Thank you for forwarding *** ***’s additional concerns to usCollege Admissions Assistance only enrolls clients at the workshop, so, if *** *** had opted not to enroll at that time, he is correct in saying that he would have had to wait for the next workshop to enrollHowever, as stated previously, *** *** was given three business days to take home the contract, perform any research necessary, and make a decision regarding cancellation*** *** opted to keep our services. As mentioned in our last letter, College Admissions Assistance services are proprietary and not offered in any public schoolOur Coaches are available over hours a week, via email, phone, or chat, to help students navigate the college admissions process and to provide expert guidance on things like college selection, career and major identifications, financial aid assistance, and many other items imperative to the college planning process. Our families also have unlimited access to SAT/ACT test preparation, personality, career, and learning style assessments, 24/Math and Science tutoring, unlimited essay review, as well as our proprietary progress tracking system. Again, we have met all the provisions in the Agreement and therefore we are unable to honor *** ***’s refund requestThank you again for your assistance in this matter. I am rejecting this response because:We need to add to *** *** description, that we signed the contract with CAA under great duress and having little knowledge at that point, of the college admission process and being that our child still was in Sophomore YearWe hesitated and wanted to check with the high school counselors before signing the contract but, once again, CAA strongly insisted that not signing at that point and time would mean not being able to sign till the next workshop the following yearDuring the following months and before our child in junior year, we got all the support and guidance for the called “college journey” for free at the high school and also through the *** *** Library System.Then, On May we claimed to CAA about interrupt the contract when we had payed $ (30%) of the total amountCAA denied cancel. Nowadays, we have realized that $ 2,have already payed (95%) of the total amountBearing in mind that almost 100% of the contract have been payed, I want to receive a payment back from CAA (compensation) from my notice on May when I asked for interrupt their servicesOn those months, we had already paid $ 1,(66%) of the total amount.With the Best Regards,Regards,

I received an e-mail confirming my place at your college on Sunday 19th August 2018. I replied saying that as my name was not on the invite and I live in the UK and a retired Police Officer I would not be attending. I also attached all the information I had obtained from that first e-mail, like full name of the parent, full address and zip code, even the name of her children. To top it all I included a photo of the invite's home to show that they should not include so much data on an invite which had been sent not only to the wrong person but the wrong country. Today I have received yet another reminder of this coming Sundays event. Sorry to say I will not be attending. Is there anyway to stop getting these e-mails from this college?

She also indicated she understood thecancellation provisions of the agreement including the three-business day right of rescissionperiod located directly above her signature, in large, bold print. At no point have we representedany other policy regarding cancellation.After reviewing the account, it appears that the technical difficulty that had to be forwarded to ourtech team was in connection to the Career Assessment posting incorrectly. While speaking to acoach, [redacted] mentioned her concern that this technical issue would hinder them movingforward. The coach reassured her that the Career Assessment was optional, that she still hadcomplete access to the rest of the services, and that it would, in no way, keep them frombenefitting from the program. Unfortunately, based on our review, it does not appear that thefamily chose to utilize these additional services or communicate with our coaching team asrequested.We have met all the provisions in the Agreement and therefore we are unable to grant acancellation at this time. While, yes, my mother did sign the contract, she only signed it under the impression that she could cancel the service with College Admissions Assistance at any time, as the representative told us. She  only understood the cancellation terms as it was described to us by the representative, and the representative misrepresented the cancellation terms by telling us we could cancel the service at any time. The part of the contract that says, "You, the buyer, may cancel this transaction in writing, any time prior to midnight of the third business day after the date of this transaction." was overlooked by my mother who believed that those terms did not apply to us since our representative repeatedly told us that we could cancel service at any time. The presentation given by College Admissions Assistance constitutes a door-to-door sale which by definition according to 16 CFR 429.0 is, “A sale, lease or rental of consumer good or services in which the seller or his representative personally solicits the sale, including those in response to or following an invitation buy the buyer, and the buyer's agreement or offer to purchase is made at a place other than the place of business of the seller... such as in a hotel.” By not informing my mother and I about the three day cancellation and telling us that we could cancel our service at any time, College Admissions Assistance constitutes a violation of 16 CFR 429.1 which describes that, “In connection to any door-to-door sale, it constitutes an unfair and deceptive act or practice for any seller to... (e) Fail to inform each buyer orally, at the time the buyer signs the contract or purchases the goods or services, of the buyer's right to cancel.... (f) Misrepresent in any manner the buyer's right to cancel.”Such practices by College Admissions Assistance also fall under the category of fraud according to the 23-269 California Forms of Pleading and Practice § 269.14 because, as a representative of College Admissions Assistance, the representative knew that my mother and I truly could not cancel at any time that we wished. Yet she still told us that it was true, and this constitutes deceit under Civ. Code § 1710(1) which states that, “A statement of fact that is not true suggested by one who does not believe it to be true constitutes deceit.”The 49-565 California Forms of Pleading and Practice § 565.31 states that, “Actions for relief under the unfair competition law may be based on any business act or practice that is within the broad definition of unfair competition under Bus. & Prof. Code § 17200.” By misinforming and withholding information from my mother and I about the cancellation deadlines, College Admissions Assistance has constituted unfair competition under the Bus. & Prof. Code §17200 which states that, “... any violation of virtually any law... can serve as the predicate for an unfair competition action based on an unlawful business act or practice.” Thus, under these laws, my mother and I are entitled to a refund and a cancellation of service.
