The member has a signature on file for membership which states "ANNUAL RATE GUARANTEE FEEYou agree a non-refundable $annual rate guarantee fee will be charged to your account within approximately days from the date you joined the Club and each year thereafter on approximately the same date so long as your membership remains in effectThe purpose of the annual rate guarantee fee is to guarantee that there will be no increase in your monthly dues during the term of your membership." The rate guarantee fee (RGF) was charged in November, which was the second billing cycle for the member after the initial paymentThe member was informed both in club and on the phone what the charge was forThe member became irate and disrespectful to the staff on more than one occasionThe account was terminated for the behavior which is clearly stated in the agreement "(d) Cancellation by Club: The Club reserves the right at any time to cancel and/or suspend your membership or any of your membership privileges for (i) failure to comply with any of the Club’s Rules and Regulations, (ii) any conduct the Club determines to be improper or in any way harmful to the best interests of the Club or other members, (iii) any payment due under this Agreement is late, or (iv) any other reason not prohibited by lawTermination of your membership in such cases is effective on the date the Club mails a written notice of termination to you at your last address shown on the records of the ClubYou will remain liable for financial obligations incurred by you prior to terminationThe Club will refund any unused dues that you have already paid for the billing period in which such notification is mailed to you calculated in the same manner as stated for Regular Cancellations above" We have chosen to terminate the member's account based on his behaviorHis account was terminated as of 11/We will issue a refund of $for his account from NovemberThe member's friends accounts were terminated at their request and no final dues were chargedThe friends last day available to use the club is 12/

I am rejecting this response because: that still does not address the issue of the business ethics of that individual miles and how fitness evolution conducts businessIf Fitness Evolution is contracting with Professional Fitness, they still have an obligation to satisfy customers needs Not harass or belittle customer knowledge and guilt a customer into a contract that is nonrefundable

I am rejecting this response because: I did send in a writer cancelation request and called customer service many timesI do not have record of the letter as it was over a year ago

Fitness Evolution has already contacted the collections agency to see why the account is still reflecting a balance and to have clearedThe collection agency was notified of the payment at the time it was madeUnfortunately, Fitness Evolution does not send the information to the credit agency, the collection agency doesThey have been notified to correct the error as soon as possible

I am rejecting this response because: I have tried multiple time to reach someone via the number provided, no one answers the line and there is no option to leave a messageI am now awaiting a response via the email providedNothing has been resolved as of yet and no one has reached out to me

The company has already contacted the member on 6/and informed her the refund was processed and would reflect in her account in a few days once her bank processes

When we purchased Bally we purchased all the accounts as in their system. We did try to reach out to the member when there was a balance due but did not hear back. When we did speak to her in October we did reach out to try and settle the account but did not hear back. There are no... notes in regards to the account being either terminated or put on hold due to medical/health reasons. If she terminated the membership we require a copy of the termination confirmation letter stating her membership ended with Bally prior to taking over. If proof is not provided what I'm able to do is offer her a settlement payment of $116.32 to settle and close the account.

Our records indicate the childcare service was added in February The member put in a request on 4/11/to cancelI have attached our notesCancellation requires a day notice which is why the member was charged on 5/1/Both Childcare options are currently cancelled with no more further charges

Our notes show the member was attempting to do trade in promotionThe attached notes indicate the member spoke to our corporate office and the member was advised to send in proof of membership cancellation from the other club, so we honor the promotionThis was never receivedOnce member provides the proof of cancellation from the other club, we can issue a refund for the enrollment fee

I am rejecting this response because: if I paid in full......then why does it show transaction sbeing taken out of my account??? I paid in full in the beginning with ***so why does it say debited transactions? also, if you do a partnership with who ever it is in your business shouldn't you try to figure out the problems because I have written to you several times and you have done nothing about your partnershipI have no problem going to litigation with thisI demand better customer service because I myself am a business owner and you guys have the most rudest people at your front desk I almost got into a confrontation with ***, whom you will see someone who did a transaction on my accountI demand this to be fixed

Members that did not want to become fitness Evolution members either terminated their membership or requested to be transferred to a different ***s location You may contact the corporate office for ***s at ###-###-#### to request proof of either termination confirmation letter or the transfer request Without either the balance is valid as this is the information we received with ***s stating you were an active member

I am rejecting this response because: they would call me on days telling me that I was supposed to have an appointment and I was late ten to fifteen minutes even though I would specifically tell them I wasn't available on those days because I worked and then said it would come out of my balance sessions Then it basically means that they intentionally lied about the sessions going out of my balance

I do not agree with this company at all BUT I went in and paid the demanded money yesterday (see attached receipt)I want them out of my lifeI went into the gym at 4:45pm and was told that they do accept cancellations between the 13th and 19th of each monthThe first time I went in I was told they do not accept cancellations between the 1st and the 4th??? This must be illegal to withhold cancellation to their membersI told them I needed to speak with the manager [redacted] the manager came and cancelled my account (this is what she said) and I paid the $She told me she could not give me proof of cancellationThe last thing I need from this company is something in writing that states my cancellation was entered into their system AND that no other charges will come up in the future

As this member clearly states and I have record of, he was aware that the membership needs to be cancelled in writing as he did the previous yearPaid in full membership was available to him but he choose to sign for the month to month agreement that continues until written cancellation is received If he cancelled in writing he would have email confirmation of the cancellationSheila K*** Billing Manager
