third-party interaction in the Business to Business arena. We could not get our old vendors to accept TCPA on their B2B as TCPA far exceeds B2B legal requirements. This is a new lead source under contract to comply with TCPA. In other words they must count businesses as consumers.The manager of the call center reported that he reached out to this B2B contact personally and corrected the DNC issue. Additionally, he told me: We are speaking with each rep to confirm that we will not tolerate any negative, vulgar, or inappropriate verbiage being used towards anyone under any circumstances. It should be obvious that we have taken third-party marketing very seriously. This particular vendor has an outstanding reputation in the B2B arena, and it is hoped and expected that this issue will not arise again.

I am rejecting this response because:This company suggests that they did not directly call me.  And they may be technically correct.  However, they are clearly empowering or encouraging call centers to cold call folks and then transfer them once qualified.  This clearly violates the sprit and intent of DO NOT CALL.Companies should not be allowed to call numbers on the Do Not Call list AND they should NOT accept transfers or leads from companies that don't EXPLICITLY adhere to Do Not Call rules.  This practice is especially harmful to senior citizens who may not completely understand what they are being sold.  The fact that they have plenty of complaints in their file AND continue to have an A rating puzzles me.  Obviously, these complaints are the tip of the iceberg.What does a company have to do to get a lower Revdex.com rating?  What is the purpose of the Revdex.com?  Am I just wasting my time?

Even though you were called legally by a fully independent third party, the Revdex.com holds us accountable. Everything you say is simply untrue.  I just went on the National Do Not Call list to verify my number.  Here is the email I received

As you can plainly see my number, which is [redacted] has been registered for nearly a decade.
 
Futhermore, whatever odd claim you try to make about verifying me as a lead or having no control over the robot calls insults everyone's intelligence.  The third part company you hire to make these robot calls is your responsibility.  The only way I can reach your company is by pretending to be a business on the initial robot call...which is how I finally made it to a "Jerry."
You are simply lying at every opportunity.

As for their denial they possess no calling means and do not do so, well, the Federal Courts have ruled against them in [redacted] vs Capital Advance Solutions LLC. No longer can Capital Advance Solutions, LLC. deny their actions, the courts have ruled that they do and have done exactly what my complaint as well as all the others on this website claim. What surprises me is that the New Jersey Revdex.com continues to give them an A rating!

I am rejecting this response because: Until the business can remove me from the spam call list and I no longer receive any calls, will I accept a resolution. Simply saying that they do business with this SPAM calling company is not good enough. The company is knowingly spamming customers whether it is technically their company or not and until they resolve that and begin to acquire business through proper business channels will I be satisfied.

I can reduce the likelihood of your receiving sales calls. What I have done is forwarded your number to every vendor I am aware of and asked them to remove you from their call systems.That said, there are a number of facts that you will find useful.First, Capital Advance Solutions does not do...

outbound calling. At all. We didn't call you.Second, we only deal with businesses. If someone forwarded your call to us, you must have told them you were a business. Businesses do not get DNC protection, only individuals.There are state-by-state restrictions, but there are no restrictions on business to business calls in your home state, [redacted]Third, you are not a customer. This is a customer complaint forum. I checked every database I had access to, which is considerable, and you have never done business with us. Therefore you aren't supposed to complain in this forum.Still, you are a human, worthy of respect. And a good one, based on your coherence and savvy. It's my pleasure to do what I can to cut down on the number of calls you get, since that is your wish. Just don't be too disappointed if you are called by a vendor outside my sphere of influence. That said, we have demanded that you not be contacted, and the call center you did interact with has agreed to reach out to their lead sources and have you added to their do not call registries. You will not be bothered anymore, at least not by business cash advance people.

This 'customer complaint' is from a non-customer who was called by an unrelated third party. Probably several unrelated third parties. We are not involved except to the extent that one of the third parties eventually forwarded his call to us in good faith when [redacted]. expressed interest in being...

Because [redacted]. provided false information, we are unable to identify this third party or even verify that he contacted us. However, the main points here are that we did not call him and whoever did call him, if they connected him to us, was calling lawfully. fact pattern in the complaint suggests you were called by several independent vendors, and one of those vendors apparently gave you our name. I did not find any record of you, which means you never actually got through to us and you certainly are not a customer. Regarding the FBI, Secret Service, etc: You may want to google these agencies. Regardless, we are not being investigated by anyone, not criminally or for any reason whatsoever. These matters are not criminal, and the source of the activity you report is not us, but completely unrelated parties. That said, you are clearly frustrated, and we can and will help reduce your pain. Company conducts telemarketing calls to numbers on federal and state Do No Call lists.

[redacted]We obviously did not call you, as you pointed out in your complaint. The unrelated third party that did call you was within their rights, as the TCPA does not govern business to business calls. The 'C' in TCPA is for 'Consumer'. You have made your case already, so this is a duplicate...

You are certainly not a customer, just someone that told a third party they wanted a loan and got referred to us.The Revdex.com is very serious about consumer protection, even when those 'consumers' own businesses. Working with the Revdex.com, we have made the adjustment to greatly reduce complaints regardless of the legal validity of those complaints.At great expense, we have forbidden referrals from all of the previous third parties that are really the source of your original complaint. We now require any third party that wishes to generate a referral to comply with the TCPA as if businesses were consumers. Any third party that wishes to refer business to us must agree to abide by an outsourced TCPA specialist to provide oversight over their telephony compliance. This compliance specifically includes applying TCPA to business owners, and also includes additional rules that vary from State to State. We expect that there will be some complaints from slow-on-the-uptake activists. There will also be a very few 'real' complaints that we will deal with honorably and amicably, as we always have. But the little flurry of business owners complaining about TCPA non-compliant sales calls that were then referred to us is over. Please respond if you are able to find a third party to refer you to us, where the third party fails to comply with all applicable 'consumer' laws from today and into the future.
