Timeshares Direct Inc. did not deliver the service that we were promised and paid for.
On January 31, 2018 I signed up with Timeshares by Owner, (TSBO) to sell my Diamond Timeshare points. I spoke with Carl J, Marketing Specialist, who said my 8,000 Diamond Timeshare points were the "Cadillac" of timeshares. He suggested a selling price of $40,000. I asked when was the last time he sold 8,000 points for $40,000; his answer was just two weeks ago. I paid $1,999 to market and sell my Diamond Timeshare points. On May 30, 2018 we were contacted by Amanda A, from TSBO Elite Plus. Amanda first asked for $1300 to move my account to Elite Plus status. She instead accepted $650 and told us our 8,000 points would sell for $40,000. My timeshare would be put in a special program and sell quickly. I did pay the $650 and now I am out a total of $2,649.00. We received a call from Tyler from TSBO Elite in August of 2018. She wanted another $1,900 to sell my 8,000 points. I said no. During the second call from Tyler when I kept saying "no" she became rude and hung up the phone. After numerous calls from Josh S and Richard H in April 2019, they kept telling me to pay more money to showcase my timeshare points. They suggested renting the timeshare, however I am not interested in renting. I asked each of the representatives the date and price of their last Orlando Diamond Resort timeshare point sales for comparison. They said that they were not allowed to give that information. They all have the same polished sales pitch. TSBO is very misleading; with LC behind their names they gave us the impression that they were a licensed real estate broker and were going to sell our timeshare points. Timeshares By Owner is a scam and a fraud and they should be put out of business. They lie and lead you on with no results after taking your money up front. I am 86 years old and a veteran and on a fixed income. I have been taken advantage of by Timeshares Direct Inc. (TSBO)

Desired Outcome

We would like a refund of $2,649.00 for services not provided after numerous occasions of TSBO asking for more money.

I am in receipt of the recent complaint filed with your offices by ***. Our records indicate that*** and *** have been clients of Timeshares By Owner since January 31, 2018 with marketing for their Mystic Dunes Resort and Golf Club. The first marketing fee of $1999 included website and walk-in office advertising as well as an ad in the next monthly edition of the Timeshare Trader Magazine. The website ad remains active and is renewed through January 31, 2020. A subsequent marketing purchase took place on May 31, 2018 in the amount of $650. Before Mr. purchased our marketing and we could accept his fee, contracts were signed. In the contract, it was understood that we did not have a buyer or renter waiting and that we could not determine a timeframe in which a property would sell or rent. The contract also included the fact there is a ten-day cancellation timeframe. As with all clients, we also conducted a Quality Control call right after the purchase in which a client must completely acknowledge their understanding of our terms and conditions. If there was not a complete acknowledgement of our terms and conditions in the Quality Control call that was conducted, a refund would have been processed.

In the correspondence prepared by Mr., he states that the representative that sold him our services had indicated that he could sell his points associated with his deed for $40,000 and that one sold for that price two weeks earlier. In the purchase that cost $650, Mr. states that the representative that sold those services had indicated that she would place his timeshare into a special program and sell them quickly. He further states that he was contacted again to purchase more marketing and refused to so and was treated unprofessionally as a result of not purchasing more marketing. He then states that we are a scam and fraud and that we should no longer be in business; therefore he believes that he is entitled to a full refund of his marketing fees in the amount of $2649. In response, Mr. neglects to indicate that he was provided with at least eight offers (Jul 26, Aug 7, Aug 10, Nov 29, Dec 1, Dec 23, Apr 10, and Apr 29 from 2018 to 2019). I'm sorry if any of those offers did not work out, but our guarantee is to market timeshares; as much as we would like to, we cannot guarantee results in regard to a rental or sale of a timeshare and that is clearly understood in the contracts that are signed in advance of fees paid and in the quality control calls that are conducted after purchases take place. Our guarantee is to market a client's timeshare and that is exactly what we have been doing for Mr. and have continued to do. As for representatives and statements they make to clients, they are fully monitored and their calls are recorded to ensure compliance in regard to the services that we provide. Counter to Mr. insistence that we are a scam, we have accurately tracked millions in transmitted offers on a monthly basis ($13,601,500 in the month of May alone) with multiple transactions that have closed on a monthly basis. With that said, despite the fact that we cannot make promises beyond marketing, I always understand the frustration in not receiving a successful offer on a client's timeshare that they may have expected after spending money on marketing. Obviously, we believe in our marketing programs and they have proven to be successful for many. To resolve matters, I will provide Mr. a refund on his last marketing purchase in the amount of $650 and I will provide him with additional marketing at no cost by providing him with an ad for his timeshare in the next editions of the Timeshare Trader and Elite Plus digital marketing program. I will also work with the Concierge Department in targeting offers that have a good possibility of working out for him. Obviously, I cannot make any guarantee in regard to a successful offer.

Unlike other timeshare resale marketing companies, Timeshares By Owner provides the marketing that is contracted and promised. We have advertised in the USA Today as well as major city newspapers, billboards, TV (ESPN, A&E, Weather Channel, and Travel Channel), direct mail marketing, internet, and other forms of media. We also attend trade shows on a regular basis in which we display client ads, we digitally distribute the Timeshare Trader and Elite Plus magazines on a monthly basis, we do seasonal showcases that are sent out in email blasts, and we sponsor our own podcast; "Vacation Time" broadcast every week live from the studios of the Timeshares By Owner corporate office. That is just a little of what we do. We have the tools to rent and/or sell a client's timeshare and have been successful at doing just that since 1998.

Again, there is no entitlement to any refund; however, as stated, a refund of $650 will be issued and additional marketing will be provided to resolve matters. I am not frustrated at my timeshares not selling as Timeshares By Owner (TSBO) states, I am mad at myself for getting caught up with TSBO. I paid $1,999 January 2018 initially for proclaimed marketing and selling of my timeshares. I received a call in May 2018 asking for another $1300 to put my account in Elite Status to which they accepted $650. I then received another call in June 2018 from Tyler asking for another payment of $1,999 to sell my Mystic Dunes timeshares. This is a predatory practice on people who just want sell their timeshares. There are hundreds of reviews where people like me have been scammed by TSBO. If I had not been conned and lied to and if I did not pay the money up front, I would not be writing this letter. How does TSBO get an A+ rating from Revdex.com? With all the bad reviews Timeshares Direct deserves a F rating, but Timeshares Direct responses to these accusations are well written however slick and misleading, masquerading its "marketing" as legitimate business.
Mr. White states I was sent eight offers for rentals, I received only five, four were worthless. I checked one and it was disapproved because it was too far from Disney. I told everyone at TSBO that I talked with not to send any rental offers I only wanted to sell.
On April 29, 2019 I received a letter with $50 gift card proceeded by a phone call all designed to make me go away. The letter did not address my complaints and the testimonials appeared fake to me. Timeshares Direct will take your money promising to market your timeshares to sell, but their representatives are not licensed or qualified to broker a closing of said property. Even if I received an acceptable offer of sale, considering all negotiations of price, paperwork, and closing documents etc., there would not be a closing without paying a real estate agent a large percent of the contract. None of this was ever mentioned in TSBO sales pitches. They make cancellation time frames and guide lines difficult to understand or follow and are rigged against the client. They were rude when I asked questions or I said no; their phone calls are high pressure and demanding.
Kevin Wh*** states in his response that a subsequent purchase of $650 was made. This call was originally asking for $1300 and was delivered with a high-pressure attitude by a representative named Amanda. During this call, I seem to remember her saying something to the effect of "It's okay, you have the money, you can afford it" and "what are you going to do with all that money?" They pretty much took from me what they could get in that phone call. If all calls are recorded, Mr. W should be eager to release all calls that have been made to me clearing any doubts that Timeshares Direct Inc is a predatory company. Mr. W also states that Timeshares Direct has been successful in selling and renting timeshares since 1998. However, it should also be noted that TSBO/Timeshares Direct Inc. had been under investigation by the Florida Attorney General and subsequently filed for bankruptcy in 2013. Timeshares Direct Inc has also been litigated by Wyndham Resorts for misrepresenting its status as an affiliate of Wyndham. This is in addition to the hundreds if not thousands of negative online reviews of the same predatory practices and ineffectual "marketing".
Kevin White 's letter dated 6/10/2019 is all about blaming me, yet they took $2,649 and wanted another $1,999. I was told by a representative in the beginning that my Diamond properties was the "Cadillac" of timeshares and will sell quickly. This was totally misleading and unprofessional since in the letter I was sent on April 29th stated they never actually sold a Diamond timeshare. TSBO should tell any potential clients that the client themselves can advertise their timeshares for free online with better results.

included the fact there is a ten-day cancellation timeframe. As with all clients, we also
conducted a Quality Control call right after the purchase in which a client must
completely acknowledge their understanding of our terms and conditions. lf there was
not a complete acknowledgement of our terms and conditions in the Quality Control call
that was conducted, a refund would have been processed.
In the correspondence prepared by Mr., he states that the representative that
sold him our services had indicated that he could sell his points associated with his deed
for $40,000 and that one sold for that price two weeks earlier. ln the purchase that cost
$650, Mr. states that the representative that sold those services had indicated
that she would place his timeshare into a special program and sell them quickly. He
further states that he was contacted again to purchase more marketing and refused to so
and was treated unprofessionally as a result of not purchasing more marketing. He then
states that we are a scam and fraud and that we should no longer be in business; therefore he believes
that he is entitled to a full refund of his marketing fees in the amount of $2649. in response, Mr.
*** neglects to indicate that he was provided with at least eight offers (Jul 26, Aug 7, Aug 10, Nov
29, Dec 1, Dec 23, Apr 10, and Apr 29 from 2018 to 2019). I'm sorry if any of those offers did not work
out, but our guarantee is to market timeshares; as much as we would like to, we cannot guarantee results
in regard to a rental or sale of a timeshare and that is clearly understood in the contracts that are signed
in advance of fees paid and in the quality control calls that are conducted after purchases take place. Our
guarantee is to market a client's timeshare and that is exactly what we have been doing for Mr.
and have continued to do. As for representatives and statements they make to clients, they are fully
monitored and their calls are recorded to ensure compliance in regard to the services that we provide.
Counter to Mr. insistence that we are a scam, we have accurately tracked millions in
transmitted offers on a monthly basis ($13,601,500 in the month of May alone) with multiple transactions
that have closed on a monthly basis. With that said, despite the fact that we cannot make promises
beyond marketing, l always understand the frustration in not receiving a successful offer on a client's
timeshare that they may have expected after spending money on marketing. Obviously, we believe in our
marketing programs and they have proven to be successful for many. To resolve matters, l will provide
Mr. a refund on his last marketing purchase in the amount of $650 and l will provide him with
additional marketing at no cost by providing him with an ad for his timeshare in the next editions of the
Timeshare Trader and Elite Plus digital marketing program. I will also work with the Concierge
Department in targeting offers that have a good possibility of working out for him. Obviously, l cannot
make any guarantee in regard to a successful offer.

The marketing fee of $1198 included website and walk-in office advertising that remains active and renewed through October 2020. Before Mr. purchased our marketing and we could accept his fee, a contract was signed. In response, our records indicate that at least five offers have been provided on November 19, November 30, December 10 in 2018, and February 21 in 2019. Deceptive sales practices with a lot of pressure to make an immediate decision to sign a contract and give a credit card number.
We purchased two contracts on December 8, 2018 to marked our two Time Share units at La Cabana Resport in Aruba. Our Units are designate at Week 18 and Week 17 and identified as Unit*** week 17 and Unit *** week 18. Our original Marketing Specialist was Penny N, Employee # ***. Time Share by Owner never advertiswd our Unit, wwek # 17. When I called, a different marketing specialist tried to upsell us and wanted to add money to our credit card. As of this date, April 22, 2019 the company has never advertised our week 17 on their web site as required under our contract for "six months of FREE advertisement".

Desired Outcome

As noted above, we seek reimbursement to our credit card in the amount of $2,450 because of theire breach of contract whereby not advertising the unit on their web site FREE OF CHARGE as noted in our contract. The company also failed to provide us any information that our week was advertised in THE TIMESHARE TRADER MAGAZINE also in violation of our contract.

The total marketing fee of $3998 included website and walk-in office advertising, along with advertising placed into the February 2019 edition of the Timeshare Trader Magazine. The website/ walk-in office advertising remains active and renewed through June 2020. Before Ms. purchased our marketing and we could accept her fees, four contracts were signed. In the contracts, it was understood that we did not have a buyer or renter waiting and that we could not determine a timeframe in which the property would sell or rent. The contracts also included the fact there is a ten-day cancellation timeframe. As with all clients, we also conducted a Quality Control call right after the purchase in which a client must completely acknowledge their understanding of our terms and conditions. If there was not a complete acknowledgement of our terms and conditions in the Quality Control call that was conducted, a refund would have been processed. The completed Quality Control call took place on December 13, three days after the approved marketing purchase.

In the correspondence prepared by Ms., she states that the sales practices were deceptive with pressure to immediately sign the contracts. It is further stated that her marketing was not advertised for her two deeded weeks and that it was not marketing in the Timeshare Trader Magazine as promised. There is also an insinuation that there was free advertising that they did not receive. In response, when reviewing the website and walk-in office advertising, indeed, there are two active ads on our website advertising deeded weeks 17 and 18. They are ad #s*** and ***-obviously being that they are specific deeded weeks, I have updated the ads to reflect the weeks coming up in 2020. The ads are also featured in the "Reserved & Ready" program. Marketing for both deeds were placed into the January 2019 edition of the Timeshare Trader Magazine as contracted. In regard to free advertising, I do not understand that reference, other than the fact that we will continue to market a client's timeshare beyond the six-month contract period at no additional cost. The client just needs to notify us at the corporate office that they want their ad(s) renewed. Finally, it appears that there have been numerous offers on Ms. timeshares; i.e., four on February 20 and two on April 30--all presented by our Concierge Department. THEY SAID THAT WE RECEIVED 4 OFFERS ON FEBRUARY 20 AND ON APRIL 30. WE DID RECEIVED SOME OFFERS BUT THEY WERE FOR OUR WEEKS AND FOR DIFFERENT TIMESHARES. SO BOB CALLED THEM AND TOLD THEM THAT THEY WERE NOT ADVERSTING OUR WEEKS. AFTER THAT WE NEVER HEARD FROM THEM IN REGARDS TO OUR WEEKS. AGAIN SOMEONE CALLED AND SAID THAT THEY MAY HAVE SOMEONE FOR 2020 I THINK SOMEONE NAMED PETER LEFT THE MESSAGE SO BOB CALLED BACK TO GET THE INFO LEFT A MESSAGE AND ONE EVERY CALLED BACK . THEY SEEM TO DO THAT ALOT SO IT MAKES ME MAD THAT THEY SAY CALLED AND SOMEONE WILL HELP-BOLONEY. IN REGARDS TO ADVISTING WE HAD SOMELOOK ON THESE SITES AND HE ONLY SAW ONE UNIT BEING ADVISED SO I DON'T KNOW WHAT THEY ARE TALKING ABOUT UNLESS THEY DID IT AFTER THE FACT. I welcome Ms. response and the fact that she does not accept my response to her complaint, but I do not agree with her statements that this would somehow justify a refund of her marketing her services, and that we did not provide the services as purchased.

The reason for the offers of other properties is because Ms. resort has RCI and Interval International exchange availability, yet she only indicates that she has specific deeded weeks that are being featured in our "Reserved & Ready" program as well as having been placed in our "Hot Deal of the Day" feature. A specific week restricts the opportunities of someone renting from a client, hence, if she is an RCI and/or Interval International member, other resorts can be utilized. We do not know that she does not have that membership if she does not inform us--and she should have indicated that to the Concierge Department when they provided her with offers. Unfortunately, when a client is restricted to a specific week, we can only provide offers to those that want that week--it can be a good thing because the week is definitely available, but like I said, we have to find someone that specifically wants that week. In reference to "Peter," he is a representative of our Concierge Dept, that works with clients from offer to completion. If anyone calls the Concierge Dept or the Client Services Dept, if not immediately available, a call is returned. Contacting the sales rep that sold the services will not likely be as responsive and that's because we provide a fully staffed Client Services and Concierge Dept--with the numbers provided in the contract and material sent out.

Again, as stated in my letter, our obligation is to provide the marketing as contracted, which we certainly did and more. Contracts were signed in advance of purchase and Quality Control (QC) calls were conducted after the purchase--and the client certainly acknowledged their understanding of our services by signing the contract and by acknowledging their understanding of our services in the QC call. As indicated in my response attached, I will provide additional marketing at no additional cost, but there is no entitlement to a refund.

Our records indicate that *** and*** have been clients of Timeshares By Owner since December 10, 2018 with marketing for their La Cabana Beach and Racquet Club on the island of Aruba. The total marketing fee of $3998 included website and walk-in office advertising, along with advertising placed into the February 2019 edition of the Timeshare Trader Magazine. The website/ walk-in office advertising remains active and renewed through June 2020. Before Ms. purchased our marketing and we could accept her fees, four contracts were signed. In the contracts, it was understood that we did not have a buyer or renter waiting and that we could not determine a timeframe in which the property would sell or rent. The contracts also included the fact there is a ten-day cancellation timeframe. As with all clients, we also conducted a Quality Control call right after the purchase in which a client must completely acknowledge their understanding of our terms and conditions. If there was not a complete acknowledgement of our terms and conditions in the Quality Control call that was conducted, a refund would have been processed. The completed Quality Control call took place on December 13, three days after the approved marketing purchase.

In the correspondence prepared by Ms., she states that the sales practices were deceptive with pressure to immediately sign the contracts. It is further stated that her marketing was not advertised for her two deeded weeks and that it was not marketing in the Timeshare Trader Magazine as promised. There is also an insinuation that there was free advertising that they did not receive. In response, when reviewing the website and walk-in office advertising, indeed, there are two active ads on our website advertising deeded weeks 17 and 18. They are ad #s*** and ***-obviously being that they are specific deeded weeks, I have updated the ads to reflect the weeks coming up in 2020. The ads are also featured in the "Reserved & Ready" program. Marketing for both deeds were placed into the January 2019 edition of the Timeshare Trader Magazine as contracted. In regard to free advertising, I do not understand that reference, other than the fact that we will continue to market a client's timeshare beyond the six-month contract period at no additional cost. The client just needs to notify us at the corporate office that they want their ad(s) renewed. Finally, it appears that there have been numerous offers on Ms. timeshares; i.e., four on February 20 and two on April 30--all presented by our Concierge Department. Timeshares By Owner guarantees to market a client's timeshare and that is exactly what we have been doing for *** and *** We have accurately tracked millions in transmitted offers on a monthly basis with multiple transactions that have closed on a monthly basis as well. We cannot guarantee any rental or sale of a timeshare within a specific timeframe and such information is covered in the contract that must be signed in advance of purchase--and we conduct Quality Control calls after every purchase to ensure that clients understand and acknowledge the marketing that they purchased. If in the Quality Control call, the client does not acknowledge their understanding of our services as sold, we will process a full refund. With that said, despite the fact that we cannot make promises beyond marketing, I always understand the frustration in not receiving a successful offer. Obviously, we believe in our marketing programs and they have proven to be successful for many. To resolve matters, I will provide additional marketing by placing ads for Ms. into the upcoming Timeshare Trader and Elite Plus digital marketing programs. I am also personally working with the Concierge Department on providing *** and *** with some, hopefully, successful offers. They are also placed on the "do not solicit" list so that they will not be contacted again to purchase more marketing.

Unlike other timeshare resale marketing companies, Timeshares By Owner provides the marketing that is contracted and promised. We have advertised in the USA Today as well as major city newspapers, billboards, TV (ESPN, A&E, Weather Channel, and Travel Channel), direct mail marketing, internet, and other forms of media. We also attend trade shows on a regular basis in which we display client ads, we digitally distribute the Timeshare Trader and Elite Plus magazines on a monthly basis, we do seasonal showcases that are sent out in email blasts, and we sponsor our own podcast; "Vacation Time" broadcast every week live from the studios of the Timeshares By Owner corporate office. That is just a little of what we do. We have the tools to rent and/or sell a client's timeshare and have been successful at doing just that since 1998.

SO BOB CALLED THEM AND TOLD THEM THAT THEY WERE NOT ADVERSTING OUR WEEKS. AFTER THAT WE NEVER HEARD FROM THEM IN REGARDS TO OUR WEEKS. AGAIN SOMEONE CALLED AND SAID THAT THEY MAY HAVE SOMEONE FOR 2020 I THINK SOMEONE NAMED PETER LEFT THE MESSAGE SO BOB CALLED BACK TO GET THE INFO LEFT A MESSAGE AND ONE EVERY CALLED BACK . I welcome Ms. response and the fact that she does not accept my response to her complaint, but I do not agree with her statements that this would somehow justify a refund of her marketing her services, and that we did not provide the services as purchased.

The reason for the offers of other properties is because Ms. resort has RCI and Interval International exchange availability, yet she only indicates that she has specific deeded weeks that are being featured in our "Reserved & Ready" program as well as having been placed in our "Hot Deal of the Day" feature. A specific week restricts the opportunities of someone renting from a client, hence, if she is an RCI and/or Interval International member, other resorts can be utilized. We do not know that she does not have that membership if she does not inform us--and she should have indicated that to the Concierge Department when they provided her with offers. Unfortunately, when a client is restricted to a specific week, we can only provide offers to those that want that week--it can be a good thing because the week is definitely available, but like I said, we have to find someone that specifically wants that week. In reference to "Peter," he is a representative of our Concierge Dept, that works with clients from offer to completion. If anyone calls the Concierge Dept or the Client Services Dept, if not immediately available, a call is returned. Contacting the sales rep that sold the services will not likely be as responsive and that's because we provide a fully staffed Client Services and Concierge Dept--with the numbers provided in the contract and material sent out.

Again, as stated in my letter, our obligation is to provide the marketing as contracted, which we certainly did and more. Contracts were signed in advance of purchase and Quality Control (QC) calls were conducted after the purchase--and the client certainly acknowledged their understanding of our services by signing the contract and by acknowledging their understanding of our services in the QC call. As indicated in my response attached, I will provide additional marketing at no additional cost, but there is no entitlement to a refund.

The company has not delivered on a service/product we paid for.
In 9/18 we paid $1499.00 to have our timeshare marketed by a company calling itself "Timeshares by Owner" which is evidently the same company as "Timeshares Direct" since it is the same address, suite number, and telephone number. This money was to have our property listed for sale on their website. It was on the website but so were thousands of other properties. They told us that we could pay extra money to have our property highlighted in a special publication and that we would receive a copy of this. We did not. We then were told that if we just paid another $2689.00 there would no additional charges involved and our property would appear in the Traders Magazine. We have never receive a copy of that or any other evidence that it was done. I have emailed Kevin W, who lists himself as Vice President or Timeshares by Owner and have also telephoned. No contact.

Desired Outcome

We would ideally like a refund of the $2689.00 since they did not deliver on this service.

This company promised to be able to sell my timeshare. I paid them over $6,000 and have gotten nothing. Every time I call they want another $3,000 to do more advertising which obviously does not work. In the meantime, they indicated that they might be able to rent out my weeks but the offers I get for rental are ludicrous. For example, they wanted a full week in Florida over spring break for 20 people for $1,000 or 5 days in Orlando for 12 people for $900. I can't believe that they would even consider such a thing. Such offers indicate to me a total lack of credibility.

Our guarantee is to market a client's timeshare and that is exactly what we have been doing for Mr.. In fact, our Concierge Department has presented him with numerous offers: April 11, April 19, May 12, July 7, October 17, October 20, October 24, November 11, and a successful booking on November 15--all in 2017. More recent offers took place on March 21 in 2018, and August 23 in 2018. We are very good at what we do and we do generate over $10 million in transmitted offers on a monthly basis with the closing of transactions all the time. With that said, despite the fact that we cannot make promises, I can understand the frustration in not receiving a successful offer in the timeframe that may be expected after spending some money on marketing. Obviously, we believe in our marketing programs and they have proven to be successful for many. Thank you for the response from Mr. W. Unfortunately, Mr. W is not aware of the pressure tactics or promises made by his employees. The 10 day period is not long enough to see the results of Timeshares by Owner's efforts. Mr. White seems like an honest person and we may have had a misunderstanding. There is no need to pursue this further.

They got a room rented out for me quickly and the payment was also fast. Everyone on the phone that I talked to was very nice. They got everything done that was needed. I am still doing business with them on renting and also trying to sell my timeshare.
