was elected in accordance with the P*** *** CommunityAssociation documents and Florida StatutesThe results of the elections included individual homeowners ***, *** ***and *** ***Recently, *** *** resigned on 3/11/due to selling his home and movingout of the community*** *** resigned on 2/24/The Annual meeting is approaching and theremaining Board members agreed to leave the two vacated seats vacant and let the owners vote for all seats atthe next annual meeting, which is being scheduled now by the Property Manager under the guidelines of theP*** *** Community documents and Florida StatutesHorton disbanded the community's rights to *** fines against homeowners and Jot owners who brokecommunity rules documented in the CCR's for P*** ***, including fines for builder.Response- Per the P*** *** documents and Florida Statutes, it is a Board decision on whether they want tohave a fining committee and *** fines in the communityThe P*** *** Board of Directors has chosen not tofine in the communityViolations are being sent to homeowners monthly and owners have cured their violations asthey get the noticesOut of the violations sent, there are outstanding violations at this time in thecommunityHorton refused to respond to due process committee Jist of violations who had completed the due process andneeded further action.Response- The protocol established by the Board, in accordance with the HOA documents, is that violations areprocessed by the Licensed Community Association Manager through the Community Association ManagementCompany, who sends notice to the parties in violationThe P*** *** Board of Directors has found that thisprocess is effective in resolving violationsHorton disbanded the homeowner run due process committeeResponse- The P*** *** Board of Directors has not disbanded the Due Process CommitteeHowever, theyhave not approved fining by the Due Process CommitteeHomeowners are taking care of their violations in a timelymannerOnly violations are outstanding in the communityHorton decided that it did not want to pay the arc committee fee required by the CCR's for architectural proposalsand announced the suspension of the requirement to pay the proposed fee.Response- The P*** *** ARC committee, under P*** *** Board of Directors' direction, was not chargingthe $fee prior to Sept5, 2013.The P*** *** Board of Directors I Licensed Community Manager posted a notice for a P*** *** Board ofDirectors meetingIt was held on March 19, at 10:a.mThe P*** *** Board of Directors asked thehomeowners at the meeting if they wanted to waive the $Arc feeThe owners were in favor of waiving the$ARC feeThe P*** *** homeowners said they felt they should not be penalized for improving theexterior of their homeThe P*** *** Board of Directors moved that the arc fee would be waived if theAssociation Attorney opinion granted them that rightAll were in favor and the motion carriedThe P*** ***Board of Directors then directed the Licensed Community Association Manager to reach out to the AssociationAttorney for a written Attorney OpinionThe Attorney said the $ARC fee could be waived by the ParksideWest Board of Directors in a board meeting, which took place on March 19, The P*** *** Board ofDirectors /Licensed Community Manager then reached out to the ARC committee and let them know theAssociation would no longer be charging the ARC feeThe ARC committee did not follow the P*** *** Boardof Directors decision and proceeded to deny ARC applications for not paying the ARC fee of $25.00.The P*** *** Board of Directors conducted a meeting on May 7, at 11:a.mIn the meeting, there wasa discussion with the owners at P*** *** about the $Arc feeThe Board found that there were someconflicting views on the ARC feeThe Board of Directors reversed the decision to waive the $ARC fee anddecided to table the discussion until the annual meeting in where the entire community can discuss thematterWhen the committee rejected the proposals (arc applications) including the Horton proposal that did not have therequired fee, Horton had letters sent to ARC committee members- all residents- that the committee was nowdisbanded-Response- The P*** *** Board of Directors received multiple complaints regarding the conduct of the ARCcommitteeAdditionally, it was discovered that the ARC Committee had ta*** actions that violated Florida Statuesand the P*** *** HOA documentsFor that reason, the P*** *** Board conducted a meeting on May 7,at 11:a.mand voted, unanimously, to remove the current ARC committeeThe P*** *** Board ofDirectors agreed to run the ARC until such time as a new ARC committee could be formed by the new P*** ***Board of Directors at the upcoming annual meeting in 2015.I would like to take I am rejecting this response because: We did met with the D.RHorton Sales Manager and Construction Manager on
3/27/to review the items in order to provide a repair plan. No repairs have been set up as to this date. Another meeting is scheduled 4/3/to discuss their formal document repair plan. Not until we actually see the repairs completed will I feel this complaint will be resolved. I have been promised many things this past year as to which not have been completed.

I MET WITH THIS BUYER PERSONALLY ON FRIDAY AND HAVE TALKED AT LEAST ONCE PER DAY SINCE ALL LAWN ISSUES WERE ADDRESSED AND FIXED. The problems that I have submitted to D.RHorton have not been fixedThey set appointments for repair on last Friday 8/5/and neither of the two appointment showed up or calledI finally called the warranty person that I have been working with and at that point received a call from one of the venders late that afternoon asking to make another appointmentThe other vender finally called me this morning and that appointment will not happen till next MondaySo they want to respond that they are waiting to schedule appointments because of my schedule issuesI have had consecutive weekdays off and gave them a couple of other options for last week and this is the type of service I getNO SHOWS, NO CALLS

I am rejecting this response
because: I complained about the Landsaping as soon as I moved after closing on my houseI contacted the Superintendent multiple times and also the sales agent who was housed in the community and they both agreed with the fact that the trees are of very poor condition but it will improve after the winter is overThe Superintendent came to the house physically and he could not assist with more than just saying water the trees, and mention that every house has a budget for Landsaping and that we reached our limit and they can't do more to our Landsapingwe were of course watering frequently but of no valueThe oak trees have been dead since we moved and they would not do anything to replace them.I gave up with DR Horton and kept the dead trees in the yard until the HOA took over and they sent me a day notice to replace the dead oak trees, I had no choice but to replace them to avoid having problems with HOA.I have the letter from the HOA and all the documents and pictures to show the dead treesAll the neighbors were talking about the poor quality of the oak trees but they all know that the trees we have in my yard are dead and have been dead since they were installed.

he has contacted them to schedule an appointmentThe grout cracking in the master shower was repaired on 2/11/17, but unfortunately the cracks have reappearedWe will need to schedule a follow up repair to install siliconized grout under the shower seat and around the corner caddyThe customer expressed concern about the condition of the foundation, so elevations were taken on the foundation on 12/15/and it showed to be relatively flat at the timeElevations will be measured again on 3/15/to make a comparison after which we expect to repair the minor drywall crack in the kitchen ceilingOur contractors and vendors schedule appointments Monday through Friday from 8-and 1-pm

Per the signed warranty agreement at the time of closing, warranty coverage for siding on this home has expiredThe homeowner may consult with the siding manufacturer should they wish to learn more about siding repair or replacement and suggested maintenance for this product

The issue is worse because there is now a ditch that is filled with water and the drain covers are also full instead of draining. It caused more of a flooding issueThe side and backyard of the house is also flooded nowThe landscaping was not layed evenly and reduces the property valueThe grass is layed in patchesThe yard no longer has the professional finished look that it once hadI have attached some photos of the issues I am talking about
