Violation of Mortgage Servicing Rules and Fannie Mae guidelines as it pertains to the rights of successors in interest on real estate.
Loan XXXXXXXXXX - borrower name *** (deceased) - Complaint submitted by ***, Executor of Manley Estate, Co-owner on the real estate, successor in interest on the property, & ex-spouse of the borrower.

On April 23, 2018 I began communication with Bayview regarding the above referenced loan. In accordance with the Mortgage Servicing Rules and Fannie Mae guidelines they were required to work with me as a successor in interest on the property allowing me all the rights and remedies of the borrower. I was assigned Efuru Beal/Gilliard as my point of contact and was always sent back to her when I would try to go around her. She refused to act in accordance with the law. She told me things such as you have no rights, that my only option was to assume the loan, that I had to make up the back payments, that only the estate had rights, that I wasn't entitled to exercise the streamline modification offered, that I wasn't entitled to apply for a modification until I assumed the loan, etc. I opened the estate of my ex-husband incurring expense, liability, and responsibilities based on it being the only option to save the home. Upon contacting her again after opening the estate she said again my only option was to assume the mortgage and being executor of the estate meant nothing. Her statements were not only contradictory they are direct violations of the law and the policies established by Bayview Loan Servicing that can be viewed on their website. Bayview Loan Servicing and their representative Efuru Beal/Gilliard are breaking the laws established for just these situations and are currently foreclosing on my home in violation of my rights. As I have phone records proving 13 calls at a total of 157 minutes and all their conversations are recorded I can prove every assertion I am making.

Desired Outcome

Withdraw of foreclosure action, reduction in mortgage balance for interest, late fees, and legal costs, reimbursement of legal fees to defend foreclosure, reimbursement of legal fees for filing response for violation of CFPB, reimbursement for legal, administrative, and bond fees for opening the estate, payment for my time spent researching and communicating with lawyers and government agencies regarding Bayview's violation of the law, damages for the mental anguish and humiliation caused by Bayview failing to adhere to the law, and Bayview to act in accordance with the law in resolving the matter to save my home from their invalid foreclosure action.

Dear Revdex.com ("Revdex.com"):

This letter is in response to your correspondence dated December 4, 2018, received in our office regarding the above-referenced loan account from which was directed by unauthorized third-party, ***. This letter also serves to respond to the substantially similar and/or duplicative concerns expressed in correspondence from the Consumer Financial Protection Bureau ("CFPB") under case number XXXXXX-XXXXXXX, and from the email dated December 10, 2018 from the Florida Office of the Attorney General. What follows is an itemized summary of the concerns of co-mortgagor, ***:

1. Ms. is dissatisfied with her customer service experience with Bayview Loan Servicing, LLC ("Bayview"), specifically pertaining to her pursuit of a loan modification for the mortgage loan secured by the above-captioned property.

2. She disagrees with the information she has been provided by representatives of Bayview, who advised her that she is unable to complete a loan modification without assuming the loan.

Bayview Loan Servicing, LLC is a debt collector. This letter is an attempt to collect a debt and any information obtained will be used for that purpose. To the extent that your obligation has been discharged or is subject to an automatic stay of bankruptcy this notice is for compliance and informational purposes only and does not constitute a demand for payment or any attempt to collect such obligation.

Confirmed SII Disclaimer: If you are a confirmed Successor in Interest to the mortgaged property, unless you assume the mortgage loan obligation, under state law you are not personally liable for the mortgage debt and cannot be required to use your own assets to pay the mortgage debt.

3. Additionally, Ms. believes that Bayview has acted in violation of the Mortgage Servicing Rules and the guidelines of Federal National Mortgage Association ("FNMA" or "Fannie Mae").

4. She would like Bayview to cease the foreclosure of the above-captioned loan, remove fees and costs associated with the foreclosure from the mortgage balance, and reimburse her for fees and costs incurred through foreclosure action and for opening the estate in her ex-husband's, borrower *** name.
Below we have provided a response to the above-listed concerns.
Bayview's records indicate that *** the Note obligor, and ***-Manley, non-obligor and co-mortgagor of the subject Mortgage, filed a petition under Chapter 7 of the U.S. Bankruptcy Code on December 30, 2011, and subsequently received an Order of Discharge on June 21, 2012. Nothing in this letter should be construed as an attempt to collect a debt against Ms. personally, or an attempt to revive personal liability on any discharged debt. Rather, this letter serves only to respond to correspondence from your office on behalf of Ms..

To address items 1, 2, and 3 above:

Bayview regrets that Ms. is not satisfied with her customer service experience. However, we appreciate her feedback as we strive to improve our customer interaction and to provide excellent customer service.

Please be advised that Bayview must adhere to the guidelines set forth by Fannie Mae when reviewing a borrower or authorized party for eligibility under a Fannie Mae modification program.

Further, please be advised that Fannie Mae requires that a confirmed successor in interest pursuing a loan modification for a delinquent account assume the mortgage debt. For more information on Fannie Mae guidelines, Ms. may visit the Fannie Mae website at www.FannieMae.com.

From a review of the Mortgage and Deed to the subject property dated October 15, 2003, at the time of Mr. death, the property was held in equal parts by both Mr. and Ms. as tenants in common. Currently, our records do not indicate that Bayview is in possession of the necessary documents to determine who may be the successor(s) to Mr. interest in the subject property.

Please be advised that Bayview is also not in possession of any documents to prove up Ms. assertion that she is the executor of Mr. estate. As such, Ms. is not an authorized party on the account, unless and until she can provide the relevant documents to show she is the successor in interest to Mr. interest in the account, or that she is the appointed executor or personal representative of Mr. estate.

According to our records, Bayview issued a letter on December 4, 2018 (copy enclosed), which provided information regarding the process for determining the succession of real property and the documents needed to confirm a successor. Please be advised that Bayview must exercise due diligence in confirming a successor in interest for the other half of the above-captioned property. Should Ms. be the intended beneficiary of Mr. remaining 50% ownership interest in the property, Bayview requests that she forward the documents necessary to evidence this so that we can review and update our system of record.

Additionally, please be advised that Bayview escalated the matter to the investor, Fannie ***, with regard to completing an assumption and modification for a party who *** only hold fifty percent (50%) of the interest in the property. Fannie *** indicated that Bayview can review Ms. for an assumption to complete a loan modification.

Please note that, per the above-referenced Mortgage, Ms. is also listed as a tenant by the entirety on the Mortgage document. Under this form of tenancy, Ms. would have inherited the property had her marriage been intact at the time of Mr. Manley's passing. However, upon the dissolution of their marriage, Mr. Manley and Ms. were no longer bound as tenants by the entirety.

To address item 4 above:

While Bayview sympathizes with Ms. frustration, please understand that Bayview is unable to comply with her request to halt foreclosure, as our records do not indicate that Bayview is in receipt of a complete loss mitigation application.

Additionally, please be advised that Bayview exercised its right to take legal action and pursue acceleration remedies in accordance with the directives outlined in the Uniform and Non-Uniform Covenants of the above-referenced Mortgage. Therefore, Bayview is unable to reimburse Ms. for fees and/or costs associated with the foreclosure proceedings for the above-captioned loan. Further, please note that Ms. opened her ex-husband's estate at will. Bayview is not responsible for the legal fees and/or costs that *** have resulted.

Initial contact with Bayview was 4/23/18. At no time since initial contact was any request for any additional documentation ever made until AFTER the complaint was filed. Had Bayview acted in accordance with the law I would have already resolved this matter. They are attempting to avoid their liability by placing it on me. Review of their internal recordings - a total of 13 calls and 157 minutes prove they refused to consider the law - even though I repeatedly brought it up to them. How is it they claim I didn't prove I was executor when they didn't ask for proof? How do they claim no documents were submitted when I have proof in the form of their confirmation and they refused to review them? Why did it take 8 months and complaints with 3 organizations for the first piece of mail to be sent addressing this issue? Unacceptable business practice and continued violation of my rights.

Loan Modification Dispute.
To Whom It May Concern: I am writing you this complaint pertaining to Bayview Loan Servicing LLC. I have been trying to work with this lender on obtaining a modification for my primary residence. From the beginning of this process of this year - to the present I have been lied to, deceived & received numerous fraudulent predatory lending practices from Bayview Loan Servicing LLC. I have several fraudulent infractions against Bayview Loan Servicing LLC when applying for my modifications. I submitted four modification packets to Bayview Loan Servicing LLC & on all four of them they informed me that the packet was not complete, when actually all four were complete ( I have attached the correspondences for you to review and add to your records). I was also informed that even though they received my modification packet that they keep the foreclosure sale active until they receive the complete packet. I informed Bayview Loan Servicing LLC that practice is unlawful. The reception of the modification packet is supposed to cease the foreclosure sale date while they review the modification packet received (This predatory lending practice occurred four times with me). I have attached the letters along with this correspondence for your records & to review. The letters from Bayview Loan Servicing are dated: January 4, 2018, April 3, 2018, May 4, 2018 & August 23, 2018. All four of this letters from Bayview Loan Servicing LLC are in reference to a incomplete modification packet, when actually they were complete. I had to resend the same documentation again to them numerous of times. During all four instances the foreclosure stayed active. I have also attached receipts of the FEDEX tracking confirmations of the loan modification packets being delivered to Bayview Loan Servicing LLC. Also, on September 21, 2018 I delivered a Quality Written Request & Complaint to Bayview Loan Servicing LLC. I did not even receive no correspondence back from Bayview Loan Servicing LLC. I requested a Quality Written Request & Compliant due to the first request was not completed. I have also attached my Quality Written Request & Complaint for your records for you to review. The correspondence sent to me dated August 23, 2018 stating that I had until September 22, 2018 to send the documents in which that was the second time sending them in this modification request was denied. I informed the Asset Manager *** that I will be appealing this decision because this is my primary residence & that I am a disabled Veteran & that this residence is equipped to assist me with my military service connected disabilities. *** informed me to email: [email protected] for me to request an appeal of the decision. I also FEDEX the correspondence as well on October 23, 2018. I have also attached copies of the FEDEX tracking receipt & screen shot of the email sent to: [email protected] I called *** a week after October 23, 2018 to check on the status of my appeal to escalations. I was Informed by *** that they received the escalation appeal from me & that they will have an answer for me within thirty days ( the 30th day would have been November 20, 2018). I came back from my doctor's appointment on Thursday November 15, 2018 I received correspondence from *** LLC that my primary residence is going into foreclosure on January 3, 2019. I never did receive no correspondence from Bayview Loan Servicing about the decision of my escalation denial appeal. I called Bayview Loan Servicing LLC trying to communicate with *** to see what is going on with my escalation's denial appeal.

Grant me my loan modification which I am entitled to by law.

I'm responding back to the previous information you sent as it relates to my QWR report:

To Whom It May Concern:

On September 21 2018, I sent in a Qualify Written Report request. However, the information that was sent to me back from someone at Bayview Loan Servicing LLC, did not meet the proper documents that the QWR requested. Therefore, I am still disputing the validity of the debt that Bayview Loan Servicing LLC claim I owe. The examination, audit and review of the mortgage loan from its inception were from original WET-INK documentations, not copies. Again, until the WET-INK sign documents with my signature on it has been submitted to me as requested by the QWR, please refrain from reporting any negative credit information to any credit reporting agencies.

The U.S. Code Title 18 section 473 & 474 states:

Whoever buys, sells, EXCHANGES, TRANSFERS, RECEIVES, or DELIVERS any false, forged, COUNTERFEITED, or ALTERED OBLIGATION or other SECURITY of the United States, with the INTENT that the same be PASSED, published, or used as TRUE and GENUINE, shall be fined under this title or imprisoned not more than 20 years, or both.

Whoever, with intent to defraud, makes, executes, acquires, scans, captures, and records, receives, transmits, reproduces, sells, or has in such person's control, custody, or possession, an analog, digital, or electronic image of any obligation or other security of the United States....

Whoever PRINTS, PHOTOGRAPHS, or in any other manner makes or executes any engraving, PHOTOGRAPH, PRINTS, or impression in the LIKENESS of any such obligation or other security, or ANY PART thereof, or sells any such engraving, PHOTOGRAPH, PRINT, or impression, ... is guilty of a class B FELONY.

This Uniform Commercial Code reference to circulating notes of banking association was omitted as covered by definition of obligation or other security in section 8 of this title. The documents that was sent to me, fall under the U.S. Code title 18 section 473 & 474, which were all counterfeit documentations. They were intended to be passed on to me as original document, but none had the original WET-INK signature or initial from the original closing date. Currently, Bayview Loan Servicing LLC is guilty of a class B FELONY.

The UCC establishes that a violation of these minimum standards by a creditor can be used as a defense by a borrower to set off or recoup damages. In addition, Bayview Loan Servicing LLC must disclosure all information relating to the loan to the borrowers for home mortgages, both at the time that the mortgage is made, as well as in the monthly loan statements. The law also protect current and future homeowner by making sure the property owner has sustainable ability for a loan modification as well. Title 12 U.S.C section 550b established the Home Affordable Modification Program, which states that under the Emergency Economic Stabilization Act of 2008 protections should include meaningful structural reforms.

The federal laws declare that a mortgage lender needs to show full and immediate disclosures of all original documents pertinent information regarding the loan. These documentations included, but not limited to:

1. All original and lawful compliance with all federal and state laws, regulations including, without limitation, RESPA, TILA, Fair Debt Collection Act, and HOEPA;
2. That any original transaction of my loan was conducted in accordance with law and was true to all security deeds, notes or promissory bill;
3. That the claimed holder in due course of my promissory note and/or deed of trust is holding such note in compliance with all laws and is entitled to any benefits of my payments;
4. That all appropriate disclosures of terms, costs, commissions, rebates, kickbacks, and other fees were properly disclosed to me at the inception of my loan;

The federal laws as it relates to mortgage lenders are included in the UCC laws which are center around who legally own and owe on a residential property. The owner of deed of trust, security instruments, or promissory bill must have original WET-INK signature to prove that they have legal ownership of a residential property. Again, the laws states that whosoever copy, print, or photographs any likeness of any such obligations or other security shall be guilty of a class B felony. The information that Bayview Loan Servicing LLC have sent to me qualify as a crime under the UCC laws for mortgage lenders against consumers.

Hence, my repercussion for this crime is suiting Bayview Loan Servicing LLC for committing fraudulent and counterfeit transaction. We are requesting full investigation into this matter from all locals, states, and federal governments. We believe that there may be a "CLASS ACTION" suit in progress. Our investigation will show that there are many other people with the same or similar injuries cause by Bayview Loan Servicing LLC which merit transition toward a full "Class Action" litigation. Therefore, I have belief that this account is in error and not any information sent to me provides no sufficient details that I am wrong according to the Uniform Commercial Code. There is not enough sufficient evidence to justify why the information that I requested is unavailable or cannot be obtained.

Please provide me with the original WET-INK signature and initials of all documents I have requested and a detailed lawful arrangement. It is my hope that we can resolve this issue without any suit or class-action suit.

Also, On all three of my modifications requests, I had ample debt to ratio income to cover my loan modification you refused to grant me my paystubs attached will confirm that. Also I informed you that I was a disabled veteran from the Desert Storm War & sent you documentation confirming this as well. Every servicer of a FHA loan is supposed to have a separate entity to handle veterans loan modifications. Bayview Loan Servicing LLC did not even take into no consideration that I am a Disabled Veteran for all three modifications & even while I was talking to them on the phone as well. That is a major FHA violation of my FHA rights. Bayview Loan Servicing LLC received several documentations from me confirming that I was a disabled veteran. Certified documentation is attached as well. Also I have a thirty year FHA fixed loan.The amount that is past due to your predatory lending services practices should have been put to the reer end of my thirty year end loan. That is the main purpose of a loan modification. Also you did not even attempt to seek all remedies of all available options to assist me keeping my home out of foreclosure. If you did you would have offered the FHA option of the FHA Home Flex Foreclosure Prevention Program for payment relief. Your entire dealing with my loan modification request was nothing but PREDATORY Lending Servicing Practices. The only way to make this situation right is to follow the FHA guidelines & grant me my modification that I am entitled to & send my loan modification to your veteran services to work with me on obtaining my loan Modification.

Select Portfolio Servicing took over my mortgage from Bayview Loan Servicing. This loan was originally in foreclosure from Well's Fargo. I wasvacated from the house for over two years. I was contacted about a modification by Bayview Loan Servicing. I agreed to take the house back andresume payments under the new modification with the ONE CONDITION that my ex-husband's name was removed from the loan. I was told thiswould happen immediately after the modification was completed. The modification was completed with ONLY my income and ONLY my name andsignature on the application and the contract. I submitted all paperwork I was told, including the quit claim deed. Now, years later, my ex-husband'sname was never removed. I have called and requested this multiple times. I have been told it could be done, couldn't be done, that it's not done. It has been years of fighting and arguing. I am now being told that it can't be done because Select Portfolio Servicing did not execute the modification, even though they now hold the loan.Meanwhile, Bayview claims they cannot do it now, because they no longer hold the loan. Both are claiming they cannot work together with the othercompany to make this happen. No one will help me and everyone is passing the buck back and forth.

Bayview's response neglects to address the fact that my ex husband did not sign off on this modification. How is it legal for them to even complete the modification without his signature if his name is on the loan? I made complaints with the company and requests before they transferred it to another company. They refused. Now they say they can't do anything because they've transferred it. Why is his name on this modification when he did not sign the documents.

This company should be put out of business. They tell you one thing and then do something else. They are causing my clients to be foreclosed on!
I have been working with them since March, 2018 on a property for a short sale. My clients are in their 70s and in very poor health. They do not have a computer and much of their mail disappears from their open mailbox. I am the authorized 3rd part on this loan. I have obtained what they want to payoff the loan. They have been completely inconsistent with what they have told me I had to send them to save the home from foreclosure.The turnover of employees is ridiculous. There is no continuity overtime they hire someone new. They seem to do everything possible to trick you so you cannot fulfill their request. I have been the authorized 3rd party on this loan since March and despite faxing them the form 9 times they still say I am not listed on the account! I siit here with an offer in hand for this homier the amount I was told they would take and no one will talk to me. I have set appointments with my asset manager (who has changed 4 times) and I never receive the calls. When I finally speak to them they say they were never informed of the appointment- and I believe them.
This company is hurting many people and my clients are about to be among the hurt. Please do what you can to stop this madness of foreclosure. The letter my clients received (10 days after it was written) said to send their offer. I sent in the signature page yesterday to the asset manager who is out of town today. Her supervisor is also out of town. When I asked to speak to another supervisor. I was disconnected. No return call. Please contact whomever is in charge so I can submit this offer on this home.

Accept the offer I have obtained on the home for the short sale as I was told to do.

Regarding the above property that is set for forelosure on Tuesday, Dec 11:

I have sent a list of questions to *** but have not been able to speak with her
after numerous attempts and messages which I have documented.

I need to know if you have considered the recent appraisal for $704,000 which is accurate
and uses the correct comps for this property? I also sent a list and supporting documents for
numerous repairs the property will require, including a roof for $27,000.

Your last appraisal used incorrect comps and was way off from the correct value. Your first appraisal was
on target with this value as was the recent one I obtained.

I have a solid buyer who will pay $650 cash for this property with a closing at the end of December!!
This has been the highest offer in the last 4 or 5 years when short sales were previously attempted.
The home is in horrible condition and the owner is a hoarder. I have photos available if you want them
and the recent appraiser took some, as well.

I filed a complaint with the Revdex.com because of lack of communication. *** has made attempts but
I still need a better response when time is so short. I can imagine how swamped she must be at this
time so I am writing to you.

I get absolutely no notifications from you and my client has had only a few. They are old and in poor
health. They do not have computers. I am their only connection with the world and yet I hear nothing.

I am requesting that you escalate this issue! There are so many problems associated with Bayview and
your process that I will not attempt to list them here.

I also requested for my clients their loan docs in May of 2018 through your online process. When I go to
that request, it still says Pending even though it says the process should not take more than 30 days. My
clients are asking why so long? Do you have them?

If you would approve the offer we have submitted, we could move forward with this sale before the end of
the year!

My loan was previously with Chase Mortgage. It was a re-finance loan not a regular mortgage. It was sold to Bayview in June 2018. Nothing but trouble!
As I stated before my loan was a re-finance that included my taxes in with payment. The amount was $***/monthly,*0 including the taxes! They escrowed for taxes AND insurance! I only owed $*** for the homeowners! Which I offered to pay! But instead had to pay DOUBLE! Since it was transferred to Bayview and it has been a nightmare! I got behind on my homeowners over an issue with a railing. I offered to pay the homeowners I owed! But they raised my payment from $***/monthly to $***/monthly which I could not afford! My credit report was severely damaged and all my credit was frozen and cut in half! As a result the credit score dropped because it said I was utilizing all my available credit but they dropped my avail. credit from $***/yr. to $***/yr. so it appears that I have used up all my credit! Even though I always made double payments and was always early..never late! And they stated that I was behind 6 months in my payments which was not true! I had been making my payments and even sent a letter from my bank proving it but not good enough! Now I have been fighting since july to get this straightened out and to no avail! I had to send in $*** and it is sitting in some bogus account! And I received my Oct. statement that says I owe them $***!!! I am going to sue somebody as I am on social security disability, 64 yrs old, am widowed, and have numerous health problems! It is affecting my health and I want this rectified immediately. Calling does no good because as other people have stated nobody answers the phone or they are rude and hand up on you.

Desired Outcome

I want my credit score back where it was and I was financial resolution. They were preditory in there fees and costs and I believe they took advantage. I should only have to pay the cost of the fire insurance which was $***.00! Which is what I tried to do but had to send in twice that amount because they are counting in taxes and insurance!!!! And it is still not rectified. And I have had my own insurance since end of July! And they have the name and address and have spoken to them! NO EXCUSE! This place needs shut down!

Below we have provided a response to each of Ms. concerns in the order listed above. To address items 1 through 3 above:
Prior servicer records indicate that JPMorgan Chase Bank, N.A. ("Chase") updated Ms. loan account to be escrowed for the purpose of disbursing annual premiums for homeowner's insurance. Enclosed for reference is Chase's Escrow Taxes and Insurance Statement dated September 14, 2017, indicating an escrow shortage in the amount of $*** and an updated payment in the amount of $***.*** effective November 1, 2017. Please be advised that Ms. continued to remit non-contractual funds in the amount of $***.*** after the above-referenced payment change.
Bayview began servicing Ms. loan effective July 2, 2018, at which time the loan was past due for the May 1, 2018 monthly installment and all subsequent monthly installments due thereafter. Prior to any verbal or written contact with Ms., Bayview received proof of continuous coverage under a preferred policy paid for by Ms.. As such, Bayview updated Ms. account to reflect a non-escrowed status for homeowner's insurance. Enclosed with this response is a copy of the Annual Escrow Account Disclosure Statement for the Escrow Analysis performed on or about August 20, 2018, reflecting a new payment in the amount $***.*** effective October 1, 2018.
With regard to Ms. concerns pertaining to the reinstatement of her loan, enclosed with this response is Bayview's letter dated October 31, 2018, sent to supplement a telephone conversation between Ms. and a member of Bayview's Customer Advocate Team. As communicated to Ms., her loan was delinquent and flagged as in an active Trial Modification Workout. As such, funds would not have been automatically applied to her loan. Our records indicate that Bayview processed the reinstatement on October 22, 2018, and effective-dated the transactions to October *, 2018.
The above-referenced arrearage in the amount of $*** was captured on the enclosed Mortgage Statement, which was generated on October , 2018, before the reinstatement transactions had been completed. We regret any confusion this matter may have caused. At this time, Ms. loan is current and due for the December 1, 2018 monthly installment in the amount of $***.. Enclosed for reference is an Account Activity Statement, reflecting all transactions and their effective dates from the time Bayview began servicing this loan.
Although Bayview understands Ms. frustration, we deny her allegations as to predatory lending practices committed by Bayview. To the extent that Chase disbursed funds to satisfy an annual premium that Ms. intended to pay herself, please understand that it was still incumbent upon her to remit her full contractual installments by their respective due dates. Notwithstanding the foregoing, Chase's records indicate that Ms. loan was past due prior to the increase of her monthly payment amount (see enclosed Chase notice dated July 21, 2017). As such, our records do not indicate that any credit reporting adjustments are warranted at this time.

I know I have payed in full .but I know they will say the taxes went up over $ 300.00 I know that and the % rate is to go to 4% nxt month I know that I want it straighten out I do not own for this year. when I called each time are they not suppose to make notes if not they should !!!!!!!!!!!!!!.because the laby never said she found my calling dates or notes.

Enclosed please find a copy of the Annual Escrow Account Disclosure Statement dated September 7, 2017, whereby Ms. was advised of the $723.71 escrow shortage. Please note that attached to Ms. statement was a payment coupon reflecting two (2) payment options. Ms. could either remit a lump sum payment in the shortage amount stated above or add the shortage to the monthly mortgage payment which would increase Ms. payment from $602.40 to $622.50. As Bayview did not receive a full payment for the escrow shortage amount prior to the New Effective Payment Date, the shortage was spread over thirty-six (36) months in the amount of $20.10.

Our records indicate that on September 18, 2018, Ms. contacted Bayview to advise that she believed that her monthly mortgage payment should be $613.00 as she has remitted additional payments toward escrow, throughout the year, to avoid the increase. She also inquired as to the reason for the increase. As Ms. advised that she was unable to remain on hold while we escalated the matter, Bayview returned a call to Ms. the following day, on September 19, 2018, to explain that her total monthly payment increased due to an increase in her insurance. Additionally, we wanted to advise Ms. that she is still repaying the forty-eight (48) month escrow shortage spread from the previous year. However, we were unable to make contact.
On September 20, 2018, Ms. contacted Bayview to again advise that she remitted higher payments that would go toward lowering the escrow balance. The Bayview representative requested a new escrow analysis be completed on the loan account. Enclosed please find a copy of the September 21, 2018, Annual Escrow Account Disclosure Statement and Change of Payment Notice. Please note that effective with the November 1, 2018, payment, Ms. total monthly payment due is $624.86.

While Ms. expressed that she has remitted full payment for the escrow shortage, our records do not indicate receipt of a payment that fully satisfies the shortage. Enclosed please find a copy of Ms. Customer Account Activity Statement (a/k/a payment history) as this statement gives a detailed accounting of all the transactions that have taken place on the loan account since the transfer of servicing to Bayview.
Ultimately, it appears that Ms. loan account has continuously reflected an escrow shortage. Enclosed please find copies of the Annual Account Disclosure Statements dated September 9, 2016; October 9, 2015; April 3, 2015; *** 6, 2014; February 27, 2014; March 27, 2013; February 11, 2013.
Please be advised that as Ms. entered into a Loan Adjustment Agreement (copy enclosed) on November 14, 2015, her principal and interest payment is scheduled to increase to $521.05 for a total monthly payment due of $692.36 for the December 1, 2018, monthly payment.
To address items 2 and 3 above:
As our representatives do their best to accommodate the needs of the loan accounts we service, we apologize for the times Ms. experienced extended hold times. We thank her for expressing her concerns as it allows us time to evaluate our processes.
With regard to the missing correspondence: Our records do not indicate that written correspondence was promised to Ms..
With regard to the reallocation of funds: We are unable to satisfy Ms. request to reallocate all additional funds remitted to escrow for the reasons stated above. Additionally, we note there to be times when Ms. remitted less than her required monthly payment. Please note that any partial payment received is not applied to the mortgage payment, but is instead held in a separate suspense account. escrow they keep charging me more one month then another minus amount I am tired of calling and not getting any were sept escrow bal 512.36-nov 2018- balance -298.11-dec 2018 minus 126.66jan 2019balance 46.65 I payed in fullfeb 2019 balance 217.96 plus the interest went up to 3% every time I call ask were did they do with my extra money for escrow all they do is send me a paper were I payed I better not get it again or a phone call all I want them to do is put my money were it goes in escrow I am tired of working overtime to pay for this. each month the escrow changes it makes no sence!

better fix the escrow or I will find another way to file a complaint.

bayview loan services in nov 2019 loan went up to 3% modification to $ 722.00 then dec 2019 went up again 3% to $781.00 call for help but said no credit score to high above 700- no late payments- in dec 2019 I have a new home insurance company rate went down-also march 2019 I turned 62 filed all papers to have school tax removed I have papers more than 5x;s to company every time I call say donot have but then say yes will take more than 30days to correct I have ask more than once what is my payment for jan 2020 still say 781.00 which is not right should be lower they have had plenty of time to fix. and have ask for a letter said no.

Below we have provided a response to each of Ms. concerns listed above.
To address all items above:
We appreciate the time Ms. took to contact your office and value her comments regarding our level of service. Ms. feedback provides us with an opportunity to review our procedures and make any necessary improvements.
Our records reflect that Bayview addressed similar concerns in our response letters to the Consumer Financial Protection Bureau dated January 22, 2020, and October 30, 2019 (copies enclosed). Please be informed that we have omitted the enclosures from our January 22, 2020, and October 30, 2019, response letters.
A review of the loan account indicates that Ms. loan was modified as indicated by the Loan Adjustment Agreement dated November 14, 2015 (copy enclosed). Per the terms of the Loan Adjustment Agreement, the interest rate was reduced to a 2.000% step rate which would remain fixed for the initial thirty-six (36) monthly installments. Subsequently, the interest would increase 1.000% annually until the interest rate reached 3.870% and then remain fixed at this rate for the remainder of the loan term. The interest rate increased to 3.000% effective November 1, 2018, which increased the principal and interest ("P&I") payment from $453.55 to $521.05. The final interest rate adjustment was effective November 1, 2019, when the interest rate increased from 3.000% to 3.870% which increased the monthly P&I payment from $521.05 to $582.33.
The enclosed Annual Escrow Account Disclosure Statement dated September 4, 2019, was completed which adjusted the monthly escrow payment to $199.08; this amount represents $175.41 for the monthly escrow payment and $23.67 for the monthly escrow shortage. Please note that the annual property taxes increased from $904.36 to $1,148.37 and the annual hazard insurance increased from $898.93 to $956.46, which resulted in the monthly escrow increase and an escrow shortage.
The new monthly escrow payment, in addition to the interest rate increase, resulted in the new monthly principal, interest, taxes, and insurance ("PITI") payment in the amount of $781.41 effective with the December 1, 2019, monthly payment. Enclosed please find the Mortgage Statement dated November 13, 2019.
With regard to Ms. request for a modification, Bayview reviewed the loan for a possible loan modification which resulted in a denial dated October 16, 2019 (copy enclosed). At the time of the review, Ms. loan account did not meet the investor requirements for imminent default.
Bayview sympathizes with Ms. understands that circumstances *** change, which *** affect her ability to meet certain financial obligations. As such, we are committed to helping Ms. explore the

Please be informed that Bayview received the document provided by Ms. regarding her property taxes. However, the document does not appear to be from the Cobb County Tax Commissioner; therefore, Bayview is unable to use this document to reanalyze her escrow account. Bayview is currently pending updated information from Cobb County.
With regard to the hazard insurance on file, please note that Ms. hazard insurance policy with her preferred insurance carrier, Farmers Insurance, reflects in our system. BayView Loan Servicing has been withholding funds from my contractor and myself that were provided to me from my Farmers Insurance Home Owners policy. My contactor has been attempting for more than a year getting funds released to begin work associated with storm damage from over a year ago. BayView has even told me that I had to pay in advance for materials to make the repairs on my home. I have already paid my deductible. The first check was for *** and BayView has only released *** of the funds. As a result, I haven't been able to get repairs made to my siding, windows, gutters, downspouts, and deck resurfacing. The total amount of *** that they are going to continue to hold.

I have my mortgage through bayview loan servicing and due to shoulder surgery, I got behind in my house payments. I contacted them back in July 2018 and they sent me out a hardship package for me to fill out to see if they can help me. I sent it back and several people I spoke to confirmed they received the package. My point of contact is*** but I have been calling and leaving message for her for almost 2 months and never received a call back and I just keep getting letters in the mail that she is who I should speak with. I have called from work several times and to no avail. I need to know what is going on with my loan. I was told they would help me but I cant get a hold of her and no one else will give me any information.

My home loan was sold to this company in 2015. They have the worst record keeping and customer service I have ever dealt with.
This company bought my home loan in 2015. I make my monthly payment to them every month. I pay my property tax to my county clerks office on a monthly payment plan and have done this since 2013. I have never had a problem with my county clerks office. Now I received a letter from Bayview Loan servicing about an escrow account saying they have paid my property tax and they are raising my monthly house payment which I cannot afford.

Desired Outcome

I need to keep paying my property tax as I have been and I need Bayview to stay out of it. I cannot afford their fees and higher payments. I also would like for them to have better customer service. When I call them, they are rude, demanding and will not let me get a word in. They will not answer questions and they just wiggle their way around the answer and keep repeating the same thing. They are not friendly or helpful at all.

I have a loan against my house. Back in July my hot water heater leaked, causing severe damage to my house. State farm insurance issued us an insurance check with my name and also had Bayviews name on the check. Bayview made me sign my check and send the check to them and then they would sign it and send it back. Needless to say they wont send it back. I had to pull out $6900 out of my IRA to pay the contractor, and now my house has no carpet bc we dont have anymore savings to pay for new carpet. We have called Bayview over and over and they wont send us our money. Please help us get our insurance check from them. We have done everything possible, and nothing has worked.

March 27, 2018- I (***, daughter of*), spoke with a Nicole, informing her of our father's passing, asking her what we needed to submit to the company at this point. She stated the company would need a copy of the death certicate, and will before further business could be conducted. I stated that my father's mail would be sent to my sister *** since he has passed *** I asked what options we had for the loan at this time and Nicole stated nothing could be further discussed until the will and death certificate were received.
March 28, 2018- ***, daughter, faxed a copy of the death certificate and will to Bayview. The fax cover letter indicated that *** or Sharon C. Little should be contacted if additional information was needed. Both phone numbers were placed on the fax cover letter.
No phone contact was received from Bayview to the updated phone number information given to the company on March 28, 2018.
April 27, 2018- ***: I received a letter 4.27 dated 4.22.18, stating that the loan was delinquent, and several attempts had been made to contact me, however, again the company made no phone contact. I phoned the company, and the representative stated a loan modification packet would be mailed and has to be completed in order to start the process of choosing options for the loan.
1st week *** 2018: *** spoke with a representative from Bayview and explained that our father was deceased and we were seeking options to do a quick sell or discounted settlement. I informed them that a realtor had looked at the property, stating the remaining loan balance, and explained the current value of the home $26,000 and those repairs were needed. I also informed them a relative was interested in buying the property at a discount settlement rate. The representative said I had to start the ball rolling and fill out a modification package. The representative stated that I would be assigned a specialized team from the Asset Department to assist me with the matter.
*** 14, 2018- I received a letter from the company created on 5.9.18. Stating options for the loan. I phoned the company and asked why I had not been contacted by someone from the Asset Management department. The representative stated they are still reviewing the loan, and I will be contacted by phone. I again gave my phone number and my sister's number to the company representative. (B. ***).
*** 17, 2018: I received a loan modification packet with a letter generated 5.11.17. I reviewed the packet with family members.
*** 18: B. ***: I received a letter generated 5.14.18 that a special team has been assigned to provide support and personalized service with the mortgage payments. No one contacted me by phone from the company.
*** 21: B. ***: I received a letter generated dated 5.15.18 with housing counselor information. Again, no phone contact was made from the team that I was told would contact me.
*** 23: B. *** - I received a letter generated 5.17.18 from the company related to the payment being due. No one from the team contacted me by phone the entire month of ***.
*** XX X:XX pm B. *** faxed the loan modification packet to Bayview.
June 9: B. *** I received a letter generated 6.5.18 that the loan has been assigned to a specialized team who will provide you with expert and personalized service. A please note section of the letter indicated that the aforementioned collection efforts will not continue if you are currently under review, and I have the right to request a telephone meeting to discuss all options available. No one from the specialized team contacted us by phone at any time.
We have more documentation to provide as well.

Desired Outcome

Resolution: We request that the company cease their illegal practices and contact us by phone as they have promised during this whole ordeal. This has caused further emotional distress on the family and has been extremely time consuming. Someone breaking into our deceased father's home displays unscrupulous business practices. Failure to speak to the family members to try to reach a resolution with the company by contacting us has occurred numerous times, and therefore this company practices should be known and investigated and our issue resolved. We thank you for any assistance that you can offer the family.

I am also working with a financial counseling program and they cannot get a hold of him either. I do not want to loose my home and need someone to talk to.

In reading the attached letter from Bayview, I did want to respond with what I had noticed. Even thought the letters do have to correct address on them, the Federal Express Label that the letters would have come in has a wrong address. The address on the label shows *** Squire Way - Hainesport, NJ XXXXX. My address is *** Squire Drive, Dyer, IN XXXXX. I do have the dates of the phone calls, emails, and fax that was sent to ***. The call dates are 8/15, 8/16, 8/17, 8/21, 8/29, 9/3 and 9/5/18. The 3-mails were sent 8/23, 8/29, and 9/3/2018. Fax was sent 9/4/18. The letters do reflect correct information. The loan modification is where the lacking takes place. I just would like communication with the status of this and not having live contact makes this extremely hard. After this Revdex.com investigation, I did receive a call from Tony of the Customer Advocate Team (XXX)XXX-XXXX on 9/11/2018. He promised to get back to me by Friday, September 14, 2018. I have not heard back from him either. I will call him today to find out the status. Bayview needs better live customer contact.

To address item 1 above:
We sincerely apologize for the FedEx package being sent to the incorrect address (this package was returned to our office as "return to sender unable to forward"). However, the loan modification denial letter is the only document that was sent via Fed Ex. All the other correspondence which provided the status of the loan modification were addressed to the mailing address of record.
To address item 2 above:
As stated in our response letter dated September 14, 2018, Ms. was participating in the Hardest Hit Funds ("HHF") Unemployment Program through the State of Indiana. This program was paying her monthly mortgage payment since December 12, 2016. Her benefits under this program recently ended on September 5, 2018, with the loan contractually due for the July 1, 2018, monthly payment. Please note that when the loan was under the HHF Program, it was assigned to Andrew Conner, Operations Associate/HHF Liaison. His responsibility is to monitor the HHF assistance and insure that the payments are properly applied to the loan account and provide monthly loan status information to the State. He is not a customer facing Asset Manager and was therefore unable to return Ms. calls.
We understand that Ms. called, faxed and emailed Andrew on several occasions with no response and we have fixed the problem. Bayview would again like to apologize for the experience Ms. encountered in reference to her loan. We have recently updated our HHF Program procedures in an effort to prevent similar issues from occurring in the future. When a voicemail is received, the HHF Liaison will send this information to the Single Point of Contact ("SPOC") or a Specialized Call Representative ("SCR") assigned to the loan and copy their Supervisor to ensure that the call is returned promptly.

September 18, 2018 Incoming call from Ms. requesting to speak to Mr., a message was sent to him to return her call. Mr. returned her call and left a voicemail message. Ms. returned the call and spoke to Mr.. He reviewed our response addressed to the Revdex.com ("Revdex.com") dated September 14, 2018. She advised him that she is working with an agent from Consumer Credit Counseling and a new Loss Mitigation Application was just submitted for review. He advised her that the package had not been uploaded yet however he would follow up on Friday, September 21, 2018, to make sure the package has been received. On the same day, Bayview received a new complaint from the Revdex.com regarding the loan status.
September 20, 2018 A Modification Acknowledgement Letter was mailed to Ms. (copy enclosed).
September 21, 2018 Mr. returned Ms. call and left a voicemail message. On the same day, Mr. attempted to reach Ms. and left a voicemail message that we received her new Loss Mitigation Application and that the Modification Acknowledgement Letter was mailed.
September 26, 2018 Bayview received a call from Ms.. As the property is located in Indiana, Bayview discussed the natural disaster. Ms. advised that neither the property nor borrower were affected. She requested the status of the Loss Mitigation Application and was advised that the request had been received and the acknowledgement letter had been sent; she had no other questions.
September 27, 2018 The Loss Mitigation Application review was completed (copy enclosed). The Loss Mitigation Application has been deemed facially complete as of September 17, 2018. However, the request is missing required documentation from third-party sources that is required in order complete the evaluation of the application; we are in the process of updating the escrow information.
Bayview would like to afford Ms. every opportunity to be reviewed for all possible alternatives to foreclosure, which *** include a forbearance, loan modification, short sale, or deed-in-lieu of foreclosure. They have attached an escrow and billing for late fees and forcing us to pay two homeowners insurances, theirs and our private one.
Our loan was sold from Chase to Bayview despite only being 1.5 payments behind.

When Bayview had the loan, they said Chase frontloaded home owners insurance. We stated multiple times we would pay the two months not covered by our home owners. They refuse to remove the escrow and we are now carrying 2 home owners insurance policies even though were were told by the customer service rep Dave that once we acquired our own, they would reverse the additional months of insurance from Chase.

We have made multiple calls to the escalation department, provided documentation of current insurance and property taxes. They refuse to remove the escrow, fees and late charges associated with the insurance.

The continue to send letters saying they are going to accelerate the foreclosure process even though we continue to make the monthly mortgage payments.

Desired Outcome

We are asking Bayview to remove the escrow account, the late fees and interest accumulated. We have stated we are willing to pay for the 2 months of homeowners insurance that Chase provided when Bayview acquired the loan. We also request them stopping with harassing us with continue mail stating they are accelerating foreclosure as the mortgage is current minus disputed escrow account.

There is no documentation from Bayview stating we were required to carry a full twelve months of homeowners insurance. When we provided written request for escrow removal, they then stated we needed the 12 months coverage.

I have twice requested removal of escrow. Reasons stating insurance current and would pay 2 months of delinquent homeowners coverage.

Bayview continues to change the terms of which we can have the escrow removed, The refuse to submit their information in writing, and will not respond to second escrow removal request.

Bayview continues to practice unethical business practices, please see Revdex.com complaints with very similar situations regarding Chase and Citibank transfers to Bayview.

If Bayview will provide written documentation, showing where they provided terms to 12 months coverage, we will pay the additional 6 months coverage if they guarantee full refund of escrow minus two months coverage by Chase.

To clarify, all escrow removed, late fees removed and home owner will pay an additional 6 months of private homeowners insurance for coverage until June 2019, plus two months of insurance approximately $300 by Chase.

When terms agreed upon, electronic transfer of funds will be sent on a one time basis for the two months of homeowners insurance provided by Chase.

Bayview = remove all fees and escrow

Homeowner = 6 months additional homeowners private insurance plus 2 months Chase.

Homeowner to continue monthly mortgage payments, without escrow of $886.73.

If this is agreed upon, in writing, money will be transferred with two weeks time from agreed amount.

Bayview has not held up their end of the agreement and I want the case to continue in dispute.
We paid the year's worth of home owner's insurance in order to have our escrow account removed. The documentation has
been provided to them, and we just received a denial of escrow removal because of property insurance.

Harassment and not acknowledging payments that have been made.
Bayview Loan Servicing took over the servicing of our mortgage from Chase Bank in December 2016. We have had a problem from the start with Bayview not giving us credit for the last payment that was made to Chase before they began servicing the loan. They call our house several times a day. They call my cell phone several times a day. Yesterday someone left a door tag with a note to call them on our basement door. We have posted " No Trespassing" signs at the end of our driveway.

Desired Outcome

I want credit for the last mortgage payment that I made to Chase before Bayview Loan Servicing took over servicing the loan.

My mom is on hospice. I contacted this company in January to ask what needs to be done so they can speak to me. I was told to get a letter stating my mom is ok with them speaking to me in regards to her loan which was done and fax it over to them which was done. I did not fax it once but multiple times! I have the proof. This company continues to deny that they received any such letter and that is to each collector I speak to. The letter was faxed with the statement on multiple dates and I have the proof. I pay the loan as she is sick. So, they call her home today still claiming they did not receive the letter even though I called 4 days ago to let them know I would pay the loan on the 10th and the gentileman did not say one word about not being able to speak to me and took my promise to pay for Friday the tenth cause when I gets paid is when I pay it! I received calls each day this week and not only one today where I told the woman all the fax numbers my letter was sent to but dates and attention to who and that I will pay it tomorrow, forward 2 hours I get another f-ing call from these thirsty losers. This bimbos response was well if you won't fax it again I can't talk to you about the loan. Well, my *** is the one whose pays it and you get that *** each month but not my letter! And I am so posed to fax this letter over a 15th time on a 4th date? What so you cannot get it? I am so angry over this cause I did my part not once but three times and they don't do theirs. My mom cannot speak, they continue to call even after they have spoken to me like I am lying to them. Once they speak to someone isn't it considered harassment to call again? I can be called day after day even though I called them to give them a ptp but they have no recourse for their actions? Find my 15 faxes that I had sent!

Desired Outcome

Other (requires explanation) I want them to do their jobs and find my 15 faxes. I want the correct information added to my mom's account. I do not want this home harassed for days over payment when they received a ptp. If you spoke to me I do not want a call back after two hours. They can harass our family but I can't get anyone to do their jobs there! I want an apology for their mishandleings of my mother's account and their staff and want it corrected.

ON AUG2, 2018, I REQUESTED A REINSTATEMENT LETTER TO AVOID FORCLOSURE ON MY HOME. I WAS INFORMED BY THE ATTORNEY BAYVIEW HIRED THAT IT WOULD TAKE 3 TO 5 BUSINESS DAYS. IT IS NOW THE 13TH AND I STILL DON'T HAVE IT. I SPOKE WITH A *** STARLING ON AUGUST 10 IN THE MORNING AND WAS PROMISED A LETTER IN MY EMAIL BY END OF DAY. HE GAVE ME HIS PHONE NUMBER TO CALL IF I HAD NOT RECEIVED IT BY 4:30 EASTERN STANDARD TIME. WHEN I CALLED HE DID NOT ANSWER AND HAS NOT CALLED ME BACK OR ANSWERED TODAY. I CAN NOT EVEN MAKE A PAYMENT ON MY HOME WITHOUT THIS LETTER AND I CAN NOT TALK TO ANYONE BUT ***. I FEEL AS IF THEY ARE TRYING TO TAKE MY HOME FROM ME, NOT HELP ME!

bayview refuses to give proof of loan payoff said 10 days now says 30. we are in home refi.
we are currently refinancing our home. Part of our agreement was to pay off small second, belonging to Bayview. it has been paid and Bayview rep *** said we would have verification within 10 days. refused to send verif. by email or on account statement. we have waited while our refi is on an extension hold. after literal hours of trying to contact personnel at Bayview they were finally reached this morning. They will verify to us but not to Rocket Mortgage that it is paid but now say they have up to 30 days to give us proof that it is paid off. This may jeopardize our refinance and we will lose all fees paid thus far. bayview is incredibly hard to communicate with. It has taken 6 phone calls and hours of being on hold just to be told we cannot access our payoff for 30 days. We have paid our final payment there should at least be access for us on the webpage to prove we have paid off the loan in a timely manner without having to wait 30 days to do so.
we may lose our refi and the lower interest rate we have signed onto due to the incompetance of this company.

Desired Outcome

We want bayview Asset management LLC to update account balance to 0 for our immediate access and/or communicate with Rocket Mortgage to verify that loan has been paid off. Final payment was made on July 19th. There is no acceptable reason for delaying verification that it has been paid.
