I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. I received a phone call on Wednesday afternoon (2-18-15)  from [redacted], the Club Manager at w4 Hr Fitness in Lewisville, Texas.  We talked for about 20 minutes.  As expected, he said nothing that really addresses the issues with this business.  It all comes down to that their is zero membership accountability, and this business has NO policies in place when it comes to compliance among its members.  For example, the issue with so many lockers in mens locker rooms having locks on them (about 35 locks on lockers when there are only two or three male members at the gym working out).  Placing a notice (usually a taped notice that can be moved or removed by anyone) on the locker advising the member to remove the locker contents, is USELESS.  Less than a week later, the same situation exists, because 24 Hr Fitness makes NO effort to determine WHO the culprits are. This is one of the worst run businesses in the metroplex.  And just continues to get worse.  Another example, in my phone conversation with [redacted], I mentioned the blasting garbage spewed over the sound system (do not insult me and say that it is music), and [redacted] said to mention it to the front desk person and that person would turn it down.  Well, this morning (Thursday the 19th) I did just that, and the front desk young man REFUSED to turn it down. This business cannot attract quality members because those that do sign up for a one month membership or so, do not renew (I have personally talked to MANY who say they will not renew membership because of how badly the place is run).  No wonder the turnover rate for employees at this business is astronomical.  [redacted] mentioned that past Managers being promoted; those managers that have been there should have been DEMOTED or better yet FIRED for such lack of managerial skills.

One of the attachments is a copy of charge to my account to update my [redacted] membership issue as which I was advised to do back in January by 24 hour fitness. 24 hour Fitness indicated once the payment was made they could transfer my account to 24 hour fitness but to no avail. . At this point they are still not accepting my membership despite following what I was told to do by their [redacted] transition center back in January. I also have the confirmation number that the payment was accepted by [redacted] the number is [redacted]From: [redacted] [redacted] Sent: Tuesday, April 07, 2015 11:05 AMTo: [redacted]Subject: [redacted] Payment and Contract[redacted] -  I have attached the payment I made to [redacted] in January in an attempt to resolve my membership issue. As discussed, when I first became aware the gym had changed to 24 hour fitness the staff at the front desk looked up my membership and indicated there was a payment issue with my account and it could not be resolved at the local gym. The staff indicated that it  had to be resolved with the corporate office. The staff provided the phone number and I called the following day. To add,  I never received any correspondence from [redacted] or 24 Hour Fitness that the gym had been sold. I had not been at the gym for several weeks due to a schedule change with my job.  Nor did I ever receive any type of communication that there was an issue with my yearly auto pay renewal from [redacted]. After I explained the issue to the 24 Hour Fitness call center I was transferred to a group that was handling the [redacted] transition. I believe the person I spoke to was [redacted] She indicated that I needed to first resolve the unpaid renewal fee before my account could be transferred to 24 Hour Fitness. I did follow up and made my payment to [redacted] which is attached. [redacted] at that time indicated that the issue was at their end and my yearly auto payment was not taken as scheduled. However, since that time I was not able to resolve the issue at the 24 Hour Fitness level despite making the payment as originally advised. I believe I reacted as quickly as possible to resolve the issue once I realized the change in ownership. I attempted to resolve the issue as advised to reestablish my membership with 24Hour Fitness.      As discussed I have attached my original contract for which I had been in good standing since 1989. I am only seeking to reestablish my membership at the [redacted] location and continue my contract with 24 Hour Fitness I truly appreciate the time and effort you have taken in regards to my membership issue. Sincerely, [redacted] Account [redacted]Phone Number – [redacted]

Dear 24 Hour Fitness Corporate Office,I am sorry you have your facts wrong and you are not able to see this or even understand the issue, even after I have explained it twice.  So perhaps, it may be beneficial to put the facts and points in bullet format:FACT: You are not following your Conduct Policy you have in place and noted on your website.  The person that assaulted me refused to speak with the Club Manager after speaking with the police.  [redacted] stated this and went on to say their is nothing more she would do and that if the person that assaulted me wanted, they could always come back and restart their membership.FACT: The local police department has not concluded their investigation.  You may contact the [redacted] Police DepartmentFACT: Good Faith means honesty and sincerity of intention.  In reading your responses and speaking with the Club Manager, District Manager, and "24 Hour Fitness Corporate Office, it is clear you do not intend to follow your own policy.  You are falsely stating a Conduct policy that you all do not enforce if it does not make you money.I sincerely hope you follow your conduct policy and change the protocol for when someone pleads for help from Emergency personnel.  The Safety and well being of your employees and members should be more important than the dues you collect from one person
