order to address this merchant concerns we have reviewed their account notations,
communications and agreements
On
09/19/at 1:PM PST merchant downloaded our Mobile Application Smartswipe,
and applied and completed application on 9/19/at 1:PM PST for the
services in question
without speaking to a representativeMobile App requests
pertinent information to be entered in prior to application submission, these
steps include but are not limited to

Our
application process is very clear, concise and requires acceptance by the
applicant in each step of the process, the final step is a set of terms, this
section provides all important details in regard to the terms, conditions,
pricing and structures for each respective applicationAll items listed in
question via the complaint detail is available at that point and view-able
prior to acceptance of the terms listed in our agreementsThere is full and
complete disclosure included with all of our applications. Application was

Despite the inaccuracies of the detailed complaint Merchant Account Solutions
agrees to close the account as a courtesy to their misunderstanding of the
terms and conditions they agreed to for the services they requested, we will
release the merchants financial responsibility from their month contract and
cover their Termination fees of $ANY fees accumulated during the active
state are valid as merchant has used the services providedIn addition
Merchant Account Solutions will not pursue to file any reports of the merchants
emotional, life threats and defamation they have done to our employees and our
company during the time we were trying to assist with their confusion

As Stated by the Business. This merchant concerns are they were not provided with equipment according to their last response nor agreement copies, please find below tracking information where the original equipment was delivered on 07/24/then returned on 09/09/15, merchant had equipment in their possession for almost months before deciding to state they never received itAlso agreement copies were also mailed out during the inception of the servicesMerchant Account Solutions has provided the merchant with the services they requestedMerchant proceeded to install the mobile application on 07/21/and did a test transactionMerchant called in September wanting to discontinue their service and was offered to cut their monthly service fees by 55% and reduce the agreement of months to month, which releases them from 66% of the financial responsibility of a year agreementMerchant agreedThe merchant is able to process credit cards as form of payment via the mobile application they have installed without needing the additional free mobile swiper by manually entering card holders information Best Regards, ** ** Operations Manager

Merchant Account Solutions gave NO customer service to me through this processIf MrHerrera would have just answered my questions back in July 2015, which would have taken him less than a minute, then we would not be in this situationHe stated that he did not see my emails, but good businesses know to check their junk mailThere were no issues with previous emails between him and I, so I do not know why my emails starting hitting his junk mailAnd, all he would have had to do was email me a message like, "you are being charged an early termination fee - see the terms on your contract." In addition, just because that the terms stated that there would be an early termination fee, there are some companies that will negotiate terms with customersThis is also why I was trying to get an answer from MrHerrera, as maybe we could have worked something out to reduce the fees, or bring my credit card fees down, so I could keep an account with Merchant Account SolutionsEven after not getting any responses from MrHerrera, I faxed the closure paperwork to Merchant Account Solutions on 10/1/15, and I also sent copies of my emails to MrHerrera, along with this faxI waited for a response from the company for approval to return the terminal, again as the closure form states "This request will not be effective until the required documents are provided an approved." But, the company continued to charge feesOn 11/2/15, I emailed MrHerrera again, and he answered this email, I believe because I may have to go to the Revdex.com to get this resolvedHe said that I would be charged an early termination fee and to mail the terminal backSo, I sent the terminal back to the company on 11/3/Yet, I still continued to be charged $per month in December, and the annual fee that I had recently been charged of $I emailed MrHerrera on 12/13/to ask why I was continuing to get charged fees - as during this entire process, I was charged $430, while the terminal just sat waiting to be returned to the companyAgain, no response from MrHerreraSo, I contacted the Revdex.com on 12/16/My account was closed shortly after this claim.I think that it is only fair that Merchant Account Solutions credit $toward the early termination feeThe credit card terminal was just sitting and not being used while I was trying to work with the companyAll I ask is for fair customer service - nothing moreI think my request is very reasonable

I am rejecting this response because:Card reader was returned by UPS unopenedNever usedI realize that I completed an application, but thought I was dealing with a different company - SquareI have no use for the services of this company and would like to terminate any arrangementWhen I realized it was a mistake within minutes of speaking to them, they said too bad. No money will be sent to them to end this contractI was within my rights to cancel within days and they denied this request

equipment was also provided free of cost per the terms of the merchant account
agreement that was requestedMerchant proceeded to complete the installation
process and ran a test transaction for $0.02, services have been installed and
used

desired settlement cannot be granted just because the merchant failed to read
the terms providedThis mistake costs our company application fees, licensing
fees and activation feesAll information pertaining to the services requested
were available to readDue to the merchant’s misunderstanding as a courtesy we
will cover the remaining of a month contract as well as all their
termination fees totaling $In order to grant this, merchant must
return equipment provided in good and working condition to the address listed
belowNo refunds will be issued as the account was requested, services
rendered, installed and usedAccount will be closed as soon as equipment is
received, please retain any tracking information for your records, any fees

After reviewing this merchants account notations, communications and agreementMerchant requested service by downloading our mobile application Credit Card Reader available through the Google Play Store for download for freeMerchant was contacted by our representative and advised to complete and
online application in order to complete activation and for equipment to be sent out, merchant was also advised to read through application before agreeing to termsMerchant completed application and agreed to terms and conditions via digital signature embedded with their IP Address **.**Within those terms any and all service fees where listed and available to save and retain, also a welcome packet was mailed which included a CD with the Merchant Services Program Guide (Terms and Conditions)In order to address the merchants desired resolutions as a courtesy for the merchant not reading the terms provided we will waive termination fees and agreement as long as the merchant returns equipment provided EPN(2) SN: 3*** and SN: 2*** to the address listed below. As previously stated Merchant Account Solutions has waived 1($350) of termination fees as a courtesy to the merchant not understanding the terms and conditions provided(online application and hard copy mailed) for services they requested, we provided and merchant installedAny other fees are valid per agreement providedMerchant requested services, provided all information for merchant application including but not limited to personal information such as social security number and bank account information and proceeded to sign agreement online, digital signature captured is embedded with IP address previously providedDates provided on agreements are the dates the agreements commenced (when account was assigned a merchant ID and associated account numbers)

I am rejecting this response because: The business's response is inaccurate The following is what transpired in this matter: On 10/21/2015, we contacted the business by phone to close our account with the business We were instructed to fax the closure request form and to return the equipment The form was faxed to the business on 10/21/2015, the equipment was packed along with a second copy of the closure form and was picked up by USPS on 10/22/ Now, it takes about five minutes, tops, to receive a one page fax The equipment, with the closure form in the box, was delivered to the business on 10/24/2015, verifiable by tracking number *** *** *** *** *** **, So, the business's statement that they did not receive the form until 10/27/without the equipment is totally inaccurate They received a copy of the form on 10/21/by fax and another copy along with the equipment on 10/24/ We can supply paper work to verify this statement if necessary We should not have been billed for anything in the month of November We are due a refund

I am rejecting this response because:I'm strongly disagree with their response Prior to P*** calling me from the month of February to July my company had a monthly average of $sales Why would I agree to work with a company that would take half of my sales in fees Your senior account representative NEVER took the time to advised or explained about monthly fees, early termination penalties, number of accounts, another account for processing by gateway, or length of contract When I finally got him on the phone he blatantly lied about our conversation that is why he said he would contact his manager to see about cancelling the contract with out any fees Which he never called back He committed fraud and I don't think your company should get anymore of my hard earn money for fraudulent contract I want all accounts closed immediately

I do not agree with the response from Merchant Account SolutionsMerchant Account solutions has not addressed the reason why they are taking $from my checking account every monthI clearly have not agreed to pay $per month, if anything should be paid to Merchant Account Solutions it is $per month I also contacted Ipayment regarding the cancelled account and the account was closed because they do not do business with insurance companies , all insurance companies pose a security riskThe account with ipayment was not closed due to fraudulent activity and I attached the letter from ipayment that shows why the account was cancelledMerchant Account Solutions is clearly telling people thay can get a credit card processing account for $per month and then going ahead and charging them more than the $and when you call to cancel the account they tell you that you are signed up for three years and it is probably cheaper to just pay the monthly fee
I believe I should receive a refund for the all of the monthly charges of $
Merchant Account Solutions has not provided a contract that I signed stating that I agreed to pay the fees I was charged
Please refund me the charges of $and close the account
