At this time the roof repair and associated drywall repairs have been made to the customers satisfaction

As of this date, roof and siding issues remain. The cosmetic roof repairs accomplished in
August did not address the underlying issues as noted in the first
inspection report.
A second professional roof inspection revealed damaged
shingles were not replaced and roof shingles were not installed and
fastened per Manufacturers instructions and the City of Lakeville’s General
Building Code Requirements
Areas of concern are high nails, improper open metal valley
installation, improper & non-existing overhang, and incorrect shingle
offsets. This improper installation also
voids the IKO manufacturer’s warranty
In addition to correcting all outstanding and existing
siding issues, I request DR Horton remove the improperly installed roof covering and replace it with new covering. I request this roof replacement be promptly scheduled and completed during the summer season.

did not contact DR Horton at all, regarding any of the repairs that reportedly needed to be addressed. Our homeowners can contact our offices in multiple ways. Most owners contact us via our corporate website at www.drhorton.com/warranty, via our local office number at *** or via our hour emergency number at *** We have received correspondence in the past from Mr* *** from both our website and our local office number. Had our offices been contacted about the issues he was having, we could have sent any vendor that needed to respond, to his home in a timely manner. Mr* *** hired vendors not associated with the initial construction of his home, nor associated with DR Horton, to perform repairs that he is seeking reimbursement for. Our offices were never able to verify work that may or may not have needed to be repaired. None of our licensed vendor were contacted by Mr* *** to verify any repairs that he may or may not have needed on his home. Per the warranty documents, any warranty defects that you repair without prior written authorization of the administrator are excluded from the warranty. These warranty documents were given to Mr* *** both at the signing of his contract to purchase, and at the closing of his homeFor reference, this exclusion is listed in section E, number 9, on page of the RWC manual. I have included this document as part of this emailBecause DR Horton and its trade partners were not able to inspect, verify or repair any of the issues Mr* *** states he had in his homeDR Horton feels there is no further action to be done in this case*** ** *** Area Manager - Warranty / Customer Service

Routine owner maintenance is required to deter issues such as water intrusionUnfortunately, the home is no longer covered under the 10-year structural warranty period through *** *** *** and it it is past the statute of repose

As has been a historic trait of emerald homes, the response is false Garage door is still damaged and requires replacement panels for past months, walk thru item The driveway continues to have large multi inch wide cracks where the concrete was improperly poured around drainage tube The concrete driveway continues to have several low spots that collect and retain inches of water that do not drain, requires person to have rubber boots to avoid soaking feet when exiting auto's Finally, the home still continues to have flooding of all shrub areas, with over a foot of water covering the patio and damaging the concrete and bricking of the home Many of the small no cost items of touching up paint and replacement of chipped tiles have been repaired within last two weeks, items of any cost or effort to repair have not been repaired!

Good morning *** I am here at the house now and the coffered ceilings have been corrected and the brick arch at the entry has been corrected as well. Cleaners are coming today, carpet tomorrow and appliances Friday to get ready for his closing next week. We will notify the buyer

I have contacted him. He is going to fax me the stain color. We will have the door stained next week and drop it off to him at the end of next week or the following. In response to Revdex.com Complaint *** Per Director of Customer Affairs Since meeting with Mr***, the mildew has been inspected and determined to be dirt running through the system caused by caked filters not changed and the fan cycle mode being ran continuously. This was allowing dirt to run through the vents. The customer has been educated to change filters monthly, as well as a gesture of good faith Horton has cleaned the affected areas The correct amount of window blinds was charged to the customer and installed, one of the kitchen nook windows is charged as windows because it is considered a double window in size. This was explained to Mr*** during the inspection The wavy ceiling repair is scheduled for repair on January 4th at Mr*** request of availability As a good faith gesture Horton is also reimbursing Mr*** for an emergency plumbing bill. This bill was caused by not calling the correct vendor noted in the Homeowner ManuelThis reimbursement has been submitted for payment The granite countertops in the kitchen have been inspected, and are the correct tops selected The granite tops are installed correctly and in a professional manner The installation of the T.Vand outlet location are correct and per plan. They are also compatible with all local providers During the masonry work of the home, the front was already being bricked and Mr*** determined he did not want to put the stone on the front façade. reviewed these issues, at separate occasions and both came to the same conclusion regarding the concrete areas and ‘deep holes’ and ‘troughs’ While the driveway and other concrete areas are excluded from warranty coverage after closing on the home and is acknowledged as accepted by the customer with their initials/signature on the closing paperwork, we reviewed the concrete areas as requestedOur managers found cracks in the expansion joints of the driveway and a small number of ‘bug holes’These issues are within industry tolerances and pose no abloss of integrity to these surfacesWe have denied further repair work for this issue We also investigated the ‘deep holes’ and ‘troughs’ and found them to be within the tolerances as outlined in the *** *** *** *** handbook page 12, Although we are within the agreed upon tolerance for this issue, we feel the amount of settlement is excessive and we have agreed to repair this at the next possible opportunity which should be within the next two weeksWe are currently arranging landscaping repair work in this area and the customer should be contacted within the next five days so an appointment can be set with them *** ***

We spoke with this customer on September 28th and she stated she was on her way to the doctor at that time and would call us back We have attempted to call her back on multiple occasions since then as she did not return our call Our tech for this subdivision went by her home
on Monday, October 3rd and was going to discuss her concerns with her if she was home since we could not get her back on the phone. She answered the door and told him that she could not speak with him at that time because she had to leave We will continue to attempt to reach her but at this time we cannot get this customer to respond to us Thanks ***Revdex.com
MESSAGE:The reason I got the better bussiness bureau involved is that I have a problem with a board that has a bow in it, ( the board is not lying flat) in the backside of my home on the second floor between two windows. There is nothing wrong with the vinyl in that area according to an employee that was sent by the technician over this subdivision that I have my new home in. I was told by a builder that is the problem and not a cosmetic issue as stated by someome at the DR Horton local headquarters in Sandy Spring, Georgia and that I should not be concerned about it.DR Horton sends customer satisfaction forms to have the homeowners ccomplete them. Well, I did complete the last one they sent me a few month back. I listed my two concerns which was the problem with the unprofessional way they did the door and the door jam of my front door. This is not something you can insulate and walk away from.Another serious problem was the way the right an back side of my land was cut totally off grade. When it rains the rain water from my neighbor, a nHorton home owner drains in my yard and after a couple hours of rain it remains in my yard like water in a trench, Last summer mosqitos took advantage of the water in the trench and was biteing the hell out of me and my little grand daughter.I did enquire about remedying the problems during the walk through. You know level the land off by filling it in. Atleaste the right side where the most rain flows from the neighbirs yard onto my yard. Properly rehanging the door and do what ever needs to be done to the door jam so that it fitsthe way a door is suppose to properly fit.I received a call from an employee at the local DR Horton Headquarters after they received my complaint from the Revdex.com. I told this person what needed to be done hoping that this time some one with the authority would understand for once the person that I spoke with stated that they would let local managemnt know what I was needing to be done and would get back with me. I never heard from that person aout what their manager was going to do

A contractual agreement was made between the buyer and us the seller/builderThe contractual agreement specifically excluded from the sellers warranty; “Landscaping, including trees, shrubs, grass and flowers are not covered by any warranty”That being said us the seller (D.RHorton) chose
to go above and beyond the warranty and address the issue at the sellers expense to pay to have portions of the yard top soiled and seededThe responsibility of nurturing and maintaining the soil and seed was the sole responsibility of the buyerAt this time we offer no warrantable action for the buyer / Homeowner after years and months of owning the home Thank you, *** ** *** DR Horton - America's Builder!
