The disclosure statement signed 04/11/ 2005 lists the collateral as. 2202dalyrymple st sanford NC XXXXX. Deed reflects no liens on the property located at 1301 Boykin ave sanford no XXXXX. Bayview loan servicing temporarily started reflecting the property as Boykin ave at the end of 2016 on monthly loan statements. Family requested promissory note and provided directly to lender requesting that correction back to rightful property of 2202 Dalyrymple be listed on statement as it previously had reflected and lender IMMEDIATELY corrected their error and statements reflected the property that the lien was on, 2 weeks ago notice of forclosure was received by heirs of property located on Boykin ave. The property located at Boykin ave was purchased March XX XXXX for XXXXX.32. The current market value for this property is listed as $35727. The property at *** st *** nc is valued at $1XXXXX and. Original loan was XXXXX.33 04/11/2005 which the value of the property on Boykin ave would not have supported in 2005.

Dear Mr. ***/*** loan was sold to Bayview Loan Servicing by One Main and I regret every day that your company b bought my loan. My first contact with your company was when I received your first correspondence introducing your company and I reach out to get familiar with your process. At that time your customer service representative was very rude. My next communication was after I file bankruptcy when I received a loan modification dated December 11, 2018. I contacted *** 01/30/XXXX X:XXpm after leaving several messages with a time to call me back. She then advises me I need to speak with a Mr. who she transfers for me to. When we first speak, he stated he could not speak with me because I had file for bankruptcy and I stated I had been discharged and he could speak with me about the loan and because of his rudeness I hang up. After that I try to contact him back several times leaving a message to at the extension, he provided which I think was a Mr.. When I left the last message, I ask that a manager to call me back after 4:00 and the manager did not call but Mr. In closing my conversation with him I ask for an invoice so I can start to pay your company. As of this letter date I have not received an invoice. Bayview Loan Servicing has very poor business ethic and incompetent to be in business and the company need to be shut down or invested by the Federal Government. This letter is in response to your correspondence dated and received in our office on April 23, 2019. What follows is an itemized summary of the concerns of borrower, ***. ***:
1. Ms. stated that after she was notified that the servicing of her loan would be transferred to Bayview Loan Servicing, LLC ("Bayview") she contacted our office. She expressed dissatisfaction with the customer service agent that assisted her.
2. She stated that she filed bankruptcy, and later received a loan modification effective
December 11, 2018. She attempted to speak with Bayview Asset Manager, ***, regarding the loan and he advised her that since she filed bankruptcy he was unable to speak with her. She expressed dissatisfaction with Mr. and claimed that his behavior caused her to end the call.
Bayview Loan Servicing, LLC is a debt collector. This letter is an attempt to collect a debt and any information obtained will be used for that purpose. To the extent that your obligation has been discharged or is subject to an automatic stay of bankruptcy this notice is for compliance and informational purposes only and does not constitute a demand for payment or any attempt to collect such obligation.

3. She later contacted Mr. and requested a billing statement. She stated that she does not have a record of having received a billing statement.
4. Ms. stated she submitted a hardship application two (2) years ago, but Bayview did not respond.
Bayview's records indicate that *** (***) *** filed a petition under Chapter 7 of the U.S. Bankruptcy Code on September 16, 2018, and subsequently received an order of discharge on December 24, 2018. Nothing in this letter should be construed as an attempt to collect a debt against Ms. personally or an attempt to revive personal liability on any discharged debt. Rather, this letter serves only to respond to correspondence received from your office.
Below we have provided a response to each of these concerns in the order listed above. Please note that Ms. is represented by Saedi Law Group, LLC ("Saedi"); therefore, a copy of this response will be sent to their office, with no copy forwarded to Ms. directly. Until we receive authorization from Saedi permitting Bayview to communicate with Ms., we will continue to send all correspondence to their attention.
In response to item 1 above:
A review of the account indicates that the servicing of the loan was transferred to Bayview effective September 1, 2017. There was no contact made on the loan until November 25, 2017. On that date, Ms. spoke with a Bayview agent regarding her Mortgage Statement dated November 22, 2017 (copy enclosed), as she stated that the total amount due was too high. As per the call recording, the agent informed Ms. that at that time, the loan was due for the November 19, and December 19, 2017, monthly installments. Therefore, the Mortgage Statement included both payments as the November 19, 2017, due date surpassed. In addition, they discussed a letter dated November 14, 2017, in which Bayview requested to have Ms. Social Security Number ("SSN") on file in order for Bayview to report to the Internal Revenue Service ("IRS") the total annual interest paid by her. However, she expressed that she refused to submit this information. In reviewing the call recording, we have determined that the agent did not exhibit unprofessionalism, as stated by Ms.. The agent assisted Ms. in a highly professional manner and supported her decision to refrain from submitting her SSN for tax purposes.
In response to items 2, 3, and 4 above:
A review of our records reflects that we are not in receipt of a hardship letter from Ms.. In addition, please be advised that this is the first time Ms. has expressed interest in loss mitigation options since we began servicing her loan. If Ms. is experiencing financial hardship, she *** fill out and return the enclosed Uniform Applicant Assistance Form/Form 710.

Our records indicate that Ms. was pre-approved for a loan modification and a letter dated December 11, 2018, was sent to the mailing address of record informing her of the process (copy enclosed). Ms. was required to make the first monthly Trial Period Plan ("TPP") payment by February 1, 2019; with two (2) subsequent payments due by March 1, and April 1, 2019. Once the payments were confirmed as received timely, and the modification documents were signed and returned, the loan would have begun the conversion process for a permanent loan modification. However, Bayview does not have a record of having received a payment since July 10, 2018. The last payment received was applied to the June 19, 2018, monthly installment.
On December 14, 2018, a Bayview agent contacted Ms. bankruptcy attorney at Saedi Law Group, LLC regarding the TPP, and was unsuccessful in reaching a party. In addition, on January 21, and January 29, 2019, Bayview agents attempted to contact Ms. regarding the TPP.
On January 30, 2019, a Bayview agent by the name of *** contacted Ms. regarding the loan. As per the call recording, *** advised Ms. that if she is in a discharged bankruptcy she was to submit a letter from her attorney stating that she is no longer represented. Ms. stated that she submitted the letter; therefore, *** advised Ms. to speak with her assigned Asset Manager, ***. The call was transferred to Mr. and as per the call recording he confirmed the recent bankruptcy discharge with Ms.. However, since she was still represented by Saedi, he informed Ms. that they would have to be on the call as he was not permitted to discuss the loan without her attorney present. Ms. expressed dissatisfaction and ended the call without notice.
On February 15, February 22, February 25, and February 26, 2019, Mr. attempted to contact Saedi Law Group and Ms. to discuss the loan, with no success.
Mr. spoke with Ms. regarding late charges assessed to the loan after a bankruptcy discharge on February 28, 2019. Please note that the bankruptcy was discharged on December 24, 2018, and that there have been no late charges assessed by Bayview since we began servicing the loan on September 1, 2017. As per the call recording, Ms. stated that she did not want to have the loan modified and that she would continue paying the monthly installments as she has done in the past. In addition, Ms. requested a copy of her monthly Mortgage Statement as she claims to not have a record of having received one. Please note that since Bayview began servicing the loan, we have generated Mortgage Statements on a monthly basis.
During the same call, she requested that Mr. ensure that no further late charges would be assessed to the loan due to the bankruptcy discharge, and requested that he notate the account accordingly. Lastly, Ms. requested to speak with Mr. manager as she expressed that he was being unprofessional. However, there is no evidence that Mr. was unprofessional as he assisted Ms. with all of her concerns. He informed Ms. that he would transfer the call to

supervisor, ***; however, Ms. stated that she has attempted to contact Mr. in the past with no success and no return calls. She stated that she does not wish to speak with anyone in our office going forward and shortly thereafter she ended the call without notice. Please note that we are not in receipt of correspondence from Ms. attorney advising that we are permitted to communicate with her.
We have enclosed copies of twenty-one (21) Mortgage Statements that were generated by Bayview and sent to the mailing address of record within the past twelve (12) months. Please be advised that starting on September 18, 2018, all Mortgage Statements included a Bankruptcy Message indicating that due to Ms. bankruptcy filing, the Statements are for informational purposes only, and are not to be construed as attempts to collect a debt. If Ms. has any questions regarding the Mortgage Statement, she *** contact our Customer Support Department for assistance.
Bayview strives to ensure that adequate assistance is provided to all borrowers. Please be advised that Bayview's Asset Managers and supervisors are often assisting multiple parties via telephone and email, as well as sending out letters as a formal correspondence, in relation to loss mitigation processing. Therefore, there *** be times when communication with a borrower is delayed. We regret any inconvenience a borrower *** experience should such a delay occur.
On March 1, 2019, Bayview cancelled the TPP due to non-payment. The loan is currently due for the July 19, 2018, monthly installment. Enclosed is a copy of the Customer Account Activity Statement as it provides a detailed accounting of all transactions and their effective dates.
We have enclosed all supporting documentation used to complete the review on the account. Ms. is entitled to request additional documentation regarding her inquiry. In response to the reply by Bayview Loan Servicing, LLC some of the information provided was untrue. The reply is not to go back forward it is to address some concerns with them and for them to address their business practice.

1.I did speak to Mr. until after my bankruptcy had been discharge.

2.I stated to Mr. I did not want the loan modification and to send me a statement of what I was pervious paying. Until *** 27, 2019 I still have not received a paper statement, I do have the one they attached to the response for the Revdex.com.

3.I did send a hardship correspondence about 2 years ago certified mail and received the green card back with a response several months later by Bayview Loan Servicing, LLL to call to discuss a loan modification, at this time I am unable to locate the correspondence.

4.When my loan was transferred to the Bayview Loan Servicing, LLC they had my Social Security Number on file why should I have to verify, I called to address the correspondence which I thought was inappropriate when you had my information. The reason the payment was past due at the time of the telephone call is because I had not received a paper statement.

5.I spoke with *** Law Group, LLC on *** 14, 2019 it which they left message to contact them regarding the copy from the Revdex.coms. I ask them about the dates in questing that Bayview Loan Servicing attempt to reach out to them with no avail. They stated to me the only contact was when they received the loan modification dated December 11, 2018 and a copy of the *** 8, 2019 Revdex.com. I have no problem reaching anyone at the office via email, voice message or direct talk to.
Ms. did not state I need to submit a letter from my attorney stating that I am no longer represented by *** Law Group, LLC. When I spoke with my attorney office, they stated to me that a copy of my discharge paper was submitted to Bayview Loan Servicing, LLC.

6.When I left my last message, I requested to speak with Mr. supervisor/manager, in which Mr. left as his contact information him was Mr. and I received Mr. instead. Mr. never in our conversation stated that he would transfer me to Mr.. Mr. state that they did just convert to a new phone system and he apologize that it did not give me his voice mail but Mr..

7.If I contact the Customer Support Department for assistance it led me to Mr. voice mail to leave a message.

The letter further explains that Bayview will stop accepting mortgage payments after June 10, 2019. We regret that our prior response to Ms., dated June 6, 2019, did not include this information, as the response was sent prior to the effective date of the servicing transfer. In addition, Ms. prior concerns did not involve anything related to the servicing transfer of the loan. Nonetheless, please note that Bayview no longer services the subject loan. Bayview loan bought out our Mtg from Citi Financial.We had a loan modification after several of our payments were not posted to our account and held for some reason? THEY WERE NEVER POSTED TO OUR ACCOUNT!!! When they modified our loan, they told us that the dd would be the 26th. That's when it's set to come out. So now we've racked up TONSN OF LATE FEES because it is not being taken out on time and our payments that we made months ago never posted but were taken out of our bank account! Bayview gives me the run around! You have to call and every time I get a different answer! My taxes aren't being payed and I'm sick of this company callin me from unknown numbers and robot calls! I think they should be in a class action lawsuit!

from 4/01/18-4/01/19. I made all these payment.

All my payments have been posted to my bank account and I have confirmation numbers from Bayview, however I constantly get letters from BAYVIEW claiming they are unpaid.

Bayview loan service has taken my insurance check. the check is for insurance to fix my home where a tree fell on it. The service has held my check for over a month. When trying to speak to anyone at Bayview I am put on extensive hold or hung up on. this is impacting my health because I have a home with a hole in it where the weather is constantly impacting me.

I have disputed my credit ratings with bayview since *** 2017. they have never updated us to current after our home modification that was approved
In March 2017 I applied for a home loan modification on my current property with Bayview ln # XXXXXXX after falling behind due to my wife's cancer. In April 2017 I received a call stating we had been approved and the trial mod pmts would start *** 1, 2017. I shortly called back after to ask if I could go ahead and make (2) 1/2 pmts in April for *** 1st due date. I was told yes and I was sent out the paperwork that was signed and notarized. I continue to make the payments in the month ahead (*** in April, June in ***, July in June/July) Aug 1st is when the 1st actual Mod pmt was due that pmt was made in July. A few months went by and I called to make a pmt and the automated system states I am due for Oct pmt in which that had already been made in Sept, so after them looking into it the rep stated they would get it fixed and retract the credit rating. they advised to call back in 2 weeks to get an update. I did that and at that time they said I only owed 131.00 after that had made all their adjustments due to misapplication of a payment ( as shown on the pmt history from Bayviews website they posted 35 transactions in August and 69 transactions in Oct) after overlooking this pmt detail I can see where the due date went back and forth from 2015 to 2017. and never showing the correct due date of Aug 1 for August's first pmt, then they tried to say after I paid this 131 in october I called back in nov to make a pmt they are still showing me past due and now state that I still owe for oct when on a recorded phone call they did infact tell me only the 131 was due because of their mistake. They assured me all this would be retracted off my credit report because we worked so hard to keep our house and stay on time with the payments. When looking at the payment history You can see where I had already made the oct pmt and it was reversed and never credited back. Bayview tried to say our modification didn't start until Oct when in fact our papers show Aug 1. So from that date they have never updated our credit report to current and continue to show us behind from april 2017 until now. I have had the case escalated several time with Bayview as I also get the same result that they do not have to update my credit report because it was contractually late (when if they would have posted the pmts correctly it would have never shown this to be late) a rep emailed me the workup sheets from the MOD where the loan officer noted they would be holding back Aug and Sept's pmt to post after mod was approved( it was approved for 8/1/17) so not posting those payments made it to look like we were always late when the money was sitting in the suspense account and they didnt post it. These payments were made from my bank account the whole time. I called again yesterday 3/28/19 to open the case again in which they said it would be a few days before they could look into it. so now here we are trying to buy a new home and cant because they show us almost 2 years worth of late payments XX-XXX days since april 2017.

I am seeking the correction to my credit report to show all months as current per modification agreement papers. All months need to show current starting in April 2017.

As Bayview started they reversed the modiification for what reason and we were never told anything about it. As they listed my payments were always made on time until they decided to reverse and redo the mod which was already in place and payments already made. The payment amount in mod was 560 not 625. The months that were paid on time need to be corrected on the credit report! They cannot show we were lte every month during the last two years just because we were late before the mod. If payments were made on time aim the month ahead they need to report those payments as current on the credit report!

-r-0-11 LOAN SERVICING received four (4) payments prior to the adjustment of the loan account rather than the requisite three (3), Bayview reversed and reapplied the payments as detailed in the response letter dated April 15, 2019, from Bayview to the Revdex.com.
Please be advised that, at the time the third (3rd) stipulation payment in the amount of $560.20 was processed on July 7, 2017, the suspense balance was $1,054.55. After withdrawing the regular payment amount of $626.05, the remaining suspense balance reflected funds in the amount of $428.50. These funds were calculated into the capitalization of the loan account, and were not to be applied to a post-modification principal and interest payment.
Therefore, at the time the loan account was converted in August 2017, the payment processed on July 27, 2017, in the amount of $560.20, were the only funds to be applied as post-modification principal and interest payment. Following the reversal and reapplication of payments, the account was correctly due for the October 1, 2017, payment as of October 18, 2017. However, Bayview received a payment in the amount of $131.70 on October 18, 2017, which was insufficient to satisfy the monthly installment amount of $560.20, and was placed in suspense as unapplied funds.
Consequently, the October 1, 2017, monthly installment was not satisfied until receipt of funds in the amount of $428.50 on November 17, 2017.
To address item 2 above:
Please be advised that prior to the conversion of the loan account according to the terms outlined in the Loan Modification Agreement, Bayview applied the funds received for the Trial Period Plan payments to the suspense account until such time that there were funds sufficient to satisfy a regular payment. Accordingly, the three (3) Trial Period Plan payments in the amount of $560.20 each satisfied two (2) pre-modification payments in the amount of $626.05 each, with $428.50 remaining in suspense.

Misapplied or missing payments.
The Bayview stated that I am 2 months behind payments. I have disputed the accertion since January 1, 2019. They did not even start the complaint or research process until March 2019. When they did find some of the payments they misapplied it to the incorrect months. I spoke with *** in escalation and he advised this will be corrected and to expect a phone call, never received one. The only call I receive is that I am delinquient on my account. Which is not the case. I have even gone as far as provided the pdf bank letter and authorization of the payments in question.

Desired Outcome

The account needs to be reaged with the payments correctly applied. Reverse late interest, fees, and other penalties. Report to all credit agencies the correct status of the account. STOP calling me for late payments when they are not late or stop the calls when it is being investigated.

Our records indicate that Bayview began servicing the above-captioned loan effective September 1, 2017, when the loan account was due for the September 1, 2011, monthly installment and all subsequent monthly installments due thereafter.
A review of the account reflects that the loan was paid up to the September 1, 2018, monthly installment at the time the reinstatement funds were posted on July 20, 2018. As a result, recoverable corporate advance fees that were assessed prior to the Reinstatement Letter dated June 14, 2018 (copy enclosed) remained unsatisfied. Subsequently, we assessed $1,888.00 on August 2, 2018, because this amount was not included in the reinstatement funds applied on July 20, 2018.
Per the terms and conditions established by the Note and Security Instrument (enclosed) Mr. singed on August 29, 2005, Section 14 of the COVEN ENTS states "Lender *** charge me fees for services performed in connection with my default, for the purpose of protecting Lender's interest in the Property and rights under this Security Instrument, included, but not limited to, attorney's fees, property inspection and validation fees. With regard to other fees, the fact that this Security Instrument does not expressly indicate that Lender *** charge a certain fee does not mean that Lender cannot charge that fee". Please be advised that the fees and charges incurred on the account were a direct result of Mr. defaulting on the terms of his Note and Security Instrument; however, these items cannot be substantiated at this time, as the proof of the claims can only be found on the invoices billed to Bayview directly. We regret to inform Mr. that Bayview invoices cannot be provided as these documents hold proprietary and confidential information, which is protected under the attorney-client privilege between the attorneys and Bayview. However, Bayview did provide Mr. with a breakdown of the all late charges and recoverable advances included in his June 14, 2018, reinstatement letter in our response dated September 19, 2018. A copy of this response has been enclosed for your review.
Bayview denies any wrongdoing in connection with this loan file and maintains that it has serviced the loan in accordance with all applicable laws and regulations. Additionally, Bayview believes that its record of the account, including the calculation of all amounts due and owing therein, is correct. We respectfully consider this matter to be closed.

Bayview is quoting from the note and security instrument that "Lender *** charge me fees for services performed in connection with my default, for the purpose of protecting Lender's interest in the Property and rights under this Security Instrument, included, but not limited to, attorney's fees, property inspection and validation fees." and I am not disputing that.
However, based on the fact that earlier reinstatment quotes provided by prior servicer, and itemized invoices from the law firm attached to those provided OBVIOUSLY FRAUDULENT figures, I have every reason to doubt the figures I am being billed, and every right to demand and receive substantiation.

Furthermore, Bayview is stating that "Please be advised that the fees and charges incurred on the account were a direct result of Mr. defaulting on the terms of his Note and Security Instrument", and while that statement might technically be true, said default was a result of the original servicer refusing to correct their Escrow errors, and their sending reinstatement quotes with fraudulent charges, refusing to provide an accurate and true reinstatement quote.

They were almost finished with it twice and it seems right at the end, the person working on it is no longer there. Then the next person Needs to start from scratch. Crazy to me. Where is the paper work from before. The reason they are taking it back. I have recently moved. I could no longer there. It was broke in to six times, my neighbor was stealing my gas and water when I was oversea's. I owe a lot more then the house is worth. Bayview said this would be the best option. I just won't to get this over with.

Asset Manager, *** was assigned to the loan to assist him with his loss mitigation options (copy enclosed).
Shortly after the servicing transfer of the loan was processed, Bayview was informed that Mr. was pending review for a loss mitigation workout with the prior loan servicer. On June 18, 2018, Bayview initiated loss mitigation contact with Mr.. At that time, Mr. confirmed that a DIL was his only intention, and Bayview confirmed that the pending condition for the DIL review was the most recent value of the subject property. Later, Bayview discovered a clouded title and required that the lien be cleared in order to proceed. Between June 2018 and August 2018, Asset manager, *** was experiencing difficulty while trying to negotiate the release of this lien. During that time, he also attempted to obtain an Authorized Third Party Form allowing the title company, Nations Lending Services, to be authorized on Mr. behalf with Bayview.
On September 10, 2018, a letter was sent to the mailing address of record to inform Mr. that the assigned Asset Manager was changed to *** (copy enclosed). At the end of September 2018, Ms. received new paperwork and requested a new property value and updated title report. The value was received; however, Bayview was still pending the release of the second lien, and the second lien holder Authorization Form, both of which are requirements for the DIL process to be completed.
On December 5, 2018, a letter was sent to the mailing address of record indicating that Mr. request for a DIL was denied as Bayview did not have a record of having received all of the required documentation (copy enclosed).
On January 8, 2019, the Asset Manager was reassigned to Andre ***, and a letter was sent to the mailing address of record to inform Mr. of the same (copy enclosed). Mr. continued the DIL process that Ms. Correa initiated. However, due to the recent denial Mr. required new/updated information for a new loss mitigation timeline.
Please note that Bayview requested documents from Mr. on only two (2) occasions: the first loss mitigation timeline after the servicing transfer; and the second loss mitigation timeline after the first request was denied.

According to our records, on February 25, 2019, Bayview confirmed receipt of a complete DIL package from Mr. and his request for a DIL submitted to the investor of the loan, Bank of America, N.A. ("BANA").
On February 26, 2019, BANA approved Mr. DIL request and a copy of the DIL Agreement was sent to the mailing address of record to be executed (copy enclosed). Bayview has confirmed receipt of the Agreement and signed Authorization, both dated February 27, 2019. We are currently in the process of having the Agreement recorded. Please allow up to ninety (90) days for this process to be completed.
Please be advised that the foreclosure sale was postponed to May 9, 2019. However, due to the recent DIL approval we have cancelled the foreclosure sale and ceased all foreclosure action.
With regard to Mr. statements regarding the property preservation efforts, please be advised that the only matter in relation to preservation work/securing work for the subject property occurred on January 28, 2019. At that time, the property was re-keyed and a lock box was installed. For your knowledge, the lock box code is "SUN" as needed for access.
On February 1, 2019 the property was winterized. This work order was at the request of Mr., who further requested that interior photos be taken of the subject property. However, when completing the work order, the contractor incorrectly secured the property and took the interior photos requested. As a result, the property was identified as frozen and a bid was submitted to thaw and winterize. The bid was approved without identifying that the contractor secured the property even though directives were provided to contact the borrower for access prior. Please note that if this work order was not approved the property would have suffered plumbing breaks but because it was approved we were able to thaw and winterize the property. The system held pressure so the vendor was able to avoid the freeze damage.
We have enclosed a copy of the Property Condition Report completed on February 1, 2019, which does not indicate that the property experienced any damage. If Mr. wishes to provide evidence that substantiates his claims of property damage, Bayview may be able to investigate these matters further.

According to our records, Bayview began servicing this loan effective October 27, 2014. Enclosed, please find a copy of the Notice of Assignment, Sale or Transfer of Servicing Rights dated October 9, 2014, from JPMorgan Chase Bank, N.A. ("Chase"). Bayview will only supply records from 2014 to present.The loan orginated in 2003. There is no accounting for the $106,000 which was added to my loan. During the modification process, they put an immense amount of pressure and stress on me.. Bayview was sending my loan information to a non-exsistant address in Florida, even though I advised them of this repeatedly. The strong arm tactics they used and constant badgering was beyond tolerable. They refused to send an accounting of the additional fees added on after many, many requests.

AFTER CALLING SEVERAL TIMES THEY FINALLY GAVE US A PAYOFF AMOUNT ON JANUARY 17TH THAT WAS $326 DOLLARS HIGHER THAN WHAT MY PAYOFF WAS ON THEIR WEBSITE. BAYVIEW SAID IT WAS A FEE TO KEEP THE PAYOFF AMOUNT THE SAME UNTIL FEBRUARY 1ST. BAY VIEW WAS CHARGING $20.11 IN INTEREST PER DAY THROUGH FEBRUARY 1ST. MY HOUSE CLOSED ON JANUARY 18TH SO I CALLED AND NEVER GOT A ANSWER IF I WAS GETTING ANY KIND OF REFUND SINCE THE HOUSE CLOSED JANUARY 18TH. I ALSO DISPUTED THEIR PAYOFF AMOUNT WHICH WAS OVER $6000 MORE THAN IT SHOULD HAVE BEEN. I FAXED BAYVIEW A COPY OF THE AMORTIZATION SCHEDULE AND THEN THEY FINALLY SENT ME A RESPONSE SAYING IT WAS BECAUSE PAYMENTS NEED TO BE PROCESSED BY THE 15TH OF EACH MONTH. I WAS SET UP ON AUTO PAY AND THE PAYMENT WAS SET TO BE PROCESSED, AND RECEIVED BY THEM ON THE DUE DATE OF THE 15TH OF EACH MONTH. I AM BEING PENALIZED OVER $6000 BECAUSE BAYVIEW WAS NOT PROCESSING MY PAYMENT ON THE 15TH. We refinanced our mortgage from this company and they were completely paid off. On 2/1/19 I went to my bank and found that this crooked company withdrew a payment of $450 AFTER they were completely paid off. They refused to refund this money to us when we contacted them directly. They were very rude and unhelpful on the phone and we have lost this money that they stole from us. This is illegal and they double-dipped from our new mortgage company that paid them and by stealing money we had.

According to our records, Bayview began servicing this loan effective September 14, 2016. Please be advised that the automatic payment enrollment transferred from prior servicer, CitiFinancial Servicing, LLC ("CitiFinancial") to Bayview, as detailed in the Notice of Servicing Transfer dated August 24, 2016 (copy enclosed).
Therefore, on January 27, 2019, Bayview withdrew the scheduled payment amount of $450.00 in accordance with the terms of the biweekly payment arrangement and applied it towards the February 1, 2019 installment. On January 30, 2019, Bayview processed a payment in the amount of $87, 207.20, which was placed in suspense as unapplied funds, pending payment posting instructions. On January 31, 2019, Bayview applied the funds in suspense to pay the loan in full. Enclosed, please find a copy of the Customer Account Activity Statement, which provides a detailed accounting of all transactions and their effective dates since the beginning of this year. As indicated above, the payoff funds were remitted after the scheduled payment.
Subsequently, Bayview issued a Payoff Acknowledgement Letter (copy enclosed), which advised that any funds received in excess of the amount required to pay the loan in full and/or any funds remaining in the escrow account will be forwarded to Mr. and Ms. twenty (20) business days from the date of payoff. On the same day, Bayview issued a Notice of Cancellation of Recurring Check Payment dated January 31, 2019 (copy enclosed).
To address items 2 and 3 above:
Bayview regrets that Mr. or Ms. was not satisfied with their customer service experience and appreciates their feedback for the coaching opportunity it affords our representatives in the event that their conduct did not meet the standards for which Bayview strives. However, a review of the call history indicated that the representative with whom Mr. spoke on February 1, 2019, conducted herself with professionalism and did not behave outside the bounds of propriety.
Additionally, as stated in the above-referenced Payoff Acknowledgement Letter, any excess funds will be returned to Mr. and to Ms. twenty (20) business days from the payoff date. Mr. was advised of such when he contacted Bayview on February 1, 2019.

I am the wrong person identified as the loan debtor. They've been harassing me since 2016 to collect a loan I don't owe.
No information has ever been provided except that they are looking for a Sam or Samuel *** who is the debtor. I have NO familial, legal or financial relationship to this man; I do not know him. He was once a tenant in my building where I now reside but he was evicted for nonpayment of rent many years ago. I have sent letters and spoken by telephone to Bayview telling them that I have no idea who this Sam or Samuel *** is and we are NOT related in any way, and that this is an egregious error. They do not care. I am continually harassed for paying a debt on a mortgage I never made. I own NO property. I am 83 years old and Bayview refuses to stop their harassment or even investigate what I've told them. I've sent them TWO Cease and Desist letters based on mistaken identity and they refuse to stop harassing me. This started in 2016. It is now the 4th year of their harassment.

Desired Outcome

I want Bayview to acknowledge their error in identifying me as their loan debtor. I want them to stop telephoning, mailing or contacting me for collection purposes. It is harassment - plain and simple. I want them NOT to impair my credit report with false information. I want a letter of apology with a clear statement that Bayview made an error in misidentifying me as their loan debtor. I wnat NEVER to hear from them ever again. If they refuse, I want them to know that there will be a huge law suit against them.

Despite my repeated responses to BAYVIEW, including demand to CEASE & DESIST, they have persisted in harassing me despite my telling them of NO relationship of any kind with the loan debtor. Their phone messages indicated they were ready to set up a loan repayment plan for me. I had only to call them and get that started. Their so-called "skip trace" efforts merely underline how untrustworthy that particular business is, including online people search engines. They disregard how their harassment has impacted me. BAYVIEW's harassment of me will not go unchallenged. They finally responded when I complained to the Revdex.com. Add to that my complaint to the office of the NYS Attorney General who has yet to respond to me as to any results. My last letter, to BAYVIEW Pres/CEO O'Brien, dated Jan. 5, 2019, was apparently not delivered or not accepted. I sent it Certified Mail with Return Request. Tracking showed the letter disappeared after Jan. 14, 2019 - a "delivery exception." At my request, the USPS is investigating where that letter went. BAYVIEW has exhibited the worst aspects of the debt collection industry and made me a victim of their vicious business practices. Nothing BAYVIEW has to say will undo nearly FOUR years of harassment.

Terrible customer service. I am working on a refinance for a client and Bayview loan servicing has their case number and refuses to transfer it causing the client to push the closing back a month. Nobody knows what they are doing over there and they have no upper management to oversee these issues. Everyone drags their feet and they will just transfer you to voicemail. Nobody takes responsibility for anything over there. STAY AWAY FROM THIS SCAM OF A COMPANY! BTW waited on hold for over 30 minutes to speak to a supervisor!

My loan was sold to Bayview and Bayview forced a flood policy on my loan. We have a Hoa flood policy which has my property covered and the property is located on 20th floor which is above any flood level. I have a homeowners policy which covers my property. I am a licenced insurance agent the policy which was forced will not provide any coverage in the event of flood. I feel Bayview is taking advantage of its clients.

On 11/23/18, I called this company to find out where to submit my Insurance check settlement, due to I lost everything due to the Hurricane Michael storm. The insurance check to made out to me and Bayview Loan servicing in the amount of $66,0000. I advised that BayView was no longer servicing my mortgage, but the check had their name on it. I was also advised not to endorse the check and that Bayview would endorse and send the check back to me, to pay my current mortgage company, which is Carrington Mortgage. The check was sent to the address below, which was provided to me: Bayview Loan Servicing LLC Attn: Loss Draft Dept *** Crooks Road Troy, MI *** sent the check via UPS 2nd day and the check was received on 11/27/18 at 9:52 am, single for by ***. I called on 11/27 and spoke with ***, who advised it would take 3-5 business days and they would send the check back. On 12-3 I spoke with ***, who advised the check was mailed on 11/30 via regular mail. I spoke with *** on 12-7- who ask me did I know that I had a mortgage with Carrington Mortgage? I told her yes and she advised, the check was mailed to Carrington Mortgage POB XXXXX, Phoenix, AZ XXXXX, Attn: *** and it was sent regular mail on 12/3. 12-10 Carrington advise, no check. I called 12-10 and spoke with ***, who advised me the check was sent and to call Carrington. I spoke with CArrington on 12/11, they still did not show a check had been sent. I called Bayview on 12/11 and spoke with *** and I asked about tracking, no tracking. I asked *** why would they send the check to Carrington, what can they do with it? replied, good question. Then he advised me, to have a new check sent with new company name because they wouldn't be able to cash. Stating the insurance did not put a code to allow it to be cashed and he was looking at copy of the check. After all this, Bayview need to held accountable for this missing $66,0000 check, they should have just sent this check back to me and now it can not be found.

Other (requires explanation) I need for this company to find out, where this check it at and to coordinate with the current mortgage company. I have already suffer one devastation and now this. I have asked for two Pay off quotes, which both have expired. I will be charged more interest and I feel like it should be paid by them, because they lied about sending the check back and did not advise, something different will occur. Why did I just find out 12/11 that Carrington can not do anything with the check mailed? UPSET!

The company is responsible for the extra interest that I have to pay. I was advised by Bayview that they would endorse the check and mailed it back for me to pay Carrington Mortgage. Instead they mailed the check to the incorrect department at Carrington, this caused another delay and Carrington had to find the check. It the midst of all this, I was being charged more interest. Once check was found, Carrington could not do anything with the check, because it had Bayview name on it. If Bayview couldn't endorse because they no longer service the mortgage, they should have sent the check back. Bay view had to know the check couldn't be cashed by Carrington. I have always been in contact with Carrington but bayview was the one who stayed to send them the check and they would send it back. They are the reason my payoff is higher with the current Mortgage company because they failed to return check and sent it to the wrong department. I feel they should be responsible for the additional interest I'm being charged or have the mortgage company to waive due to this error was totally their fault. They knew carrington could not process the check with their name on it. Somebody didn't do their job

I've been having problems with this company since I was switch to them for my mortgage the collection agency it's to much with them they change payme
They give me modification then they tell me I got pay by a certain day but we still in the same month the collection agency if iam still in dec in iam tryn to work agreement y tell me I did to many agreements just work with me in I don't like the Alsace's manger Juan delpohens he's to negative in keep giving me problems the won't switch me at all

Gm this is mrs *** iam still fighting against this complaint they *** manger don't have no concern about my health I ask him we're is my forbrance I have been out of work do to terminally illness they have recived doctor notes from my dr letting know that I've been hospitalized on servals occasion the assets manger didn't take that in consideration she will not go into detail with them on my medical illness because it's a hhippa law so while all he said to me u on disability u can't oay that was assacting my caratrcher I don't care how they say he try with me I ask he be change they still didn't give me my right been out of work since October watting on my disability rerano my modification as forbearance all they working about is how to paid which I can but just like any thing else in nj if ur income change u notified ur Mortgage company in get a plan they have not done it haven't sign any of the modification so how they doing them with out a signature illegal please help or I want ok go further

Hello this company needs to be investigated they say one thing it's another now I recived letter stating that because I didn't accept a Modoforcation that they denied my case I never disregard my trail plan just didn't have it for December that's y I was asking for another modification cause they said I miss it so they sent me another R.m.a yo renew it in told me to talk to Hud Counsler which I did still dealing with one so how do they dined me when I just was told to do it last week this week I get letter this is unacceptable I will go to get a lawyer on this case this was due to medical illnesses so they told me to start over this getting ridiculous I need help now I do not accept this in they won't remove my asset manger in iam not being treated fair so please look over this matter

Loan has been paid off and company refuses to apply the monies correctly and continues sending me a balance statement. Problem continues
Continue receiving balance statements. Fradulently added a flood policy when I have flood insurance thru my association. Not to mention they are not my primary Loan holder.

Desired Outcome

Refund the add on for flood insurance which was not required or consented.

This letter is in response to your correspondence received in our office on December 7, 2018, regarding the above-referenced loan account. What follows is an itemized summary of the borrower, ***'s, concerns:

1. Mr. states that the loan is paid off and Bayview Loan Servicing, LLC (Bayview") refuses to apply funds correctly and we continue to send him balance statements.
2. He states that Bayview fraudulently added flood insurance when the flood insurance is included in the homeowner's association.

Below we have provided a response to each of your concerns in the order listed above.

To address item 1 above:
Our records indicate that the above referenced loan account was paid off December 12, 2018, and the Payoff Acknowledgement letter was mailed on December 13, 2018 (copy enclosed). We are sending all appropriate documents, including the lien release, according to the mailing instructions received with the borrower's payoff check. Generally this will occur no later than sixty (60) to ninety (90) days from the date of the payoff. Until Mr. receive the documents, this letter will serve as proof that his loan obligation has been paid.

To address item 2 above:
Any funds received in excess of the payoff amount and/or remaining escrow funds will be forwarded to the borrower twenty (20) days (excluding legal holidays, Saturdays and Sundays) from the payoff date.

Please be advised that sufficient homeowner's insurance is required for the subject property as detailed under the terms of the mortgage. As our records indicate that Mr. did not submit proof of an existing flood policy that provides adequate coverage, Bayview obtained a policy on his behalf. Enclosed please find the insurance notices that were sent prior to Bayview obtaining lender-placed flood insurance. Upon receipt of proof of adequate coverage, Bayview cancelled the lender-placed policy and credited any unearned premiums to the escrow account which at that time was $.71 on December 20, 2017.

We have enclosed all supporting documentation used to complete the review on the account. Mr. is entitled to request additional documentation regarding his inquiry.
