They may request for the consumer to complete an affidavit of fraud so they may further investigate the disputed accountA Security Alert has been added to the consumer's credit report. This message, which will expire after 90 days, alerts credit grantors to verify the consumer's identification in case someone is using their information without their consent. As an additional precaution, we have removed the consumer's name and address from prescreened offer mailing lists for six months. of our investigation directly to the consumer.When a consumer disputes the accuracy or completeness of information on the personal credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contact the furnisher of the information or the vendor that collected the information from a public record source such as a court or other government office either electronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and complete investigation to verify all of the information regarding the disputed item, and report back within the time frame required by law. We review and consider the response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or cannot be verified, we then delete that information, or modify that information, as appropriate, based upon the dispute and the results of our processing. If we do not receive a response from the furnisher or the vendor within the required period, we update the item as requested or delete the information, in some instances, upon reviewing the credit file and any relevant information submitted to us, we are able to determine whether the disputed information should be changed or deleted without having to contact the furnisher or the vendor. Investigations can take as long as 30 days to reach a conclusion. the above mentioned consumer's Experian credit report.Our records indicate that the disputed information was previously investigated and confirmed as accurately reported.If a bankruptcy was dismissed or withdrawn, it appears on the Consumer's personal Credit report because every action that relates to credit may become part of the credit history. So even though the Court did not allow the filing of the bankruptcy or the bankruptcy did not go through, the fact that the case was documented allows it to appear on the personal credit report.According to the Fair Credit Reporting Act (FCRA), Section 605 (d) (1), if a bankruptcy is withdrawn before a final judgment "the Consumer reporting agency shall include in the report that such case was Withdrawn"The bankruptcy dismissed withdrawn status will remain on the consumer's Experian credit report for seven years from the filing date.Experian strives to achieve a high level of Customer service for all the Consumers they assist. We have mailed a current Experian Credit report directly to the Consumer for review.Additionally, research indicates that the [redacted] HELOC account was included in the chapter 13 bankruptcy filed on February 28, 2010. Because this account had reached the maximum retention time permitted by the Fair CreditReporting Act (FCRA), it was deleted from the consumer's Experian Credit report. Our records indicate that We previously conducted an investigation regarding the disputed information and have provided the results of our investigation directly to the consumer on May 18, 2016.Each national consumer credit reporting agency may interpret the requirements of the Fair Credit Reporting Act differently and each company has their own policies and guidelines for disputing information. Therefore, we cannot update or delete information in our database based on the results of a dispute with another consumer credit reporting agency nor can we dispute information for a consumer with another consumer credit reporting agency.If your client disagrees with the results of the reinvestigation, it is the consumer's legal right, under the FCRA, to add a 100-word statement specifying the nature of their dispute. The statement will appear with the item as long as the item remains on the credit report. Any further concerns regarding the disputed information may need to be directed to the data furnisher reporting this information. I do not agree with their response. I asked for a response from my certified and notarized affidavit. they have to uphold the law just like I do. if the response is not answered this time I will proceed with a small claims court and provide all my paper work and copies. this is my third and last time attempting to get this affidavit answered. provide validation. i refuse to take no for an answer.
