I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.   I am very disappointed that this happened a second time.  A written apology to my mother is unnecessary as she would likely not understand in her present medical state.

Ms. [redacted] currently has a balance in collections in the amount of $26.25.  This is for a toll in the amount of $1.25 that occurred on 6/22/2014 that was not charged to an EZ PASS account.  According to NYSTA, when the toll was incurred, no transponder was read and the invoice was...

billed by the license plate.  The first invoice was mailed out with an administrative fee of $5.00.  After no response, a second invoice was mailed out with an additional fee of $20.00 and a then final invoice was mailed out with no additional fees.  All the notices mailed by NYSTA were sent to Ms. [redacted] at the registered address for the vehicle.It is noted Ms. [redacted] spoke to a representative on 10/24/2015 and a request was made for an image of the vehicle was made.  The representative stated and noted that it was to be mailed to her address.  A request for the image has been made to NYSTA and the account is considered under review.

I am rejecting this response because their response was insufficient and inaccurate.First after I spoke with this firm on the telephone they refused to remove me from this account until I authorized them to speak with my Ex-wife. I did not give any permissions for them to contact anyone, nor do I have any authority to do so. I only repeatedly informed them that this was not a debt incurred by me, and furthermore I also sent a letter disputing their claim of validity in writing.  They have misconstrued my actions with their inaccurate statement in response.Second I had requested they remove any incorrect marks on my credit report, that are related to this. There is no indication in their response that this has been accomplished.

communication to that same address, addressed to anyone other than complainant.    We have verified with our client that complainant does have an outstanding and unresolved matter.    In the event additional details become available to us that allows us to better identify the exact nature of this statement/complaint, we are happy to further review and move this matter toward further resolution.    In absence of additional information, we will assume this response is sufficient to respond to the statement/complaint.

I am rejecting this response because:I have no problem paying the $29 fee. But I am not providing falsehoods when stating that I did NOT receive the original notification. The complex where I live allows for the front office to reject or accept mail pieces that do not contain apartment numbers if they know the renters by name. When the apartment received the original notification of the EZPass violation nearly a year ago, they may have rejected the mail piece. For whatever reason, I did not receive it, and I do not have it to provide to the PA EZPass to pay my toll. After a year, they now know who I am and directed the law firms mail piece to my apartment.That said, your team mentioned that you had a copy of the original violation. Please mail me the violation or provide the information necessary to complete the fee payment so that I may pay the original toll amount and the processing fee of $5.00. I cannot pay this violation since I have none of the corresponding paperwork to provide to the PA EZPass.

Ms. [redacted] complaint regards an unpaid toll violation owed to our client, the South Bay Expressway (SBX) in the San Diego, California area.According to the South Bay Expressway (SBX), a vehicle registered to a “[redacted]” incurred one toll on March 18, 2015. SBX mailed its first notice to...

[redacted] at the registered address on March 29, 2015. They received returned mail on this statement. As the amount remained outstanding, the violation was sent to the firm on June 8, 2015 and we also mailed a notice to the registered address. We received mail return on this notice. In November, a possible new address for Ms. [redacted] of 6253 [redacted] Rd, Dublin, CA 94568 was located and a new notice was mailed. Upon receipt of Ms. [redacted] complaint, we removed her [redacted] Rd address from Ms. [redacted]’s account so that no further notices to Ms. [redacted] would be mailed from our office at that address. We appreciate her bringing this matter to our attention so that we can correct and update our records.

Florida’s Toll-By-Plate mailed Ms. [redacted] an invoice on October 13, 2015 for two tolls incurred in late September.  A second notice was mailed on November 17, 2015.  The notices were mailed to the address provide by the DMV; [redacted].  When...

no response was received, the account was referred to the firm on December 29, 2015 and notice mailed on January 6, 2016.Our notices provide multiple options for paying the amounts owed.  On average calls to the toll-free number provided in our notice are answered  in approximately 30 seconds.  Callers also have the option to leave a voice mail message. Messages are normally returned within one business day.  Ms. [redacted] inability to get a person on the telephone may have been an issue with the number she was dialing.  We have reviewed our systems and everything is in working order.A call was placed to Ms. [redacted] after receiving this complaint.  Even though we do not show a return call, the account does show as having been paid as of January 12, 2016.

We reviewed the original violation notice, and Ms. [redacted] claim that the address was not correct for the initial notices is not correct. client.   The first $25.00 fee is assessed on the first notice but they will waive the fee entirely and charge only the actual toll if the debtor provides proof of an E-ZPass tag that they are able to charge. At this stage they will still accept the actual toll if the debtor contacts E-ZPass, provides a toll ticket, and pays an additional $5.00 processing fee.E-ZPass has agreed to waive the entire $40.00 fee for a total due of $29.80. This is the maximum toll for the exit she used. They are willing to do so since this is her first and only violation; even though her argument regarding the address is invalid.

I am rejecting this response because:I have never received any answers to the questions I posed.  This law firm references my "third request", but they never really answered requests one or two. Pretty simple questions I've asked, the sort of things anyone would want to know. Please have someone from the City of Galveston contact me directly.

I am the Managing Partner of the [redacted] office, and have personally investigated this matter.  Our call records only show one call from the complainant, not ten, and said call was before 8:00am and thus before our office hours.  We did return the call, but did not leave a message...

Mr. [redacted] states on the complaint the toll charges do not belong to him due to having an active EZ-Pass.  A vehicle with an EZ-Pass device belonging to Mr. [redacted] was detected using the New York Thruway on 4/26/2016.  Due to insufficient funds, NYSTA was unable to charge the toll to...

the EZ-Pass account.  The toll violation was invoiced and mailed to the address listed on the EZ-Pass account that was provided to NYSTA by Mr. [redacted]’s tag provider, the Maryland Transportation Authority.  After an additional invoice with no resolution, the account was forwarded to our firm for collection on 7/21/16.  The balance is due in full.We contacted Mr. [redacted] and explained the breakdown of the balance.  Mr. [redacted] stated he never received the invoices from NYSTA.  We explained that the address provided to NYSTA by the Maryland Transportation Authority was [redacted], Chevy Chase, MD 20815.  He acknowledged this was his previous address.  Mr. [redacted] says he will contact MTA to confirm the address on the account and will call back for a resolution.

Ms. [redacted] states on her complaint she never received the original invoices and the collection letters did not contain the license plate of the vehicle.  As we stated in the previous response, if a device is detected, NYSTA does not record the license plate, which is the reason why no plate information is given.  Ms. [redacted] device was detected on a vehicle for a toll on 7/3/2014.  When NYSTA requested the toll from Massachusetts, it was not able to be paid because Massachusetts reported that there were insufficient funds on the customers E-Z Pass account at that time.  Massachusetts provided the name and address associated with the device tag number.  All notices were sent to [redacted].  NYSTA states none of the notices were returned to sender.  The 1st notice was sent on 7/9/2014 in the amount of $6.75 which included the toll amount of $1.75 and an admin fee of $5.00.The 2nd Notice was sent on 8/13/2014 in the amount of $26.75 which included an additional fee of $20.00.The final notice was sent on 9/18/2014 in the amount of $26.75 with no additional fees.

Ms. Johnson says on the complaint that the unpaid tolls and charges owed to our client, the Florida Turnpike Enterprise (FTE), were included in her bankruptcy, and she is no longer responsible for the balance. We submitted the bankruptcy filing information to FTE for review.  FTE...

confirmed that the date of the filing was on May 15, 2017 and that any tolls incurred up to that date are protected.  However, the tolls currently in collections were incurred after the filing of Ms. Johnson’s bankruptcy, and the balance of $73.48 remains due in full.
