and meet with him face-to-face Unfortunately, the district where this client lives requires that step and does not allow clients to meet with their attorney exclusively over *** Since *** *onsultations are something that we routinely offer to clients and this client does not have the ability to meet with her attorney in person, UpRight Law refunded 100% of this clients' payments back to her with our sincere apology for any miscommunication We wish her all the best in her future and I asked her to feel free to contact me directly with any questions, concerns or future needs

At UpRight Law we feel that our client relationships are among our highest prioritiesWe strive to cultivate an open, honest and professional environment wherein we can service or clients' needs with great care and a high degree of qualityTo that end, I am trying to contact you so that we cam work together to solve your concerns
On August 26, a member of my staff spoke with you regarding your cancellation request and request for a refundThat staff member communicated to me that you were unhappy with the refund policy that you agreed to when you asked for our help with your financial situationOn that same day, I called you and spoke with you about that refund policyI also explained that we begin work on the files at the time the client agrees to hire UpRight Law to address the clients' debt concernsAt the end of that conversation, we agreed that I would complete a full accounting of all work that had been completed on your file and send it to youYou can find that accounting attached here
Later that same day, before I had an opportunity to follow-through with our agreement, you lodged a complaint with the Revdex.comIn that complaint you alleged that we have not responded to an email that you sent on July 17, despite the fact that you spoke with multiple members of our staff, including me, that same daySince that time, I have called you multiple times in an attempt to resolve this matter, including a call this morning
At this point, I have to respond to the Revdex.com complaintWhen a complaint is filed with the Revdex.com we have days to respondToday is the 14th day since your complaintMy response will include this email

This client contacted me back todayHe has not yet reviewed the accounting that I sent to himI offered to send him another copy to an email of his choosingHe indicated that he does not currently have access to emailI offered to send him a paper copy and he indicated that he would rather wait to discuss it with his wife and call me back at another timeI will be happy to discuss the accounting or any other concerns he has when he returns the call

I am a managing attorney at UpRight Law. When I was notified about this complaint by the Revdex.com, I tried to contact this client by phone. Unfortunately, she was not available to speak at that time. I left her a voicemail and sent her this follemail:Dear MsXxxxxxx,
I just left you a voicemail and I am writing you now so you have my contact information written down. At your convenience, please give me a call back. I would appreciate the opportunity to discuss your Revdex.com complaint with you. Regarding your student loan, a regular bankruptcy will not discharge that debt. The is a law, called ** *** ***, that says that students loans are excepted from discharge unless you can show the *** that excepting the discharge for those loans would amount to an "undue hardship" to you, as the Debtor. That means that in order to discharge student loans, you need to file something called an adversary proceeding. An adversary proceeding is an entirely separate legal action that sometimes occurs in conjunction with the bankruptcy. When you call me back, I will be happy to discuss this in more detail and talk to you about the possibility of filing an adversary with your particular circumstances. Additionally, the retention agreement (your contract for services with the firm) specifically states that discharging student loans will require work that you are not hiring the firm to complete. The retention agreement also says: "Even if you receive a discharge, there are some debts that are not discharged under the law. Therefore, you may still be responsible for such debts as certain taxes and student loans, alimony and support payments, criminal restitution, and debts for death or personal injury caused by driving while intoxicated with alcohol or drugs." I am a managing attorney at UpRight Law. Upon receiving this complaint, I contacted this former client of the firm and we discussed this matter. In this instance, there was clearly a miscommunication between the client and the people with whom he spoke. UpRight Law has many
attorneys in Missouri who regularly assist clients with Chapter bankruptcies and do so successfully. Additionally, the contract signed by this former client clearly states that the work performed by the firm shall be compensated even in the event the client decides or need to change the chapter under which he expects to file. Lastly, the firm did not send him a bill for the services provided. The firm sent him an accounting of the time put into the case thus far. Still, UpRight Law cares deeply that all clients of the firm receive the best possible client experience, so when I contacted him, we were able to quickly come to a resolution of his concerns. We wish him all the best of luck in the future and hope he will consider UpRight Law for any future bankruptcy needs
