After receiving this former client's response, I called her and I was able to reach her.We discussed her case and cleared up the confusion around the difference between being prosecuted for a debt (which is not legal) and being prosecuted for fraud (which is very much legal) She decided that taking care of her criminal concerns was most important to her at this time and decided not to move forward with the bankruptcy.She and I came to an agreement regarding her case she indicated that she was very pleased with the outcome

call and email her over an approximate 2-week period, but she has not responded to any of my attempts to contact her Accordingly, I cannot report that this has been resolved.As to the substance of the complaint, however, it is important to note that there are a number of factual inaccuracies This client was absolutely not given the advice that she claims in her Revdex.com complaint She was given a number of options and I have personally spent a few hours with her local attorney coming up with multiple courses of action to reach her goals However, she would like to accomplish things that are not consistent with the law We are certainly open to helping her accomplish her goals, but she will have to be able to prove her assertions to the Court We have further told how how to go about put herself in a position where she can prove her assertions, but she has not yet taken those stepsMy door remians open to her if she would like to further discuss this, but her refusal to respond to my many calls and emails leaves this firm without a mechanism to resolve her concerns

I am the Managing Attorney at UpRight Law for Enhanced Service. When I received notice of this complaint, I reviewed the file and spoke with all of the attorneys involved with this case. I then spoke with the client and we came to an agreement regarding how we will resolve this matter
as quickly an easily as possible for her.When someone contacts an attorney and indicates that they would like to file for bankruptcy relief, that attorney needs to rely on the client to give the attorney all relevant information regarding the client's debt. The reason for this is there is no database that contains all agreements and debt information that could potentially be relevant to a client's life. Attorneys do the best they can to gather this information by asking for documentation from the clients and pulling credit reports, but it is still possible for facts to go undiscovered. Usually, this risk is minimal because of all of the investigation that goes into a file, but every once in a while, when neither the client or the attorney have a reason to check for something, facts can exist and must sometimes be addressed after the filing of the caseThis is what happened in this case. Despite our very thorough investigation and despite our client's best efforts to get the relevant documentation, neither the attorneys nor the clients were aware of a lien that was filed by a creditor. The case was entirely successful in discharging the debt, but the lien against the house was never removed because no one knew it existed. The process for resolving this, however, is fairly simple and we have taken steps toward that resolution already. We will be filing an emergency motion to reopen her bankruptcy case and an emergency motion to avoid the lien. Once signed by the judge in her case, the client will be able to sell her property free from the encumbranceWe are very happy that we were able to successfully resolve the complaint and help our client toward her financial rehabilitation

I am the Managing Attorney at UpRight Law for Enhanced Service. When I was notified of this complaint earlier today, I immediately reached out to this client and we came to a very quick resolution to her concernsAt UpRight Law, we take in clients based on the information that the
client gives us during that consultation. In circumstances where we are given information that later turns out to be incorrect, adjustments have to be made to the plan we set in place at the time of the intake. In this case, there was some confusion about when this client last filed for bankruptcy. At the time of the intake, we were told that this client has a prior bankruptcy just over years ago. By law, a person cannot file for a chapter bankruptcy more than every years and receive a discharge in that bankruptcy. We accepted that information as true and moved forward with the payment plan that this client asked UpRight Law to set up for her. During the process of building this case, we discovered that the time of the prior bankruptcy was actually less than years ago. Since the client was only wrong by about a year, we offered to hold her case at no extra charge and file it for her in months, when she became discharge eligible. On February 1, the client called us back and let us know that she thought the law was unfair and she just wanted a refund. UpRight Law informed the client that we would have to perform an accounting of the case to determine the amount of the refund. We have now completed that accounting, informed the client of her refund amount and she is quite pleased with her result. In addition to her refund, I have given the client my personal contact information and assured her that should she choose to file a case when she becomes discharge eligible in November, we would credit her future case with the amount she already paid. I went on to explain all of the legal options and asked her to give me a call if there is ever anything we can do to help her in the future. She agreed and we're very happy to have resolved this matter so quickly and put her in a position to make the best decisions going forward. recovery.Regarding the substance of this complaint, I believe that this former client experienced some miscommunications with the attorneys with whom she spoke The amount of the refund she received was tempered only by the work the firm put into the case Also, UpRight Law does not now and has never acted as a middleman for other attorneys People who hire this firm and file their cases with this firm have their cases serviced by UpRight Law attorneys without exception Additionally, it is unclear to me what she means when she says she didn’t want her home to be “in” the Chapter case I will be happy to explain all of her options for the treatment of her home in the bankruptcy when she calls me back. These points of confusion will be cleared up when I speak with her I’m confident that we’ll be able to resolve this complaint in short order when we speak
