SECOND PARAGRAPH OF D.RHORTON'S RESPONSE - We were Never given a copy of the MLS listing We were shown the house by *** *** and was quoted a price of $349, We went home *** *** contacted us by phone and we make an offer of $320,based on the quoted price over the phone Within six (6) hours *** *** phoned us to say that our offer was accepted We were never given a "configuration sheet" during this process Mr*** notation that we paid less that the MLS listing price is correct - $2,lessThe MLS listed price was $322,455.00. After attorney review we found the MLS listing of $322, Another untruth is the comment that we received an explanation that the same house constructed on a different lot in the Camelot community would cost $20,more That discussion never occurred with us and we resent the attempt by those representing D.R.Horton as some great benevolent benefactor The MLS price represent a house that was completed in June and offered as a Quick Sale There was an "unadjusted price" - Adjusted to fit a cash buyer We have a copy of the listingTHIRD PARAGRAPH OF D.R.HORTON'S RESPONSE - We signed a contract based on *** *** explanation that "a junior employee entered the wrong price on the MLS listing" with misgivings unaware that there was another option As the attorney review was completed we signed the papers and gave a deposit of $5, Ms*** was unaware that we knew of the the MLS price when she presented us with papers justifying the $349,price Her paperwork was prepared in advanceWe did not inform our attorney of the pricing discrepancyFurthermore, our attorney, *** ***, was unaware of this incident until we asked him if we could file a complaint days before the complaint was filed It is our understanding that in New Jersey items advertised lower by a seller must be honored We were not given the option of making a lower bid for this houseIn addition, *** *** works for the interest of D.RHortonShe did not show up for the closing She sent someone else to the closing who was completely unaware of what was taking place We expressed our dissatisfaction with the entire process at closing and made it very clear that dealing with D.RHorton was "Messy" We may or may not receive remediation for what happened However, it is our expressed intent that D.RHorton and those acting in their interest will conduct more honest, transparent transactions in the future It is our belief that we were victims of "improper conduct" by those involved in this transactionNo letter from an attorney or anyone's attempt to muddy the facts will change what occurred There is no misunderstanding Thank you for your attention in this complaint

Ms*** first visited our Brio community on 8/29/16. Ms*** expressed interest in our Home of the Week, *** *** *** Chris D*** our sales agent, took Ms*** to the home site. Ms*** informed Mr*** that she was not interested in the home because she did not
like its location in the community. Ms*** thereafter came back to the community and again asked to see Lot Another sales agent, Travis ***, was working that day, and he took her to the home site. When Ms*** and Mr*** returned to the sales office, and Ms*** indicated that she wanted to determine if she could prequalify for financing to purchase Lot 219. Mr*** gave her a prequalification, which Ms*** took with her and completed at home. The following day, Mr*** followed up with Ms*** on the status of her prequalification application. That’s when Ms*** informed Mr*** that she did not want to purchase *** *** ** ***; instead, she was interested in purchasing Lot at Symphony (another D.RHorton community just across the street from Brio). The home being built on Lot at Symphony was an entirely different plan with a more desirable location than the home being built on *** *** ** ***. As such, the home on Lot at Symphony was priced more than the home on *** *** ** *** Angela Carmen, D.RHorton’s Area Sales Manager, and MrDowney have both spoken with Ms*** and informed her that the two homes in question are entirely different homes in two different communities with two different prices based on their locations, included features and the like. I accept the changes regarding raising the fence. I need clear requirements and acceptance criteria for the drainage systemthe claim is the ground is so saturated that the drainage system is not able to function and grass as not routed, but in previous statements you have said grass is rooting and growing nicely is most area's and yet the moisture level is similar in both high and low areaif you are saying that the drainage system will work when the grass is rooted and growing then the area that has grown and high then those area should be dryerif you are expecting the entire ground to dry up before testing the drainage systemi need to know how many days without rain or water needs to occur, how much rain or water needs to happen after that, how many days before the ground becomes is dryi am close to my year warranty, what happens if the system is not tested prior to my warranty end dateit feels like these are stall tactics to run out the clock

On April 19, 2016, an email was sent directly to *** *** (not our D.RHorton Website for monitoring and tracking of service requests as is dictated in the warranty guidelines) from Claimant regarding low water pressureThe Claimant had noted that an HOA related repair to a mainline meter in
the vicinity of the home on or around April 15, was likely the cause of it*** *** informed Claimant that repairs to the mainline could not cause this, but that D.RHorton would investigate if Claimant would sign a Possible Non-Warranty Form as is practice in this type of a service request due to the age of the homeClaimant refused to sign the form and proceeded with his own repairsInvestigations by D.RHorton had eventually determined the cause for the decreased water pressure was related to an obstruction to the submeter for the residenceTo help Claimant with his concern, *** *** contacted Cal Submeters and requested a “trouble ticket” to look into the matter even though the submeter is not covered by the D.RHorton warranty, nor was the obstruction a result of the work performed to the mainline previouslyThe claimant had already contracted services with outside contractors which were unnecessary and did not correct the water pressure concernPer warranty guidelines, D.RHorton has no obligation for reimbursement for work performed by Claimant, or for amounts paid by Claimant for repair or replacement of any item which has not been pre-approved in writing by D.RHortonIn addition to the above, the statute of limitations for plumbing concerns per California statute of limitations is years from the original close of escrow, making the expiration of the warranty March 27, 2013, years beyond the warrantyNonetheless, as a goodwill gesture, D.RHorton will reimburse the Claimant the full amount of his claim for $411.11, upon submission of paid receiptsPlease contact me at *** *** if you have any questionsWe appreciate your assistance and thank you for your time in this matterRespectfully, *** *** *** *** Vice President of Customer Service
With regard to us signing that, yes we did Verbally we were told this issue was to be readdressed at the month warranty, which we assumed it would be I believed I was signing that said the painters had corrected only the issues which were addressed, which after they left we found multiple issues that were taped and had not been corrected I assumed that since we were revisiting this at the month that was the case and they would be addressed However on the month, the project manager wrote "multiple paint issues" on the warranty list which included deep trowel marks in the ceilings, unmatched baseboards, and a inch crack in the wall board, as well as a window sill that has fallen inch which I believe is a structural problem He agreed that the paint issues had to be revisited, when he returned with the work orders he said, "you will need to take the paint issues up to another level, I am being told paint will not be addressed on this report" and he was clear that the issue needed to be responded to from a higher level At this point, all the structural and wall cracks that should have been covered by the warranty were buried by how it was written in the warranty paperwork Truthfully, Horton is well aware of this issue, having visited it before Paint was done in this home at 9pm at night, without lights, in temperatures over degrees, the primer coat was applied by someone who did not mix it correctly, that was acknowledged multiple times, they were still painting this home days after we closed because there was no occupancy permit, they painted the burnished brass fixtures white, that we paid premium forSome hinges are painted white on the frame side and then they hung the door where the burnished brass is not covered, leaving striped hinges There are rooms where the white base coat was never covered with beige paint There are baseboards where chunks of rug and dirt are embedded within the paint. That being said, I believe the main HORTON company does not hear of this house because they have tried to cover up all of these issues so home office doesn't see them Although, we were lead to believe, by two of the ever changing project managers, that this issue would be addressed at our month meeting, and there is nothing in writing to indicate that What I propose at this point is this, we obviously were mislead about how this would be handled, and the company has not responded to us after MULTIPLE requests for someone to come view this issue I would like a letter from the Horton main offices stating they are aware of the issue, and would again like someone from home office to view this, so that another customer does not ever have to live in a home that is repulsive, due to the Horton company hiring contractors who do not meet their standards I don't expect them to do the right thing anymore, based on all the other issues with these homes, its clear they do not have any commitment to providing a quality product and have no desire to consider that maybe, just maybe, there is a home out there that didn't get finished correctly and has fallen through the cracks of warranty As for the tree issue, the woman next door contacted MRHORTON directly and had main office people visit her home last week She told them that my tree would be a projectile during a hurricane and that it was a liability to the neighborhood Her lawn and my tree were both replaced within days of the main office people viewing the situation Thank you for taking up this matter, I got my tree replaced which was the main concern After a year and a half of fighting, that issue is finally resolved
We appreciate the customer reaching out to us regarding their concerns. We are in the process of addressing the drainage issuesThe yard has been re-graded and a drainage system has been installed in the yard to direct water away from the homeWe are currently waiting to install sod once the
temperatures rise and look forward to resolving the customer's concerns

We are in the process of reviewing the customer's concernsA preliminary assessment has shown that some items were corrected, some were denied based on the terms of the warranty and some items were canceled due to inability to schedule with the customer
The Board of Directors has authorized the relocation of the pet waste station to the opposite end of the grass area closest to the parking lot. The station will be relocated upon the acceptance by the homeowner that this will resolve the pet waste station issue Included with this response is the contract for janitorial service between the association and *** *** *** which outlines the removal of pet waste from the common areas. Unfortunately it is not financially possible to have the pet waste removed each day, but it will continue to be removed twice a week in accordance to the terms of the contract. Also attached are invoices for the pest control service provided by *** *** to demonstrate that the association is making every effort to manage the ants and other pests that reside within the common elements.
