As a threshold matter, DraftKings’ response to your letter
in no way waives its contractual right, pursuant to its terms of use, that the consumer must pursue his claims in a binding, non-class arbitration in
Massachusetts. While an arbitral forum
would be the appropriate forum to hear the
consumer's claims, in fact, these claims
are meritless and should not proceed in any forum. His complaint fails to tie DraftKings’
alleged conduct to any harm he supposedly suffered. Nevertheless, and without waiving any of the
foregoing, DraftKings provides the following response to your complaint. SCORING REVISIONSDuring each game, DraftKings receives live scoring updates from our stats provider, *** ***After the game has concluded, DraftKings receives a final box score, which will be used to calculate the results of each contestHowever, the leagues and stats provider will occasionally revise box scores after the final box score has been releasedIn the event this occurs, the player scores on DraftKings will not be updated and the settlements will not be revisedNote that this is not the same situation as a case where a correction needs to be made after settlement due to a bug or issue with the data feed or the settlement processIn these cases the settlement process (including payment) may be reversed and redone correctly.PAYOUTSDraftKings will wait until all of the final box scores have been reported for each contest's games to ensure that the final results are accurateOur statistics provider, *** *** will occasionally make revisions to final box scores that correct statistics published live during the gamesIn those cases, payouts will be based on the final box scores, not the box scores published during live gamesIf revisions are made after the final box scores are published, payouts will not be reversed or changedIf there is difficulty obtaining official results or issues with scoring, the contest may be settled the following day or whenever the final box scores are initially published

The local post office said that any undelivered check is sent back to the original sender, and is "not a priority" Due to this, they explained that it may take an elongated period of time to reach you (since your checks are sent from Canada) I'm requesting Draft Kings to place a stop on this check, and reissue a new check in it's place This will absolutely resolve the issue Thank you .

Good morning,Again after 20+ inquiries, all of which they refuse and reject to communicate person-to-person, they ignore *** ***'s Fraud report and request for explanation of why there were two (2) account numbers being drawn from inside DraftKings They continue to demand that I drop my complaint and prove it to them in writingThe Bank requested I close the account immediately, monitor my credit and destroy my debit card, which I did This group is passive aggressive in how they have treated me as a customer Moreover, when fraud is suspected and a company is alerted to it by the Fraud Department of a major bank, most businesses would quickly act and respond to their paying customer This group has attempted to dismiss, accuse and intimidate me I have no interest in continuing to have an account with this company I hope to obtain the digital record of what they did with the funds and games they seized from meThe bank records of unauthorized "recurring" withdrawals (from within DraftKings) and additional the account number were not something they could keep from me When this group provides me with a full accounting of every transaction that occurred (after they froze me out of my account without warning), an explanation of the second account number and "recurring" unauthorized withdrawals, I will be satisfied (assuming there was no violation of law)

"Authorized Account Holder" is defined as the natural person years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address for registration on the WebsiteBy inputting a payment method to participate in real money contests, the Authorized Account Holder hereby affirms that the Authorized Account Holder is the lawful owner of the payment method account used to make any deposit(s) on the WebsiteIt shall be a violation of these Terms of Use for any Authorized Account Holder to submit payment using any payment method that is not owned by the Authorized Account HolderDespite several requests to provide information to the merchant we did not receive the requested information to verify the consumer account. To amicably resolve the matter between the consumer and merchant, at this time we have closed the said account and we will be issuing a refund for the remaining $in the accountThe consumer will receive a confirmation email from our Accounting Department once the refund request has been processedThe consumer can then expect their funds to post back to the deposit source(s) within 2-business days.

The consumer was instructed by our support staff how to add their physical address to their account and submit a withdrawal requestThe consumer's withdrawal request is currently on hold for processing as they submitted it outside of our Accounting business hours. Our Accounting
Department processes withdrawals Monday - Friday from AM-PMAny withdrawal requests that come in after PM on Friday will be processed in the order that they were received starting the following Monday. Once our Accounting Department processes your withdrawal request (you'll receive a confirmation email), it typically takes anywhere from 2-business days for your funds to appear in your accountIf you request a check it can take up to two weeks to receive.

My issue was resolved for which I had filed a complaint on 10/05/15my complaint # was ***

The consumers account has been deleted and they will no longer receive promotional emails from the merchant.

We appreciate the feedback in regards to our policies and how they can be best handled in the future, within our regulatory obligationAs a final make-good, we are willing to provide the customer with DK Dollars which can be used for play on the site but is non-withdrawablePlease let us know if this resolution is satisfactory.
