We disagree with your claim that D.RHorton failed to honor its warranty obligationsInfact, D.RHorton went beyond the terms of your warranty to address your concerns.Our records indicate that you purchased your home on March 21, 2009- over six yearsagoPursuant to the terms of your warranty
and as explained in your homeowner booklet,you were obligated to provide us with your one year list on or before March 21, 2010.However, you submitted your one year list on March 28, 2011, which is one year afteryour list was due and two years after your closingIn April 2011, you explained to usthat for the intervening year you were faxing your list to a phone number instead of thefax number referenced in your warranty materialsAs a courtesy, we agreed to addressa number of items contained on your one year list and scheduled an appointment withyou for May 24, A D.RHorton representative appeared on the scheduled date andcompleted the items we agreed to addressMoreover, you provided us with a sign-ofknowledging your acceptance of those repairsThus, we believe your assertion thatD.RHorton failed to honor its warranty obligations is completely unjustified.Should you wish to discuss this further, please do not hesitate to contact me

Please enter your reason(s) for rejecting the business response below.Mr*** and D.RHorton did not make any genuine attempt to find a fair resolution They did not even respond to the proposal that my attorney and I made, which was that they simply perform on the sales contract Instead of responding to the proposal and using the dispute resolution methods stipulated explicitly by the contract (including formal negotiation, mediation, and arbitration) D.RHorton backed out of the contract unilaterally, in violation of the parameters of the contract.In fact, when D.RHorton canceled my contract they referenced section of the contract is entitled "SELLER'S BREACH" and identifies the buyer's legal prerogative, in his or her "sole and absolute discretion", to unilaterally cancel the contract and retain all deposit monies if the seller breaches and does not resolve within days of the breach In my "sole and absolute discretion" I never canceled anything I only requested that the builder negotiate in good faith to resolve their breach of the contract that they had written Thank you, D.RHorton, for exercising my legal right for me

DR Horton spoke with the homeowner last week concerning the issue. We are in contact with the homeowner and are addressing. The Pensacola area has experienced an unusually high, record amount of rain fall during the month of December

A conversation prior to clo**ng was conducted with Ms*** in regards the purchase of her Townhome unit. We told Ms*** if she was not happy we did not want her to close and we would cancel the contract and refund all her earnest
money with no penalties to her. This was communicated by the sales agent and the area construction manager to Mr***, Ms*** and their Real Estate agent. Ms*** decided to proceed with clo**ng at that point. As with any new build construction items can be found after a first walk through, after a second walk through and after clo**ng. There were three small items that were addressed after close that were not part of items we agreed to remedy on the initial walk. All items were corrected as promised in a timely manner, and future items will be addressed in accordance with our warranty policies

Ms*** complaint should be taken care of completely on Saturday, August 12th. Our painters have already been by there once to do one coat and will return on Saturday, at her convenience, to complete the task to her satisfactionSincerely, *** *** Customer Service

In reference to the above complaint, there have been modifications made to the rear yard of this home after closing, which are causing the drainage issues. These modifications were not made by DR Horton. I have searched our records and do not find any requests for service for the caulking, sheetrock or any other items on the home. Should the homeowner be able to provide any documentation showing the timely requests for the mentioned repairs, we will be glad to schedule an assessment by one of our team members At this time, any remaining warranty is through RWC and we refer the homeowner to that warranty

Afternoon, I have read and understood what the business response was stating, but I disagree in the fact that the tile in the house, it had a crack downstairs in front of the door onlyAfter moving in a few days after, cracks in the upstairs bathroom, laudry room and kitchen started cracking, these cracks were not on the inspections or walk through of the home, it occurred after the closing I also did agree on receiving the tiles and we do the labor, but the crack are appearing everywhere and this is not the homeowners concern or mistakeAlso, regarding the flood outside, the soil never drys up*** *** has personally appeared to the home and have made sure that the sprinklers and ariggation timer is set correctlyIt has not been touched or changed by us and it has been raining and storming hereI did research and it should not take more then 48-hours for the soil to dryThe soil is not drying up, I also requested a friend to come and check out the issue and I was told it is not installed correctly and that the issue will only get worstThis issue is known with the community I have spoken to neighbors and they have sent warranty requests and complaints I also brought this attention to the inspector from DR Horton and asked if this is and he said, yes because our neighbors over run their sprinklersI have followed what was requested and spoke to my neighbors and the issue remainsLike I stated before; kids can't play outside, I can not setup a fence, it is close to my ace unit; which will cause major issues later on in the futureThe stand up shower has been reported from the time we moved in, that's months ago, and yet we are still waiting. I am requesting for your help, because I have been patiently waiting and I don't want to be like these other homeowners when their issues haven't been resolved after their one year warranty ended There were other issues and I accepted the fact they won't fix it because it's not covered with warranty, but these issues have been over due.***Revdex.com:

We have reviewed the owners’ complaints and we have discovered the following information: The owner submitted a complaint that their warranty items have not been addressed, we do show that this customer had a pre-existing issue with the items described in the complaintWe will contact the owner
within the next 5-business days and schedule a full review with our regional warranty area manager to review this customers current unresolved issues and determine warranty coverage at that time

We have attached closing paperwork for the owners in questionAs you see there is final paperwork that the field supervisor went over with buyer, the Warranty summery sheet, homeowner orientation, homeowner orientation acknowledgements and the homeowner orientation list for items of their concern,
the paperwork addresses landscaping that they signedThere is nothing about their yard and nothing in writing in file about any promise to install a retaining wall or to make their back yard “flat” and they have not produced any literature that someone ever said thisThe field super on this home unfortunately is not with DR Horton any longer but in the area where owners home is there are no retaining walls and their yard is as all others and not in need of a retaining wallKindest regards, *** ***

I am rejecting this response because: work schedule were promised to be scheduled but
workers would not show up, including the superintendent (*** ***)He promised several times that he would come and check the work that was promised to be done; Job is not finished! They promised to come back and finish the job but everything is promises! The carpet on the stairwell is all flattened and dirty with the construction that was done in the house! This is a brand new houseThe carpet should still be clean and fluffyThis was due to the construction workers’ filthy shoesThe plastic that was placed to protect the carpet were torn and there’s drywall compound all over carpet, everywhere! I was told the cleaners would take care of itThey came rushing and left after minutesI’m still gradually working on the d rywall compound on the carpetThis company is full of liars and lazy workers!!!

I am rejecting this response because:No one has contacted me directly regarding the sinking in my yard When Mr*** was out looking at the roof on 4/20, he said that *** had stopped by and that "someone would be out to fix it Tuesday." It is now Wednesday 4/26/17, *** has not contacted me directly (even after I left him a message), and the sinking is getting worse Soil is eroding from underneath the driveway, and DR Horton does not warranty their concrete work However, due to the negligence of DR Horton, my driveway could crack I am working with *** *** in regards to the roof The fence was fixed only after this complaint was submitted

They did come to see the issue, but they only put stucco on a part of the wall that was not affectedThe part of the wall that gets water to the garage was not touched and the wood chips/mulch next to the wall were not even moved to see what was below thatThe garage is inches below the foundation of the rest of the house.I appreciate the fact that they fixed one part that should have been fixed, but I don't see any change in the affected area Regards,
