An area of the gym that I used on a regular basis for the past eleven months has been cordoned off and designated personal training only I feel that when I joined this gym I had this area available and now I do not that they have reneged on what was I originally agreed upon I don't like to be crowded to a small place The owner/manager was very rude with poor people skills I would appreciate if my account was not debeted on febI no longer intend to go there as the manager told me to leave

HiNotes on the account show a request for cancellation in 2011. The member was informed by phone and letter that the membership termination was denied due to return of payment for final termination fee of $25. We had informed the member that it must be paid in order for us to process the... cancellation. We can settle the account and remove it from collections if the member makes payment for $25 termination fee that was initially declined and caused the account to stay active.

The member has spoken with the corporate officeThe notes on the account show that the guest was confronted by management after multiple visits freelance training membersHe was reminded of the policy and both continued with their workoutIf the member feels uncomfortable, we can cancel the membership with no further charges

[redacted] contends that she "called to cancel" in the beginning of April due to unauthorized charges to her account On 4/15/a cancellation request (copy attached) was electronically submitted and the cancellation process began Both the Contract (copy attached) and the Cancel Request (copy attached) state the need for cancel in writing with a day notice, including additional month's payment and the need for the account to be current Subsequently on 4/20/ [redacted] had her bank withdraw the payment received by us on 4/and at this point she would have been contacted by the call center in TX who handles our past due accounts The return is documented on the Account Transactions (pymt history-attached) listing The May payment that was due to fulfill the terms of the Membership Registration Agreement and Cancellation Request is also outstanding resulting in additional calls from the call center The monthly billing has stopped on the account however the account will not be "closed" as noted in Desired Outcome until the terms of the signed agreement are met.Respectfully, Sheila K***Billing ManagerFitness Evolution Home Office

***With our paid in full memberships we are not able to refund any unused time if a member is requesting to terminate the membership I do apologize but the information that was received to terminate the membership applies to our month to month memberships that do have a day notice to cancel What we are able to do is transfer the membership to someone and they will be able to use our facilities through the end of the year that is set to expire on 1/4/ To make the transfer you may go into your local facility and have the member provide a valid id and we are able to make the change

I am rejecting this response because:This is the response always given when expressing concerns with no follow through would like:Classes- I'm paying the extra for classes, yet not all are offered Want all fitness and training classes included and not keep adding additional chargesAn honest time line of fixing the facility Keep hearing a different story each time I ask about when they will begin constructionThank you, [redacted] ***

To terminate all membership there is a day written request that needs to be provided to terminate the membership any and all fees during that time need to be paid in order to complete the request We have waived the day notice and not additional fees will be charged to the account

In order for us to make any changes to the accounts we need a written request from our members If a member is not able to go in to sign their termination request they are also able to send a certified letter

HelloI recently filed a report a few months back about a business that would not close an account and continued to charge meI was given a case number and once the matter was claimed as addressed, I thought my troubles were overI was told all I owed was $even though I canceled prior to the charge dateI went to the gym to make the payment days ago and was told I owed $dollars and some changeJust today I received a letter from Collections stating that I owe $I am beyond frustrated and at my breaking point of frustrated and stressedI have worked very hard to keep my name and reputation clean and now have wrongfully received a debt collection letter having been officially my first oneI am hoping to have my case re-opened and this matter addressed and hopefully clean up my name from this wrongful doingI don't know what they are doing and I need to know what is going onThe collector that I have apparently been sent to is from [redacted] I really need someone to get back to me as soon as possibleThis situation is pushing my anxiety over and stressing me out in more ways than oneThank you for your time.I hope for an adjustment and for this issue to be permanently resolved as soon as possible

We apologize if there was any confusion on the charges on the member's accountWe have attached a transaction history for the member as well as the break down of the chargesThe initial payment of $was both first month's dues and enrollment fee.The following payment was the regular monthly rate of $14.99.In February was when the member was charged the rate guarantee which was part of the agreementAs a courtesy, we can issue a refund for the $paid as the member's day notice

In order to terminate any membership there is a 30 day notice, any and all fees due in that period need to be paid in order to terminate the membership. As the annual fee is billed during that period of time it does need to be paid and we do not pro rate the amount. All of our fees are... disclosed in the agreement that was emailed at the time of signing. There will not be a refund issued.
