[redacted] , I have attached a copy of the signed agreement for your records, our contracts are electronic and the gym would not have printed a copy off for you at the point of sale but you would have received a copy to the email provided at sign upThe first page is a breakdown of the payments, amount and length of the contractThe second page is the the rules and regulations including the terms for early terminationYou agreed to make biweekly payments of $ starting 12/30/The agreement would go into month to month renewal as of 5/19/17, this would have made your final contractual payment scheduled on 5/5/When the payment was then disputed by your credit card company our billing company kept attempting to collect this payment through retriesTo date you were written off for the final contractual payment of $and a return fee for the payments being declined by your credit card companyAny balance added by the collection agency after write off on 10/2/is not accounted for in our officeAs stated before we will be happy to settle the debt for only the $as stated owed in the contract provided.In regards to your final question I did reach out to the manager you would have spoken to and she did confirm that the account would be canceled after the contractual portion had ended, the only reason this continued to bill you after those conversations is because we were attempting to collect the final and 9th payment owedThe account did not go to collections for anything more that was agreed upon at the point of saleThe accounts month to month renewal was canceled as told to you by the Bountiful managerPlease let me know if you have any more questions

Looking at the agreement it is showing there would be a $cancellation feeas a courtesy the rep had waived it to $with your proof of relocationThere was not violation of the agreement and the repdid try and help and resolve?

Complaint: [redacted] I am rejecting this response because: Though it is fine that they are offering to back date the cancellation and waive the late fee of $25, I do appreciate that but this does not quite fix the problem nor does it protect anyone from this happening againThe business states that the contracts are done online, but I went into the gym physically to set it up and did not do anything onlineAlso this contract that I allegedly signed state that the monthly charge is $per month but yet my credit card was charged as follows.04/29/15=$42.7305/29/15=$21.3606/30/15=$63.0308/01/15=$88.0308/08/15=$46... comes to a total of $261.51, but yet if we go to the back dating of 8/27/that is only months of membership which should equal $I was greatly overchargedI was mislead and the charges were never consistentI highly doubt I am the only person this has happened to I will agree to their terms of back dating to 8/27/even tho I cancelled on 06/27/but I still should be refunded the difference I was overcharged equaling to an amount of $ Sincerely, [redacted]

***, It looks like you signed up on different agreements, one was for a month to month membershipsThese are the charges you are seeing for $The enrollment fee of $was waived for you on this membership but you were responsible for the first monthly duesThe 2nd
agreement was for the fitness training, this contract was for biweekly payments of $Based on the signed agreement we have with you, this was not a trialYou would have had the first business days to cancel the training agreementAfter the days the contract is then in term for the payments. We did place a hold on the personal training account in December while we were looking into the claims your wife had made about the point saleThis was only applying to your training not the month to month membershipTo resolve the matter we will close the account a $cancellation fee for the personal training and $cancellation fee for the membershipLet me know if you have any questions

I am rejecting this response because:I deserve a refund regarding my ex-wife being on my account after I went into the gym in
the brickyard and paid the cancellation feeI added her to my account I gave the gym her information and they added her to itI was solely responsible for the financial portion of her paymentsThe gym told me in person all I had to do was pay the early termination fee of $before the six month periodI am now out $that shouldn't been taken out of my account for the last nine monthsThis is unacceptable business practice

The conversation with paramount and the mother was they were calling for the member was told that she would tell the member.Several attempts were made to get in contact with the member to resolve the past due.We will waive the $cancellation fee but the past due amount will need to be paid
