While the consumer has rejected the initial reply from the merchant, the consumer now must contact their payment provider as this matter is now in mediation between the consumers merchant bank and merchants payment processorThe consumer filed a dispute (charge-back) for a transaction they authorized and our staff cannot assist as the consumer must contact their payment provider (issuing bank/credit card provider) on the status of the claim that they filed.?

The consumer violated the merchants terms of service by providing monetary incentives for subsequent users to joinThe merchant has sufficient evidence the user consumer promoted he would pay any user who signed up through the consumers referral link in order to obtain promotional creditsThis is a violation of our Refer A Friend terms of service, as outlined in attachedOn the consumers account, the $deposit was refunded and processed on 1/27/These funds will be posted in the users bank account within business daysAs the consumer violated the merchants terms of service, the merchant is exercising their right to withhold any winnings in the consumers account above their deposit totalAt this time the merchant deems this matter resolved as it is a violation of the terms of service and player agreementWe will be happy to comply with any further mediation.?

The consumer contacted our Customer Support team at 5:AM EST this morning and received a reply at 6:AM ESTThe email they received also states "While we are assisting other customers, below you may find the answer to your inquiryIf you do not find the answer to your inquiry, please reply directly to this email." The consumer has failed to reply to that email, thus why they have not received an additional response from our Customer Support team.? The Consumer received a total of? $in contest prize winnings this morning between the times of? 12:58am and? 01:09amThey placed a $withdrawal request and they currently have a active cash balance of? $and $on hold for upcoming contestsThe consumer can view all of these transactions within their account by going to their My Account page, clicking on the "transactions" tab and then scrolling through the listWe will not be issuing this user any additional form of compensation as they have received all proper contest winnings for their corresponding contests and it appears they are simply confused at this time.?

The merchant has refunded all of the consumers deposits at this time and the consumer has no outstanding balance left in their accountThe merchant sent $payments to the consumer the dates of 10/12/15, 10/14/and 12/12/All funds have been accepted by [redacted] If any further mediation is necessary, the merchant will happily comply.?

The merchant responded to the customer, clarified the contest rules explicitly and as a one time exception we credited the customer with the $refund they desiredPlease confirm that this is an amicable? resolution for the customer.?

The consumers account was funded by three separate individualsPer our multi funding policies, only one person may fund an individual accountUpon a violation of these Multi Funding policies, the merchant requests identification of all of those who deposited on the accountThis practice is to ensure that there has been no fraudulent activity on the accountOnce the three individuals have sent in the requested information, the account will be reinstatedThe merchant has refunded the deposit total of the customer in full, ensuring the customer is not at a net lossAny additional winnings can be withdrawn after the account has been verified by all depositors.?

The consumer has failed to read any email the merchant has providedThe conusmer has contacted our support staff several times and each reply states the following:? As the consumer failed to reply directly to each email they received they did not receive a direct responseThey continued to send new emails in and reeive the same email and their lack of attentiveness to the email sent by merchant, led to a non-response (due to their error).? The consumer currently has a cash balance of $in their accountThey could have simply withdrawn the funds by going to their My Account page, clicking the Withdrawal tab and submitting a withdrawal requestAs the consumer has not realized they can perform this action without contacting our support staff, we have taken the? liberty? of doing so for himWe have submitted a $refund request for the consumer and they will receive a confirmation from our Accounting Department once the request has been processedThe confirmation code for the refund request is? [redacted] and the consumer must allow 2-business days for the funds to post back to their respective account.?

As a threshold matter, DraftKings’ response to your letter in no way waives its contractual right, pursuant to its terms of use, that the consumer must pursue his claims in a binding, non-class arbitration in Massachusetts.?
