I was promised a money back guarantee and they did not make any sales offers or stand by their guarantee when I asked to cancel.
On 2/1419 I was contacted by the company to list my timeshare in the Bahamas for sale. I was told they have had excellent track record and a money back guarantee so I was not risking anything. in Feb they had me pay $749 to list my timeshare and promised if I did not get a sales offer they would guarantee my money back. I checked in monthly as I had not received any offers. they continued to tell me the "hot" season was coming and that they were sure my unit would sell very soon and reminded me not to worry I had a money back guarantee. In May they called to indicate they had moved my account to the HQ since it had not been getting any offers and HQ could do more for me. At that point it was 5/29/19 and they stated that to get me into a "special showcase" it would cost an additional $1472.00. They walked through the match of what type of sales offer I should get from this showcase and it still seemed like a decent deal. I asked if this new showcase was covered under the same money back guarantee as the previous had been and they indicated of course. I again did not get any offers and called monthly to check on it and was each time assured the hot time was coming and I should see offers very soon. In October 2019 I called back and explained I was tired of waiting and just wanted my money back. They attempted to up-sell me again and I politely declined and asked that they honor their money back guarantee since they had not provided me even one sales offer. I was transferred to a manager and again was attempted to up-sell. They also stated they had provided rental offersI had not responded to and I explained I had reviewed them all but non applied to my property as I dd not have any connecting entities like RCI. they again refused to make good on their money back guarantee. I attempted to dispute with my CC company however the transaction is too old. I waited to long and let these people steal money from me.

Desired Outcome

I would like to have the money back guarantee I was promised upheld and for them to refund me the $749 and the $1472 I paid for services they did not deliver on.

I am in receipt of the recent complaint filed with your office by ***. Our records indicate that Ms. has been a client of Timeshares By Owner since February 14, 2019 with marketing for her Viva Vacation Club at Viva Wyndham Fortuna Beach resort in the Bahamas. Ms. purchased marketing on two occasions to advertise her timeshare, first in the website/walk-in office advertising program and a second program in the "Spring Showcase" marketing program on May 29, 2019. Before any marketing fee could be processed, contracts were signed in advance and followed up with complete Quality Control calls. Quality Control calls took place on February 14 and on May 29 respectively for each marketing purchase. The calls covered all the policies, terms and conditions of the Timeshares By Owner marketing program. The client has to acknowledge their understanding of our terms and conditions in the Quality Control call, or a refund will be issued. The contracts provided to the client and signed in advance of purchase included the fact that there was a ten-day cancellation timeframe. Ms. never provided any notice of cancellation within the ten-day cancellation timeframe.

In the correspondence prepared by Ms., she is requesting a refund of her marketing fees based on alleged being informed that she could receive a full refund of her marketing fees if she simply canceled her advertising. She further states that she purchased additional marketing in which she received no offers on her timeshare. In response, our administrative notes indicate that there was at least four offers on her timeshare on March 28, April 23, June 26, and July 23--and all the offers were presented by representatives of our Concierge Department. I do not see that any of the offers were successful, but that does not mean that another offer will not be successful. As for a money back guarantee, we do not have any guarantee to issue a refund if a client's property is not rented out or sold. If a client happens to sell or rent their timeshare on their own without our services, there is the possibility of a refund only if their timeshare is sold or rented for an equal or greater amount than their original advertised marketing prices. Obviously, we will need specific documentation in regard to their sale or rent. Yes we have issued refunds for that on a few occasions. Otherwise, refunds are only issued if cancellations take place within the ten-day cancellation timeframe. Ms. understood that Timeshares By Owner never guarantees a timeframe in which a timeshare will rent or sell or what price might be received. As for the advertising, we generate over $10 million in transmitted offers on a monthly basis and we close on transactions all the time. We certainly hope to do the same thing for Ms., as our guarantee is to market a client's timeshare and that of course is exactly what we have been doing. Once there is an offer, it will come from a representative of our Concierge Department and they will work with the client from offer to completion. A Quality Control call is also conducted after every purchase which further confirms the terms of the contract. We have performed the services as contracted and purchased and we have been providing a tremendous amount of exposure. We truly are the gold standard of the industry in recording and reviewing all conversations, consistently providing offers and working with clients. We work with clients over the long term to achieve goals, and we are always available to talk and work with our clients in achieving mutual success. There is no entitlement to any refund based on providing the services promised and contracted.

Unlike other timeshare resale marketing companies, Timeshares By Owner provides the marketing that is contracted and promised. We have advertised in the *** as well as major city newspapers, billboards, TV (***, direct mail marketing, internet, and other forms of media. We also attend trade shows, we now digitally distribute the *** and *** magazines on a monthly basis, we do seasonal showcases that are sent out in email blasts, and we sponsor our own podcast; "Vacation Time" broadcast every week live from the studios of the Timeshares By Owner corporate office. That is just a little of what we do. We have the tools to rent and/or sell a client's timeshare and have been successful at doing just that since 1998.

Again, there is no entitlement to any refund; however, to further resolve matters, I will specifically go ahead and place Ms. active website advertising into our next *** Program that includes the*** digital marketing programs. This response is putting me into yet another type of marketing posting. As well the Quality control calls I sat through did not detail out the specifics of the 10 day cancellation window. Frankly I had been impressed with this company when I first agreed to work with them and I had told them of being scammed in the past. This response indicates my ad is still active. When I was talked into the spring showcase it was indicated to me that my other marketing was not longer active. at a minimum I would like a refund for the spring showcase

In response, let me start with the fact that contracts were signed in advance of purchase and signed electronically with the contract being in front of the client for signature all of which specifically detailed the ten-day cancellation timeframe. In conducting the Quality Control, we go over the specifics of the purchase, what it contains, how the services work, what exactly what we do, and all of our Client Services and Concierge Services contact information. We want the client to fully understand and if they do not understand or do not believe that is what they were informed at time of purchase, and do not want to proceed, a refund is processed. There is nothing specific about the cancellation timeframe discussed in the quality control call and why we would we bring that up?

We really do not expect people to purchase our services only to want to cancel, and the cancellation policy is already specifically spelled out in the contract they signed in advance of purchase. If the question is asked during the quality control call, of course we inform them that they have ten days from the date of purchase to cancel their services for a full refund of their marketing fee.

The last marketing that was sold to Ms. was for the Spring Showcase, a digital marketing program that consists of direct emails going out to those interested in the client's timeshare and/or something similar as well as a digital marketing platform that specifically markets the client's timeshare. The marketing I am providing at no additional cost to resolve matters is marketing that Ms. has not received previously--and obviously there is a cost for that service of which I am providing at no additional cost. Again, there is no entitlement to any refund based on the fact that we are providing the services as contracted and as promised. I am also specifically working with the Concierge Department to ensure that any offers being presented that meets the criteria of Ms. timeshare is being presented to her. Offers received come from people specifically seeing a client's ad as well as those contacting us to take a vacation somewhere and/or expressing interest in a timeshare without defining what timeshare. Offers have also been presented to Ms. from our Concierge Department as spelled out in the my correspondence.
Finally, Ms. is placed on the "do not solicit" list, so that she is not contacted again to purchase more marketing. I can certainly promise Ms. that we will be in contact with her for offers and ad updates. The company COO called and was able to listen to my concerns and address all of them appropriately. He is reviewing how my entire case was handled and is taking decisive corrective action. I appreciate the call and his ability to understand my point of view. I originally signed up with the company because I believed in their product and after speaking with him I again believe in their ability to deliver what was asked.

I have been working with Peter at Timeshares for Rent By Owners and he was able to find me a very nice stay in Las Vegas and Florida. In working with Peter I found that he is very professional and hard working. He was very prompt in returning my phone calls. For both of my trips he was able to find me a room within 48 hours and below our budget.

The renter called in the morning to rent and indicated that if not done by the 3pm time, he will go through the website. Paid $1500 upfront for advertising to rent or sell my current timeshare. After 90 days, zero activity. Now, I am getting calls asking for MORE money.
on 8.16.19 Paid $1500 for assistance with renting out or possibly selling my timeshare. There has been zero activity thus far, on 11.6.19 I was contacted and offered an "executive advertising" package for an additional $1500. I adamantly stated I am not interested and do not believe I need to pay more for something when the initial cost I paid has not been recovered. I expressed how unhappy I was with the service I was receiving, or better stated, the lack of service I am receiving. I was told they have a perfect Revdex.com rating and no other customer has ever complained and how shocked they were that I am unhappy with the services they are providing. on 12.2.19, I received yet another call, asking for and soliciting for addition money for advertising of my property. This was a serious mistake I made by entering into a contract with them.

Desired Outcome

I would like my money back as NOTHING has been generated with this contract. They charged me and are seeking MORE money to carry out what was agreed upon in or original contract.

Our records indicate that*** has been a client of Timeshares By Owner since August 16, 2019 with marketing for her *** Resort at *** resort in Baja California. Ms. purchased marketing in the amount of $1499 to advertise her timeshare on our website and in our walk-in offices. Before any marketing fee could be processed, a contract was signed in advance and followed up with a complete Quality Control call on August 16 at the office of purchase and again on August 20 at the corporate office of Timeshares By Owner. The calls covered all the policies, terms and conditions of the Timeshares By Owner marketing program. The client has to acknowledge their understanding of our terms and conditions in the Quality Control call, or a refund would be issued. The contract provided to the client included the fact that there was a ten-day cancellation timeframe. Ms. never provided any notice of cancellation within the ten-day cancellation timeframe.

In the correspondence prepared by Ms., she is requesting a refund of her marketing fees based on alleged zero activity and the fact that she was contacted again to purchase additional marketing. She further states that she was told that no other customer had ever complained. In response, our administrative notes indicate that there was an offer presented by our Concierge Department through Gigi B on November 26. Ms. understood that Timeshares By Owner never guarantees a timeframe in which a timeshare will rent or sell or what price might be received. As for the advertising, we generate over $10 million in transmitted offers on a monthly basis and we close on transactions all the time. We certainly hope to do the same thing for Ms., as our guarantee is to market a client's timeshare and that of course is exactly what we have been doing. Once there is an offer, it will come from a representative of our Concierge Department and they will work with the client from offer to completion. A Quality Control call is also conducted after every purchase which further confirms the terms of the contract. We have performed the services as contracted and purchased and we have been providing a tremendous amount of exposure.
