The response has not said anything about fixing the problemI spent over an hour on the phone discussing the issue and the member on the phone stated that "they had tried to call me"I confirmed the phone number they had on file was correct and as it was the only phone I have I promise they did not call meI have zero missed calls and I also do not have any voicemail's from their company

I was contacted once (by phone) while I was in a meeting at work and received a voicemail from *** *** who works in some branch of the Navient officeI tried to return his call for two weeks and left at least four messagesHe never called me backI called the same office and did not dial his extensionAnother woman helped me to the extent that she could (with one of my complaints, not the other)I cannot imagine that they could send me anything in the mail that would resolve this issueIn fact, I doubt they sent anything, but I certainly would not receive this letter in the five-day window I have to accept or reject this response.

I have checked my mail as of April 30, re: complaint ID ***, and have received nothing from NavientI have continued to receive harassing and threatening calls from the same woman at NavientIf I were to receive an actual letter from Navient, I would be glad to read it

For your reference, details of the offer I reviewed appear below.The advocate did respond via email and stated that the principal and interest had only been hit for months starting in DecemberI tried replying to the email and also called the advocate at the number provided twice to indicate his records were incorrectThe advocate has not returned my calls or emailWhen my daughter contacted Navient in December they told her the principal and interest had only been hit for months starting in MayWe have records to support that Principal and Interest have been paid since May and have satisfied the terms of the agreementThese records are available on Navient web site, and were accessed by an employee that managed to mistype my last name and then correct it when I notified the advocate in my response to their decision They have now put off releasing us as co-signers and my daughters ability to consolidate at a lower interest rate for another monthor more if this continuesI am hesitant to attach the account history here, but will if Revdex.com deems it secure

For your reference, details of the offer I reviewed appear below.I received a letter that simply rehashes the same response that they have given me for nearly a year They state in their letter that "defaulted loans are not eligible for a deferment or forbearance, therefore, your request has been denied" That is not my dispute My loans were in deferment for two months prior to them putting them into default status They should have never gone into default It was either a processing error on their behalf or a deliberate action on their behalf Either way, they are in violation of Section 623(a)(2) of the FCRA by refusing to update my reports to reflect the true status This section states that they have a duty to "update and correct" any inaccuracies once they are made aware of the inaccuracies They have never addressed the issue that the loans were deferred so, therefore, they could not be defaulted Instead they simply state that "defaulted loans cannot be deferred" over and over again I would like for them to address the error of defaulting the loans in the first place and to "update and correct" my credit bureau reports to show that there were no late payments in and to dhow that they loans never defaulted
