We do not interact with consumers, being strictly B2BWe do not outbound call and we did not call youWe sincerely regret any third-party error that may have resulted in you being calledYou are already on private do not call lists because of your lawsuits, but we have added you to all the
private do not call lists again just to be sure

*** *Consistent with your report, we do not do outbound marketing or sales initiation callsWe do not possess equipment capable of making random or sequential calls, or of autodialing lists of phone numbersWe did not call youWe do not have any record of you, which is consistent with your
report that you provided informationHowever, there is a discrepancy in your reportThe issue is that the Indian call center you were called by is one of the vendors we had to cut off for non-compliance with the DNC listThey may have called you, but they aren't allowed to transfer you to usWe don't work with anyone that will not respect a DNC requestWe have told all known business funding call centers not to call youYou will be added to all DNC lists that we have any influence overWe found out some additional information that might surprise you, though. It really wasn't us, not at any phase of your ordealDuring our investigation, we found that an unrelated call center called you and transferred you not to us, but to another cash advance companyWhich explains why we don't have you in our systemWe proved to our satisfaction that every word you said is true--except it really wasn't us that called you or took your callWe are a little curious how you concluded it was us.We did put a stop to the activityBut you should be aware that the call centers technically didn't have to grant our demands that you be left aloneYour status as CEO of a tech company makes you fair game for B2B callsAs far as we know, we are the only B2B company that complies with the national DNC list.Regardless, we took your frustration seriously and we took care of thisAll the best to you, ***

I am rejecting this response because:This was not a B2B call? This number is not associated with any business line, and therefore your presumption is incorrect and this activity falls within the three federal statutes which were violated? If you do not make telemarketing calls, then you purchased the information illegally obtained from those calls, which I would caution as it opens your company up for liability? Not only this, but three separate people I spoke to at your company hung up the phone when I politely asked for my information to be removed? They neglected to even request the phone number for which I contacted them to remove. If you are claiming to have received and purchased this information from a third party, please inform me as to appropriate contact information for this company.? Lastly, however you made the determination that I was a principal at ANY company was Regards,

We don't have any record of talking to youYour complaint has nothing to do with usWe don't do telemarketing, we don't do business with individuals, and we didn't call youIf you were contacted by a third party and got them to transfer you specifically to us, then that third party was acting
within all applicable laws and regulations.Regarding the rates: Subprime advances have a 12% cost of capital and a 7% loss rateSo a funder would have to charge at least 20% to break even, and more if they want to be profitable and to cover additional risksWe are not a funder, and we don't set the ratesIn order to get a better cost of capital, qualify for a better class of advanceYour sales representative will be able to help you with that. There are too many of these complaints, and it is no longer possible for us to allow the confusion between legal B2B calls and TCPA-regulated consumer telemarketing to affect our good nameIn cooperation with the Revdex.com, we will be extending TCPA protections to business owners, in fact everyoneThis necessitated a new compliance vendor, and will take a few weeks to implementIn the meantime, please let us know if you would like to be placed on a lot of private Do Not Call lists to cut down on your telemarketing calls

We didn’t call youYou never talked to us, we checkedYou and us have no relationship whatsoever, no contact at allYou have no reason to target us with your frustrations Still, we put you on all the Do Not Call lists that we have knowledge ofYou will get fewer callsYou can’t be calling us
'scammers'That’s slanderIt’s also really unfair·? ? ? ? ? ? ? We established credit for hundreds of companies that truly needed our help to get started ·? ? ? ? ? ? ? We helped hundreds of companies overcome disasters such as hurricane Sandy ·? ? ? ? ? ? ? We helped thousands of companies overcome temporary cashflow problems or expand If you need business funding, we will get it done when others can’tWe will treat you fairly and with respectWe are the absolute best in our field Please be well, and enjoy the relative peace that we have negotiated on your behalf

*** *** you are not a 'customer'You are not even a 'consumer'As the owner of a Pediatrician office in Texas, you are not legally entitled to the consumer protections you invokeWe did not call you as we only accept inbound calls with regard to marketing and salesThe entity that did call
you is a completely independent entity, unrelated to usThat said, when you decided to "press charges", *** *** you certainly picked the right place to press themThe Revdex.com is not particularly impressed with fine points of law or semanticsThe Revdex.com is probably the fiercest defender of individuals on the web, and they hold us to a very high standardWe take our Revdex.com rating very seriously and work hard to do as much good and as little harm as possibleAccordingly, we have already added you to the Do Not Call lists of every vendor we have contact information forThis will almost certainly prevent you from being called againAdditionally, we will investigate what happened that allowed you to be calledYour Do Not Call listing might not count outside the Revdex.com, since you are a business and not a consumer, but we have promised the Revdex.com that we will respect the National Do Not Call registry regardless of whether a person is a consumer or a business ownerIn short, your Do Not Call preference was supposed to have been respected whether you are legally entitled to these protections or not Your statement that you are willing to help put us out of business kind of hurtWe have helped thousands of businesses, helping them recover from disasters, grow their business, and grow their credit so that they could get bank creditFrom a societal point of view, we provide liquidityThe value we provide to society is stunning in scale, with a huge multiplierThe credit we provide is used by businesses to pay other businesses...which pay others, in turnAnd we don't just benefit society and business - we employ dozens of good people, people with kids and mortgagesPeople you seem to want to toss out into the streetWe are trying, with all our mightWe regret any involvement we had in the unwanted phone calls and ask that you give us a chance to continue to improve our compliance with TCPA protections for all, including you and your fellow business ownersWe promise to chase down this error and correct it at its sourceMeantime, you will not be called again

I am rejecting this response because: Until the business can remove me from the spam call list and I no longer receive any calls, will I accept a resolutionSimply saying that they do business with this SPAM calling company is not good enoughThe company is knowingly spamming customers whether it is technically their company or not and until they resolve that and begin to acquire business through proper business channels will I be satisfied.?

I am rejecting this response because:
This is a cookie cutter reply and blatantly falseCapital Advance Solutions, LLCcontracts with 3rd party telemarketers and in long established law and FCC rulings are vicariously liable for the conduct of their telemarketersSorrywrong answer.?

Keith - As you correctly noted, we did not call youWe don't do outbound callingWe don't possess equipment that can perform auto-dialing or 'robo-dialing'We do strictly business funding and we do not deal with the publicThat said, there have been too many problems with unrelated parties
dialing people who don't wish to be botheredOne of the main problems is business to business sales calls that do not conform to TCPA regulations--they generally don't have toIn cooperation with the Revdex.com, we are influencing business telemarketers to follow TCPA rules, and anyone that wishes to forward a call to us must prove that they are using the more stringent consumer rule setThis has been costly and distracting, but we feel that you will see a strong improvement in this less-regulated segmentOn a more personal level, we can put your number on many private do not call listsThese lists tend to be well-heededThank you for letting us know about the problemPlease do let us know if our corrective action is inadequate, just give it a few days for everyone to update you onto their do not call listsBe well, Keith

Complaint: ***
I am rejecting this response because:
This business is stating that they do not utilize telemarketing to market their business yet has eight separate complaints against them in the last year for this very reason? Obviously their response is not truthful and is an attempt to subvert the negative aspects of this complaint? Bottom line is that I am NOT a business owner, my number is on the Do Not Call List, and I did receive multiple calls, all leading to Capital Advance Solutions? A subpeoena requesting all contracts and affiliations with telemarketing companies will shed light on this as I am moving forward with legal action here in *** if this issue is not resolved to my satisfaction by the end of the month? In consultation with an attorney, this may result in a class-action lawsuit against the organization

We do not make telemarketing callsWe do not interact with consumers; we interact only with businessesYou aren’t a customer (this is a customer forum)You were not called by us; you were called by an unaffiliated third party call centerWe make certain that we operate within the law, but more
than that we take the high roadWe take your complaint very seriouslyIn a world where nobody cares about the little guy, we careWe will do our utmost to clear this upWe put you on every Do Not Call list we have influence overThese are not State or Federal call lists, which are generally not applicable to business callsInstead, these are private Do Not Call lists maintained by call centersThis has been done, and you will experience fewer telemarketing callsSince you may be retired, and not an active business owner, we intend to dig deeper in our corrective actionFor you to have been called, someone erredThis error probably means that whoever called you has an outdated databaseWe will attempt to identify the caller and get this database problem correctedThis is not our screw-up, but we’ll exert our influence on your behalfWe sincerely hope this brings you peace and tranquility

We do not interact with consumers at all, we are strictly B2B. We do not do robocalling or any other type of telemarketing. We do not own or control any telemarketing company or individual. We did not call you.Additionally, we are highly ethical and 100% legal. We are the good guys that save...

businesses from disasters, fund growth, create jobs. Consistent with that good will, we have placed you on every Do Not Call list that we have access to.

[redacted]We are strictly business to business, which technically is not subject to the National Do Not Call registry and generally is unregulated depending on the State. However, we don't do telemarketing for the simple reason that it does not work for us. We don't own or control any telemarketing companies. That said, we are working to bring a new culture of sensitivity and TCPA compliance to the B2B telemarketing industry because that's what you want and what most people want. Additionally, you personally should not have been called by anyone in the business to business community, because we put the word out they are not to call you. If anyone does call you, let us know--we will ramp up the pressure and get it taken care of.We do regret any inconvenience you may have suffered. We wish you all the best; may you enjoy peace and health.

[redacted]As you apparently detected, we did not actually call you. We do not do outbound marketing calls, and we only do business with other businesses, never consumers. We have added you to our internal and to all external third parties we know of. At a minimum this will cut out the bulk of your...

unwanted calls.More proactively, we notice you're a consultant. It's obvious you don't need business funding. We will find out who messed up and get them to quit wasting our money and your time. Just clarifying on accredited lenders: We cannot be an 'accredited lender' because we are not a lender. We arrange for future receivables to be purchased at a current value. There are specific tax and operational advantages to this structure, but the main advantage is quick turnaround and easier qualifying in comparison to a bank loan. Accredited lenders are compliant with Title 15 USC, which is as much about lending rationally to people likely to pay it back as it is about accurately reporting rates and fees. It's an interesting topic but not relevant here.Tyler, you're obviously a good guy that doesn't need the hassle. We have put a stop to it. We sincerely hope this helps.

[redacted] We do not make outbound sales or marketing calls. We do not possess equipment capable of sequential, random, or robo-calling. We did not call you. We do not control the third party that called you.The investigation we requested on your behalf credibly reported that you are a high level...

businessman and a potential customer. The multiple calls you reported were not completed calls, but only attempts to call and only one real call. The GA national Do Not Call (DNC from here on) list on file did not list your number, so when they pulled the list you were not on it for whatever reason; most likely it is a recent entry. They probably need to re-pull the DNC list, and we requested that they do so.None of that makes it okay[redacted] We regret the inconvenience caused by the unrelated third party caller, but it does appear that a reasonable effort was made to avoid this incident. We have requested that you be added to all private DNC lists--a request that has always been honored in the past. Nobody we have any influence over will ever bother you again. Still, if there is any further activity we need to know about it.

This is a duplicate of a previous complaint in which we placed this business owner on a series of private do not call lists. We did not call this individual. We do not do telemarketing. We do not interact with consumers, we are strictly B2B. We are not affilia[redacted] with call centers or telemarketers...

and we do not control or own these. We do not possess telemarketing equipment.

Complaint: [redacted]
I am rejecting this response because: Everything you say is simply untrue.  I just went on the National Do Not Call list to verify my number.  Here is the email I received  Thank you for registering your phone number with the National Do Not Call Registry. You successfully registered your phone number ending in [redacted] on January 06, 2007. Most telemarketers will be required to stop calling you 31 days from your registration date. Visit https://www.donotcall.gov  to register another number or file a complaint against someone violating the Registry. As you can plainly see my number, which is [redacted] has been registered for nearly a decade. Futhermore, whatever odd claim you try to make about verifying me as a lead or having no control over the robot calls insults everyone's intelligence.  The third part company you hire to make these robot calls is your responsibility.  The only way I can reach your company is by pretending to be a business on the initial robot call...which is how I finally made it to a "Jerry."You are simply lying at every opportunity.
Regards,
[redacted]

Complaint: [redacted]
I am rejecting this response because:I am already on the do not call and have been for years. The company you hire to make your robocalls is ignoring the list. That is the problem. If you receive leads from a company that makes millions of robocalls (and ignores the do not call list) then you are responsible for the calls. You are the reason they are making the calls.I expect better integrity from a company whose founder used to work at [redacted]
Regards,
[redacted]

[redacted]We have placed you on dozens of private Do Not Call lists, and we are fairly certain that you have not been called by anyone we have any influence over in some time. That is the component of your request that we have any influence over.We have no record of any contact with you, which is a fact. In certain rare circumstances, the sales representative might hang up before the system is populated with the individual's information. Not to say you might have been a bit intense or anything like that, but the possibilities are 'no contact' or 'emotionally-charged contact that forced a call termination'.We have granted your request and sincerely hope that it helps you.

CAS is strictly Business to Business, we have no interest in consumers. We do not do outbound calling other than to follow up with existing clients. While it is possible to work directly with CAS to get a business cash advance funded, we encourage you to work with our many highly qualified sales...

partners. We are not operating a call center at this time. You should really take this up with the owner of the call center. That said, we have demanded that you not be contacted, and the call center you did interact with has agreed to reach out to their lead sources and have you added to their do not call registries. You will not be bothered anymore, at least not by business cash advance people.
