This email is a follow up to the claim from Mr*** after the initial repair was done, in my earlier response I noted that if the initial repair did not work property that DRHI would agree to address again and complete as needed. I met with Mr*** on Friday and after taking some grade shots of the swale was able to determine that there is still not sufficient fall to allow the water to drain properly. Based on this meeting DRHI will be readdressing the problem and correcting properly, below is my email follow up that I sent to Mr*** following up on our on-site meeting

I am rejecting DR Horton’s response as the work has not been completed, and I have not received an email from the business stating that the work has been completed. The Area Construction Manager falsely stated that *** Roofing had been out to my house on two occasions, and on the second trip the roof and flashing were inspected from the outside. *** Roofing had not been to my house. *** Roofing went to the wrong house on two occasions. It turned out there was missing flashing that had been filled in with caulk for the garage roof leak. Also, I have not received a report documenting what repairs were made to prevent future roof leaks. The water stained drywall and the drywall covered with black mold have not been replaced. The garage drywall tape that has fallen off, is loose, is covered with mold, or is crinkly has not been replaced. When *** Roofing added the missing flashing to the roof, they damaged the siding, and now a siding contractor needs to come out to the house and replace the siding

I understand that maintenance is required on homes, what I don't understand is why only certain portions of the stucco is falling offI have read that if stucco is properly applied it can last for up to yearsI may be naïve in expecting this to be case from homes built by D R Horton but after reading all of the complaints from other home owners I now understand that their quality control needs helpThe person that came out from DR Horton was quite pleasant and told me about the repair kit that I would need to purchaseThe problem is this repair is close to the roof. Not something I am comfortable with doingSo DR Horton now has another unhappy customer who purchased one of their homes. I was also told I could call and get the name of the company that did the original Stucco on this house, why would I want the same people doing the work again when they did not provide quality work initially.

I am rejecting this response because I was experiencing the same issue before the storm.The roof was not installed properly period and the builder/roofer/Warranty is not willing to stand behind heir work.I hope future homeowners seek prior experiences and reviews before buying a home from * * *** as their history shows and is confirmed by myself, they do not hold their end of the bargain as it relates to repairs and customer service.Shingles should not blow off my roof months after purchasing the home, PERIOD and they continued to do so to this day

Dear *** *** In response regarding complaint ID 10723104, Mr*** met with our superintendent for the final walk on his new home purchase before closing on the same day just hours before closing. During this time Mrand Mrs*** told the superintendent that he
wanted the HVAC unit switched out to a ton unit because of a home inspection report that he had requested on his new home suggested that the ton HVAC be replaced with a ton unit on this particular home. The superintendent explained to Mr*** that the HVAC unit could not be replaced because we had an engineered report stating that the HVAC unit installed was sufficient for the home. We provided the report to Mr*** realtor after the discussion at the final walk. The realtor at that point after the discussion stated that since we were not going to replace the unit then they demanded a $20,price reduction or they were not going to close. I asked the sales agent to tell the realtor that we would not be able to reduce the price of the home $20,We would have completed the other issues stated in the home inspection report before close but was never given the chance. Mr*** and his wife left with the realtor to discuss options. The realtor representing the *** called the sales agent and told her that they would not be moving forward with the purchase because we were not going to do anything for them They asked for the earnest deposit of $to be returned to them .The sales agents explained our policy to the realtor Mr*** called me directly and asked me why he would not be able to receive the deposit back and I explained to him that we by contract give the earnest check back when there is a financing issue. I explained to him that it is policy to give the earnest check back when the buyers are unable to obtain financing. He asked me why again, and I explained to him per contract, we only return deposit money on a financing contingency SINCERELY, *** ** *** Area Sales Manager, MS DR Horton Homes

In response to the claim filed to your office 1. Inadequate or substandard finished. a. This home closed in and we do not have
any open work orders in our systemI understand that Ms*** was not happy that we would not paint on our month warranty, however that is our policy with all homeowners2. Dead Palm Tree a. We do not warranty landscaping materialsIn the HOA documents it clearly state that in this area of Tuscany the HOA is only responsible for replacement of damaged materials in the common areas and that the homeowners are responsible damaged materials in their own yards

I am rejecting this response because:The subfloors is part of the structure of the home which according to DrHorton is a year warranty.my original complaint about my sub floors was because my entire upstairs was unleavened. Which was properly adjusted to make leveledWas it done right, who knows but it solved the issue of being unleveled.I then complained about my floors making popping noisesThey came out and put a few nails in and left.The guy I spoke to who told me he could fix this problem never showed up to the jobnon English speaking men did and requested for me to show them the issue again.I complained multiple times about this problemThe fact that it does not get fixed and just gets touched up should have nothing to do with a one year waarentyThe complaint was filed way before the one year warranty.I bought a brand new home because I aspect it to have issuesI deal the the noises my house makes daily and live with itI am told it settling cracks, which are insanely loudI owned plenty of houses not built by DrHorton and never had these issues. Its actually funny that my last house was built by the same builder and made the same cracksAlso it was years oldWhat was the excuse oh its settling. I want my floors fixed and then I am going to sell my home and never buy a Dr Horton home againI would not wish it on my worse enemy.My floors need a professional to fix themIf you need a video of the horific sounds it makes when you walk on it let me know

Please accept this correspondence as D.RHorton, Inc.’s reply to the Revdex.com with regard to the above-referenced complaint. Our records indicate that the home at *** *** *** closed on March 31st, Past issues or concerns with the shower glass door had not
been reported prior to the shower glass shattering and being reported on May 4thWe arranged an inspection by the vendor that supplied and installed the door (Aztec Glass & Mirror)Their inspection findings did not find issues with the material or installation and noted the probable cause to be from improper operation of the door. Being that a defect was not found the issue is excluded from coverage by the home’s written limited warrantyBut given the nature of the concern, as a good will gesture we offered to replace the shower enclosure as well as fulfill the homeowner’s request of installing an upgraded productWhile this was an unfortunate occurrence and we sympathize with the homeowner, we do not assume responsibility since a defect was not found. At present time we are in the process of addressing additional items that were reported to us by the homeownerWe appreciate the opportunity given to look into our homeowner’s concern. Please accept this correspondence as D R Horton, Inc.'s final response to the Revdex.com with regard to the above-referenced complaint. Talked to the Husband today around 1:30pm; told him the situation and why the check came from my company. He understands that I'm the president of the HOA, and that the $initiation fee was being paid by a HOA board member. The situation should be resolved because they did receive the check and cashed the check, plus they have been told why. Thank you *** *** VICE PRESIDENT
