Thank you for looking into this matter, but Bay view has not sent a paid balance letter or zero the account out on their website. Due to this error I have lost a substantial amount of money , as it relates to getting a home loan, that was denied.

1) Company did not apply mortgage payments for multiple months during year 2018/2019 and reported to the credit bureau as being late 2) Company did not implement a Harvey Disaster Relief program offered by the State of Texas in a timely manner3) Company had to be called 100s of times from July 2018 to the present to 1) implement the State Program started and transferred from Chase Mortgage; 2) Company to apply monthly mortgage payments to loan and escrow on a monthly basis from July 2018 to February XXXX X) Company after repeated calls to act on correcting (calls on every Monday of every week) which my account was finally assigned to *** #(520) 239-5622 - *** only returned one phone call in over 14 months of calling... Company does not return phone calls 4) Company needs to clear my credit on all credit bureau agency from when they bought my mortgage from Chase in July 2018 to present 5) I have multiple phone recordings, multiple correspondence/statements reporting the billing or collection issues with Company 6) Proof of all monthly payments from Chase Checking to Company after Mortgage Services were bought by Company, that all payments were made in full, including and not limit to, their missed management monthly ledger, escrow and mortgage payments; in addition to, chase mortgage hand over paperwork for the Harvey Relief Program that was not followed and/or implemented for several months after July 2018 when the Company began receiving mortgage payments for my property. Total mismanaged my account from day one and now will not report monthly payments to the credit bureau... Records show... 1st call to Company was on July 11, 2018, and the last call to Company(*** was November 18, 2019, and the Company still miss manages my mortgage services

1. Mr. states that "company" did not apply mortgage payments for multiple months during years 2018/2019, and reported the missed installments to the credit bureaus as late.
2. Mr. states that "company" did not implement a Harvey Disaster Relief program offered by the State of Texas in a timely manner and he called "company" hundreds of times from July 2018 to present to implement the state program started by Chase prior to the transfer of his loan to Bayview.
3. Mr. states that all payments were remitted timely; however, Bayview has mismanaged his account.
4. Mr. is requesting that Bayview submit a credit adjustment from July 2018 to present.
Below we have provided a response to each of *** A. ***'s concerns.

To address all items above:
Based on a review of Mr. account, our records indicate that Bayview acquired the servicing of his loan on July 2, 2018, from JPMorgan Chase Bank, N.A. ("Chase"). At the time Mr. loan was transferred to Bayview, his account was due for the October 1, 2017, installment and all subsequent payments, fees, and costs incurred.
A review of The Federal Emergency Management Agency ("FEMA") disaster web site indicates that a Major Disaster Declaration was issued for the county in which Mr. lives (Harris) on August 25, 2017, due to Hurricane Harvey. Additionally, the FEMA site references a disaster period of August 23, 2017 through September 15, 2017.
On September 11, 2017, Chase issued Mr. the enclosed correspondence seeking his confirmation that he wished to receive payment assistance through the disaster relief program which would be in place until March 11, 2018. Under this program, Mr. would receive the following benefits:
He would receive monthly statements, but was not required to make monthly payments; however, he was encouraged to still pay some amount each month, even if it was not a full payment.
Late payments would not be reported to the credit reporting agencies.
Late charges would not be assessed.
Any automatic monthly mortgage payment service would be cancelled to ensure payments were not drafted.
At the conclusion of the program, Mr. would be required to bring his loan up to date or work with his Servicer on another repayment option.
On November 3, 2017, Chase issued Mr. the enclosed mortgage assistance application requesting that he complete the Request for Mortgage Assistance ("RMA") form and return it along with all supporting documentation by November 18, 2017. Mr. returned the completed RMA on November 14, 2017.
On November 17, 2017, Chase issued Mr. the enclosed notification which advised him that although his application for assistance had been received, additional document ion was needed to determine his eligibility for an assistance option. Specifically, Chase requested that Mr. provide copies of documents verifying the income for each borrower.
On December 15, 2017, Chase issued Mr. the enclosed correspondence advising him that the assistance period offered as part of his disaster relief was scheduled to end on March 31, 2018, and he would be required to resume making payments of $3,280.54 following the original terms of his loan on April 1, 2018. Additionally, Chase advised that if Mr. was unable to resume making payments,

they would extend the maturity date of his Note by the number of outstanding payments owed, bringing his account up to date. To accept this offer, Mr. was required to remit three (3) consecutive monthly payments of $3,280.54 beginning January 1, 2018 through March 1, 2018.
On January 25, 2018, Chase issued Mr. the enclosed notice which advised that his request for mortgage assistance had been cancelled so that he could take advantage of the assistance being provided through the disaster relief program.
On February 15, 2018, Chase issued Mr. the enclosed correspondence advising him that the assistance period offered as part of his disaster relief was scheduled to end on March 31, 2018, and he would be required to resume making payments of $3,280.54 following the original terms of his loan on April 1, 2018. Additionally, Chase advised Mr. that if he was unable to resume making payments, they would extend the maturity date of his Note by the number of outstanding payments owed, bringing his account up to date. To accept this offer, Mr. was required to remit three (3) consecutive monthly payments of $3,280.54 beginning March 1, 2018 through *** 1, 2018.
On April 28, 2018, Chase issued Mr. the enclosed mortgage assistance application requesting that he complete the Request for Mortgage Assistance ("RMA") form and return it along with all supporting documentation by *** 13, 2018.
On *** 14, 2018, Chase issued Mr. the enclosed mortgage assistance application requesting that he complete the Request for Mortgage Assistance ("RMA") form and return it along with all supporting documentation by *** 29, 2018.
On June 6, 2018, Chase issued Mr. the enclosed correspondence advising him that his mortgage assistance through the disaster relief program would be extended until September 30, 2018. At the conclusion of the program, Mr. would be required to bring his loan up to date or work with his Servicer on another repayment option.
On June 8, 2018, Chase issued Mr. the enclosed correspondence advising him that the assistance period offered as part of his disaster relief was scheduled to end on September 30, 2018. Additionally, Chase advised Mr. that if he was unable to resume making payments, they would extend the maturity date of his Note by the number of outstanding payments owed, bringing his account up to date. To accept this offer, Mr. was required to remit three (3) consecutive monthly payments of $3,280.54 beginning July 1, 2018 through September 1, 2018.
A review of Mr. loan payment history confirms that he was able to remit the required plan payments timely. As such, Bayview issued Mr. the enclosed Loan Adjustment Agreement on November 26, 2018.
Bayview began reporting Mr. loan to the credit reporting agencies on August 5, 2018, and report his loan as "no status" for the August 5, and September 5, 2018, reporting cycles due to the payment plan agreement. A credit correction was issued by Bayview for the October 5, November 5, and December 5, 2018 cycles to report his loan as "current".

Additionally, Bayview submitted a credit correction on August 7, 2019, to report the April 5, 2019, credit cycle as "current" as it was previously reported as 30 days delinquent.
Bayview reports to the major credit bureaus on a monthly basis and understands the importance of maintaining accurate credit reporting for all of our customers. Loans are reported as delinquent when a monthly mortgage installment is not paid within the month due. Please be informed, the processing of this credit correction is solely controlled by the credit bureaus. Therefore, we are unable to provide Mr. with the date that the credit bureaus will update their records. However, Mr. should keep this letter for his records while this correction is pending as evidence that the months in question should not have an adverse impact on his credit rating.
As it relates to Mr. assertion that Bayview did not apply multiple payments to his mortgage loan in 2018 and 2019, we believe this statement to be vague and unsubstantiated. If Mr. has supporting evidence that specific payments were not applied to his loan, or were not applied timely, we encourage him to provide that documentation for further review.

I am in receipt of the Bayview Loan Service response from Ryan Fortenbury.

Revdex.com Representatives please be informed:

Mr *** Fortenbury's response to this matter is grossly inadequate, late and NOT acceptable.

1) The documents sent to Bayview Loan Service via Chase are correct. These dates are NOT in question nor is Chase Bank. I might add, this program would have been implemented by Chase and completed September 2018 if Bayview Loan Services had not purchased the Services of my loan from Chase Bank.
2) Bayview Loan Services DID NOT act on these documents submitted by Chase and/or where even aware of their existence until weekly/monthly phone conversations mid October 2018 to force someone to do their job.
3) After weekly calls starting in July 2018 to present December 2019 (most made on Monday & all recorded), WAS THE ONLY WAY TO CONDUCT BUSY with Bayview Loan Services. BAYVIEW LOAN SERVICES DO NOT RETURN PHONE CALLS... PERIOD... NOT JUST ONCE, NOT TWICE BUT, FOR PERIOD OF OVER A YEAR. I DO have the frequency of the phone calls and recorded voice conversation to support this claim.
4) I have attached the Sept 2018 statement for a direct example of Bayview Loans Services gross negligent accounting practices. Keep in mind, NOTHING... NOTHING, NO ACTION was taken in regards to my account until the month of November 2018. I heard apology after apology and that someone was assigned to my account and was never called back and/or never support to my concerns.
5) I have Chase Bank records of all payments sent to Bayview Loan Services. I have ALL of Bayview Loan Services monthly statements, some times 3-4 per month, statements which reflect the grossly negligence on posting payments to my account properly.
4) I agree the transferred program from Chase to Bayview Loan Services DID end on Sept 2018 based on Chase dates and NOT based on Bayview Loans Services records. Bayview Loan Services did not know what to do and/or implemented the program for months (apologized numerous times and on a recorded line of making a mistake). I continued to call weekly to get Bayview Loan Services to implement the program sent via Chase. After weekly calls, and some time daily calls at this point, (phone records to support this claim),
5) Mid February, *** ph: (XXX) XXX-XXXX was assigned to my account. She was a very pleasant person to talk to but, I still required the action due on receipt of my account on July 2018. Keep in mind, Bayview was still reporting my account 30, 60, 90 days late to all three Credit Bureaus at their own accounting errors with ALL my on time monthly payments sent from July 2018 to the present December 2019 (Chase Bank Records to support this claim) & (the abrasive communication channels to conduct business via Bayview Loan Services.

7) Please find attached, Bayview Loan Services monthly statements for July 2018 and June 2019 for an example of Bayview Loan Services gross negligent and accounting practices (all statements can be accessed upon request).
8) I request an Immediate credit and/or an explanation of the charge:
a) July 2018 Statement charge of $101.00 (Rec. Corp Advance Balance)
b) July 2018 Statement charge of $75.00 (Fees & Charges)
c) June 2019 Statement charge of $98.48 & $75.00 (both the $75.00 and $98.48 are stated as Past Due/Fees Amount)

Bayview Loan Services purchased my loan July 2018. Their accounting practices and lack of support of my account give me not reason to trust them and/or to have them correct their own accounting problems them selves after hours, hours, months, months of continuous calling to get them to do their job.

*** suggested on a phone call *** 2019 to dispute the incorrect report of my account to all three Credit Bureau Agency. All three Credit Bureaus were notified with all Chase Bank Records of Payments from July 2018 to *** 2019 and Bayview Loan Services denied the dispute and replied all report were correct.

I have requested my credit report for the 2019 year. The time and effort put into getting my account corrected since Bayview Loan Services has been a nightmare.

Mr *** response DOES NOT address the time spent in regards to Bayview Loan Services lack of service and/or time spent to rectify their gross accounting practices with my account.
Mr Fortenbury response just corrects the errors reported to the Credit Bureau so, this response will NOT be acceptable.

As stated in our prior correspondence, Bayview acquired the servicing of Mr. loan on July 2, 2018, from JP Morgan Chase Bank, N.A. ("Chase"). At the time Mr. loan was transferred to Bayview, his account was due for the October 1, 2017, installment and all subsequent payments, fees, and costs incurred.We are aware that Mr. received payment assistance through the disaster relief program due to Hurricane Harvey, and was ultimately offered an Extension Modification Agreement by Chase on June 8, 2018.To accept this offer, Mr. was required to remit three (3) consecutive monthly payments of$3,280.54 beginning July 1, 2018 through September 1, 2018.Mr. loan serviced transferred from Chase to Bayview during this trial payment period and was considered an "in-flight"loan modification agreement. We certainly apologize for any perceived delays or lack of communication Mr. *** have experienced during this period. Mr. Dotsonwas able to successfully complete all required plan payments and a Loan Adjustment Agreement was issued to him on November 26, 2018.Bayview began reporting Mr. loan to the credit reporting agencies on August 5, 2018, and report his loan as "no status" for the August 5, and September 5, 2018, reporting cycles due to the payment plan agreement. A credit correction was issued by Bayview for the October 5, November 5, and December 5,2018 cycles to report his loan as "current".Additionally, Bayview submitted a credit correction on August 7, 2019, to report the April 5, 2019, credit cycle as "current" as it was previously reported as 30 days delinquent.As it relates to the fees/charges present on Mr. monthly Mortgage Billing Statements, please be advised that Chase issued Mr. a statement dated *** 16, 2018, which showed his loan due for the October 1, 2017, installment and a corporate advance balance due of $60.00. At the time Mr. loan transferred from Chase to Bayview, an outstanding corporate advance balance of $75.00 was present on his loan. Please be informed that these fees were not assessed by Bayview, but represent property inspections fees performed in accordance with Mr. Note and Security Instrument due to the delinquent status of his loan. On July 24, 2018, Mr. was charged a property inspection fee of $11.00, bringing his recoverable corporate advance balance to $86.00. This assessment is evidenced on Mr. August 1, 2018, Mortgage Billing Statement (copy enclosed). On October 5, 2018, Mr. was charged a property inspection fee of $15.00, bringing his recoverable corporate advance balance to $101.00. This assessment is evidenced on Mr. November 16, 2018, Mortgage Billing Statement (copy enclosed).

1) Bayview Loan Services has a pattern of not posting mortgage payments properly (July 2018 to April 2019).
2) Bayview Loan Services has a pattern of reporting to the Revdex.com incorrect information. Loan purchased July 2018 and my credit report is still not corrected December 2019.
3) Bayview Loan Services says one thing on the phone, another in statements/correspondence and another with there online system.
3) THE ONLY REASON WE ARE AT THIS POINT TODAY, IS SIMPLY PUT... MY CALLS TO WEEKLY/MONTHLY/YEARLY BAYVIEW LOAN SERVICES TO GET THEM TO DO THEIR JOB.
4) There is no evidence Bayview Loan Services is reporting to the Revdex.com correct information as of December 2019. I had force all issues with them. Like I have said, Bayview Loan Services does not return phone calls.
5) Bayview Loan Services delay to act on my behave and post my payment incorrectly from July 2018 to April 2019 to my account caused problems that will be address at a later date.
6) To date, I have not received a satisfactory answer of why Bayview Loan Services spent so much of my personal time, miss managed posting payments and misreported my pay history to the Revdex.com.
7) Bayview Loan Services purchased my mortgage from Chase on July 2018 with the transfer of the hazard relief program that ended September 2018. Bayview Loan Services did not act on this transfer with multiple excuses (all on recorded).
8) Bayview Loan Services "in flight" loan comment is after the fact to cover up the negligence to service my *** NO ONE, NO ONE had an answer for my account, including but not limit to, *** Lecuro and Sergio Serrano).
9) The reason for reporting Bayview Loan Services to the Revdex.com and the State is because of the gross negligence to my account.
10) BEST EFFORTS?... There was not effort until making regular calls to get action. With the history of late and grossly negligent accounting practices with my account, the public needs to know. I DO NOT trust Bayview Loan Services accounting practices.

I submitted a hardship application on June 26 with Bayview for a deed-in-lieu of foreclosure. Since that time, I've sent numerous emails, left a number of voicemail messages and uploaded supporting documentation via fax, website and dedicated email box. I rarely receive a response from Bayview, and in the few times I do, the information is conflicting or flat-out incorrect.Bayview uses a single-point-of-contact (SPOC) process that prevents me from communicating with anyone else at the company. Recently, my SPOC changed for unknown reasons, and I'm getting less information/response than ever before. I have no way to escalate or expedite this issue.I am now on my third hardship/DIL application as the first two were declined because I did not have access to the account number of the second mortgage on the property, and Bayview was unwilling to assist in researching it. Once I found the account number, I promptly submitted it with my latest DIL application on September 3. My former SPOC communicated that the process was moving forward and their title company was negotiating the second mortgage/lien. My new SPOC is now telling me they never received the account number. However, she was able to produce it when I asked her to look at the documents submitted on September 3.I've been working on the DIL process for four months now and am incredibly frustrated with this process and the lack of response, urgency and respect. To make matters worse, I've been flooded with snail mail from Bayview that conflicts with the little information I'm getting from my new SPOC. Additionally, I've received a number of form letter mailings that have language like "(Insert customer condition/situation here.)" They don't even bother to update the letters.Lastly, I suspect there *** be some fraudulent behavior on behalf of Bayview. The original SPOC had an in-home appraisal completed for the property. It was valued at $255,000. The new SPOC ran an automated Black Knight appraisal that came back at $373,000. What's curious on the new appraisal is that of all the comps listed on the sheet, including identical homes in the neighborhood, none of them sold for more than $300,000. Why is this so far out of line? Are they trying to defraud an investor interested in purchasing the property?

Nonetheless, Bayview apologizes that Mr. feels that Bayview Representatives did not uphold the exemplary customer service standards for which Bayview strives, and thanks him for the feedback. However, a review of the account indicates that Bayview Representatives have been in frequent contact with Mr. and there have been multiple instances in which our attempts to reach Mr. were unsuccessful. Furthermore, our records indicate that Bayview has worked diligently to assist Mr. in reaching a foreclosure avoidance outcome.
To address item 4 above:
With regard to Mr. valuation dispute please be informed that a full interior appraisal is required for all liquidation request. Thank you for the feedback. Bayview alleges that information is missing. This is incorrect. I supplied the account number for the second mortgage on September 3, 2019. Once my SPOC changed, Bayview lost this information and stopped negotiating the second mortgage. It took almost two months for them to contact me to notify me of their error and start over.

Additionally, I just received a request to complete a hardship application for the 5/3 second mortgage on Nov 13, 2019, with a deadline of November 13, 2019. This was received around 4pm in the afternoon and is not an acceptable lead time for a form of this nature. Nevertheless, I completed the form on deadline and submitted both to Bayview and 5/3 bank (both via fax and loss mitigation email box). I have not received a response or confirmation to this submission.

My SPOC, ***, does not respond to emails and rarely returns voicemails. In the rare instance she does return a voicemail, she makes sure to call at a time she knows I will be unavailable.

I have been asking for a DIL for more than six months.

It is also important to point out that an in-home appraisal has already been completed, complete with interior and exterior pictures of the home. Why does Bayview need to perform a third appraisal? Additionally, they did not notify me of this need. Instead, I received a call from a third party asking to make an appointment.

Bayview does not respond to questions or provide a status on the process. I have asked my SPOC *** a number of times for an update and received nothing in response. My previous SPOC, ***, was a much better communicator and was actually pleasant to work with.

I also receive a number of mailings that do not explain what is needed. These mailings are form letters that have not been customized/updated to the customers' situation. I routinely receive things like "We cannot proceed with your request because insert customer situation or missing document here."

At this time, I do not know the status of the second mortgage negotiations. Nor do I know the next steps. I have asked to speak to someone else who will be more responsive than ***, but again, no response.

I'm at a loss as to how to proceed next. I've provided everything Bayview has asked for, but numerous times, months go by and they ask for the same, already-provided information.

Bottom line is Bayview is stonewalling me and will only allow me to talk to my SPOC. Unfortunately, my SPOC will not provide information, explain next steps, respond to emails or move the process along in a timely manner.

We refinanced our current mortgage our current bank The Peoples Community Bank requested a payoff, The first payoff total was ready to be paid when the bank received another payoff amount. When I called I was told that the difference was due to an escow shortage, we had to pay an approximately $1600, which made the entire tax escow complete. Our banker suggested we do a conference call since they were given different amounts, during the call we were told this was our only option to satisfy the loan and the entire escow account would be sent back to us. A week later when I called and asked for the total that would be sent I was told nothing would come back to us, the next call they said approximately $600. Far from the $3000 due. I called repeatedly since September 18 and every time I was given a different answer. Today the customer service was horrific, the woman I spoke with said that it was our choice to pay the amount in full and that we should have paid the first amount. Frustrated that no one knows what is going on and being accused. I said that your company if a bunch of @%$&^@& is. The competence of these individuals is lacking!!!!

Bayview Loan Servicing's response is really unbelievable. I have never experienced anything like this. I have been abused by this company and it's sad what they have done to me. Just a few things that they have done. This company has accused me of a felony and they have accused my Trustee of lying.

I am hopeful they will refund the money that they have taken from me and the money they are continuing to take from me through monthly loan payments.

I do not take from anyone and I do not lie on people. I don't think I am the only one that Bayview Loan Servicing are treating this way and this company needs to stop the practices that they are carrying out.

I feel the consumer should have rights just like any company or any organization. Consumers should be protected from this kind of behavior.

I am a law biding senior citizen, I am a retired school teacher and all I want is peace and not this kind of stuff.

All they need to do is settle up with me and I'm done with this company.

Additionally, please be informed that the statement dated *** 9, 2019, reflects the status of the account prior to the loan adjustment according to the terms of the Loan Modification Agreement effective *** 28, 2019 (copy enclosed), and as indicated on the Mortgage Statement dated July 11, 2019, enclosed with Ms. correspondence.
Further, a review of the account history indicates that there were multiple occasions in which payments were received late or not received, resulting in the accrual of delinquent interest and the assessment of applicable fees or costs and charges per the terms of the Mortgage dated February 1, 2008 (copy enclosed).
Our records indicate that this loan was previously modified under the terms of the Loan Modification Agreement effective October 16, 2015 (copy enclosed), in which the amount of $95,408.93, comprised of escrow advancements, expenses associated with the protection and/or enforcement of the lender's interest in the subject property, and delinquent interest was added to the loan. This brought the New Principal Balance to $316,561.52. Please note that $95,755.97 of the New Principal Balance was deferred, bringing the Interest-Bearing Principal Balance to $220,805.55.
Additionally, please note that the Deferred Principal Balance increased to $99,187.12 per the *** 28, 2019, Loan Modification Agreement referenced above, as Ms. had defaulted under the terms of the above-referenced October 16, 2015, Loan Modification Agreement and requested mortgage assistance.
With regard to the amount financed, please note that the original terms as outlined in the Note dated February 1, 2008 (copy enclosed), required three hundred fifty-nine (359) payments in the amount of $1,330.55 each (or $477,667.45) and one (1) final payment in the amount of $1,326.65, to repay the loan by the scheduled maturity date of February 1, 2038. At a yearly interest rate of 5.75%, this equates a total repayment amount of $478,994.10, providing that all payments are received timely.
To address item 3 above:

I realized in March that my Credit Score had dropped significantly. Once an inquiry was made into my credit report, I realized that I had numerous delinquent accounts from my mortgage company BayView Loan Servicing. My husband and I pay our mortgage on time so we were unclear as to how this was happening. After looking into it further, it was found that BayView had opened a second account in our names and without our knowledge and was charging us PMI on our house.My husband contacted BayView on numerous occasions and spoke to many different people in the company to try and resolve this issue to no avail. He found the people to be rude, incompetent, and not caring of our situation. After much time and energy, my husband did finally speak to someone who was able to explain the second account and confirm that BayView had in fact made a mistake and that they would take care of it. Well, after some time that did not happen. My husband finally had a lawyer write a letter and it wasnt until then that BayView took care of the problem and sent us our mortgage re modification which we signed and returned. The problem we are facing now is that my credit score is still much lower than what it was and that is due to many delinquencies that still appear on my credit report. I attempted calling BayView myself in order to have them contact the credit bureaus to have those delinquencies erased from my report and I like my husband got the run around and spoke to many rude people who were not willing to help. One supervisor told me she saw no record of a second account being opened or that bay view closed the account due to their error. Another person told me she could help but I would just need to show documentation that those delinquencies were in fact paid and then they could move forward. I tried explaining to her that those delinquencies were never paid because they never should have been charged in the first place. Again, I got nowhere.

I have read BayViews response and I continue to not be able to make sense of it or anything else for that matter. This company is beyond hideous and horrendous and I have read hundreds of similar complaints through the Consumer Affairs Website. My main issues at this time are as follows.
1. This company does not communicate via email, therefore, allowing for no documentation of conversations had so it essentially becomes a he said/she said case. My husband and I have each spoken to numerous people at Bayview, supervisors included and each time we get a different story and we are not able to request to speak to the same person as no one has any idea as to who anyone is.
2. My last conversation was with a representative named ***. She assured me she would be sending out a copy of our mortgage payment history as it is showing in her computer. No surprise, have yet to receive a copy and that was two weeks ago if not more.
3. This company has done severe damage to my credit to the point that it has crippled our family. We want answers. We pay our mortgage and it is mind blowing to us that we have deficiencies on our credit report for thousands of dollars owed when we pay thousands to Bayview monthly for our mortage. I feel helpless at this time. Like I stated previously, we have gotten a different story from every representative we have spoken with and again, nothing is communicated in print so its not like we can go back and say we have documentation that a rep from Bayview stated etc.
I am not going to let this issue go until I have the answers I need and until my credit is restored. It is extremely concerning to me that there are hundreds/if not thousands of other similar complaints about this company and the damage it has caused many people.

NATURE OF DISPUTE
Lost mortgage payoff check and refuse to close loan
Lakeview loan servicing was our mortgage provider at the time we sold our home in July 16th, 2019. Per the company's instructions, our title company sent a check via UPS for the total amount of the loan. On July 17th at 9:43am, an employee of Lakeview signed for the check according to UPS tracking.
On August 1st, Lakeview auto-debited our monthly mortgage payment claiming they never received a loan payoff. I spoke With customer service on five separate occasions over the course of the next month in an attempt to get this resolved. They have been unwilling to work with me and each time I call they apologize for the confusion and assure me it will be resolved tomorrow or next week, or some other arbitrary date. They refuse to give me a case number and have made no attempt to resolve this either by re-sending a check or providing wiring instructions.

Desired Outcome

DESIRED RESOLUTION Close out my mortgage loan and show it paid in full. Either cash the check that they signed for or provide alternate way to pay

I'm not sure how I got forwarded to Bayview. Unless they are another servicer for Lakeview? My complaint continues to be with loancare LLC and Lakeview. They have continued to pass *** buck and not admit fault and I believe that is how my complaint ended up with Bayview. I don't expect to get anywhere with this so I accept the response. If I don't have a resolution in the next month I will reopen a complaint with Lakeview/ Loancare.

balance reduction payment. Ms.' maximum Pay for Performance Incentive is $1,000.00 ($83.33/month).
The principal balance reduction is accrued monthly as long as Ms.' loan is current, and credited to her loans principal balance annually on the month following the anniversary date of her trial period plan.
Additionally, a $5,000.00 additional principal balance reduction will be applied the month after the sixth anniversary of the month in which the HAMP trial plan became effective as long as the loan is in good standing at the time the final incentive is paid.
Pursuant to the guidelines set forth by the investor/insurer of your loan, Bayview issued Ms. correspondence (copy enclosed) on June 19, 2019, which advised that in order for her to retain the incentives paid to date and continue to receive the incentives stated above related to the HAMP modification, we needed her to sign, date, and return the Dodd-Frank Certification. Our records confirm that Ms. provided the requested document (copy enclosed) on June 27, 2019.
Unfortunately, the receipt of Ms.' signed Dodd-Frank Certification letter inadvertently caused a system generated Request for Mortgage Assistance ("RMA") solicitation package to be issued to her on June 28, 2019. Our records reflect that a Bayview representative contacted Ms. on July 5, 2019, to explain these sequence of events to her in detail and advised that we would have the matter resolved.
On July 8, 2019, Bayview issued Ms. the enclosed retraction letter advising that the correspondence issued to her on June 28, 2019, contained incorrect information and was sent in error.
We greatly appreciate Ms. taking the time to bring this matter to our attention, and apologize for the confusion and frustration she experienced.

Submitted documentation via their website & fax to 305-644-8104 (tax dept) notifying Bayview that RE taxes aren't due for 2019. First submission was 5/25/19 & second 6/11/19; received fax confirmation for both. Additionally, received auto-emails @ 2:45 PM & 3:46 PM respectively confirming receipt and stating that a letter would be received. Neither letter came. Had process begun on 5/28/19, could've been effective on 7/1/19. Spoke with *** on 6/21/19 who claimed neither was received.....provided email address for resubmission. Nonreceipt seems very odd since one avenue was via their website's "Contact Us" process. If said process doesn't work, deactivate it and replace with the email address.Submitted via email immediately following call. Received "Acknowledgement Letter dated 6/27/19 with Proposed Resolution date of 8/5/19. This is NOT acceptable. Three submissions to get this taken care of is beyond ridiculous.

The monthly payment was adjusted from $3,094.76 to $2,467.40 effective with the July 1, 2019, monthly payment. Bayview will reach out to the County to find out if they will be providing a refund of the taxes paid for 2019. Unless the County provides a refund, Bayview is unable to disburse additional funds to the borrower.

Ms. states that taxes were paid in Nov. 2018. Per https://www.fairfaxcounty.gov/taxes/pay/due-dates the due dates are:

JULY 28
First installment real estate tax payment due.

DECEMBER 5
Second installment real estate tax payment due.

Every year, a Bayview provides a schedule that reflects the change in escrow due to tax increase. I assumed that had to be updated.

Again, customer service will not be contacted due to the reason stated previously, and there will be no acceptance of resolution until additional funds are received.

I received a insurance claim check from State Farm in the amount of $190,725.40. This check was made out to me and Bayview Loan Service. I endorsed the check and sent the check to Bayview so they couldendorse per their instructions. I sent the check certified mail and was received by them ***3,2019.They were to use the proceeds of this check to pay off the loan I have with them and send the remainder of the check to me. They sent me via email forms I needed to fill out and return with the check. I returned all information requested. I called them after about 14 days to find out the status of this transaction. They then informed me I needed to send them a email with a attachment stating that I wanted to pay off the loan with them and the balance forwarded to me. I sent a signed attachment to them *** 20,2019. They stated they never received the email although my computer shows it was received. My loan was not paid off until ***31, 2019 and with a different amount than what originally stated. I still have not received the balance of approx. $140,000.00. Bayview says that it has to go through a process.

Our records indicate that Mr. contacted Bayview on *** 9, 2019, and advised us that he had the insurance check in the amount of $190,725.40 and he would like to payoff the loan. We sent him the procedure package (copy enclosed) via email to ***1142@compcastet. Bayview also advised him to send in the signed claim check, adjuster's report and the owner's affidavit and once received it could take up to three (3) weeks to process. On *** 13, 2019, the claim check was received and sent to be deposited. On *** 16, 2019, Mr. called for the status and he was advised that we require a letter from him stating that he would like the loan paid off with the insurance proceeds. Mr. called again on *** 20, 2019, and he was again advised him that we are pending the letter from him which must be signed; this was received on *** 28, 2019 (copy enclosed). The loan was paid off on *** 29, 2019, Bayview began paying off the loan which was completed on *** 30, 2019. Mr. was sent a Payoff acknowledgement letter on *** 31, 2019 (copy enclosed) advising the borrower that any funds received in excess of the payoff amount and/or remaining escrow funds *** be forwarded to him twenty (20) business days from the payoff date. Please note that twenty business days from the payoff is June 27, 2019, and he *** receive the refund by that date if not before.
To address item 2 above:
Our records indicate that a Payoff Statement was generated on *** 1, 2019 (copy enclosed) which reflects a payoff in the amount of $51,592.91 good through *** 15, 2019. An updated Payoff Statement was generated on *** 29, 2019 (copy enclosed) with a payoff in the amount of $51,037.50 which is the same amount reflected on the Customer Account Activity Statement (copy enclosed) and less than the payoff amount provided on *** 1, 2019, resulting in a higher refund amount.
Bayview denies any wrongdoing with the processing of the claim check and payoff of the loan account as everything has been processed within the stated time frame. Also please note that these funds are from an insurance claim (restricted escrow) and are typically not used to pay any portion of the loan as these funds are required to be used to pay for the repairs of the property to protect our mutual interest; the subject property.

Bayview bought over my mortgage company, I never had trouble before. My house is not to be paid off until next October of 2020, but I have paid it off early. However now that it is paid off, they are claiming that I owe another $2000 in escrow, but they have 1116 dollars in unapplied funds that they have not dispersed and is just holding on to it. I have spoken to them several times and did not get anywhere. Now they are threatening to foreclose on my house for $2000.00

My complaint is with the mortgage company Bayview Loan Servicing customer service. The first issue is regarding the website, when it comes to making my payments on line, the website does not work correctly, creates errors and does not take your payments, it will state to try again, when you do it actually ends up debiting accounts twice, causing accounts to go negative. The Second issue is, such an incident happened again back on April 30th 2019 where Bayview debited my account for two payments which caused my account to go negative, I requested to put a stop on one of the payments a representative from Bayview suggested that I contact my bank to put the stop in which I did, my banking institution did their job and refunded my money back into my account. When I tried making my payment on line again for the month of May Bayview has created an issue by putting a flag on the account so that I cannot make my payment, and has stated that they are unable to remove the flag, I requested to speak with a supervisor and they stated that it would not do any good because a supervisor could not remove the flag either. Bayview than requested they needed a letter from my Bank authorizing to debit my account in order to process my payment. I got the letter from my bank as requested on May 25th which was faxed over by the bank Manager. On May 28th I contacted Bayview again to see if they got the letter, representative stated could not find any such letter, asked if the letter could be emailed, and representative stated yes, was given an email address (I was informed previously that email could not be done)When my conversation was complete, I proceeded to email Bayview and I had to go back to the bank and request it to be faxed again as well. Bottom line the customer service with Bayview is completely unacceptable and I have had to take time off and try to get this resolved with no avail. All Bayview seems to do is say they are sorry but unable to help me out, so in turn my payment is still not resolved.

Desired Outcome

Other (requires explanation) Management needs to review the account and do some research and see if they have received the faxes and emails that have been sent by me and my bank and contact me by email as to the results of the outcome and get this issue resolved. Management needs to look at their website issues and make sure there is no further errors making it more user friendly going forward. Management needs to be more customer oriented in helping out their customers instead of just saying sorry nothing we can do.

We can never get a straight answer from them. There is always a problem with the payment. We have even hired a lawyer and yet problems persist.
We have had problems with Bayview from day one. My name somehow got taken of the mortgage. My husband and I have the mortgage together. Sometimes I can speak with them other times not. We are always given the run around. People constantly are leaving and the paperwork always seems to disappear with the person. Every single month there is a new issue.

My Husband *** tried to talk with this company they gave him the run around. NACCA , OAKTREE LAW FAMI feels this company was causing of his death.
XXXXX and 2018 my husband *** went to Nacca in Pomona, They tried to talk with them about the house. Oak tree law tried to talk with them. They refuse to talk with him . Many times he tried to make payment the refused them. Family feels they were causing of his death. But because They refuse deal with the situation in professional matter . I worked in claims file investigation dept.at AAA. I know protocol. Very unprofessional. but after my Husband *** passed now they wanted to talk but they want the payment that he wanted to pay. They wanted a big lump sum of sixty to eighty six thousand dollars all of a sudden

Desired Outcome

COME TO A REASONABLE BILLING AGREEMENT. They were not trying to take his payment when he was alive. Why asked over and above the amount now amount now his gone. Oak tree law tried to talk with them . They didn't bother to hear them out either.

Bayview was informed 3 times by Legal Services and Court Order to convert to me as payee, They continually would not speak to me nor accept payments
8 phone calls required to get Bayview to acknowledge that I am paying the mortgage even though court ordered. They still would not communicate with me anf forced an Ilkegal auction to be scheduled even after the Courst order of the change of ownership and multiple requests to make payments to their Customer Service emails that were ignored. I had to retain and bear $5K in Legal expense to stop the auction. Then Bayview refused to accept 3 mortgage payments to an account at Chase Bank that they had given me. Then after I paid all fees and paymnents, next they claimed Insurance had lapsed causing me many more hours on the phone to resolve, and its still not resolved and they are changing $300 extra for lapsed insurance

Desired Outcome

Bayview should reverse all excess fees and charges. Bayview should pay my $5k of unnecessary Legal expenses Bayview should be required to improve their CRM immediately, or lose their ability to service mortgages

They say I am three payments behind. They refuse to provide proof. My records show I am a payment ahead. They are threatening foreclosure.

Bayview took over my mortgage March 1. They immediately say I am a payment behind. I call and they say I am two payments behind. I have been threatened with foreclosure even though I have made five payments since March 18. I have spoke with three agents, all of whom give me differing information. I have asked for proof of being late and they do not respond after numerous complaints. Last agent I managed to get on the phone said I was two payments behind, even though their own website shows me having made five payments. Plus they are adding outrageously high late payments.My latest threat of foreclosure came Friday March 26. My account number is XXXXXXX. Property address is RR4 Box *** Ms XXXXX Payment amount is 468.34 paid from Regions Bank and paid online every time but once. One payment was made directly to an agent on the phone.

Desired Outcome

I seek proper credit for payment or proof that am behind. My records show I am not late. I seek removal of outrageous late fees and cessation of letters threatening foreclosure.
