I really feel as if they are taken their time or just don’t care if my account goes into defaultCan they at least grant me a forebearance until this issue is resolved? There has been no offer made that satisfactorily addresses my concernsNavient has offered a refund check in the amount of $which states "CUSTOMER REQUEST RECEIVED
TO REFUND PAYMENT"Navient has disregarded my concerns and have willfully chosen to ignore the terms under which the payment was tenderedThey were notified well in
advance before the payment was processedWhat I requested was that Navient honors the agreement that was made to remove the derogatory information from my credit reportThey
received correspondence from me with the terms of the agreement which were non-negotiableThey later received a second correspondence which restated the terms of the agreement
that was previously sentThe payment was enclosed in the second correspondence with a check in the amount of $
The only acceptable resolve is that Navient honors the "accord and satisfaction" laws of NC
N.C.G.S‘ 25-3-states that the cashing of a check is considered satisfaction of a claim if:
Check is tendered in good faith
Amount submitted is subject to a bona fide dispute
Check contains a conspicuous statement that the check is being tendered as full satisfaction of the claim
I have followed protocol as NC law requires and I expect the same of NavientI have attached both correspondences with proof of conspicuous and time sensitive delivery
