To Whom It May Concern and All Parties Involved,

I have been trying extremely hard to save my home that I have lived in and raised both of my children in, since 2005. Through unfortunate circumstances at work, I was injured. I then, lost my job and eventually was able to get it back, again within the Police Department.

Unfortunately, as you can see from the emails below, my lender, Bayview Loan Servicing, LLC, has not been willing to assist me with my efforts and desires to keep our family home.

On 11/29/17, I emailed Bayview Reps *** and customer service and requested information to have a loan modification due to my recent changes with my employment. Instead of giving me loan modification, I received a "Notice of Sale" and a "Notice of Trustee's Sale" which would become in effect on January 4, 2018 (Foreclosure) (Please see the attached PDF).

On 12/01/17, I called and asked for loan modification documentation, but still no reply.

As you can see, I have been more than willing to work with Bayview to keep my home during these unfortunate and unforeseen circumstances, yet the feeling has not been mutual from Bayview.

Can someone please assist me with this continuous and ongoing matter? I've been trying to get a loan modification processed, but Bayview will not respond to me with the proper documentation.

I constantly receive calls trying to reach ***. My name is ***. I have never done business with this company.
I have no business connections with this company, but I receive calls at least every week trying to contact ***. My name is ***. I have explained that I do not know the person they are calling, and ask them to not call anymore, but they persist in calling. I have just gone through this with them again. The person making the call identified herself as *** I again asked that they not call me anymore.

I have not contacted them. They call me. I do not want anymore calls to this number. I am not the person they are trying to reach.

I accept their promise to remove my phone number from their calling list. However, they only list the most recent calls. This practice has been happening for a number of years. When I would complain to the one calling I would be promised that they would remove my number, but after a few months they would call again. One of their callers, about 2 years ago, when I told him that I was not the person and to not call again, accused me of covering up for the person and lying to them. If they do not call again I will be fine with it.

Breach of Contract required attorney services
On Oct. 10, 2017, Bayview Loan Servicing breached my Home Affordable Mortgage Program (HAMP) contract dated December 17, 2012, by changing the terms of my mortgage. The loan terms increased from 2% to 6.87%. As a corollary the automatic payment amount became $2,379.59. Upon this discovery, I contacted Bayview Loan Servicing on the same date through the customer service number, ***

I spoke with a customer service agent, ***, who stated that she was not able to provide any information regarding my account due to a legal representation injunction placed on said account. I requested to speak with her manager and *** a collection specialist, confirmed the information regarding legal representation. *** was also permitted to provide further information as the account had a notation that the customer was under legal representation.

This information was surprising to me. An attorney has not represented me since finalizing my HAMP process in 2012. Since the close of HAMP, I have called Bayview Loan Servicing for various issues, such as setting up automatic payments and changing my address. The customer service agent never stated that I needed to have an attorney speak on my behalf. I felt betrayed and extremely upset by Bayview's actions.

After speaking with Bayview Loan Servicing, I contact *** from the Law Office of *** in San Diego, CA, and we discussed the events described above. *** contacted Bayview Loan Servicing and discovered the same information. It took Nelia several days for the breach on my loan account to return to the HAMP contracted terms.

A breach of contract is a party's failure to perform any term of a written or oral contract, without a legitimate legal excuse. Bayview breached our contract through the unauthorized increase in monthly loan payment term, the increase in the loan interest rate term, and the failure to exercise proper notice of any increase.

Bayview's actions are also negligent. Negligence has the elements of duty, breach, causation and damages. Bayview owes a duty of care to place the proper notations and information on accounts so that customers can freely communicate with their loan-holder. Bayview breached this duty by placing an incorrect claim that legal representation was the only method of communication with its customer. Due to this breach of duty it caused damages in the form of attorney fees.

I requested that Bayview reimburse my attorneys fees and they have refused to respond.

Repayment plan started 8/1 of deposit of 1,000. Then four more payments of payment plus $200 extra, now stating we owe an $500 more.

Extremely overcharged for late fees, attorney fees, insurance fees, and miscellaneous fees.
I obtained my original mortgage with Bank of America in 2005. My original loan amount was $192000. Since the original start of my loan in 2005, I have proof of payment for over $168000 in monthly mortgage payments. The transfer of my loan from Bank America to Bayview Loan servicing did not report accurate escrow or loan amount. Since Bayview took over the loan, there have been numerous charges added to my account associated with miscellaneous late fees, suspended/inaccuratee payment reports, insurance billing, attorneys fees, and misc. fees.
My current loan amount is showing that I owe $193000+ which is more than the original loan amount. Surely, this must be a mistake on the lenders behalf since I have proof of over $165000+ in mortgage payments since 2005.
I currently have an offer for purchase on my condominium and the payment plan statement I just received says I owe over $9000 in addition to the current loan amount for $192000. The payoff quote request has been suspended online and I am unable to get an accurate payoff amount. Please have someone review this account for payoff amount as soon as possible. It is holding up the sale of my home.

Please credit back to my mortgage account for the inaccurate miscellaneous billing, unjustified attorney fees, unnecessary insurance fees, inaccurate late fees and mortgage payments that were not accounted for on my statements. I have submitted many disputes in writing, through my account website, through the insurance department and over the phone.

Bayview purchased our 1st mortgage home loan from Bank of America, since taking over they have refused to provide mortgage billing/escrow statements.

I have contacted them several times but each time they insist they can not speak to me because we have an attorney of record, We do not. We had an attorney in 2016 that represented us in a bankruptcy case which was discharged in March 2017, they know this yet still refuse to deal with me, the home owner and mortgagee. I an convinced they are attempting to hide escrow/insurance and possibly payments in order to force our home into foreclosure so they can somehow profit from forcing our loss..

I want this issue resolved, want access to online mortgage information and bill pay, mailed monthly billing statements, annual interest and escrow statements. Nothing more than any mortgage company does for its clients, yet they refuse.....

I was denied modification several times,until I was way behind my payments, and they did it purposely to keep my home.
My name is ***, I have been living in Modesto CA since 1999. My original lender Bank of America gave me a modification in 2008. I requested it because I struggled to make the montly payments. In 2013 Bayview took over my loan and I became behind on my house payments because my husband lost his job. I keep requesting Bayview loan for a modification and they denied more than twenty occasions. I qualify under "making home affordable" program, but they dont want to give it to us. I hired an attorney and he promised to get my a modification but instead I got a email from him telling me that my home is going to sell in auction on 12/04/2017. Many people like me are still struggling with some unscrupulous lenders like Bayview.

In 2013, Bayview took over our loan and we were behind because of thr drought here in California my husband's business declined and, we fell behind a few payments. I requested a modification under the program Keep Your Home California, I was denied several times according to Bayview 15 but the results are the same, my family's home is going to sell in action February 18, 2018 I didn't get any alternative from you, my former attorney (which is no longer representing me) sent me a outrageous agreement, it insulting (which is being attached) a letter that Bayview sent me stating that I didn't submit a modification prior to the foreclosure, but they states that I was denied 15 times. Bayview keeps contradicting themselves, I filed for bankruptcy per my attorney adviced, to stop the
the sell of the property. My attorney suggested to file so he cpuld have enough time to submit our complain. I thought Bayview was going stop the auction process until we could agree on a modification but it never happened. I am going to continue working on an agrement with

Bayview loan servicing llc has refused to add $2700 extra payments to my principle of my mortgage. I have called several times and was told several times it would be done. I was also told extra money goes towards principle automatically. Then I was told no it goes into unapplied funds because they dont know what to do with the extra money but thats a lie because they applied it ALL to regular payments which means im paying on all that interest im trying to avoid.. I wrote on the stub principle ONLY, HIGHLIGHTED IT, MARKED ALL OTHER OPTIONS OUT, AND WROTE ON THE MONEY ORDER ITSELF...PRINCIPLE. Somehow they still used the funds however they wanted. I also got a statement for march after they informed me im paid up for 3 months because of there error that they are charging me a $18 late fee and another $18 processing fee'? I called again 5th time this month because $700 was suppose to be applied to my principle earlier this month and was never applied. Ive paid $2700 towards principle and pay extra every month and my outstanding balance is still 57000. Ive been lied to and misinformed about how extra payment are applied and my money has been handled inappropriately even against there own stated polices regarding extra payments towards the principle. This needs to be fixed. I should have to call every time when on the money order AND the paystub I write PRINCIPLE ONLY. They obviously got my money order with it written so they had to get my paystub with it written and highlighted and told that my payments are already auto drafted. How hard us this to accomplish'?

Incorrect information reported to Credit Agencies.
Property was foreclosed on and account should be closed.
Bayview Financial Loan (aka Bayview Loan Servicing) has inaccurately reported to the credit agencies on a Real Estate Loan Account. It is inaccurate in 2 parts of the report. 1. Bayview has been incorrectly reporting '120 days late' from April 2016 - September 2017. a. I was relieved of all liability of this loan when property was foreclosed March 2016. b. September 7, 2017 I requested that this item be changed to show the last date to report as '120 days late' to be March 2016. 2. Bayview has been incorrectly reporting loan closed / terminated as of May 5, 2017. a. I was relieved of all liability of this loan when property was foreclosed March 2016. b. September 7, 2017 I requested that this item be changed to show the loan closed / terminated as of March 2016. 3. October 25, 2017, Bayview Financial Loan sent me an Escrow account statement letter detailing fund distribution from March 2016 - September 2017 in the amount of $13,779.75 and funds received of $2,276.99. a. This property was foreclosed in March 2016 b. I did not make any payments to Bayveiw Financial Loan, ever. c. When I called to get more information, they claimed I am in bankruptcy and they cannot discuss my account without my attorney present. I have never nor am in the process of filing bankruptcy. My attorney did not file nor address bankruptcy in any call, letter or document when attempting to contact Bayview Financial Loan on my behalf. d. The representative at Bayview said they would contact my attorney and get back to me. I have not heard back in over a week. Prior to the September 7th letter, I have made multiple attempts to have this inaccurate information corrected by Bayview Financial Loan since August 2016, with no resolution. I have furthermore sent the same letter and supporting documentation to the 3 credit bureaus in a dispute. Only Equifax and Transunion have corrected their reports, although Experian acknowledged the dispute, it has not made any correction. I have also enlisted the help of an attorney to have this corrected and he has not been able to gain any response from Bayview Financial Loan

I have been having to deal with Bayview Loan Servicing, LLC since CHASE sold my loan to them, which is approximately 6 months. They continue to hold my mortgage payment until after the due date in order to attempt to collect late fees. I contact them by phone and continually get disconnected without my issues being resolved. I received a draft from my Insurance Company listing Bayview Loan Servicing, LLC as a 3rd party payee and when I contacted them FOUR TIMES THIS MORNING, I was disconnected 4 times, without any assistance whatsoever. My call was transferred repeatedly with no employee giving me the information I needed, which was just an address to send the draft to be endorsed and returned back to me so I can have the roof repairs done. I have the property sold, with a closing date of 12.12.17 and time is of the essence.

I completed a modification to my mortgage. But they have been reporting me past due ever since and haven't updated my account.
The statements are saying I am not making a payment for months, then 3 months later; they are updating my previously made payments. When I call them, they tell me I am not past due and that I was not reported past due and that if I am showing past due on my credit report; that I need to call the credit reporting agency.April 2016 my employer Verizon went on strike. My income was reduced to 800.00 a month. I called M&T to setup some kind of arrangement to keep my mortgage current. The representative connected me to Bayview Loan Servicing who handles arrangements. I was told that I could apply for a modification but I had to wait until after April 16, 2016 so that my account would show in the arrears. I called back after that date and applied for the modification. I received a call a few days later that I was approved for a 3 month modification and that I needed to pay taxes and interest and my payment would be 222.84 and that I needed to make a payment that day, but also had to mail my payment to Bayview or call Bayview to make the payment by phone. I made the payment (all three payments) by phone and in July I received an alert from Credit Karma that I was behind on my mortgage. I called Bayview to see why I am reporting behind and I was told that I would report past due until I satisfied the 3 month modification. Once I satisfied it then the account record would update to current. After I completed the 3 month modification, I received a letter from Bayview telling me to call in because my account was in a past due status. So I call very upset, asked to speak with a manager. The manager tells me that I was given wrong information in July. That she sees the notes from when I called but that I was given the wrong information. She said she will setup the correct kind of modification to bring my account current. She said it will update that I am current but during the modification process I will show past due (again).Subsequently, I applied for the new modification with the manager to bring the account current due to the misinformation from the previous modification. I made my September payment. I received a call that I was approved for the new modification on 10/31/16 but that I needed to make two payments that day (to cover for October and November) to initiate the process. I was told to pay 808.43 each month for 3 consecutive months to successfully complete the modification. The manager said once again, that the account will update from the previous past due. But that it will show past due until January when the 3 month period for the modification is completed successfully. Again I had to call Bayview to make each payment. At the end of December 2016, I received a call from Bayview telling me that my modification had been completed and my modified payments were 599.00. I began making 600.00 even payments to Bayview. I was told that I still had to make the payments directly to them until everything was completed on the backend. When January came, my past due was updated from being over $5,000.00 behind to a little over $1,000.00 behind. So there was some kind of update but it did not fully bring the account current.On the annual escrow account statement dated 7/25/17, I was advised that my new monthly payment changed to 779.38. So I began making $800.00 payments. As you can see by the statement date 7/26/17, all of my payments from the beginning of the year were applied in July to my mortgage. I enclosed the statements showing my payments, showing that I was past due (even though I call and am told to disregard those because the modification is being processed). To date, I am still getting notices that I am past due.I spoke with *** on 8/21/17 who said that my account is not past due. He transferred me to *** to confirm. *** said my account has not been reported past due and that I need to reach out to the credit bureau. Now 11/13/17 I get a call from bayview collections that I am 2 mths past due.

Desired Outcome

I am wanting my mortgage to update that I completed the modification in December 2016, I am wanting my credit report to not show that my mortgage has been past due since September of 2016.

As You can see from the notice that I agreed to, it says in the final loan modification agreement that I will pay 575.49 beginning 1/1/17 to 12/1/2056 (item 3, page 3 of 12). Then I was notified 7/25/17, that my payment of 799.87 is effective...but backdates the effective date to 1/1/17. How am I suppose to know that I am to pay 799.87 starting 1/1/17 if the documents state 575.49. So, this looks like Bayviews error...which should not fall back as an error or past due on my part.

I am not sure why Bayview keeps resending the same response but are ignoring section 3 that specifies the 575 payment. Also, I included the July 2017 statement, that says that my payment changed effective 1/1/17. Where can Bayview show me that I was given another figure besides the 575 prior to 7/25/17?

I am very unnerved to find that so many customers have had the same issues with this company. I have had a similar problem with this company and I am being charged for a missed payment that was not my fault. Bayview did not take the correct account number, 2 months in a row, and I so I was two months behind. I was then charged for NSF fees and I made a deal to pay back my missing payments. I am now paying 200 dollars more to make up the shortfall. I also got a notice that my escrow fees were not paid either. This whole company is a disaster and I have had enough. My loan was sold to this company and I have had nothing but problems with them. I do not recommend them and they need to be shut down or serverely reprimanded.

Baview Loan Service will not up-date my account to reflect that I pay my own insurances. I do not need any kind of escrow.They've added over $15,000.
Bayview loan servicing took over my loan from Citifinancial. They made me pay $3,325.44 at the beginning even after I had already paid that amount. In addition to me paying that amount they again added it as a deferred amount which still lingers on the account. Therefore, I was wrongly charged and again had no one who was willing to rectify the situation. Someone that I had spoken to said it was an error and that he would get back with me. The next thing I knew, they added that same amount onto the loan amount. The next issue with Bayview Loan Servicing is that they refuse to up-date my bill to show my regular payment of $1095.10 per month. I pay my own taxes and insurance and has never given anyone permission to open an escrow account, nor do I need and/or want an escrow account. I have never had an escrow account. Every time I call the company I am shifted to someone else. People in the company let me know there is a problem, but no one can seem to remove the additional charges and outrageous cost. I am being charged over $1200.00 per month in addition to my regular payment. This is insane. There is no amount of insurance that cost over $12,000. per year. When I have tried to make my regular payment of $1095.10 I have been told that I would lose that money because it would sit in a suspense account, and that I would not get credit for it. All I have asked of this company is to adjust the un-necessary charges and allow me to get back on track as I had been before. I have had my insurance company talk to someone in the company to verify information, yet some people I talk to in the company said the account would be adjusted and others can't seem to provide professional customer service as I try to rectify the problem. This has been going on for over 2 months. When I found out in September, 2017 that additional charges were added, I called the company to get the problem rectified and to make my usual payment. Now time is passing *** I gave them time to fix the billing situation as they said they would but yet another month is about to past with no resolution. Where is the care and positive customer service in this company? Why am I constantly being given the run-around?
When will I be able to get this situation solved? I have never paid escrow and do not need anyone else to pay my insurance. Furthermore, if anyone would look at the amount charged, they could see that it is outrageous. Some of the people that I have spoken to in the office have agreed that they don't know why the cost is what it is. I am being charged more per month than my regular payment of $1095.10. Bayview is charging me $15,389.52 for flood insurance! Wow, this has to be a mistake. How can that charge be corrected and deleted from my bill? Your prompt assistance is appreciated so that I can get back on track and gain trust of the company. Thank you.

I am asking that the $3,325.44 that was deferred be removed. I also am requesting that the escrow be removed from my account so that I can continue paying my original amount of $1095.10. I pay my own insurance and do not want to be forced to pay over an additional $1200.00 per month. I need my bill to reflect my true amount owed. Some of the people who I have spoken to at the company said that they always suggest that people get their own insurance and told me that I was able to get my own insurance. I got my own insurance as in the past. Some people I had soken to in numerous attempts to get all of this corrected also said that the price that I was required to pay was awfully high and that they had never seen anything like this before. Yet, it seems as though no one in this company can provide me with accurate billing inquiry. Remove the escrow and provide me with regular monthly billing of $1095.10.

In November 2017 I made 3 payments, each in the amount of $1.095.10 for a total of $3,285.30. Such payment brought my account up to date as also indicated by Mr. Tony Montiel of Bayview Loan Servicing. As you can see from their response, they are aware that they made mistakes. After speaking to Mr. Montiel on November 30, 2017, he informed me that my account was current. However, the company is still trying to charge me an outrageous fee of an additional $3,415.26. I still don't understand why such exorbitant fee still exists. In addition, Mr. Montiel told me that the company would be adding an additional $78.00 per month to my account for 60 months. This is an approximate total of an additional $4,680.00. When I told Mr. Montiel that I didn't understand why I have to pay that amount, he told me that the cost did seem high and that he would look into it and get back with me next week. Clearly, there are too many mistakes and additional money trying to be collected. No amount of insurance cost over $3,000.00. Then he quoted me two different figures. He first said that I had to pay an additional $3,415.26, and then he said I would have to pay that by adding to my monthly payment. Well again, adding $78.00 per month is $4,680.00. I am still in the same place where I started. The only thing that has been done is that I was able to pay 3 months of payments to get my account up to date. There is still additional cost that are not correct. I should not have to pay an additional $3,415.26, nor should I have to pay an additional $78.00 per month for 60 months. Something is clearly wrong.

Please be informed that the business response from Bayview Loan is NOT satisfactory. After trying to obtain an understanding and positive experience from Bayview Loan Servicing, they have carefully chosen to portray themselves as providing appropriate business practice, when indeed this is not the case. Information that has been provided as a result of this investigation should have been provided to me at the beginning when the loan was first taken over from Citifinacial. Instead of giving me the run-around, someone should have been honest and should have given me time to get what their company required.

I spoke with Tony Monteil from Bayview and the story has changed. Throughout the conversation, I was initially informed that the insurance department was a part of Bayview. Now, I have been told that the additional cost that I am being forced to pay is due to the exorbitant amount charged by Proctor Financial. Bayview agrees that the amount charged is high, and that I need to find out from them why it is so high.

Due to the excessive additional fee, I am being charged an additional $62.17 each month for the next 5 years. I find this unfair and certainly not consumer friendly. Again, Bayview has found a way to get additional money from me. This is stealing in a sneaky way. I have purchased my own insurance and have been informed from other insurance companies that the amount that I was charged for the months that they chose not to work with me is extremely high.

The extremely high forced placed money was not only due to charges assessed by Bayview, but also Proctor Financial. Together, they found a way to profit from the poor. Mr. Monteil from Bayview provided me with Proctor Financial's address of 5225 Crooks Rd. Troy Michigan XXXXX. He said that he would like to know also why the cost was so high.

When I tried to talk to someone at Proctor Financial, I again was met with women who were rude and did not care about the cost. I spoke to someone who said her name was Brianna. When I was getting nowhere with her, I asked for a supervisor. Someone by the name of Lynette came to the phone and rudely let me know that the cost is the cost. Again, I ran up against a brick wall and got no help. Needless to say, they were not courteous nor helpful.

When several people I had spoken to at Bayview throughout this time said I would be given time to get insurance that I never needed before, clearly it was not true. They also agreed that the cost was truely too high. They force placed flood insurance from the beginning of the loan takeover and did not indeed give me ample time to get my own insurance. Because of the investigation, the companies did an upcharge and provided a response that still does not address the exorbitant cost or the lack of positive communication.

Therefore, I would like an investigation on why Proctor Financial chose to charge such high cost. I have purchased my own insurance for a year that is no where near the cost of what Bayview and Proctor charged me for just a few months. If staff at Bayview find the cost too high, why was it justified? I am still being charged a fee that I don't understand.

I also am requesting that the additional $3,730.20 be investigated. That cost for just a few months is unbelievable and unjustified. The additional $62.17 that Bayview has added to my monthly amount is a hardship. I was told by Mr. Monteil of Bayview that the cost could not be added to the end of the loan. Therefore, it is clear that their motive was simply to get more money from me, and demand that I pay regardless of the situation.

Results from Bayview are unsatisfactory and the amount should be adjusted, as everyone agrees that the cost is too high for just a few months. They are now passing *** buck to Proctor Financial.

This entire situation has affected not only my finances, but also my health. Such gross mistreatment and inhumane practices have caused me to feel very uncomfortable with the companies involved.

I have to say I had no problems with receiving a re-modification with Bayview Loan Services, LLC. I have read so many bad reviews but with me it was the total opposite. I don't know if I can say her name but the person who assisted me was so wonderful, she had no problem doing everything via email. The experience I had with Chase Mortgage was horrible, they sold my mortgage to Bayview Loan Services. They did not want to re modify when they still had the mortgage when in fact they had stated yes during the signing of the contract. I fought back and sued them, the court battle lasted five years until I had enough and did not want to spend more money because I now have a daughter in college but I will tell you I put up a good fight. I spoke with Bayview Loan Services. The person was so caring, she explained step by step what I needed to do so that the process could go smooth and quickly. she was an angel on my shoulders I cant even express the gratitude I feel and I only wish her success. I now have a re modification paying less from my original payments. I am so happy this is over with, it was a nightmare that would not end thank you Bayview Loan Servicing LLC.

THE INTEREST OF THE LOAN IS 12.65% FOR 10 YEARS. MY CREDIT SCORE IS GOOD AND THEY REFUSED TO REFINANCE MY LOAN.
THE COMPANY REFUSED TO REFINANCE MY MORTAGE WITH A BETTER RATE. MY CREDIT SCORE IS GOOD AND I HAVE NEVER BEEN LATE IN MY MORTGAGE PAYMENTS AND THIS COMPANY NEVER REPORT MY PAYMENTS HISTORY TO CREDIT BUREAU.

BETTER RATE UNDER 10% AND REPORT MY PAYMENTS HISTORY TO THE CREDIT BUREAU

My payments are not being applied to my account correctly. My asset manager is not responding to my emails.

My mortgage was transferred to Bayview from Bank of America in December 2013. I got behind on my mortgage when I lost my job in 2012. After several attempts to get a loan modification with no success, we filed Chapter 13 in February 2016. We resumed making payments to the loan servicer in March 2016. My mortgage arrears are being paid through the bankruptcy plan by the trustee. The company is supposed to pay my principal/interest and taxes/insurance. I received an escrow history statement from them and to my surprise, my payments, which includes my escrow payment, that I make directly to the mortgage company have not been applied correctly. I am confused because the account history appears to not to show the tax and insurance payments that I send with my monthly payments. I contacted Bayview and spoke with *** in customer service who told me that my escrow payments had been being placed in a suspense account until there was enough to make a P&I payment and then applied to the P&I account. I explained that the account needed those payment reversed and applied to escrow account. He told me that he would submit a request to have the payment reversed and applied correctly but he was not sure that could happen. So, I contacted, via email, my asset manager to ask her what could be done to correct my payments and apply them correctly. I also asked her how the payments from the trustee are being applied. I have not heard back from the asset manager.
The trustee has sent a total of $12,952.56 in payments. I have paid a payment every month since March 2016. I need to ensure these payments are being applied correctly. After I filed bankruptcy, Bayview took online access to my account away so I cannot see online my transaction history.

Desired Outcome

I would like bayview to confirm that my escrow payments have indeed been applied to my P&I. I would like Bayview to correctly reverse those escrow payments from wherever they were applied and apply them to the escrow account. I would like Bayview to send me documentation of the corrections showing that the payments have been applied correctly. I would like Bayview to tell me how the payments from the trustee have been applied to my account. I would like Bayview to provide me with Online access to view my account transactions and history.

The worst mortgage company ever. They aren't professionals and don't care about costumers

Clear violation of State of California's Home Owner Bill of Rights and Guidelines of US Treasury in terms of assisting people with their mortgages.
Dear Madam or Sir: Since November of last year I have been trying to achieve a loan modification with the above entity. Unfortunately up to this date this entity has been playing very unpleasant game with me. Every time that they requested any documents I provided them in a timely manner, however they always claim that they are not in receipt of requested documents. I have recorded my communications with them along with proves that I provided and submitted requested documents completely. The ironic issue is that BLS constantly denies receiving documents. I have clear proof for most recent communication that they are a bunch of liars and are focusing only to foreclose on people's properties with no mercy. BLS has violated my rights as a consumer when I am very good candidate for loan modification. I have contacted Treasury also Housing authorities in state of California and complied with what ever they guided me through, even then BLS denied my demand and claimed my documents are not complete. based upon my research I found out that BLS does this trick on every single case and this is their administrative practice to derail every single request of modification and disregard the laws all together. Please assist me in this matter which will be greatly appreciated.

Desired Outcome

I just want them to comply with the law and stop playing game. BLS must comply with Home Owners Bill of Rights also be reasonable in my modification request and DO NOT consider people stupid.
