The Board of Directors has authorized the relocation of the pet waste station to the opposite end of the grass area closest to the parking lot. The station will be relocated upon the acceptance by the homeowner that this will resolve the pet waste station issue Included with this response is the contract for janitorial service between the association and *** *** *** which outlines the removal of pet waste from the common areas. Unfortunately it is not financially possible to have the pet waste removed each day, but it will continue to be removed twice a week in accordance to the terms of the contract. Also attached are invoices for the pest control service provided by *** *** to demonstrate that the association is making every effort to manage the ants and other pests that reside within the common elements. We appreciate the customer reaching out to us regarding their concernWe understanding the claim was first issued in September, when a construction superintendent inspected the home and had the stucco company inspect the wall to determine the possible leak sourceUpon inspection, it was determined
that a few minor cracks occurred in the stucco, which were found to be normal, non-warrantable stucco cracks that do not exceed the 1/inch wide criteria under the *** one-year limited warrantyAs communicated by a warranty service member in an update provided to the homeowner on 12/18, the results of the exterior water leak detection inspection found the leak to be related to normal, non-warrantable stucco cracks per the criteria mentioned above

We disagree with your claim that D.RHorton failed to honor its warranty obligationsInfact, D.RHorton went beyond the terms of your warranty to address your concerns.Our records indicate that you purchased your home on March 21, 2009- over six yearsagoPursuant to the terms of your warranty
and as explained in your homeowner booklet,you were obligated to provide us with your one year list on or before March 21, 2010.However, you submitted your one year list on March 28, 2011, which is one year afteryour list was due and two years after your closingIn April 2011, you explained to usthat for the intervening year you were faxing your list to a phone number instead of thefax number referenced in your warranty materialsAs a courtesy, we agreed to addressa number of items contained on your one year list and scheduled an appointment withyou for May 24, A D.RHorton representative appeared on the scheduled date andcompleted the items we agreed to addressMoreover, you provided us with a sign-ofknowledging your acceptance of those repairsThus, we believe your assertion thatD.RHorton failed to honor its warranty obligations is completely unjustified.Should you wish to discuss this further, please do not hesitate to contact me

***This letter is in response to DR Horton’s rejection letter received on November 2, I am once againrejecting the response because I still feel that DR Horton is responsible for the damages.It seems as though DR Horton is suggesting that I was purposely negligent of the warranty guidelines.Yes, I understand that I signed the warranty packetDR Horton’s most recent response highlights thefact that I acknowledged “receiving a copy of the Home Buyer’s Guide upon initial sale of the property”.Yes, I acknowledged thisYet, I do not see where I acknowledged having to use their list of preferredcontractors or I would be considered out of warrantyIn addition, I was not made aware verbally by therepresentative that went over the warranty packet that I must use the preferred contractors by DRHorton or I would be considered out of warrantyStill, had I been aware that DR Horton had preferredcontractors I would have gladly used themThis would have saved me the time of having to do researchon my ownIn addition, I would feel more comfortable partnering with a company that isrecommended by my home builder.DR Horton suggests that I was fully aware of their warranty guidelines because I previously owned a DRHorton homeThis should have no bearing on my current disputePolicies changes over time and anew warranty packet was presented for the sale of my current homeIf DR Horton wants to use the factthat I owned a DR Horton home previously as grounds for why I should be aware of their guidelines,then they should not have had me sign a new warranty packetDR Horton is correct in stating that Iused their list of preferred contractors in my previously owned DR Horton home for repairsThe list ofpreferred contractors was in fact located on the inside of the kitchen cabinets in my previous homeIwas under the impression that the list was provided as more of a courtesy than a “must use” guidelineIwill indicate again that it was NOT located on the inside of my kitchen cabinet in my current home, andthis was confirmed by Jimmy Roots, a representative of DR HortonI only received this list after I wasmade aware of their guidelinesFurthermore, if DR Horton wants to suggest that I should have thesame expectations from the warranty guidelines in my previous home, then I will maintain that the listshould have been properly placed in my current home as it was in my previous.Furthermore, the underlying reason for my dispute is the fact that I should not be having this kind ofexperience in a home that is less than years oldI could potentially have damage to my home becauseof a faulty faucetAgain, I will indicate that both the representative from DR Horton and DR Horton’spreferred contractor suggested that this was a known and common problem throughout the communityand other DR Horton homesWhy weren’t homeowners made aware of this? Horton, Inc. After conducting a thorough investigation, D.RHorton concluded the following in this matter. D.RHorton representatives met with Ms*** on March 25, regarding her concerns. At that time, we agreed to replace certain areas of sod surrounding the home. Additionally, all parties agreed to allow an independent inspector to evaluate the flooring on April 1, 2016. Please let me assure you that DR Horton strives to provide satisfied customers. I appreciate that finally someone is seriously working to resolve open issuesHowever, the job is not done until it is completely done. A lot of coordination and people have to come to fix the problems, we are dedicating quite a bit of our own time to facilitate the process where in fact these should have not existed in the first placeHere we are in our 3rd month and we cannot consider ourselves settled yet. Once everything is resolved then I can accept to close this complaint

The QC from Atlanta Flooring is going out to determine what the correct repair to the shower is. A rep froHorton will be on site with themA rep from Horton went out yesterday to access the yard to determine if there was standing water after the rainfall here stopped. If he has a drainage problem we will get the landscapers out to correctThanks ***
