Member claiming only has a fitness account looking at the personal training agreement the member has used sessionsHad the member not been aware of the personal training agreement why were sessions used? All documents for the personal training are signed initialedMember has talked with the member service team a few times wanting to cancel the accountWe will waive the $transfer or relocation fee

We talked to the member 8/31/15, we do show the member did talk to the front desk 7/27/member was informed that the account was past dueThe member informed the front desk she will have to pay next time because she die not bring her cardThe membership would not have been able to be cancelled until the past due amount was brought currentWhen the member talked to us 8/31/we processed the cancellation and waived the days so the member is not drafted again?

We strive to make sure all our members are aware of any additional fees that would be charged, I apologize if you were not aware of our Rate Guarantee Fee, we do have you initial on your agreement for this rate, its posted in all our facilities and also included with your welcome letterThis fee is charged on your 3rd payment looking over your payment history your first fee was drafted 3/17/once this charge processes the fee is charged annually after this was 3/17/Looking at the notes on the account you did call in 3/18/asking the same question at this point our billing company made you aware of what the charge was

The membership is good until 2/14/to use the sessions The notes indicate the member stating she wanted a refund due to a medical injury or relocation The injury was not done by or at VASA Fitness and we have nothing to indicate this remark The member has sessions available to use after she is well and/or transfer them to another member We have made note that the transfer fee has been waived The contract does not have a medical clause, but the month extension of time is reflected which is the date of 2/14/Thank you

Complaint: [redacted] I am rejecting this response because:When I called and spoke with Shaq via phone I asked very specifically if there were any enrollment or miscellaneous fees on top of the $per month because I was just looking for a quick 3-month summer break solution for my daughterHe said no, so I drove right into the gym to sign my daughter upWhen I arrived, I was told that he misrepresented those facts and that there was indeed a $enrollment fee, a $facility fee in the 2nd month and a $termination fee if I cancelled my "month to month" membership before months was up Sincerely, Justin D***

***, On 5/15/we attempted to draft your May payment for the amount of $this was your monthly dues of $+ $for the yearly rate guarantee fee as listed in the signed agreement the first time it is applied is days into the membershipIt is then applied annually after that.Our rate-guarantee fee locks in your rate so that you do not have to pay more even if our rates increase in the futureAs long at this payment is paid annually, you can relax and enjoy our low prices and gymsWhen this payment declined on your billing date a return fee of $was added to the accountOur billing company processes retry payments through out the month to bring delinquent accounts current, this did include the full balance owing as of 5/19/As a courtesy we can refund the $back to your cardThis typically takes 5-business daysLet me know if you have any questions, have a wonderful day!

The cancel fee was paid and the fitness membership was cancelledThe personal training agreement is separate this agreement was for month termTo cancel the personal training the member need to follow the cancellation process, relocation or transfer with $cancellation feeI have attached a copy of both the Fitness and Personal Training agreements for review
