Loan company still attempting to collect funds from a loan that was FORECLOSED over a year ago.
This loan company continually sends me harassing notifications to pay on a loan that has been FORECLOSED on. It's bad enough I lost my family home. I have continued to write to them, call them and email them that the loan has been foreclosed on but they continue to send me harassing notifications to pay.

Desired Outcome

There is no loan left on a FORECLOSURE so for them to please stop harassing me

Loan ModificationPlease be advised I am asking for an escalated review of this file and that it be assigned to a loss mitigation escalation specialist. I want to stay in my home. I have been providing documents in this matter since February 9th 2018. I last sent updated documents per a verbal request on April 23 2018 which would be the last documents required. You also requested that I fax the documents to the underwriter. I did per your request. I have not heard from you with a update as you said.' I did not receive an acknowledgement of those documents and called on'May 23rd and spoke with a gentleman in your office. He looked at your notes and again requested the documents to be resent.' My original loan was with Bank of America, who transferred it to Dietech. I became very ill in 2016 and underwent three surgeries in 2017 and one this year. I had missed several payments but Dietech encouraged me to apply for a loan modification. I was in the midst of completing the necessary paper work when Dietech returned my most recent two mortgage payments and notified me that my loan was transferred to Bayview Loan Servicing. Bayview would not accept payments from me. They immediately served me with a notice of default. I completed their loan modification paperwork and submitted it in a timely manner on October 6, 2017, only to have them send me numerous notifications and emails that they needed additional information. FYI The letter I received April 20, 2018 requested "a copy of Estate Documents i.e. executed Last Will and Testament" and "Copy of Trust Agreement. Must be irrevocable trust with borrower reflected as beneficiary", among other now "expired" documents.I have complete records of their correspondence with me along with all my responses that I sent registered mail with tracking numbers. I also have a phone log of my numerous attempts to contact them by phone. I have been shut down from accessing my account via their website.Bayview Loan Serving has intentionally mislead me and delayed prompt review of the materials I submitted in hopes that they would foreclose on my home.I was notified to contact their partner, Quality Loan Service Corp. of WA to obtain the loan re-instatement amount. Neither Bayview or Quality Loan Service would provide me with the information I needed until I filed a complaint with the Consumer Financial Protection Bureau. After CFPB contacted Bayview Loan Servicing they finally gave me the re-instatement amount so I had the funds wired to them on *** 9th. The amount was inaccuratetoday I received a notice that my loan was once again past due! The additional re-instatement is $2,327.32!

Desired Outcome

Other (requires explanation) I need to know what these new charges are for and how they were calculated. I know I have a loan payment of $1539.01 due on June 1, 2018. Provide proof that an inspection on my property was done on 4/30/2108.I need a complete itemization of ALL charges since Bayview took my loan from Dietech. Dietech would not provide me with any records of fees and payments that I requested. I will make a request to Dietech one more time before I file a complaint.

1. Bayview charged $160 for alleged drive-by fees and

2. they promised a $300 visa card if my mom paid on time, never sent it, and sold the loan.
Bayview Loan Servicing, LLC promised to send my mother a $300 gift card if she paid her balance and if she made 3 months of on-time payments. I put my mom's account on auto from my personal checking account after she had been given the run around for over a year for a modification. We tripled the time of 9 months and they still gave her the run - around with no modification, and no gift card. We later found out that they sold the loan and added the fee's that they alleged that she owes. This is no way to treat senior citizens. I'm authorized to speak and make changes on my mom's account and they lied to me stating she didn't pay on time until I confirmed that I had proof because it was set up from my personal bank account.

The company representative stated that the extra fees of $160 was due to them alleging that they drove by my elderly mom's home 16 times. My mom lives on a dead end street, so you can't drive by. As we attempted to clear both matters up, they sent us a letter stating that we now had a new company and must contact them.

Desired Outcome

The resolution that we are seeking is a reimbursement of $470.00 This amount includes the $160 plus interest $10 and the $300 visa gift card. Thanks, Joyce Agee XXX-XXX-XXXX

BofA flipped our Mortgage to Bayview last month. We are 1 month behind and their computer system has been Robo calling and Slamming my phone number day and night, 7 days a week 2 or 3 times a day. They are un-relentless with the number of calls they make. Each time their computer calls with the same message, "Change in Status of your account' followed by you must call within 24 hours. This is stressing me out and counter intuitive, I have to work to pay bills, the interruptions are so numerous I am lacking in work related productivity, to answer their calls and or delete their numerous voice mails.

Bayview wrongfully foreclosed on my property in Michigan.
My name is *** and I am writing to you in hopes that you can help me regain my home as I feel I am a victim of unfair lending procedures and pressure to resolve a mortgage by Bayview Loan Servicing, LLC. Please let me give you insight to my problem;
In November of 2012 I filed bankruptcy after a divorce and unemployment issues to prevent my home from being foreclosed on at which time Bank of America currently had the mortgage. Prior to filing the bankruptcy BOA would not speak with me regarding the mortgage. When I would call their only response to me was, "we cannot talk to you about this account" even though my name was on the account. I defaulted on the bankruptcy in March of 2015 after being fired from the job I had for 3 years though I continued to pay what I could. At some point BOA turned the mortgage over to Bayview Loan Servicing, LLC. In the spring of 2015 I began attempts to have my mortgage modified through (HAMP) Bayview and for the past 3 years I have been trying to get this worked out but on February 14, 2018 they sold my mortgage in foreclosure, to which the papers were filed in July 2017. I was completely unaware of this until March 17, 2018, it was my understanding that Bayview's Asset Manager *** Tyer was working with my attorney whom did not know of the foreclosure sale either.
My problem lies in this:
According to the bankruptcy trustee's records my actual balance owed was $70,174.00 as of October 3, 2014. Yet all of the paperwork from Bayview lists the principal balance as:
December 2015 = $92,977.15
December 2016 = $92,228.36
December 2017 = $91,848.71
Each time I have received modification paperwork I questioned them on a few things and when that happened I was shut down by the company with no response to my questions. I called Bayview and sent emails without as much as an attempt to answer or resolve the issues I had. I would make the agreed upon modification payments by phone as they insisted was the only way I could until their system would no longer let me.
In July 2017 I contacted an attorney to assist me with the last attempt at modification. In July when I received the Stipulation Agreement I agreed with it, signed it and made the first payment that day, July 12, 2017. The next day I received the exact same paperwork but with a Balloon payment addendum written in it dated for July 12, 2017. When I contacted my attorney he advised me not to sign the second set of papers but keep making the payments to which I did through November. December and January 2018 were late. February 2018 when I made the payment to Bayview it was returned and that was how I found out my house was actually sold in foreclosure.
In 2015 Bayview's modification amounted to the following:
$534.13/month for 3 months (paid)
$534.13 x 19 years = $121,781.64
Balloon pmt(yr. 20)= $ 75,308.44
Total $197,090.08
After attempting to rectify the fact Bayview refused to remove my ex-husband's name from the paperwork and not having a clue to the money already paid in during bankruptcy.
In *** of 2016 I was advised by *** Salazar Asset Specialist to continue making the payments of $534.13 to which I did until their system would not accept them in July of 2016.
Again I contacted Bayview and began the process once again submitting all of the required paperwork. In July 2017 I received foreclosure paperwork and again began the process.
2017 Modifications is as follows:
$421.39/ month for 3 months (paid)
$421.34 x 18 years = $90,972.72
Balloon pmt.(yr. 19)= $45,419.17
Total = $136,391.89
I do not understand the huge difference in the amounts they are requesting. Also, once an attorney got involved again I was shut down by Bayview and no correspondence was given from Mr. Tyer until it was too late.
Contrary to what some *** believe, I am not looking to be relieved of my debt. I have been attempting to resolve this issue for 3 years now and have been stonewalled by Bayview and their employees.

Desired Outcome

Put a stop to the practices of Bayview and their subsidiaries from predatory lending. They have attempted to bully me into an agreement that is not right. I have been backed into a corner as I will loose my home completely unless I can find some resolve. Bayview has done this and worse to hundreds of people. From what I can gather they get away with it because they are affiliated with New York Bank of Mellon.

PayOff Demand Letter
I have asked for a request to pay off the remaining balance of my account with a horrible company. The company have prolonged the process so the can continue making money with interest and payment fees. The first attempt of asking for the payoff of my account I was told inaccurate information (would be faxed within the next 20-30 minutes). I then proceeded to reach back out to the company after making the payment of the remaining balance that is listed on my account-with no pay off demand received from the company. I spoke with the first agent in which didn't recite the correct payment that was received from me by the company. I got the agent to research the payment I had just processed to make sure the company was not play with such a huge amount of money. After getting the recent payment information confirmed, I proceed to ask what the balance was on the account. The agent was completely confused and begin to argue with me. I requested to speak with the supervisor in which I was advised there was still a balance on my account and that I payoff demand was faxed to me on yesterday. The supervisor proceeded to tell me that a payoff demand take 48 hours to process after I advised him I never received such information. I proceeded to request one more payoff demand to be mail via mail to me. The supervisor was very irritated with me as well as the what I was requesting. In the middle of the supervisor processing my requesting and me voicing my opinion about how this is being handled, the supervisor hung up on me. The supervisor's name was Jason and was not nice at all especially to a person that was paying off their account. The request that I have asked from this company is not unheard of but how I was treated for attempting to fulfill my commitment to a contract was unprecedented. I had more time to review the company that was now over my loan and the company has several complaints as well as reviews about how their billing and services are handled. If this company has so many concerns and alarming complaints, why is there no one regulating this? Why is there no check and balances in place? Me being a consumer should not have to deal with issues like this coming from a company rated so high by the Revdex.com. I'm in complete awe and disbelief that I'm not having to reach back out to this company to confirm payoff request has been processed and being mailed to me. The values that are displayed within your employees is a direct reflection of this company and the services they have to offer! This company is not consumer friendly and they do not have the family values that are portrayed across their brand!

Desired Outcome

For me to receive a new pay off request reflecting the payment that was received by your company of 5/9/18.

Bayview Loan Servicing, LLC sent M&M Mortgage Services to change locks and to winterize my home. They did more snooping then work.
This company went into my home and searched through everything. They pulled down curtains, rods ,blind, and left used materials all over my home, used my personal property to do whatever worked they did and took what they wanted from my home. I called both parties involved neither bothered to respond.
As I looked through the complaints for this company, I'm realizing this is what they do, go into your home make a mess and take what they want, and they are getting away with it. It seems as if Bayview is co-signing this type of behavior.

Desired Outcome

I want what was taken from my home returned, I know that's not going to happen. I was charged fees for M&M Mortgage Services, Inc. to go into my home, search through it, take what they wanted and leave a mess behind. I shouldn't have to pay for this. I want rental fee and charges for the use of my equipment and products. As comical as this *** be, my personal property should have been HANDS OFF.

Regarding Complaint: XXXXXXXX

I do not accept Bayview's response to my complaints because I do not agree with their findings and explanations. I'm amazed at the novel that was put together for this response directed to the Revdex.com when all I asked with my many calls to Bayview was just a few minutes to discuss these issues.

Bayview implied that on April 13, 2018 a representative contacted me and it is when I voiced my complaint regarding the vendor that winterized my home. This is not true. I contacted Bayview on April 13th with questions regarding my account. After this discussion, I then asked for and update regarding the complaint that I submitted on March 22, 2018. I was told that there was no such record. I explained my complaint and told this CSR that I faxed a copy directly to the Asset Manager for my account Sveen Zamalloa at XXX-XXX-XXXX, a copy to XXX-XXX-XXXX and I emailed a copy to ***@bayviewloanservicing.com. She checked on this and told me that the company said everything was done professionally. That's when I told the CSR that I had some pictures. She asked me if she could call me back me to let me know where to send the photos. Later on that day she called back and told me to send them to her (***@bayviewloanservicing.com), that way she could make sure they were properly handled, and follow up with me. I emailed this information to her on April.15th. This is why I got a call (a return call) from Bayview on April 13, 2018. See my attachment for a copy of the emailed I sent.

Regarding the reinstatement concerns:
This $1673.30 figure, where and how it was applied and whatever process they are trying to complete is the first that I am hearing of this. And that Sveen Zamalloa verbally conveyed this information to me is a flat out lie. I have not spoken to this person since March 19th. If need to I can get my phone records to show when Bayview called or didn't call me. Better yet calls to Bayview are said to be recorded, pull the recordings for this specific conversation Mr. Zamalloa allegedly had with me.
Other than the April 13th return call, the only call that I've gotten from Bayview was on *** 9th to tell me that they received my complaint from the Revdex.com and they will get back with me.
I asked for a simply statement confirming that my loan had been reinstated and any pending and future foreclosure sale were canceled. I don't think that such an outrages request. Legal advice told me to make sure that I get such a statement. I even asked the foreclosure firm that was handling the foreclosure if they would give me such a document after payment was made. They told me that the mortgage company should give me a confirmation statement .When I spoke with a CSR after I made payment regarding the confirmation she said the statement was in the works. But here we are more than a month later and I still haven't gotten anything. Every day my mailbox is full of mailings from people/companies who want to buy my home before the June 5th foreclosure sale. So I don't know if the sale is still on or not.

The problem with M&M Mortgage Servicing:
The lack of response for the complaint against M&M Mortgage was already disrespectful and unprofessional and now the lies.
I understand they were only doing their job when they went into my home without my knowledge. All I expected from them was to be professional about it.
Photos 55 - 59 shows the toilet seat and lid are raised and properly attached. When I enter my home the seat and lid was broken off. You can see in photo 08 the after winterizing that the lid is broken.

Posted photos XXX-XXX,XXX-XXX, 190, XXX-XXX, 226, shows everything that I complained about, except they showed what this company wanted them to show. I was so amazed to see in the photos that after they pulled my curtains, rods and one of my blinds down, or left them hanging off the rods and piled up like trash, they took pictures as if that's how they found them. The dressing to these windows were all properly hung ,blinds lowered and along with the curtains closed, just like in photos 35-42,47 & 48. And just like the window in photos 221 & 222 shows one of the windows in that bedroom with the curtains properly hung and closed, it's exactly how the other two in the room were. I started to re-hang the curtains then I stopped and took pictures. That neighbor that you claim gave information regarding me and my home, ask them if they were ever able to see through my windows. Ask if any of my windows were ever open without blinds, curtains, or curtains hanging off rods as shown in the photos?

Photo 68 - This is the closet that they really took the time to go through, the picture shows how it looked when they entered my home. When they left stuff were moved around and hanging out of the closet. It you look closely you will see my HVAC system filter on top, this filter ended up near the bottom of the closet.

Photos 102 & 103 - Shows my grill in the garage you can also see the cover that was on it when they entered my home. Take a close look at the photo no dust or element affects. Why did they feel the need to uncover my grill and just toss the cover to the side? Pictures could have easily been taken with the cover on.

Photos 106 & 107 - Shows my ladder in the garage that ended up upstairs. As you can see from the pictures it's in the garage. Take a look at photo 165, it shows a picture of a tissue holder upstairs outside the bathroom. Now look at my photo showing where I said they left the ladder, you can clearly see this same tissue holder and it is not in the garage. If you want to say I staged this, asked yourself why would I stage a photo of a ladder of all things???

Photos XXX-XXX,XXX-XXX,159, 160 - Shows the dining area where I store the boxes as I packed them. The empty space between the iron *** and box is where they left my desk chair that was brought from my bedroom. Look at the photos that I sent in, in my complaint I question why was my chair brought downstairs. They made a point to take a picture of every little thing and area in my home. Take another look at the millions of pictures that are posted and see if you see this desk chair in any of them. Why not? I'm thinking the plan was to take that chair with them, but I guess it was too noticeable to take out of the

house. But before then they sat comfortably as they searched through my packed boxes. The space in photos 216 & 217 is where I left the chair.

Your response was ended with if I have any questions I can contact the Customer Service Department. Well I have done so at least ten times regarding these issues, and all I get is their favorite response "I'm going to escalate this ticket and someone will get back with you soon". I should have at least five escalated tickets that have never been responded to. But I will contact customer service again and I hope that I can have a discussion with Ms. Schamerhorn.

My mortgage loan was charged off by Bayview and they are unable to provide me with the necessary information regarding the charged off.
My loan XXXXXX with Bayview was modified back in 2010 but was charged off in 2011 with 0 balance remaining. I was under the impression the loan was satisfied but during a recent transaction i'm being told my loan still has a balance and it has been accumulating interest of $10/day. I've called bayview numerous time the past months and I have been bounce back to several departments with different answers. I am very frustrated because they have no information why the loan was charged off, and when a 1099 was sent to in the past. I was making payments on the account. I extremely upset that Bayview don't have any information on their system regarding my loan details. I am at a point looking to do a settlement with bayview for a lower amount to have their name removed from the lien. I need to settle this debt and adding $10/day on a loan that Bayview have accurate record of and that was charged off is not ethical.

MY original amound was 91k but now it is over 104k with $10/day accumulation.

Desired Outcome

I am looking for bayview to contact me to workout a settlement agreement due to the poor mismanagement of the loan and the lack of information from customer service. I am looking for a settlement that I can afford to have the lien remove on the property.

Hello Revdex.com,

This case can be closed. I've reached out to Bayview and we were able to come to a settlement that's suitable for both parties. Surprisingly, Bayview did live up to its expectation with putting customer satisfaction first. Really appreciate the cooperation and the settlement.

I believe I've been a victim of predatory lending. I obtained this loan back on August 2005 thru Citifinancial here in Richmond Virginia. The loan was marketed as a Home Equity loan in order to pay off my credit cards etc. The amount was $136,000 @ 7.9% interest for 30 years. I recently went to my bank for some business and we had an opportunity to look at the terms of the loan. I was told that this loan seemed very deceptive and not what the industry standard should have been then or now. I have been faithfully making payments of $995 every month for the past 13 years. However, I've just realized that about most of my monthly payments around $750 have been going toward the interest. In fact on Tuesday of this week I asked for a payout amount and the amount was around $128,000. Which means I've been paying over $11,000 a year for the last 13 years and only reduce my outstanding balance by $8000. This does seem right.
Account_Number: XXXXXXXXXX

Desired Outcome

Other (requires explanation) I'd like to have a fair amount of the money I've paid allocated to the principal of the loan. Also, if possible the percentage rate adjusted to the industry norm which is about 6%.

Mortgage company holding insurance money belonging to home owner (me). Every time they ask for something we give it to them, and they come up with something new needed and refuse to send check. The final straw was they asked for proof of mortgage payment, which has been set on auto draft since the beginning loan. We have provided this and now wait for the next thing they will come up with so not to give me my money.

We sent they a check for more than our mortgage amount to prevent the nickle and dime stuff, the won't send back the overage.
Last fall our mortgage was sold to Bayview loan servicing, I believe it was because we were paying it off to fast and Citifinnical wanted to get out of the country. Our house burned down Jan. 16th 2018, the insurance company wrote out a check to Bayview and us for well more the the mortgage with instructions for us to endorse and send to Bayview with instructions to them on what to do with it, we sent it them on Feb. 10, 2018. We got the signature certification in a week or so. Since then they have done what seems like everything they can to put off paying us the remainder with is about $85,496.65.

Desired Outcome

We want the $85,496.65 they owe us as soon as possible, so we don't have to legally go after for damages like loss time and everything else a good lawyer can think of. We've tried.

To whom this *** concern:
I'm writing to complain about this company because of the predatory lending on their loans. The interest rate is like 34 percent and this is not right. My mother died in 2004, before she does she fell on hard times because her husband died in 1997 a she was responsible for paying all the bills. She wasn't educated so she went to this company called green tree who sold her loan to this bayview loan servicing. My complaint is... my bother lives in my moms house who been to Iraqi 3 times sweving this country. He only owes like 1200 on the house before it would have been paid off.. bayview are saying that the house matured in December 2017... so ALL the money he was sending in was put in a suspended account as a credit BUT IN THE MEANTIME , it's addin more fees and making it look like the house payment aren't being paid.... now bayview has put the house loan in foreclosure... the little over $1200 now has grown to over $5000. This isn't right because the house loan should have been paid off years ago BUT this interest rate is outrageous! I think companies like this should be held accountable for their actions against the consumer! I will be contacting a lawyer because this was what the guy *** M... explain to me.... his direct number is XXX-XXX-XXXX this shows up as a Miami
Florida telephone number. This guy told me that if he couldn't make the 1200 payment by the 27 of April to let him know... not one time did he say anything about foreclosures!! I'm upset because my brother is doing all he can to keep our Mother's house.. he's on a fixed income! I know people have been a victim of predatory lending companies and my mother is one of them!!
Thanks for your time and for reviewing my complaint!

Desired Outcome

Billing Adjustment My brother would like to pay what bayview said he owes which was only around $1300 and get this account Closed!! Thanks

My husband and I fell behind in our mortgage payments and applied for a loan modification with our lender in December of 2017. Since that time we have had multiple requests for additional information. The most recent was during a telephone call with *** on 4/13/18. He told us that we needed to send in bank statements for Feb. and March. These documents were faxed to the # provided on 4/16/18. On 4/20/18 we received a denial of our modification request and the reason stated was that we failed to provide requested documentation. Since then we have left 7 telephone messages on 4/20,4/23,4/25 and 4/26/18. We even scheduled a call back time for 4/25/18 @ 1:00pm and received no call. We have not received any call back. I did speak with a Iyata on 4/26/18 and she informed me that *** was the only person who could talk to me about our account. She did confirm that they had received our bank statements on 4/16/18. She was going to send a message to David's supervisor to call us back. As of today we still have not received any call back.

Just did a modification agreement Bayview is not showing payment even though it was done by electronic transfer by phone. Received late fees and for some odd reason even though my property taxes went down; Bayview claims they did an analysis on my escrow and still will not reflect it in a adjusted payment OK people enough talking and complaining about this company. Unfortunately big banks do not understand or take you serious until you file a class action lawsuits like the mortgage customers of BANK OF AMERICAN for overcharges, not applying payments in a timely manner, and late fees and violations of FHA to the tune of a 29 million dollar settlement. Bayview just lost a lawsuit for violations of FHA and regarding the loan modification. The Montana Supreme court and Florida Circuit court ruled against them for their business practices so there are precedent cases. Just do it!!

my parents house burnt, received ins. money, would not let but house on land and now don't have money to put on the account.
My parents house burnt on 3-5-18. the insurance gave my parents the check and we sent it on to bayview. they got the check put in unapplied fund account. they will not let my parents put a trailer on the 18 acres of land. they tell me they don't have the money which I have proof they have it. they will not dropped the interest that has been accuring since 3-5-18. they have made two payments on the house. I get a different story everytime I call and have a big notebook as this has been a daily process to get them home. as my parents are 72 and 70 and my dad has leukemia. I feel this company has taken advanatage of not only my parents but other elderly. the people there are the *** people to deal with. I have been told my parents get the money back, then they can put a trailer and now they can't and they can put a trailer anywhere on the 18 acres of land and this land has been in the family over 150 years. is there anyone that can help me? my parents can't afford an attorney to pursue and all they want now is to get the insurance money applied to the balance and the interest be dropped since 3-05-18 and if you pay something off earlier it should be for a lesser amount then for the year 2041.

Desired Outcome

I want the interest dropped, payoff lesser since will pay off earlier then 2041.

Will not provide the Deed of Re-conveyance after the loan was paid in full. Interfering with a refinance.
In September 2017 our loan with Bayview was paid-off in full by New American Funding. They have continued to be on the title to my property. I have contacted them trying to get a copy of the deed at which time I was informed it would be THREE weeks. A copy of the deed would suffice but they will not send it. They stated that they sent the deed to my attorney from our BK. I have informed them that I am no longer represented, he no longer practices and that my bk was discharged four years ago. I have sent the necessary paperwork a half dozen times as well as my did my attorney in 2014.

All I need is the deed to have them removed from the title since they have not done do.

Desired Outcome

To provide the deed of reconveyance

I have been trying for the last two years to get my home loan modified after losing my second job and falling behind. I have been given the run around for two years with loan representatives not conveying needed information by phone or email, not sending me needed documents and then denying me for not having them, not checking the documents I send until I call and ask them to, not answering my emails and at the same time sending me letters about foreclose even though we are paying our full mortgage now. I was told once they could not email or call their customers to let them know if they received documents. Well then how do we know where we are in the process? I can never get in touch with the person working with the modification and when I do they never know what is going on or have in hand the latest documents that have been sent. I have asked to be sold to another bank but that was denied. They don't do refinancing so basically I'm stuck with a company who cares nothing for their costumers and seems to only pay their people to sit at their desk rather than help people who are striving every day to provide for their families and actually pay their debts. This is not a company anyone should seek to work with. My loan was sold to them. What a dark day that was.
