When Ms. Sink placed her
order from her computer at the website, www.BroadwayTicketsCenter.com, she was
obliged to review her order and accept that website’s terms and conditions
before her order was complete. These terms and conditions clearly state:
General.
BroadwayTicketsCenter.com ("SITE") acts as an intermediary between
buyers and ticket sellers ("TICKET SELLERS") to facilitate the
purchase and sale of event tickets, and as such is not directly involved in the
actual ticket sale transaction between the buyers and TICKET SELLERS. All sales
are final. As tickets sold through SITE are often obtained through the
secondary market and prices are determined by the individual TICKET SELLER, the
prices for tickets may be above or below face value. Tickets sold through SITE
are from a third party; therefore, the buyer's name will not be printed on the
tickets. Please note that the name on the tickets does not affect the buyer's
ability to access the event.
The website terms and
conditions were available to Ms. Sink as a scroll box during the checkout
process and as a link on each page of the site. If Ms. Sink did not click on
the "yes" button on the checkout page that states "I agree to the Terms &
Conditions," the software would have removed her from the checkout page and she
would not have been able to go on to complete her order.
Also, the total price,
including service fees and delivery charges, was given to her before she gave her
credit card information and completed her order. Ms. Sink chose to comply with
the price and the terms before sending her final order for processing. Both the
service fees and the delivery fee are displayed at the top of the checkout page
and the total for the order is shown in bright red. Once the customer clicked
on the continue button to complete her purchase she was brought to a final
review page which also showed short disclosures of the terms and policies from
checkout and the complete breakdown of the total of the purchase. Mr. Sink was
informed numerous times of the additional service fees on the order and of the
website's policies before completing her purchase.
At no time before placing her
order did Ms. Sink contact our Customer Service Department with any questions
or for any clarification of the pricing and terms and conditions. If she was
unsure about the order she was placing, she was free to call the Customer
Service Department at the readily available number or to comparison shop at
other sites before finalizing her order.
Ms. Sink was educated to the
fact that tickets are in many cases sold above face value and that www.BroadwayTicketsCenter.com
is neither a primary sale box office nor the venue. Ms. Sink's freely-chosen
acceptance of the price and the terms and conditions indicates that she did
make a conscious and educated decision to purchase tickets at the price she
agreed to.
There is no refund due.

As far as
Minnesota’s 3 day cooling off period, according to the Attorney General’s
website, it applies to only specific situations, which are: Home solicitation
sales, life insurance policies, hearing aids, extended car warranties, military
personnel (cell phone/ wireless contracts, rental contracts, club contracts,
service contracts and membership travel contracts when called to active duty),
Debt Management/ Debt Settlement Service contracts, Credit services contracts,
Health club/ Social Referral Clubs/ Buying clubs, Reverse mortgages,
residential roofing/siding contracts, and Agricultural contracts.
Because our
orders don’t fall inside these categories, the terms and policies of
[redacted] are what governs the sale.
There is no
refund due.

On May 12, 2014 Ms. [redacted] placed her order for five tickets to The [redacted] April 11, 2015 show at the [redacted] in [redacted] using www.[redacted].com.
 
When Ms. [redacted] placed her order from her computer at the website, www.[redacted].com she was obliged to review her order and accept that website’s terms and conditions before her order was complete. These terms and conditions clearly state:

Ticket Availability. SITE cannot guarantee ticket availability until USER is in possession of USER'S tickets. Some ticket listings on SITE may only be representations of available tickets and not actual seat locations or currently available tickets. Occasionally tickets ordered may no longer be available at the price or in the quantity originally ordered at the time the order is received. If equivalent or better seat locations are available at the same price, TICKET SELLER will fill the order with the alternative seat locations. If no alternates are available, either USER'S credit card will not be charged at all or the entire amount charged will be refunded, and USER will be notified that the ticket request has been rejected. 
 
The website terms and conditions were available to Ms. [redacted] as a scroll box during the checkout process. If Ms. [redacted] did not click on the “yes” button on the checkout page that states “I agree to the Terms & Conditions,” the software would have removed her from the checkout page and she would not have been able to go on to complete her order. Ms. [redacted] chose to comply with the terms before sending her final order for processing.
 
We sincerely regret Ms. [redacted] experienced difficulty with her ticket order. When Ms. [redacted]’ original order was unable to be fulfilled, a customer service agent was able to place a second order request to a different seller on December 5, 2014. However, when this second order was also unfulfilled, Ms. [redacted] was offered a 125% order refund or an alternative date as per our advertised terms and policies. During the course of the phone conversation with Customer Service, a third ticket group for the original show date was identified and ordered from an additional seller. This final set of tickets was expedited to Ms. [redacted] and the delivery fee waived.

Price: $88.00 Each Quantity: 4
Seller's Note: Balcony, Rows T-Y. If more than four (4) tickets are purchased
from this group, your tickets may be split. All seats are guaranteed to be
located within the requested zone.. Tickets will be ready for delivery by Jun
02, 2015.
Additionally, the map which accompanies the ticket listing indicates
that Zone E is the entire balcony of the venue and is color-coded accordingly
on the map. When Mr. [redacted] clicked on the Zone E ticket listing the balcony
section of the map was also highlighted to indicate that this is the section
that was being chosen for purchasing.
When Mr. [redacted] chose to complete his purchase for tickets
in Zone E he was also required to read and agree to the website’s terms and
policies. These policies state:
All sales are final.

If Mr. [redacted] was unsure about the order he was placing or
had questions about the Zone seating that was advertised on the website, he was
free to contact our customer service department at any time before completing
his order. Since Mr. [redacted] willingly selected Zone E tickets, and willingly
agreed to the website's all sales are final policy, no refund or exchange will
be provided.
Please see the attached screenshots which indicates that the
information about Mr. [redacted] tickets was clearly disclosed on multiple pages
before he finalized his order.

I am rejecting this response because:
 
First, please get my name correct as misspelling it many times is somewhat insulting.
 
Second, when I called, the rep told me that they are the same company as the main website, and they both operate as one.
 
Third, the language you copied is buried in the midst of volumes of webpages.  You still really need to make it clearer.  How about a large font description on your webpage that states you are NOT part of the venue or authorized sellers and are in face resellers.  The reason you put this all sales final language on that page is you are counting on people (such as myself) who fall prey to these tactics and refuse reasonable requests to get a refund.  There is no reason you cannot offer the refund.  I wish I had searched your main websote online as it would have led me to your other company.  Both have many negative comments on this same problematic predatory selling behavior.  I guess there will be just another one out there warning people with a possible search engine link that rates right below your company name to provide a warning to other victims.

While we regret that [redacted] has rejected our response, we will be unable to offer a refund for reasons previously mentioned. 
As far as excuse making, [redacted]'s main concern seems to be how the website advertises itself. Once again, Ticket Galaxy only owns and operates our own website. Our inventory is found on many websites that we do not own or operate, and we cannot control advertising of these websites thusly. 
I hope this clarifies [redacted]'s concerns.

In order to investigate an invalid ticket claim, the
customer is required to provide proof from the venue that the tickets were not
valid. The word “VOID” does not mean the tickets are not valid, rather it means that
they were printed on photo-protected paper. Again, if [redacted] claims that
the tickets were not valid for entry, she would need to provide proof from the
venue itself.

I am rejecting this response because: As stated in my initial complaint - I was not told by a representative that the amount was in USD. As I live in Canada and was purchasing tickets for a show in Canada I assumed the currency was Canadian and was not told otherwise. I reject the response given by ticket galaxy and am unwilling to pay this amount. Please refund as soon as possible. I understand your policy is no refunds however I have done research and know refunds have been given. I believe my circumstance consitutes a refund and would like this done as soon as possible to avoid further action taken to achieve this.

Delayed Shipment Event tickets are generally delivered according to the delivery method selected at the time of ticket checkout. Most orders are shipped the same business day in which they are received or, if placed after business hours, orders may be shipped on the next business day. However, tickets may not always be available for immediate delivery, particularly in cases when the tickets have been purchased far in advance of the event in question or for certain events including but not limited to the following: all off-season orders for professional sporting leagues, concerts, and Las Vegas events tickets. While most tickets are delivered within three business days of the delivery method chosen, this does not imply a guaranteed delivery date. In these situations tickets may be marked with an estimated ship date. USER will be provided with account access information that will allow them to view the status of their order and tracking information, if available, after purchase. In the case where tracking information is not available USER may contact SITE for shipment information or an estimated delivery date. Tickets will be shipped when available, and choice of an expedited delivery method does not guarantee that tickets will be shipped immediately. USER should check the order notes for the estimated delivery date.
Mr. [redacted] was informed of the fact that his tickets would be ready for delivery four days prior to the event when he selected the tickets he chose to purchase and again before placing his order.
The website terms and
conditions were available to Mr. [redacted] as a scroll box during the checkout process
and as a link on each page of the site. If he did not click on the “yes”
button on the checkout page that states “I agree to the Terms &
Conditions,” the software would have removed him from the checkout page and
he would not have been able to go on to complete his order.

We assisted Mr. [redacted] in arranging to resell the tickets, but can take no responsibility for his success or failure in doing so.

I am rejecting this response because:  The company states that I ordered tickets on the web site and accepted their terms.  However, as my original complaint clearly states, I ordered these tickets over the phone and therefore did not click any box accepting these terms, and was not stopped from completing my order.  
Again, the inaccuracy of their explanation further demonstrates the dishonesty and unfair policies of this company.

I feel that it is reprehensible that anyone would sell seats to any venue that are over three times the value of the ticket.  Additionally, the charge for handling the transaction was 25% more than one seat to the concert.   You obviously do not have the obligation to refund the purchase price, however don't you think it would be good business?  Word of mouth advertising is a very powerful sales tool.  When I am asked about the concert, I will more than likely lead with how your predatory business is an example of greed and deception.

[redacted] was unable to fulfill Ms. [redacted]’ order and thus canceled said order on April 30, 2015. Ms. [redacted] was contacted by [redacted] on that date to notify her of the cancelation.
 
[redacted].com offers a 125% money back guarantee on the following situations:
 
Your order was accepted but not delivered by the seller.
Your order was accepted but not shipped in time for the event.
Your tickets were not valid for entry.
 
In accordance with this guarantee [redacted] provided Ms. [redacted] with a 125% refund on May 4, 2015. Since Ms. [redacted] has received the guaranteed refund we feel that this matter has been resolved according to the advertised policies and guarantees.

I am rejecting this response because the matter has not been resolved. It appears that this is not the first time this company has had to resolve costumer complaints through formal avenues. I request that until a refund be granted, the complaint is not settled and is unresolved. If Ticket Galaxy indeed held customer service and customer satisfaction as core value of their business, they would issue a refund.

take accusations of hijacking and skullduggery seriously.
 
On 8/30/16, [redacted] placed her order on
BoxOfficeTicketSales.com, which is a website not owned or operated by Ticket
Galaxy. Per the terms and policies published on BoxOfficeTicketSales.com, there
is an all sales final policy that stats that the tickets may be above or below
face value. Specifically, the terms and policies state:
 
Above
Face Value Tickets sold through SITE are often
obtained through secondary market TICKET SELLERS and are being resold, in many
cases, above the price or "face value" listed on the ticket. All
ticket prices include additional service charges and handling fees as defined
on each order. SITE and its TICKET SELLERS are not directly affiliated with any
performer, sports team, or venue; and SITE does not act as a primary sale box
office, unless otherwise stated. By agreeing to these TERMS, USER agrees that
the purchase price for tickets on their order does not reflect the original purchase
price of the ticket and may be either higher or lower than the original
purchase price.
Orders Orders placed through SITE will be
fulfilled by one of SITE'S network of participating TICKET SELLERS. Contact
information for the TICKET SELLER who fulfills USER'S order (hereinafter known
as "FULFILLER") will be provided to USER upon completion of the

When [redacted] contacted our office, saying that she had
purchased tickets for the wrong state, we looked into making an exception to
see if we were able to exchange her tickets for the correct state. We did this
as a favor to [redacted], instead of advising her to resell the tickets that
she would be unable to use and then re-purchase. [redacted] spoke with a
representative from our office, and accepted a re-delivery fee of $30, as we
had to send her an airbill to ship her already-delivered ticket back into our
office and ship out the new ticket back to her.
 
When [redacted] received her ticket, she called our office to ask
about the face value of the tickets, and the difference in price. The response
was essentially mirroring what you have read in the above terms and policies.
 
As far as the website “Hijacking” [redacted], the order was
placed on 8/30/16 at 11:50 AM from [redacted] computer. Because the terms
and policies have to be accepted prior to placing the order, as well as the
website clearly declaring that it is a marketplace and not the venue or box
office, we do not believe that this claim holds merit.
 
Because of the reasons listed above, we will be unable to process
a refund at this time.

This is not a matter of right and wrong, nor is it a matter of electronic tickets. If the tickets were available electronically, or if we were able to have the tickets re-printed for [redacted] daughter and her friends, we absolutely would.
