Almost 2 years ago we had damage done to our home in Illinois and we have been trying to get Bayview to return the insurance check to us so we do what we need to do. State Farm has had to cancel several checks because Bayview is holding the checks. We have overnighted the last check over 2 months ago and we endorsed it because we was told we had to so they could cash it and return it to us but we still haven't recieved the check back as of today. We can't get anybody to answer us as to why. They keep saying the need pictures of the home and the work done but we had a house fire over a year ago and the house was a total loss so we can't give them pictures which they was told about. We need to get the check back in our hands so we can pay off the bills that we have been putting off since we fixed the damage.

Desired Outcome

Other (requires explanation) To have the insurance check sent back to us.

We was never notified by any party that there was a mechanics lean but on our property and I have been in contact multiple times with bayview and different people and never has this been told to us. Bayview was never told who the contractor was that used for the repairs and no contract was ever signed between the contractor or us he always told us later. We was given 3 different bids and was told by state farm that it was up to us to pick and pay for the repairs. We have sent the check multiple times to bayview endorsed and they have not cashed them resulting in state farm reissuing them. We have no prove that a contractor was paid because nothing was ever sent to us. We was told the check would be returned to us so we could pay the proper people. I have talked to many different people and always get a different answer. We want the check returned to us so we can pay the bills that we have for the repairs on the home which was destroyed in a fire.

Harassing phone calls over last two months prior to grace period.
I have had this mortgage for over 5 years and never missed nor made any late payments. Beginning in March 2018 the company has started calling every day sometimes twice per day the very next day after the 1st of the month and during the grace period until my payment is received. As well, I am sending an additional amount. These are harassing phone calls during the week and on the weekend from just past 8:00 a.m.

In addition, I reach out to Bayview for deferment due to Hurricane Irma and all that was offered to me was six months with interest compounded and catch up amounts when resumed.

I also asked for a loan modification and was denied.

This company seems to be very predatory. Bayview has not been transparent enough and has deceived many customers who thought that they were receiving some sort of relief only to interest and late payment fees piled on.

Desired Outcome

Stop these harassing phone calls.

BAYVIEW(r)
LOAN
Below we have provided a response to each of *** and ***'s concerns in the order listed above.
To address item 1 above:
Our records indicate that the loan originated with PMI; enclosed please find the Notice Concerning Private Mortgage Insurance Initial Disclosure Fixed Rate Mortgages. As stated on the disclosure,
Borrower Requested Cancellation of PMI
You have the right to request that PMI be canceled on or after the following dates:
1. The date the principal balance of your loan is first scheduled to reach 80 percent of the original value
of the property. This date is February 1, 2018. For balloon loans with a fixed interest rate andno
conditional right to refinance, if applicable, this date *** not be reached before the loan matures.
2. The date the principal balance actually reaches 80 percent of the original value of the property.
"Original value" means the lesser of the contract sale price of the property or the appraised value of the property at the time the loan was closed. If this loan refinanced an existing loan secured by the property, "original value" means the appraised value relied on by the lender to approve this loan.
PMI will only be cancelled if all the following conditions are satisfied:
1. You submit a written request for cancellation;
2. You have a good payment history;
3. You are current on the payments required by your loan; and
4. We receive, if requested, and at your expense, evidence satisfactory to the holder of your loan that the value of the property has not declined below its original value, and certification that there are no subordinate lien on the property.
On January 10, 2019, Bayview sent the borrowers the Private Mortgage Insurance Disclosure notice (copy enclosed) which provided the borrowers with the above information. After receiving the request to cancel the PMI, the Notice of Grounds for Not Cancelling Private Mortgage Insurance was sent on January 15, 2019. Bayview was unable to cancel the PMI as the principal balance of the mortgage loan had not reached 80% of the original value of the property of the appraised value of the property at the time the loan was closed. The principal balance at the time was in the amount of $200,027.80 and the contract sales price was in the amount of $249,661.00; 80 percent would be $199,728.80. Please note that the loan was modified on July 1, 2010, which increased the principal balance (copy enclosed).
The loan was also denied for PMI cancellation on February 26, 2019, at that time was in the amount of $199,751.57. As the principal balance still had not reached less than $199, 728.80; Bayview was unable to review the loan for a possible PMI cancellation.

Ill LOAN SERVICING
As the principal balance had reached $199,488.84 which was below the 80 percent of the "original value" (contract sales price) Bayview could now review the loan for PMI cancellation eligibility. On April 2, 2019, the Appraisal Authorization and Sub-Lien Affidavit Required for Cancellation of Private Mortgage Insurance form was sent to the borrowers (copy enclosed). As stated on the form, we have received the request to cancel the PMI and determined that the loan reached 80 percent of the original value of the property.
The cancellation request cannot be processed until we are in receipt of the following:
Evidence that the value of the property has not declined below its original value, as determined by a current appraisal; and
Certification that there are no subordinate liens on the property, as verified on a signed and notarized Subordinate Lien Affidavit.
Upon completion of the appraiser's evaluation, the loan would be reviewed for cancellation eligibility. On April 22, 2019, the appraisal was completed (copy enclosed) with a value in the amount of $235,000.00. On *** 16, 2019, the Notice for Grounds Not Canceling Private Mortgage Insurance was sent to the borrowers (copy enclosed). A review of the loan determined that the requirements for cancellation of PMI under federal law were not met because: The appraisal has determined that the value of the property securing the loan has decreased from the original value of the property ($249,661.00). Per the PMI Disclosure, the loan is ineligible for PMI cancellation at this time.
Please be advised that Bayview reviewed the loan for possible PMI cancellation in accordance with the PMI Disclosure. We deny any wrongdoing with the servicing of the loan.

In November of 2016,I did a deed in Lieu on my former property with Bayview.Property was sold for $5000They have not taken the deed out of our name
I continue to receive letters from code enforcement, IRS for taxes owed, as well as water bills. We have not resided at the property in @ years and are no longer the owners. IRS, code enforcement or the water department will relinquish us of any obligation because of Bayview not transferring the deed. Ive called several times and each time, I'm transferred or handed off to the next person who can help. From lost mitigation dpt., asset management, customer service, and escalation. NO RESOLUTION. I discovered today that there is a law suit against them currently, I'm not the only unsatisfied customer. This has to be resolved code enforcement is threatening 5 days or we'll have to reimburse them for clearing the yards, IRS say we owe $900- and the water bills are piling up and we sold Bayview back the houes! PLEASE PLEASE HELP!!!

Desired Outcome

Name off the deed for myself and ex husband, documentation proving it, Credit restoration, direct contact to IRS for incorrect money owed

(The consumer indicated he/she DID NOT accept the response from the business.)
The date of November 15, 2017 IS NOT the correct date of when the Deed-in lieu was final It was November 15, 2016 not 2017. Any bills received after that IS NOT our responsibility. Property clean-up, water bill etc..

Also, to clarify, I HAVE contacted Bsyview several times in reference to the bills and as explained in the original complaint, I was shuffled around and never got anywhere, UNTIL I contacted Revdex.com. I could not get any further with either bill without my name being removed from the deed.
I have received the original contract, understand the tax liability as countable income, but only received $2'500, not the other $7'500.???/
Also, when will our names be removed and placed in the new buyers name?? I would like to be contacted when that is done.

Bayview will not respond to our Payoff Demand!!
Unfortunately, M&T Bank utilized Bayview Loan Servicing to oversee our mortgage loan. A quick Google search of Bayview will show thousands of complaints of their terrible business practices. We have sold our home and are scheduled to close tomorrow. Everything is now on hold because Bayview will not respond to our attorney's Payoff Demand!! We have been trying for weeks to get the payoff total. The absolute worst customer service I have ever seen. How are they in business?

Desired Outcome

Please send the Payoff Statement TODAY (April 2nd, 2018) so that we can sign the closing documents tomorrow (April 3rd, 2018) and pay off the mortgage loan in full.

I accept this response; however, it should not take 2.5 weeks, a Revdex.com Complaint, sending a Notice of Error, and hours of phone calls to provide a Payoff Statement. Terrible customer service; no one at Bayview has a clue how to bring customer requests to a resolution.

HOW ON EARTH does this company get a B+ rating when there are 3 positive reviews and a total of 344 customer complaints. Worst company ever... in my case I personally believe they are riding a very fine line of double dipping. Where they take my payments on my deceased mothers house and yet will turn around the same day and tell me they are making arrangements for foreclosure. I've never missed a payment since finding out they owned my mothers loan. Then I just found out the money I've been paying for what I believed was back payments, hasn't been applied whatsoever. Where is that money? There website just shows payments doesn't show what the previous balance was.... worst company ever that needs to be investigated. I hope they take me to court, because I'll be there and God forbid they get a judge who sees their practices as illegal in someway.... sending notices that I'm to sign within ten days, but arrives two days into the ten days I have to get it done. That's a sneaky tactic...so bring on court, you've accepted every payment, but yet want to foreclose? Bring on the courts, I have transcripts of conversations, OH YES you can record them and you don't have to tell them. Don't tell them because they will hang up on you, yet Federal law states that its legal in any state if you are performing legal business transactions to record calls....so when they refuse to be recorded it makes me feel they are playing loosely with the law....and no one can call them on it without them hanging up.

Sale date on my house of 3/28/2018. Company makes no effort to speak with you or follow up. Cannot through to someone because their telephone system.
Will not move forward to make any attempt to resolve my past due mortgage. Stuck on 37 days!!!

Desired Outcome

Help me with a loan modification request or principal reduction so that I can keep my home.

Bayview is absolutely the worst company to harass senior citizens...I mail my payment to them and they will hold my check up to 2 weeks before cashing it..in the mean time sending me threatening letters about how far my payment is behind well if they would cash my checks it wouldn't be behind the last check I mailed them was February 23rd they cashed my check March 19th in the meantime I got two threatening letters from them demanding where my payment was from now on will get their payment but at the very last day of the month that I possibly can get it there and I will tare up their threatening letters and burn them without a second thought and if they keep harassing me I will get a lawyer...they hold all my checks for at least 2 weeks after I mail them... and this old senior citizen is getting freakin tired of it..

Bayview Loan Servicing, LLC has been late paying our property taxes out of our escrow account twice withing the last 6 months.
I have been calling and complaining to Bayview since March of 2017 about the property tax issue. In March of 2017 they didn't have our property taxes listed as part of the escrow account. In September of 2017 they didn't pay the 2nd half of our property taxes. I had to call and fight with them to get that resolved. They were 2 months late in finally paying them which resulted in our name being published in the local newspaper as being delinquent on our taxes.
It is now March 2018 and the 1st half of our property taxes were due on the 2nd. Again, Bayview has not paid them. I called and they tell me they have to review things. The bill for the taxes was sent to them from the county treasurers office in January. Bayview confirmed that they received the bill.....but has still not paid the taxes due.
I have already filed a complaint with the Consumer Financial Protection Bureau. I am now filing a complaint with Revdex.com.

Desired Outcome

I want Bayview Loan Servicing to fix the issue so that in the future I don't have to worry about whether or not my property taxes are getting paid. I pay my house payment, Bayview takes out the escrow amount from the house payment. They need to make sure their systems are updated with what is to be paid out of that escrow account and when they receive the bill for the taxes or home owners insurance .....make sure the bill gets paid before the due date.

Bayview Loan Services refuses to accept the money from RI housing from the Hardest Hut Fund to bring my mortgage current so I can remain in my home.
I was served a notice of foreclosure On myBayview Loan (XXXXXXX) on 1/27/18 with an auction date of 3/14/18. I never received any mediation letters or or letters to cure my default. As soon as I received the foreclosure letter, I contacted RI housing to see if they could help me to get caught up on my payments. Well, I was conditionally approved for their help from the Hardest Hit Fund back on February 12th and they have been trying to get in touch with the lender through a portal since then (2/12, 2/20, 3/1) but the lender has not responded. I have also contacted the lender in the asset management department *** and *** who have both said they have yet to receive anything from RI housing so I faxed and emailed the conditional letter myself. They told me it would take 72 hours to upload and to call back. Long story short, they have yet to take my funds from RI housing. Although, RI housing did call me on 3/2 to tell me the auction was postponed which the asset manager, *** confirmed for me on the 6th as well. However, the very next day,the loan is now being shown as a "deed in lieu" on my credit report which I don't understand at all. I called *** the next day and he basically screamed at me and told me to stop calling him with every little thing and to find the "right" peraon to call and he's just been nice enough to take my calls! I need help! I need this lender to take the money from RI housing so I can stay in my home!

Desired Outcome

I want the lender to take the funding from RI housing so I can remain in my home. Very simple!

This company took over my mortgage from Chase back in November. According to my loan terms from Chase, I have a grace period to the 16th of every month to make my monthly payments. No terms of the loan have changed, but when Bayview does not receive your payment the first of the month, they will harass you everyday with 3-4 phone robocalls per day. If you choose to speak with a customer service representative, most of them do not know what they are doing. I finally got through to someone who did know what they are doing. This is the worst mortgage company I have ever had and I just wish they would sell my account to a different servicer.

This company bought my 2nd mortgage last year. Somehow they managed to lose my automatic payment information. When I signed up again, it was never processed and I got behind. They are impossible to contact. They won't accept an online payment if you're behind, but you can't get through to them to make a payment. All I want is to get caught up and pay this loan off. If I could give them a half star I would.

I contacted Bayview Loan Servicing on January 31st to inquire if I would be receiving a 1099-C in addition to the 1099-A that I had already received. My asset manager, *** did not return my call. I called again on February 7 and was told that the 1099-C was not yet prepared to to call back the following day. I called back on February 15th and was told that an "action was started and should be completed by February 22." I proceeded to leave messages for my asset manager on February 20th and 27th. On February 28th I called the main toll free number and spoke with *** in the call center. *** told me that the 1099-C was prepared, completed, and mailed on February 22nd. I called the main toll free line again on March 9th and was told that the "action was never completed and the 1099-C is still not prepared." I spoke to the escalation department and was told it was still not completed and no one was available for an explanation. I was told I would receive a call back within 24 business hours.

Bayview loan services refunded my mortgage payments made on time back to my account. This made my mortgage delinquent and placed it in foreclosure.
Bayview loan servicing refunded mortgage payments starting 10/2017 through 12/2017. This made my account delinquent and put my mortgage in foreclosure. My mortgage payments have been made monthly and on time using bill pay for as long as this account has been with this loan servicer. I have attempted on numerous occasions to resolve this issue. I spoke to them on 10-23-17 once I realized the mortgage had been accepted and refunded back to my checking account. They told me I was a month behind and had been for the entire year. I told them that was incorrect. They told me OI had late fees and the amounts paid on the mortgage was incorrect.I went through every month with the representative and paid those fees. They also said I had money in a suspense account that was placed there, at that time it was $916.12. Which I later realized was the monthly payment they said I was behind on.I paid all fees which equaled to 128.36 (late fees)+916.12 (suspense account)+1172.84(credit card payment)which equals to $2217.32 including October's payment again. Confirmation number XXXXXXX. After doing that I was told my account was correct and my mortgage payment was changed again to $988.94. In 11/17 and 12/17 The mortgage payments were made, accepted by Bayview loan servicer and again for both months refunded back to my checking account. I called on 11-27-17 and spoke to someone and they requested bank statements to show proof I paid. I faxed them on 11-27-17. I called on 11-29-17 and 11-30-17 to speak to someone about this matter, her name was *** and she told me this matter would be escalated. On 1-9-18 I called and spoke to *** who told me she would escalate this matter. On 1-10-18 I received certified mail stating my house was in foreclosure and will be seized on 2-5-18. On 1-11-18 I called and spoke to *** to inform them I was receiving foreclosure information, she told me that was correct and it was on my statements. On 1-15-18 I spoke to *** who was very helpful she told me that they had received the bank statements and she would escalate the matter also not to make payments until they figure out what was happening to the account, and she would call me back. However she did not call back. I called on 1-18-18 and spoke to *** who told me I was 3 months behind I attempted to explain to him the situation. I explained to him why I was not making the payment again for the 2 months. On 1-29-18 I called about my account, no-one had returned my phone calls. I wanted to know whether they had identified the problem. I left a message for *** I spoke to her on 1-30-18 who said that upper management said it was not their error because the account number was incomplete. I explained to her that the mortgage was sent by bill pay and it was the same account number that they had received payments for 8 months with no problems and for October, November and December this company accepted my payments and then refunded them back to my account and then told me I was delinquent and in foreclosure. She said I was correct and that she needed to escalate this issue.I then spoke to *** who told me I was 3 months behind and their cashiers office did not make an error and requested I send bank statements, which I did again via e-mail. On 2-14-18 I spoke to Mr. who told me I was behind 2 months on my mortgage and I was delinquent. I explained to him the reason why and he said I should have made my payments on time,at that point I could no longer handle this situation without help or some kind of support.
This company has received mortgage payments for the months of January, February and March on time via bill pay, using the same account number and these payments were received and accepted by them. They have not been refunded in my account. However, the loan servicing company has broken into my home, changed the locks on my door, winterized my home and replaced a back door, knocked the fence down without my permission.

Desired Outcome

I want a letter from the company stating it was their error that my account was delinquent for me and my creditors. I want my credit score restored. I want late fees paid back that did not apply. I want them to explain to me WHY did the first statement I received from them on 11-6-16 stated I was 2 months behind and the mortgage was paid on time via bill pay to the previous loan servicer for that month and previous months?

Horrible, tried my best to due without any stars, horrible company. Ignores laws and regulations. I don't know who is posting positive reviews, but it must be employees. Do not due business with this company, they have to be on the brink of investigation. What they don't understand is that sure people will cover for them until the seat gets hot ( have you not watched our political circus in progress). Bayview, I hope you're reading this, it will be your own employees that realize they can get millions for whistle blowing, and they will tell on you, and boy will I be dancing around the house. You're on borrowed time, talk to BOA.

Horrible company with horrible customer service. They tell you all is fixed but still can't get a statement right to save their souls if they have any.

Unpaid property taxes
The city of Yonkers is in the process of putting a lien on my property as my mortgage company has not keep the city taxes. I've called numerous times and was promised this was done and it has not been in addition they have not provided me proof that they have paid the taxes even though I'm paying the taxes to my mortgage. I also receive bad customer service where I've been hung up numerous times and put on hold for long periods of time when I call customer service .

Desired Outcome

I want a member of management to call me to resolve this asap and pay the taxes in full. In addition, I'm requesting proof of payment.

Was working in a Modification which was never declined. They sent my home for foreclosure without notifying me once.
In October I called Bayview to work out a modification. The representative said to show hardship, I should miss two to three payments. I did I was told and then she declined my modification and refused to take any payments. I just found out by a third party that my house in in foreclosure and never did I receive one piece of mail or calling telling me this. The same representative that I have speaking to, has stated that she has called me at least once a week which is not true. She has not called but instead I have been trying to get into contact with a manager because the agent is cruel and rude. I told her that payment was sent of 7000. She said I would need the double of that amount. How can I save my home if they are uncooperative and don't follow FDCPA rules.

Desired Outcome

I want to pay the past due of my mortgage without the double attorney fees which are ridiculous since they never got into contact with me.
