Complaint: [redacted] I am rejecting this response because: The phone call was made to a private cell phone located on the do not call list and not to a business number? This is in violation of the law? The "Third party" claims to work on behalf for the company listed so they are one in the same to the victims of the cold calls.? Regards, [redacted]

We do not do outbound telemarketing calls, but we reserve the right to make outbound calls for other purposes, such as investigating complaints. We do not interact with consumers as we are strictly business to business. [redacted] complaint is about a third party calling business to business. When transferred to us, [redacted] the complainant, hung up on our call center immediately without a word spoken on either side. The cursing and offensive and threatening language claimed by [redacted] did not happen. [redacted] did not interact with us, he simply hung up. This is proven, recorded fact. If anyone complains about an unrelated vendor who happens to transfer a call to us, we will investigate. In this case, we called to investigate and make amends. We did express regret for the incident, even though we knew it was embellished, and we stopped the unrelated third party from making perfectly legal business to business sales calls to this individual out of respect and goodwill. We regret any inconvenience caused be the unrelated third party, and we have made sure that vendor will not call again. There is nothing further to do.

Complaint: [redacted] I am rejecting this response because: I am still receiving calls, but that does not solve the issueWhen the "company you work with" spam calls people, they provide an automated response of users to unsubscribe to calls (which I never subscribed to in the first place) however, this function DOES NOT WORK and people continue to receive spam callsThen, when I try to get to speak with an actual person and ask them to remove me from their spam call list, they just HANG UP ON MEI had to complain to the Revdex.com about you guys to get you to do anything about thisIs that the company that you want to be? Do you think that continuing to spam call people will make them want to do business with you? If you think that the answer is yes, you are sorely mistakenYou need to 1) stop scraping phone numbers from webpages and spamming people who did not sign up for your service and 2) you need to have a way for people to opt out of the spam callsHaving to complain to the Revdex.com is not the proper way to go about business Regards, [redacted]

Complaint: [redacted] I am rejecting this response because: I am already on the do not call and have been for yearsThe company you hire to make your robocalls is ignoring the list That is the problemIf you receive leads from a company that makes millions of robocalls (and ignores the do not call list) then you are responsible for the callsYou are the reason they are making the callsI expect better integrity from a company whose founder used to work at [redacted] Regards, [redacted]

For every single Revdex.com complaint there are thousands more people that never file a complaint yet still have to deal with this company's unending Robo-Calls all day, every day, all year long, every yearThey claim they make 'no outbound calls' but they pay a proxy to do so just so they can skirt the laws on predatory robo callsThey praise the Revdex.com for being a perfect forum and then claim ZERO responsibilityNonsenseIf I filed a lawsuit I could list both Capital and their marketing proxy as defendantsLegallyThey need to stop feigning ignorance and take responsibility for their questionable practicesFurthermore, I asked them "Is this a loan you are offering?", they said "No, it’s a cash advance for your business with interest and fees that you pay back daily Monday - Friday"I said "What is the difference between that and a loan?”As you can imagine, the line went silentTo avoid banking laws they cannot call it a "Loan"Stay away from this placeNo matter how bad your situation is, they will only make it worseThey have purchased hundreds of domains that help drive traffic to their business through another proxy called ‘Firm Attorneys’This business is registered to a private home in New Jersey with no other traceEvery website points paints them in a positive light with a convenient link to their loan applicationThis is called ‘Black Hat SEO’ and is against Google policyThey have been reported to googleEven their websites all end in the word 'Loan'How can this business be 'Accredited' by the Revdex.com? The first thing they said on the call was “We are a Revdex.com Accredited Business!” And before Capital replies with “There are no laws governing calling businesses for marketing purposes”, you are calling my personal phone number and I do not own a businessAnd why would you even make that statement since you "don't make any outbound calls"??? Ooops

Complaint: [redacted] I am rejecting this response because: While I understand that the business in question claims they have no part in the processIt doesn't make sense while they would be the person answering the phone after pre qualifying questions are answered by their 3rd partyObviously, they have contracted this 3rd party to robo dial people so they can claim deniabilityThis practice of utilizing such discreditable methods to contact people is why this company really needs to be reported to the Revdex.comThey do not provide any information on who is doing this nor do they provide any knowledge of why this is occurringThey just answer the phone after a person is pre qualified and take an application if it is a businessHowever, they do not stop in the process or respect the do not call registry for people who do not have a businessThis is an ugly and disgusting way to affect so many people and that is why I reject this responseIn addition, if they want to have my phone number to take off the registryI call back every time they call and say take me offThey have yet to do this and thus why do they even offer this service Regards, [redacted]

We discovered that the the core difficulty was a misunderstanding over a fee for creating financial reports and documentationThis was necessary work, work that paid offWe got [redacted] funded and got him a positive credit historyWe accomplished the (almost) impossibleRegardless, we respect [redacted] and we understand his feelingsWe refunded the fee; the money will be present in [redacted] 's account on September Documentation of the successful transfer of funds to [redacted] is attached to this messageWe love what we do, helping businesses grow and helping them through emergencies [redacted] : If you need us, you can count on usWe will treat you fairly and get you back on your feet

We do not make telemarketing callsWe do not interact with consumers; we interact only with businessesYou aren’t a customer (this is a customer forum)You were not called by us; you were called by an unaffiliated third party call centerWe make certain that we operate within the law, but more than that we take the high roadWe take your complaint very seriouslyIn a world where nobody cares about the little guy, we careWe will do our utmost to clear this upWe put you on every Do Not Call list we have influence overThese are not State or Federal call lists, which are generally not applicable to business callsInstead, these are private Do Not Call lists maintained by call centersThis has been done, and you will experience fewer telemarketing callsSince you may be retired, and not an active business owner, we intend to dig deeper in our corrective actionFor you to have been called, someone erredThis error probably means that whoever called you has an outdated databaseWe will attempt to identify the caller and get this database problem correctedThis is not our screw-up, but we’ll exert our influence on your behalfWe sincerely hope this brings you peace and tranquility

[redacted] - We did not call youWe did add you onto several business marketing Do Not Call lists that are outside of the National Do Not Call Registry's sphere of influenceHopefully this will help you sleep easier; working nights is difficult We investigated and found that we didn't call you, nor did our usual suspectsAny third party that might have called you is completely independent of usWe researched and did not find your name or your phone number in any of our systemsThe fact that you are being called by different numbers every time suggests that you are being called by different peopleWe will do everything in our power to restore peace and uninterrupted sleep to your lifeBut you may want to invest in an app that blocks all callers other than those you white-list, especially during the time when you're trying to sleepThank you for being polite about this, you're obviously a good guyWe really did add you to a lot of Do Not Call ListsHope it helps

Complaint: [redacted] I am rejecting this response because: This is a cookie cutter reply and blatantly falseCapital Advance Solutions, LLCcontracts with 3rd party telemarketers and in long established law and FCC rulings are vicariously liable for the conduct of their telemarketersSorrywrong answer.? Regards, [redacted]

Complaint: [redacted] I am rejecting this response because: This company uses off-shore marketing companies to subvert the US laws pertaining to the National Do Not Call List I have received calls from three separate US based numbers with individuals with strong Indian accents, when following their sales pitch, all transfers lead to this company The US based numbers are fictitious and are likely used to deceive US recipients into thinking they are receiving a US based call Stating below that they did not contact me is completely false, as after receiving a call and following the transfers, I was directed to and spoke with a specific individual at this company and received a definitive email pushing their services with links to signup for their business loans I have documented and preserved this email and my incoming phone records for litigation and investigative purposes sand have made direct contact with the company's CEO for resolution I have also filed a formal complaint with the Federal Trade Commission and will be pursuing resolution legally Regards, [redacted]

[redacted] *We have placed you on dozens of private Do Not Call lists, and we are fairly certain that you have not been called by anyone we have any influence over in some timeThat is the component of your request that we have any influence over.We have no record of any contact with you, which is a factIn certain rare circumstances, the sales representative might hang up before the system is populated with the individual's informationNot to say you might have been a bit intense or anything like that, but the possibilities are 'no contact' or 'emotionally-charged contact that forced a call termination'.We have granted your request and sincerely hope that it helps you

*** *We obviously did not call you, as you pointed out in your complaintThe unrelated third party that did call you was within their rights, as the TCPA does not govern business to business callsThe 'C' in TCPA is for 'Consumer'You have made your case already, so this is a duplicate
complaintYou are certainly not a customer, just someone that told a third party they wanted a loan and got referred to us.The Revdex.com is very serious about consumer protection, even when those 'consumers' own businessesWorking with the Revdex.com, we have made the adjustment to greatly reduce complaints regardless of the legal validity of those complaints. At great expense, we have forbidden referrals from all of the previous third parties that are really the source of your original complaintWe now require any third party that wishes to generate a referral to comply with the TCPA as if businesses were consumersAny third party that wishes to refer business to us must agree to abide by an outsourced TCPA specialist to provide oversight over their telephony complianceThis compliance specifically includes applying TCPA to business owners, and also includes additional rules that vary from State to StateWe expect that there will be some complaints from slow-on-the-uptake activistsThere will also be a very few 'real' complaints that we will deal with honorably and amicably, as we always haveBut the little flurry of business owners complaining about TCPA non-compliant sales calls that were then referred to us is overPlease respond if you are able to find a third party to refer you to us, where the third party fails to comply with all applicable 'consumer' laws from today and into the future

I am rejecting this response because:They appear to be claiming they don't hire 3rd parties to make these calls I find that very hard to believe since they transfer you directly to the company in question Why would a 3rd party call center make calls on behalf of the company in question if they're not being compensated for their time and efforts? The simple answer is the wouldn't and that makes Capital Advance Solutions LLC responsible for the actions of their contractor They're trying to hide behind the illusion of 'we didn't call you so we're not responsible' but conspiracy to harass people is just as bad as the actual harassment. Notice also they claimed from another complaint back in April that they'd stopped this practice and yet it obviously continues to this day That makes their response back in April void too The Revdex.com of New Jersey should reject any response from this company that does not include the guarantee that 100% of numbers on the National DNC list will be blocked from unsolicited phone calls and that anyone not on the DNC who asks to be removed is permanently and immediately removed Short of that the Revdex.com of New Jersey should invalidate their accreditation.

I am rejecting this response because:
Once again, cookie-cutter reply! I am still being emailed by their employee Jerry M on a daily basisAll call made by telemarketers were made by and for Capital Advance SolutionsAll with their approval and benefitA class action suit was just certified in Florida against Capital Advance Solutions, LLC( *** vs Capital Advance Solutions, LLC) My telephone # is registered on the national "do not call" register and has been since March 23, Complaint has been lodged with the FTC by and through my counsel todayCapital Advance Solutions, LLC refuses to provide even basic, information such as their registered agent for processRealistically, the class action which was certified in Florida and alleges exactly the conduct I have complained of to the very letter! It's apparent the Revdex.com has no influence on this Capital Advance Solutions, LLC has no intention of mending their illegal activitiesCounsel has advised to file suit in my local courts via our long arm tort law, obtain judgmentWe have contacted New Jersey counsel to enforce judgment and enroll lien(s)This was done this AM.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me
Please be advised, I accept this as a conditional response as I have not been contacted by the company in question since I filed my complaint For the record, if I am contacted again by the company in question I will, without additional mediation, file a federal TCPA lawsuit and ask for treble damages

This 'customer complaint' is from a non-customer who was called by an unrelated third partyProbably several unrelated third partiesWe are not involved except to the extent that one of the third parties eventually forwarded his call to us in good faith when ***expressed interest in being
fundedWhoever it was that connected him to us is required to maintain outside compliance expertise and was operating within the lawBecause ***provided information, we are unable to identify this third party or even verify that he contacted usHowever, the main points here are that we did not call him and whoever did call him, if they connected him to us, was calling lawfullyNotably, ***is a business owner and there are no restrictions on B2B telemarketing at the Federal level or in his home state. That said, it is obvious that ***is a good person who does not wish to be contacted by telemarketersIt is within our capability to greatly reduce the amount of telemarketing he experiences and it is our pleasure to add him to every Do Not Call list we have access toThis has been done; it is our sincere desire that ***enjoy the enhanced peace and quiet that will follow

I am rejecting this response because:This company suggests that they did not directly call me And they may be technically correct However, they are clearly empowering or encouraging call centers to cold call folks and then transfer them once qualified This clearly violates the sprit and intent of DO NOT CALL.Companies should not be allowed to call numbers on the Do Not Call list AND they should NOT accept transfers or leads from companies that don't EXPLICITLY adhere to Do Not Call rules This practice is especially harmful to senior citizens who may not completely understand what they are being sold The fact that they have plenty of complaints in their file AND continue to have an A rating puzzles me Obviously, these complaints are the tip of the iceberg. What does a company have to do to get a lower Revdex.com rating? What is the purpose of the Revdex.com? Am I just wasting my time?
Regards,

As you pointed out, we did not call youWe don't have anything to do with consumers, we are strictly Business to BusinessWe don't do outbound telemarketing or cold callingThat said, the Revdex.com still holds us responsible for any complaints that ultimately can be traced to us, and we have come to
take this very seriouslyIt sounds like an unrelated party got carried away and called youYou reported that you are on the National DNC registry, so the call center that called you either made an error or they are falling off the wagonWe have already requested that all call centers DNC Do Not Call you, a request they are sure to grantAdditionally, the possibility that these unrelated parties are backsliding concerns usThis will be vigorously investigated.Thank you for bringing this to our attentionYour personal situation is corrected, and rest assured we will pro-actively hunt down and eliminate any possibility that this vendor is bypassing the controls that have been imposed
